CIRCULAR

Regulations on collecting and processing information about families and preventing domestic violence

Based on the Law on Prevention and Control of Domestic Violence 2007;

Based on Decree No. 08/2009/NĐ-CP dated February 4, 2009 of the Government detailing and guiding the implementation of certain provisions of the Law on Prevention and Control of Domestic Violence;

Based on Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Based on Decision No. 111/2008/QĐ-TTg dated August 15, 2008 of the Prime Minister promulgating the reporting and statistical system applicable to Ministries and sectors;

Based on Decision No. 43/2010/QĐ-TTg dated June 2, 2010 of the Prime Minister promulgating the national statistical index system;

The Ministry of Culture, Sports and Tourism issues this Circular to guide the collection and processing of information about families and prevention, of domestic violence as follows:

Article 1. Scope of Regulation and Applicability

This Circular stipulates the content of information collection, recording, and updating into the "Family Information Record Book for Prevention and Control of Domestic Violence" (hereinafter referred to as the Record Book); processing and reporting information about families and prevention, of domestic violence throughout the country.

This circular This Circular applies to People's Committees at all levels and state management agencies responsible for culture, family affairs, sports, and tourism at localities.

Article 2. Purpose and requirements for collecting and processing information about families and prevention, of domestic violence

1. Objective

a. Collecting basic and accurate information about the current status of families and changes over time to serve as a basis for policy formulation for state management of families;

b. Collecting information about the current status of domestic violence to serve as a basis for determining directions and solutions for prevention and control of domestic violence.

2. Requirements

- Information is collected in the form of recording and updating information into the Record Book;

- Recording information about families and prevention, of domestic violence must ensure objectivity, truthfulness, completeness, and accuracy;

- Writing and numbers when recording must be clean, clear, and legible;

- In case of incorrect recording, the incorrect information should be crossed out with a single line drawn over it, then the correct information should be recorded in the appropriate position, erasing or rubbing out the recorded information is not allowed;

- For blank spaces without information, it is agreed to mark "X" to avoid additional or mistaken entries.

- Applying information technology in data processing.

Article 3. Subjects of information collection

1. Subjects of information collection about families

All households registered with permanent or temporary residence permits within the territory of provinces/cities nationwide.

2. Subjects of information collection about prevention, control of domestic violence.

All cases of domestic violence discovered and handled within the territory of provinces/cities nationwide.

Article 4. Content of information collection

1. Information about families

- Total number of households;

- Types of households;

- Households with elderly members;

- Households with children;

- Households with early marriage;

- Households with domestic violence;

- Households awarded the title of Cultural Family.

2. Information about prevention, control of domestic violence

- Total number of cases of domestic violence;

- Forms of domestic violence;

- Perpetrator of domestic violence: gender, measures taken;

- Victims of domestic violence: gender, age;

- Number of domestic violence cases handled;

- Assistance facilities for victims of domestic violence: counseling centers for prevention and control of domestic violence, medical examination and treatment facilities, social welfare facilities, support centers for victims of domestic violence, trusted addresses in the community.

Article 5. Provisions on Record Books

1. Scope of Record Book Establishment

Record books shall be established in all communes, wards, towns (collectively referred to as commune level) throughout the country.

2. Recording Date for Record Books is the first day of the first month of the first quarter and the third quarter.

3. Sample Record Books

a. Family information record book (Annex 01).

b. Domestic violence prevention and control information record book (Annex 02).

Article 6. Responsibilities for Collecting Information about Families and Domestic Violence Prevention and Control

1. The People's Committee at the commune level shall be responsible for organizing the initial recording of information, updating information periodically every six months and annually, and managing the Record Books;

2. The Department of Culture, Sports and Tourism at the district level shall be responsible for collecting information about families and domestic violence prevention and control within their management area periodically every six months and annually.

3. The Department of Culture, Sports and Tourism at the provincial level shall be responsible for collecting information about families and domestic violence prevention and control within their management area periodically every six months and annually.

Article 7. Processing Information about Families and Domestic Violence Prevention and Control

1. Comprehensive reports on family information and domestic violence prevention and control shall be submitted according to the following regulations:

a. The semi-annual summary form (Form No. 01) at the commune level shall be completed and sent to the district level on July 5th, and the annual summary form shall be sent no later than December 5th each year;

b. The semi-annual summary form (Form No. 02) at the district level shall be completed and sent to the provincial level on July 10th, and the annual summary form shall be sent no later than December 10th each year;

c. The semi-annual summary form (Form No. 03) at the provincial level shall be completed and sent to the Ministry of Culture, Sports and Tourism; the Provincial People's Committee onJuly 15 and the annual summary form shall be sent no later than December 15th each year.

2. Reports shall be sent in two forms: in writing and as a report data file (sent via email).

Article 8. Implementation organization

1. The Ministry of Culture, Sports and Tourism

a. Directing and guiding the Department of Culture, Sports and Tourism to organize the recording of Record Books, processing information, and compiling comprehensive reports at various levels;

b. Inspecting and evaluating the activities and results of Record Book recording, information compilation of localities, reporting to government leadership annually and submitting special reports when required.

2. Provincial People's Committees directly under the Central Government

a. Directing relevant agencies and units to organize the collection of information about families and domestic violence prevention and control within the provincial management scope and ensuring funding for implementation;

b. Inspecting the Record Book recording process at localities.

3. The Department of Culture, Sports and Tourism

a. Taking the lead and coordinating with related agencies to submit to the Chairman of the Provincial People's Committee for approval of the implementation plan;

b. Providing guidance on the procedures for establishing Record Books, methods of monitoring, updating, processing information, and compiling statistical reports;

c. Organizing the printing and distribution of Record Books on family information and domestic violence prevention and control;

d. Inspecting, summarizing the results of information collection about families and domestic violence prevention and control, and reporting to the Ministry of Culture, Sports and Tourism as stipulated in this Circular.

4. The People's Committee at the district level

a. Directing relevant departments and the People's Committees at the commune level to organize the establishment and maintenance of Record Books on family information and domestic violence prevention and control;

b. Inspecting the Record Book recording process in managed areas, processing information, summarizing, and compiling periodic and special reports to be sent to higher-level authorities as stipulated in this Circular.

5. The People's Committee at the commune level

a. Organizing the collection of information and statistics about families and domestic violence prevention and control within the managed area;

b. Establishing and maintaining Record Books through organizing the initial recording of information and periodic updates on family information and domestic violence prevention and control within the managed area;

c. Processing, summarizing information, and compiling periodic and special reports to be sent to the District People's Committee as stipulated in this Circular.

Article 9. Funding for Implementation

Initial recording and periodic updating costs shall be guaranteed by the local budget.

Article 10. Provisions on implementation

This Circular takes effect from February 14, 2012.

During implementation, if there are any difficulties, please promptly reflect them to the Ministry of Culture, Sports and Tourism for research and supplementary amendments./.
