Issuing the List of Goods for Import and Export
in the Printing and Publishing Industry Sector

Pursuant to the Law on Publishing dated November 20, 2012;

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decree No. 195/2013/NĐ-CP dated November 21, 2013 of the Government detailing certain provisions and measures to implement the Law on Publishing;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;

Pursuant to Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government regulating printing activities;

Pursuant to Decree No. 25/2018/NĐ-CP dated February 28, 2018 of the Government amending and supplementing some articles of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government regulating printing activities;

Upon the proposal of the Director of the Publishing, Printing, and Distribution Department,

The Minister of Information and Communications issues this Circular on the List of Goods for Import and Export in the Printing and Publishing Industry Sector.

Article 1. List of Goods for Import and Export in the Printing and Publishing Industry Sector

Attached herewith is the List of Goods for Import and Export in the Printing and Publishing Industry Sector, including:

Article 2. Implementation clause

This Circular shall take effect from February 12, 2019 and replace the following Circulars:

a. Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications detailing the implementation of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government on the export and import of goods in the Printing and Publishing Industry Sector;

b. Circular No. 41/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications amending and supplementing some articles of Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications detailing the implementation of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government on the export and import of goods in the Printing and Publishing Industry Sector.

2. The Heads of the Office, the Director of the Publishing, Printing, and Distribution Department, the Heads of agencies and units under the Ministry of Information and Communications; organizations, entities, individuals participating or related to the import and export of goods in the Printing and Publishing Industry Sector shall be responsible for implementing this Circular.

3. During the implementation of this Circular, if there are any difficulties, they should promptly report to the Ministry of Information and Communications (through the Publishing, Printing, and Distribution Department) for guidance and consideration and resolution.

APPENDIX 01

LIST OF GOODS ACCORDING TO HS CODE AND MANAGEMENT FORM FOR GOODS FOR IMPORT AND EXPORT IN THE PRINTING INDUSTRY
(Issued together with Circular No. 22/2018/TT-BTTTT dated December 28, 2018)
1. Goods listed below must have a permit from the Ministry of Information and Communications when imported (only applicable to goods with HS code 08 number):

I. Goods by HS Code and Import Management Forms

Description of goods according to HS code in the List of Goods for Export and Import of Vietnam as stipulated in Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance

2. Procedures, formalities, and documents for issuing import permits for goods listed in Section 1.1 shall be implemented in accordance with Article 27 and Article 28 of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government regulating printing activities (amended and supplemented by Decree No. 25/2018/NĐ-CP dated February 28, 2018 of the Government).

3. Goods in the printing sector with HS codes belonging to groups 84.40, 84.41, 84.42, and goods of group 84.43 as stipulated in Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance but not listed in Section 1.1 of the List when imported do not need to have an import permit from the Ministry of Information and Communications.

II. Exported Goods

Goods listed in Section 1.1 when exported do not need to have an export permit from the Ministry of Information and Communications.

PROCEDURE, PROCEDURES, AND DOCUMENTS FOR ISSUANCE OF IMPORT LICENSES FOR NON-BUSINESS PUBLISHING PRODUCTS FOR GOODS IN THE LIST AT SECTION 1.1 SHALL BE IMPLEMENTED IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 41 OF THE PUBLISHING LAW AND CIRCULAR NO. 23/2014/TT-BTTTT ON DECEMBER 29, 2014 OF THE MINISTER OF INFORMATION AND COMMUNICATION PROVIDING GUIDELINES FOR IMPLEMENTATION OF CERTAIN PROVISIONS OF THE PUBLISHING LAW AND DECREE NO. 195/2013/NĐ-CP ON NOVEMBER 21, 2013 OF THE GOVERNMENT PROVIDING GUIDELINES FOR IMPLEMENTATION OF CERTAIN PROVISIONS AND MEASURES OF THE PUBLISHING LAW.

4. GOODS IN THE LIST AT SECTION 1.1 THAT DO NOT REQUIRE AN IMPORT LICENSE PURSUANT TO CLAUSE 1 AND CLAUSE 2 OF ARTICLE 42 OF THE PUBLISHING LAW SHALL NOT APPLY THE MANAGEMENT FORM IN THIS CIRCULAR.

5. GOODS IN THE LIST AT SECTION 1.1 WITH CONTENT VIOLATING THE PROVISIONS OF CLAUSE 1 OF ARTICLE 10 OF THE PUBLISHING LAW SHALL BE PROHIBITED FROM IMPORT UNDER ANY FORM.

II. EXPORT GOODS

1. GOODS IN THE LIST AT SECTION 1.1 THAT HAVE BEEN LAWFULLY PUBLISHED AND DISTRIBUTED IN VIETNAM ARE PERMITTED TO BE EXPORTED ABROAD IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 43 OF THE PUBLISHING LAW AND DO NOT REQUIRE AN EXPORT LICENSE FROM THE MINISTRY OF INFORMATION AND COMMUNICATION.

2. GOODS IN THE LIST AT SECTION 1.1 WITH CONTENT VIOLATING THE PROVISIONS OF CLAUSE 1 OF ARTICLE 10 OF THE PUBLISHING LAW SHALL BE PROHIBITED FROM EXPORT UNDER ANY FORM./.
