AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE PRIME MINISTER’S DECISIONS ON REGULATIONS AND POLICIES FOR PERSONS PARTICIPATING IN RESISTANCE STRUGGLES, DEFENSIVE WARS TO PROTECT THE COUNTRY, AND INTERNATIONAL MISSIONS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE
Pursuant to the Government Organization Law on February 18, 2025;
"Based on the proposal of the Minister of National Defense;"
The Prime Minister issues this Decision to amend and supplement certain provisions of the Prime Minister’s Decisions on regulations and policies for persons participating in resistance struggles, defensive wars to protect the country, and international missions under the management of the Ministry of National Defense.
Article 1. Amending and supplementing Article 5 of Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister on regulations and policies for certain individuals directly participating in the resistance struggle against the United States to save the nation but have not yet benefited from the policies of the Party and State.
"Article 5.
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to be responsible for guiding the implementation of this Decision; at the same time, directing the organization to implement the one-time regime for military personnel, defense workers, militia, self-defense forces, and secret forces within their management scope.
2. The Ministry of Public Security shall be responsible for guiding and organizing the implementation of the one-time regime for public security personnel and secret forces within their management scope.
3. Central ministries and agencies within their functions and tasks shall be responsible for directing and organizing the implementation of the one-time regime for the following categories: workers, civil servants, Party cadres, youth volunteers, and secret forces within their management scope.
4. The Chairman of the People's Committee of provinces and centrally-administered cities (hereinafter referred to as the Provincial People's Committee) shall be responsible for directing the Department of Home Affairs to take the lead and coordinate with relevant agencies to organize the examination, verification, and issuance of decisions to benefit from the one-time regime for workers, civil servants, Party cadres, and youth volunteers who have returned to their localities; examine and issue decisions to benefit from health insurance and funeral expenses for the subjects as stipulated in point d, clause 1, Article 1 of this Decision. Within the capacity of the local budget, the Provincial People's Committee shall provide material and spiritual support to those who participated in the resistance struggle against the United States to save the nation with particularly difficult circumstances.
5. The Ministry of Finance shall be responsible for allocating the annual budget to implement the regimes and policies as prescribed by the Law on State Budget."
Article 2. Amending and supplementing Clause 2 of Article 7 of Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister on regulations and policies for persons participating in defensive wars to protect the country and international missions in Cambodia and assisting Laos after April 30, 1975 who have been demobilized, discharged, or retired.
Amending and supplementing Clause 2 of Article 7 as follows:
"2. The procedure for implementing the one-time allowance regime shall be carried out as follows:
a) The subject as stipulated in Clause 1, Article 2 of this Decision or the relative of such subject shall be responsible for filling out the application form and submitting one set of documents as prescribed in Clause 1 of this Article to the People's Committee of communes, wards, or special administrative zones (hereinafter referred to as the Commune People's Committee) where they are registered.
b) The Commune People's Committee shall direct subordinate agencies to receive applications, review, compile, and report to the Military Command of the province or centrally-administered city (hereinafter referred to as the Provincial Military Command), the provincial or centrally-administered city Police (hereinafter referred to as the Provincial Police), and the Department of Home Affairs according to the authority prescribed in Article 9 of this Decision;
c) The Provincial Military Command, Provincial Police, and Department of Home Affairs shall receive applications, review, compile, and report to the competent authority to issue decisions to implement the regime for the subjects as stipulated in points d, đ, and e of this clause;
d) The Provincial People's Committee shall direct the Department of Home Affairs to issue decisions to benefit from the one-time allowance regime for subjects within its jurisdiction; đ) The Military Zone Command, and the Command of the Capital City of Hanoi shall direct subordinate agencies to review and verify; issue decisions to benefit from the one-time allowance and monthly allowance regime for subjects within the jurisdiction of the Ministry of National Defense;
e) The Cadre and Civil Servant Organization Department of the Ministry of Public Security shall issue decisions to benefit from the monthly allowance and one-time allowance regime for subjects within the jurisdiction of the Ministry of Public Security."
Article 3. Amending and supplementing some articles of Decision No. 49/2015/QĐ-TTg dated October 14, 2015 of the Prime Minister on certain regimes and policies for civilian fireline workers participating in the resistance against France, America, protecting the Fatherland, and international missions.
1. Amending and supplementing Clause 2 of Article 4 as follows:
"2. Health insurance regime Those who have not yet enjoyed the health insurance regime shall be entitled to the health insurance regime in accordance with the laws on health insurance."
