The Minister of Science and Technology promulgates this Circular detailing certain articles of the Intellectual Property Law and implementation measures of Decree No. 65/2023/NĐ-CP dated August 23, 2023 of the Government detailing certain articles and implementation measures of the Intellectual Property Law concerning industrial property rights, protection of industrial property rights, rights to plant varieties, and state management of intellectual property related to procedures for establishing industrial property rights and ensuring industrial property information.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular details certain articles of the Intellectual Property Law and implementation measures of Decree No. 65/2023/NĐ-CP dated August 23, 2023 of the Government detailing certain articles and implementation measures of the Intellectual Property Law concerning industrial property rights, protection of industrial property rights, rights to plant varieties, and state management of intellectual property related to procedures for establishing industrial property rights and ensuring industrial property information (hereinafter referred to as Decree No. 65/2023/NĐ-CP).
Article 2. Applicability
Organizations and individuals implementing registration procedures, complaint procedures, and dispute resolution procedures in activities for establishing industrial property rights, ensuring industrial property information, and other organizations and individuals related thereto.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. The applicant for registering industrial property (hereinafter referred to as "the applicant") is an organization or individual submitting applications for patents, layout-designs of integrated circuits, industrial designs, trademarks, and geographical indications. When a patent, layout-design of integrated circuit, industrial design, or trademark certificate is issued, the applicant is recorded as the holder of the certificate. When a geographical indication certificate is issued, the applicant is recorded as the registrant of that geographical indication.
2. The complainant is an organization or individual carrying out complaints related to industrial property procedures as stipulated in Clause 1 of Article 119a of the Intellectual Property Law.
3. A person with average knowledge in the relevant field is understood to be someone with common practical skills and thorough general knowledge commonly known in the relevant field.
4. The Paris Convention is the Paris Convention for the Protection of Industrial Property of 1883, amended in 1967 and 1979.
5. The Budapest Treaty is the Budapest Treaty on the Recognition of International Deposit of Microorganisms for the Purposes of Patent Procedure of 1977, amended in 1980.
Article 4. Representative of the applicant, complainant
1. The lawful representative of the applicant, complainant as prescribed in Article 89 and Article 119a of the Intellectual Property Law includes the following organizations and individuals:
a) For the applicant, complainant who is an organization or individual as prescribed in Clause 1 of Article 89 and Clause 2 of Article 119a of the Intellectual Property Law:
(i) In case the applicant, complainant is an individual: the legal representative of the applicant, complainant or the person authorized by the applicant, complainant or an industrial property service organization authorized by the applicant, complainant;
(ii) In case the applicant, complainant is an organization: the legal representative of the applicant, complainant or a person within the organization authorized by the legal representative of the applicant, complainant; an industrial property service organization authorized by the applicant, complainant; the head of the representative office or branch in Vietnam or the legal representative of a foreign-invested organization with 100% foreign capital established in accordance with the laws on investment (if the applicant, complainant is a foreign organization).
In case the object for protection is the result of a scientific and technological task using state budget funds assigned before the date when the Law Amending and Supplementing Certain Provisions of the Intellectual Property Law on June 16, 2022 takes effect or belongs to the field of national security and defense: the representative of the state owner; an industrial property service organization or an organization in charge of implementing the scientific and technological task authorized by the representative of the state owner.
b) For the applicant, complainant who is a foreign individual not residing in Vietnam, a foreign organization or individual without a production or business base in Vietnam as prescribed in Clause 2 of Article 89 and Clause 2 of Article 119a of the Intellectual Property Law: an industrial property service organization authorized by the applicant, complainant.
2. When conducting related procedures, the National Office of Intellectual Property shall only be allowed to transact with the applicant, complainant or the lawful representative of the applicant, complainant as prescribed in Clause 1 of this Article. Transactions with the above subjects are collectively referred to as transactions with the applicant, complainant.
Article 5. Authorization for representation to conduct procedures for establishing industrial property rights
1. The authorization for representation, including re-authorization, to conduct procedures for establishing industrial property rights (hereinafter referred to as "authorization") must comply with the provisions of the Civil Code on authorization, Article 107 of the Intellectual Property Law, and the guidance provided in this Circular.
The applicant, complainant may change the representative (hereinafter referred to as replacement of authorization). Replacement of authorization terminates the authorization relationship between the applicant, complainant and the currently authorized person. Replacement of authorization must be declared in writing by the applicant, complainant (either in the authorization document or in a separate document).
