Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 62/2009/NĐ-CP dated July 27, 2009 of the Government detailing and guiding the implementation of certain provisions of the Health Insurance Law;
Pursuant to Decision No. 32/2014/QĐ-TTg dated May 27, 2014 of the Prime Minister on criteria for households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living during the period 2014-2015.

The Minister of Labor, Invalids and Social Affairs hereby issues guidelines for the process of identifying households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living during the period 2014-2015.
Article 1. Scope of Regulation and Applicability
Article 1. These Circular guides the process of identifying households with a moderate standard of living during the period 2014-2015 as the basis for determining the subjects eligible for state budget support for health insurance contributions under the Health Insurance Law.
Article 2. These Circular applies to households engaged in agriculture, forestry, fisheries, and salt production (referred to as households) throughout the country.
Article 2. Criteria for identification and principles of implementation
Clause 1. Identification criteria:
Households with a moderate standard of living are those with an average monthly income per capita ranging from VND 521,000 to VND 900,000 in rural areas and from VND 651,000 to VND 900,000 in urban areas.
Clause 2. Implementation principles:
Point a. Households voluntarily registering to participate in health insurance;
Point b. Ensuring democracy, transparency, and fairness;
Point c. Simplified procedures for convenience;
Point d. Implementing the registration and verification process as prescribed in this Circular.
Article 3. Propaganda work
Clause 1. Organizing extensive propaganda about the purpose and significance of the policy supporting health insurance contributions for households through mass media.
Clause 2. Guiding methods and ways to organize the identification of household subjects eligible for state budget support for health insurance contributions under the Health Insurance Law.
Clause 3. Training relevant staff at the commune poverty reduction boards, village chiefs, and community leaders on the implementation process.
Article 4. Registration, verification, and confirmation process for subjects
Clause 1. Households wishing to participate in health insurance shall fill out an Application Form and submit it directly or send it via postal service to the People's Committee of the commune for verification (Form No. 1).
3. The time from receiving the Application Form from a household to completing the verification and confirmation process shall not exceed ten working days.
Article 4. Responsibilities of local levels
Step 1. Conduct a quick assessment of the household's characteristics and living conditions (criteria related to employment, education, household assets, housing, and electricity, water, and sanitation conditions) to determine if they belong to households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living (Form No. 2).
If the household meets all the quick assessment criteria, the commune poverty reduction board will propose that the People's Committee of the commune determine that the household does not qualify as a moderate standard of living household, terminate the verification process, notify the household, and return the form (Form No. 1).
If the household fails to meet at least one quick assessment criterion, proceed to Step 2 to investigate household income.
Step 2. Conduct an investigation into household income (Form No. 3).
When investigating household income (Form No. 3), only consider the household's income over the past 12 months up to the date of receipt of the application form; do not include social assistance or welfare payments from the state budget in the household's income.
b) Results of the household income investigation:
If the household's income exceeds the specified criteria, the commune poverty reduction board will report to the People's Committee of the commune to inform the household that they do not meet the conditions to be recognized as a subject eligible for state budget support for health insurance contributions under the Health Insurance Law;
If the household's income is less than or equal to the specified criteria, the commune poverty reduction board will report to the People's Committee of the commune to confirm that the household has a moderate standard of living and is a subject eligible for state budget support for health insurance contributions under the Health Insurance Law (Form No. 1).
2. Department of Labor, Invalids and Social Affairs:
Article 5. Responsibilities of local levels
b) Inspect and re-inspect the results of confirming households with a moderate standard of living eligible for state budget support to pay health insurance premiums under the Health Insurance Law on its territory;
a) Disseminate and publicize the purpose and significance of the health insurance support policy; the procedures and formalities for assessing and confirming eligible subjects;
b) Organize the receipt of the Application Form from households, and assess according to the procedure;
c) Propose the Chairman of the People's Committee at the commune level to confirm (or not confirm) the household as an object eligible for state budget support for health insurance contributions under the Health Insurance Law;
d) Report to the Poverty Reduction Steering Board at the district level the list of households confirmed as objects eligible for state budget support for health insurance contributions under the Health Insurance Law on the territory twice a year before June 5th and December 5th each year (Form No. 4).
c) Compile and update the list of households with a moderate standard of living eligible for state budget support to pay health insurance premiums under the Health Insurance Law on its territory; report to the Ministry of Labor, Invalids and Social Affairs twice a year before June 15th and December 15th each year (Form No. 6).
a) Organize training for the Poverty Reduction Board at the commune level on the implementation procedures;
b) Inspect and recheck the results of confirming the household with average living standards on the territory;
c) Compile and update the list of households with average living standards on the territory as the basis for implementing the policy of state budget support for health insurance contributions under the Health Insurance Law, and report to the Poverty Reduction Steering Board at the provincial level twice a year before June 15th and December 15th each year (Form No. 5).
3. Department of Labor - Invalids and Social Affairs:
a) Organize training for county-level staff on business procedures;
b) Inspect and re-inspect the results of identifying households with a medium standard of living within the jurisdiction;
c) Compile and update the list of households with average living standards on the territory as the basis for implementing the policy of state budget support for health insurance contributions under the Health Insurance Law; report to the Ministry of Labor, Invalids and Social Affairs twice a year before June 25th and December 25th each year (Form No. 6).
Article 6. Effectiveness
1. This Circular takes effect from October 15, 2014.
2. In the course of implementation, if there are difficulties, please reflect them to the Ministry of Labor, Invalids and Social Affairs for study, amendment, and supplementation to be appropriate./.