2. Amend and supplement Clause 1, Article 5 as follows:
“1. Documents and procedures for resolving one-time allowance regime
a) The documents of the subject to consider the entitlement to the regime include: one application form of the subject or the subject's relatives (for deceased subjects); original or copy of the documents related to participation in civilian fireline work (if available).
b) Procedures for resolution
- The subject specified in Article 2 of this Decision or the subject's relatives (for deceased subjects) are responsible for preparing the application form and submitting one set of documents according to the provisions at point a of this clause to the People's Committee of the commune where they reside in person, through public postal services, or via electronic environment; the commune organizes review in batches, compiles and reports to the Military Command of the province, the Political Department of the Hanoi Capital Military Command;
- The Military Command of the province, the Political Department of the Hanoi Capital Military Command examine, approve, and propose the Military Region Command, the Hanoi Capital Military Command to issue a decision on the one-time allowance regime.
The time limit for resolving the regime for the subject according to the responsibility assigned to each level shall not exceed seven working days from the date of receipt of complete documents as prescribed; if the documents do not meet the conditions for examination and resolution, the receiving agency must provide a written response specifying the reasons.
- After issuing the decision on the regime and the one-time allowance funds, within seven working days, the People's Committee of the commune directs subordinate agencies to pay the one-time allowance regime to the subjects.”
3. Amending and supplementing Point b of Clause 3 of Article 5 as follows:
“b) Procedures for resolution
- The relatives of the subject submit one set of documents as prescribed at point a of this clause to the People's Committee of the commune where they reside in person, through public postal services, or via electronic environment; within five working days, the People's Committee of the commune compiles and reports to the Provincial Department of Home Affairs;
- The Provincial Department of Home Affairs checks, compiles, and reports to the People's Committee of the province and issues a decision on funeral allowance for the relatives of each subject. The time limit for resolving the regime for the relatives of the subject according to the responsibility assigned to each level shall not exceed seven working days from the date of receipt of complete documents as prescribed; if the documents do not meet the conditions for examination and resolution, the receiving agency must provide a written response specifying the reasons;
- After the funeral allowance funds are available, within seven working days, the People's Committee of the commune directly pays the funeral allowance to the relatives of the subject.”
4. Amending and supplementing Clause 4 of Article 5 as follows:
"4. The Ministry of National Defense shall issue a unified model of the "Certificate" of participation in civilian fireline work; the Military Region Command, the Hanoi Capital Military Command shall sign and hand over to the People's Committee of the commune to direct subordinate agencies to present together with the payment of the one-time allowance regime to the subjects."
Article 4. Implementation provisions
1. This Decision shall take effect from July 10, 2025.
2. Replacing the term "Labor - War Invalids and Social Affairs" with the term "Home Affairs" in the following articles, clauses, and points:
- In Article 5 of Decision No. 47/2002/QĐ-TTg dated April 11, 2011 of the Prime Minister on the regime for military personnel, defense industry workers, and civil servants who participated in the resistance against France and were demobilized (discharged, resigned) before December 31, 1960;
- In Article 2 of Decision No. 188/2007/QĐ-TTg dated December 6, 2007 of the Prime Minister on amending and supplementing Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister on the regime and policies for certain subjects directly participating in the resistance against America to save the country but not yet enjoying the policies of the Party and State;
- In Clause 1, Clause 2 of Article 7, Clause 2 of Article 8 of Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing the regime for military personnel who participated in the resistance against America to save the country with less than 20 years of service in the military and were demobilized and returned to their hometowns;
- In point a, point b of Clause 1, point a, point b of Clause 2, Clause 3 of Article 9 of Decision No. 62/2011/QĐ-TTg dated November 9, 2011;
- At point a of Clause 1, Clause 2 of Article 8 of Decision No. 49/2015/QĐ-TTg dated October 14, 2015.
3. Transitional Provisions
Applications for entitlement to the regime that have been received before the effective date of this Decision but have not yet been reviewed and reported for issuance of the entitlement decision shall follow the procedures, formalities, authority for review, and issuance of the entitlement decision as stipulated in this Decision; in cases where applications for monthly allowance under Decision No. 62/2011/QĐ-TTg for subjects in the Hanoi capital area have already been reported to the Policy and Social Affairs Department of the General Political Department, the Policy and Social Affairs Department of the General Political Department shall issue the entitlement decision.
Article 5. Responsibilities for Implementation
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial and centrally-run city People's Committees are responsible for implementing this Decision./.