The authorized person may re-authorize another person in accordance with the Civil Code, provided that the organization or individual being re-authorized meets the requirements stipulated in Article 4 of this Circular. Re-authorization can only be implemented after the initial authorization has been recognized by the National Office of Intellectual Property as prescribed in Clause 2 of this Article.
2. The date on which the authorization document is recognized in transactions with the National Office of Intellectual Property is the date on which the National Office of Intellectual Property receives a valid authorization document. For cases of replacing authorization, re-authorization, or modifying information related to changes in the scope of authorization, termination of authorization before the due date, or changes in the address of the authorized party, this date is the date on which the National Office of Intellectual Property receives the corresponding valid documents.
3. In case the authorization document is submitted later than the application date but before the application is accepted as valid or processed, the National Office of Intellectual Property will transact with the person claiming to represent the applicant, complainant (in the declaration form or complaint form) to carry out the formal examination procedure to conclude whether the application is valid or invalid, accepted or not accepted, including conclusions on the legality of the representative's status.
4. Any transaction conducted by any authorized party within the scope of authorization at any time is considered to be conducted on behalf of the applicant, complainant, thereby generating rights and obligations of the applicant, complainant. In cases of replacing authorization or re-authorization, the replaced authorized party or the re-authorized party continues to represent all issues arising from the actions of the previously authorized party in previous transactions with the National Office of Intellectual Property.
5. If the authorization document has a scope of authorization comprising several independent procedures and the original authorization document has already been submitted to the National Office of Intellectual Property, then when proceeding with subsequent procedures, the authorized party must submit a copy of the authorization document and accurately indicate the application number associated with the original authorization document in the declaration form or subsequent procedure document.
6. In case of authorizing an organization or individual who is not permitted to represent or authorizing multiple organizations or individuals simultaneously, including those who are not permitted to represent, the application is deemed invalid.
Article 6. Responsibilities of the Applicant and the Complainant and their Representatives
1. The applicant, the complainant, and the representatives of the applicant and the complainant shall be responsible for ensuring the authenticity of all information and documents provided to the National Office of Intellectual Property during the establishment of industrial property rights as follows:
a) All transaction documents must be self-certified by the applicant, the complainant, or their representative through their signature and the stamp of the organization (if applicable). In cases where the law requires that documents be notarized or certified, such requirements must be fulfilled accordingly.
b) Any translations of documents into Vietnamese from other languages must be accompanied by a commitment from the applicant, the complainant, or their representative guaranteeing that the translation is a true and accurate rendition of the original document, except when the Vietnamese translation has been notarized to confirm its accuracy.
c) Where the representative of the applicant or the complainant is an industrial property representation service organization, the person signing the transaction documents on behalf of such organization must hold a valid professional certificate for industrial property representation services.
2. The applicant or the complainant shall bear responsibility for all consequences and obligations arising from actions taken by their representative in transactions with the National Office of Intellectual Property as stipulated by law.
3. The representative of the applicant or the complainant shall be liable to the applicant or the complainant according to the provisions of the law.
Article 7. Fees and Charges for Industrial Property
1. The applicant and users of industrial property services must pay fees and charges as prescribed by the Ministry of Finance and other service fees as required.
2. The collection of fees and charges shall be carried out as follows:
a) Upon receipt of an application or request for procedures involving fees and charges, the National Office of Intellectual Property shall require the applicant to pay the prescribed fees and charges (a payment notice will be issued to the applicant).
b) When collecting fees and charges, the National Office of Intellectual Property shall issue a receipt for the collected fees and charges, which shall serve as proof of payment and shall clearly state the amounts and types of fees and charges collected, and shall be kept in the application file for formal examination purposes.
c) In cases where fees and charges are paid via postal services or directly deposited into the National Office of Intellectual Property's account, the collection of fees and charges shall be confirmed through copies of payment receipts included in the application.
Chapter II
HANDLING APPLICATIONS FOR ESTABLISHING INDUSTRIAL PROPERTY RIGHTS
Section 1. GENERAL PROVISIONS ON HANDLING APPLICATIONS FOR ESTABLISHING
INDUSTRIAL PROPERTY RIGHTS
Article 8. Receipt of Applications for Establishing Industrial Property Rights
1. The National Office of Intellectual Property shall accept applications that comply with the provisions of Article 89 of the Law on Intellectual Property and Clause 1 of Article 48 of Decree No. 65/2023/NĐ-CP.
