CIRCULAR
Amending and supplementing certain provisions of Circular No. 07/2012/TT-BVHTTDLdated July 16, 2012 issued by the Minister of Culture, Sports and Tourism guiding Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural goods not for business purposes not for business purposes
On the basis of Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural goods not for business purposes;
On the basis of DecreeNo. 79/2017/NĐ-CP dated July 17, 2017 of the Government prescribing functions, tasks, powers, structure and organization ofAND Cultural Education,Ministry of Culture, Sports and Tourism;
The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."
The Minister of Culture, Sports and Tourism issues this Circular Circular amending and supplementing certain provisions of Circular No. 07/2012/TT-BVHTTDL dated July 16, 2012 issued by the Minister of Culture, Sports and Tourism guiding Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural goods not for business purposes.
Article 1. Amending and supplementing certain provisions of Circular No. 07/2012/TT-BVHTTDL dated July 16, 2012 issued by the Minister of Culture, Sports and Tourism guiding Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural goods not for business purposes
1. Supplementing Clause 1a as follows:
"Clause 1a. Explanation of terms
Audio and video recordings specified at point a Clause 2 Article 3 of Decree No. 32/2012/NĐ-CP include: Audio and video recordings about performing arts."
2. Amending and supplementing Clause 4 as follows:
"Article 4. Competence to appraise exported cultural goods
Cultural, sports and tourism authorities shall be responsible for appraising exported cultural goods according to the provisions of Article 7 of Decree No. 32/2012/NĐ-CP which are specified as follows:
1. The Cinema Department under the Ministry of Culture, Sports and Tourism shall appraise cultural goods that are films produced by agencies, organizations, or co-produced with foreign service providers that have not been released or publicly disseminated.
2. Departments of Culture, Sports and Tourism, Departments of Culture and Sports, or specialized agencies authorized by Departments of Culture, Sports and Tourism, Departments of Culture and Sports shall appraise immovable cultural assets, antiques, and national treasures of individuals and organizations in their localities."
3. Amending and supplementing Article 8 as follows:
"Article 8. Competence of agencies issuing permits for importing cultural goods
1. Cases within the competence of the Ministry of Culture, Sports and Tourism to issue permits for importing cultural goods as prescribed in Clause 1 Article 8 of Decree No. 32/2012/NĐ-CP are specified as follows:
a) The Cinema Department under the Ministry of Culture, Sports and Tourism shall handle the receipt of applications for permits to import cultural goods whose content is films;
b) The Performing Arts Department under the Ministry of Culture, Sports and Tourism shall handle the receipt of applications for permits to import cultural goods that are audio and video recordings about performing arts;
c) The Heritage Department under the Ministry of Culture, Sports and Tourism shall handle the receipt of applications for permits to import cultural goods that are immovable cultural assets and antiques for exhibition or display in museums;
d) The Fine Arts, Photography and Exhibitions Department under the Ministry of Culture, Sports and Tourism shall handle the receipt of applications for permits to import cultural goods that are works of visual art, applied fine arts, and photographic works.
2. Departments of Culture, Sports and Tourism, Departments of Culture and Sports, or specialized agencies authorized by Departments of Culture, Sports and Tourism, Departments of Culture and Sports shall issue permits for cases within the competence of Departments of Culture, Sports and Tourism to issue permits for importing cultural goods as prescribed in Clause 2 Article 8 of Decree No. 32/2012/NĐ-CP."
4. Supplementing Article 8a as follows:
"Article 8a. State Management Responsibilities
The Cinema Department, the Performing Arts Department, the Heritage Department, and the Fine Arts, Photography and Exhibitions Department under the Ministry of Culture, Sports and Tourism shall be responsible for advising the Minister of Culture, Sports and Tourism to promulgate regulations within their authority and submitting to the Government for promulgation regulations on the export and import of cultural goods within their specialized fields."
5. Amend and supplement Article 9 as follows:
"Article 9. Issuing accompanying this Circular the following forms
1. Form No. 01: Permit for Importing Cultural Goods (BM.GP);
2. Form No. 02: Appraisal Report and Sealing of Exported Cultural Goods (BM.BBGĐ);
3. Form No. 03: Application for Permit to Import Cultural Goods (BM.NK);
4. Form No. 04: Application for Appraisal of Exported Cultural Goods (BM.GĐ);
5. Form No. 05: Sealing of Cultural Goods (BM.NP)."
Article 2. Content to be abolished
1. Abolish Article 6 of Circular No. 07/2012/TT-BVHTTDL dated July 16, 2012, issued by the Minister of Culture, Sports and Tourism guiding Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural products not for business purposes.
2. Abolish the following forms of import permits for cultural products (BM.GP), inspection report forms, export cultural product sealing forms (BM.BBGĐ), application forms for import permits for cultural products (BM.NK), application forms for export cultural product inspections (BM.GĐ), cultural sealing forms (BM.NP) attached to Circular No. 07/2012/TT-BVHTTDL dated July 16, 2012, issued by the Minister of Culture, Sports and Tourism guiding Decree No. 32/2012/NĐ-CP dated April 12, 2012 of the Government on the management of export and import of cultural products not for business purposes.
Article 3. Implementation Provisions
1. This Circular takes effect from August 15, 2018.
2. In the course of implementation, if there are any difficulties, organizations and individuals are requested to promptly raise their concerns and feedback to the Ministry of Culture, Sports and Tourism for study and revision./.
