Guidelines for transferring grades and determining salaries for legal aid officials

Pursuant to Decree No. 116/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of civil servants in state-owned units and Decree No. 121/2006/NĐ-CP dated October 23, 2006 of the Government amending and supplementing certain articles of Decree No. 116/2003/NĐ-CP;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
Pursuant to Decree No. 93/2008/NĐ-CP dated August 22, 2008 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Circular No. 06/2010/TT-BNV dated July 26, 2010 of the Minister of Home Affairs stipulating titles, grade numbers of legal aid officials (hereinafter referred to as Circular No. 06/2010/TT-BNV);
Pursuant to Circular No. 15/2010/TT-BTP dated October 4, 2010 of the Minister of Justice stipulating professional standards for legal aid officials (hereinafter referred to as Circular No. 15/2010/TT-BTP);
The Ministry of Justice and the Ministry of Home Affairs provide guidelines for transferring grades and determining salaries for legal aid officials as follows:
Article 1. Scope of Regulation
This circular provides guidelines for transferring grades and determining salaries for legal aid officials into the Legal Aid Officer grade and the Regular Legal Aid Officer grade as stipulated in Circular No. 06/2010/TT-BNV and Circular No. 15/2010/TT-BTP.
Article 2. Applicability
Legal aid officials currently working at State Legal Aid Centers and Branches of the Centers.
Article 3. Principles for transferring grades
Clause 1. Grade transfer must be based on job responsibilities, positions, and suitability with assigned tasks of the officials.
Clause 2. Officials eligible for grade transfer must meet the professional standards of the Legal Aid Officer grades as stipulated in Circular No. 15/2010/TT-BTP.
Clause 3. When transferring from current civil servant or official grades to Legal Aid Officer grades, there shall be no combination of salary increase or change in official category.
Article 4. Cases of transferring grades from current civil servant or official grades to Legal Aid Officer grades
Clause 1. Transfer to the Regular Legal Aid Officer grade (grade number 03.289) for officials currently holding the Senior Specialist grade or equivalent.
Clause 2. Transfer to the Legal Aid Officer grade (grade number 03.290) for officials currently holding the Specialist grade or equivalent.
Article 5. Determination of salaries for Legal Aid Official grades
Clause 1. Legal Aid Official grades shall apply the Professional Salary Table for Civil Servants and Officials in State-Owned Units (Table 3 issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for civil servants, public officials, and armed forces) as follows:
Point a) The Regular Legal Aid Officer grade shall apply the salary table for Category A2, Group 1 (A2.1) officials;
Point b) The Legal Aid Officer grade shall apply the salary table for Category A1 officials.
Clause 2. The determination of salaries for officials transferred to Legal Aid Officer grades as stipulated in Article 4 and Clause 1 of Article 5 of this Circular shall be carried out according to Point a, Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary determination when upgrading grades, transferring grades, and changing official categories.
Article 6. Implementation Organization
Clause 1. Directors of State Legal Aid Centers in provinces and centrally-administered cities have the responsibility to check and review the positions, conditions, and standards of legal aid officials under their management and develop plans for grade transfer and salary determination for legal aid officials to submit to Provincial Departments of Justice for consolidation and submission to competent authorities for approval.
Clause 2. Directors of Provincial Departments of Justice in provinces and centrally-administered cities have the responsibility to:
Point a) Consolidate plans for grade transfer and salary determination for legal aid officials of subordinate units and submit them to Provincial People's Committees (through Provincial Departments of Home Affairs) for consideration and approval;
Point b) Decide on grade transfer and salary determination for legal aid officials within their management scope according to their authority or delegated authority after the plans for grade transfer and salary determination for legal aid officials have been approved by competent authorities.
Clause 3. Chairmen of Provincial People's Committees in provinces and centrally-administered cities have the responsibility to:
Point a) Direct agencies and organizations under their management to implement grade transfer and salary determination for legal aid officials;
Point b) Approve plans for grade transfer and salary determination for legal aid officials within their management scope; resolve issues within their authority during the process of grade transfer and salary determination for legal aid officials;
Point c) Decide on grade transfer and salary determination for legal aid officials within their management scope according to their authority;
Point d) Report the results of grade transfer and salary determination for legal aid officials within their management scope along with a list of officials who have been transferred and determined salaries to the Ministry of Justice and the Ministry of Home Affairs before August 31, 2012.
Article 7. Effective Date
Clause 1. This joint circular takes effect from February 15, 2012.
Clause 2. During implementation, if there are any difficulties, please report to the Ministry of Justice and the Ministry of Home Affairs for consideration and resolution.