2. If an application contains all the minimum documents as specified in Clause 1 of Article 108 of the Law on Intellectual Property or Clause 3 of Article 48 of Decree No. 65/2023/NĐ-CP, the National Office of Intellectual Property shall accept the application, confirm the filing date and application number, and return to the applicant a Receipt of Application containing the filing date, application number, and results of the document checklist, with the name and signature of the officer receiving the application clearly stated.
For online submissions, if the application is accepted, the National Office of Intellectual Property shall return to the applicant a Receipt of Application containing the filing date, application number, and results of the document checklist, with the name and signature of the officer receiving the application clearly stated through the online submission system.
3. If an application lacks any of the minimum documents as specified in Clause 1 of Article 108 of the Law on Intellectual Property or Clause 3 of Article 48 of Decree No. 65/2023/NĐ-CP, the officer receiving the application shall refuse to accept it or send a notification from the National Office of Intellectual Property refusing to accept the application to the applicant (in case of postal submissions or electronic applications submitted through the online submission system). For postal submissions refused acceptance, the National Office of Intellectual Property is not required to return the application documents to the applicant, except for the original document submitted for comparison.
Article 9. Examination of the Form of the Application
1. The examination of the form of the application as stipulated in Article 109 of the Intellectual Property Law is the process of checking compliance with the provisions on the form of the application, thereby concluding whether the application can be considered valid or not.
2. An application shall be deemed invalid if it falls under any of the following circumstances:
a) There is a basis to affirm that the applicant does not have the right to file for registration according to Articles 86, 86a, 87, and 88 of the Intellectual Property Law;
b) The application is filed contrary to the provisions of Article 89 of the Intellectual Property Law;
c) There is a basis to immediately affirm that the object described in the application is an object not protected by the State according to Articles 8, 59, 64, 69, 73, and 80 of the Intellectual Property Law;
d) The application is filed contrary to the security control regulations for inventions before registering abroad as stipulated in Article 89a of the Intellectual Property Law, including cases where international applications are directly submitted to the International Bureau;
đ) The applicant has not paid the required fees and charges as stipulated in Clause 2 of Article 7 of this Circular (including cases where the filing fee, publication fee, examination fee, and information search fee for examination have not been fully paid, except for the information search fee for examination and the substantive examination fee for invention applications if there is no request for substantive examination in the application);
e) It fails to meet the requirements on form stipulated in Articles 14, 17, 21, 24, and 28 of this Circular (with deficiencies):
(i) The application does not meet the quantity requirements for one of the types of mandatory documents; does not meet the presentation format requirements; trademark registration applications do not clearly state the type of trademark being registered, lack a description of the trademark; fail to classify inventions, industrial designs, goods, or services bearing trademarks, or incorrectly classify them without paying the classification fee; lack translations of priority right basis documents (if necessary), translations of registration right proof documents if the applicant inherits the registration right from another person; information about the applicant in the documents is inconsistent, erased, or not confirmed according to the regulations, the declaration lacks sufficient information about the author (for invention applications, design applications, and layout design applications), about the applicant, about the representative, lacking signatures and/or seals (if applicable) of the applicant or the representative; confidential invention application documents have not been stamped as confidential according to the regulations, etc.;
(ii) There is no valid power of attorney (if the application is submitted through a representative).
3. The filing date of the application is determined as follows:
a) The filing date is the day the Intellectual Property Office receives the application according to Clause 2 of Article 8 of this Circular;
b) For international applications designating or choosing Vietnam, the filing date is the international filing date.
4. The priority date is determined as follows:
a) If the application does not claim priority or although it claims priority, it is not approved by the Intellectual Property Office, then the application is considered to have no priority date;
b) If the application claims priority, the priority date (or dates) is the date stated in the priority claim and approved by the Intellectual Property Office;
c) Determining the priority date based on the first application(s) filed in Vietnam according to the principle stipulated in Article 91 of the Intellectual Property Law and the corresponding provisions at points b, c, and đ of Clause 1 of Article 12 of Decree No. 65/2023/NĐ-CP.
5. The Intellectual Property Office will notify the result of the form examination and issue a decision accepting a valid application as follows:
a) If the application falls under any of the circumstances stipulated in Clause 2 of this Article, the Intellectual Property Office sends the applicant a notification of the form examination results, with the intention of rejecting the application due to its invalidity. The notification must specify the name and address of the applicant; the name of the authorized person (if any); the name of the object in the application; the filing date and application number; the reasons and deficiencies causing the application to be rejected and set a deadline of two months from the date of issuance of the notification for the applicant to provide comments or correct deficiencies.
In particular, for documents proving the basis for claiming priority, the applicant is allowed to submit supplementary documents within three months from the filing date according to point d of Clause 1 of Article 12 of Decree No. 65/2023/NĐ-CP.
b) In the case of a valid application, the Intellectual Property Office issues a decision accepting the valid application, which must specify the name and address of the applicant, the name of the authorized person (if any), and the information about the object in the application, the filing date, the application number, the priority date (if any), and send it to the applicant. If the priority claim is not accepted, the application is still accepted as valid, except in cases where other deficiencies affect the validity of the application, and the decision must specify the reason for not accepting the priority claim.
6. In the event that the applicant has been sent a notification of the form examination results with the intention of rejecting the application due to its invalidity according to point a of Clause 5 of this Article, but the applicant does not correct the deficiencies or the corrections do not meet the requirements or does not provide comments or provides comments that are not reasonable within the prescribed period, the Intellectual Property Office issues a decision rejecting the application and sends it to the applicant.
7. The time limit for examining the form of the application is calculated as follows:
a) The time limit for examining the form of the application is one month from the filing date according to Clause 1 of Article 119 of the Intellectual Property Law;
b) In the case where the Intellectual Property Office issues a notification according to point a of Clause 5 of this Article, the time for the applicant to respond to the notification is not included in the examination period. This period is understood as:
(i) The time from the date of issuance of the notification to the date the applicant responds to the notification; or
(ii) The deadline set in the notification (including any extension according to Clause 2 of Article 15 of Decree No. 65/2023/NĐ-CP), in the case where the applicant does not respond to the notification.
c) In case the applicant proactively requests to amend or supplement the application or responds to the notification of the National Office of Intellectual Property as stipulated in point a, Clause 5 of this Article, the deadline for formal examination shall be extended by ten days in accordance with Clause 4 of Article 119 of the Intellectual Property Law.
d) Before the end of the deadlines specified in points a, b, and c of this Clause, the National Office of Intellectual Property must complete the formal examination of the application and notify the result to the applicant in accordance with Clauses 5 and 6 of this Article.
Article 10. Publication of Valid Applications
1. Information related to applications that have been accepted as valid shall be published by the National Office of Intellectual Property in the Industrial Property Gazette in accordance with Article 110 of the Intellectual Property Law. The applicant must pay the publication fee as prescribed.
2. The publication of applications for patents, industrial designs, trademarks, and geographical indications shall be carried out as follows:
a) For patent applications:
(i) Patent applications shall be published in the nineteenth month from the priority date or filing date, if there is no priority date;
(ii) Early publication requests for patent applications shall be published within two months from the date the National Office of Intellectual Property receives the early publication request or from the date the application is accepted as valid, whichever is later.
b) For industrial design applications:
(i) Applications shall be published within two months from the date the application is accepted as valid if the applicant does not request late publication or has requested late publication but the application is accepted as valid after the applicant's requested late publication period has expired;
(ii) If the applicant requests late publication and the application is accepted as valid before the expiration of the applicant's requested late publication period, the application will be published in the following month after the end of the requested late publication period.
c) Trademark applications and geographical indication applications shall be published within two months from the date the application is accepted as valid.
3. The content published in the Industrial Property Gazette includes information related to the application that is valid in form as recorded in the decision accepting the application (including the decision number and decision date) and the following information:
a) For patent applications: the name and nationality of the inventor; information related to the application (conversion of applications, division of applications, original application number of divided/conversion applications, etc.); summary of the invention; characteristic drawings accompanying the summary (if any); date of requesting substantive examination (if any); date of requesting early publication (if any); international classification of the invention; and other information (if any).
b) For industrial design applications: the name and nationality of the designer; information related to the application (division of applications, original application number of divided applications, etc.); photographs or drawings of the industrial design; number of designs sought for protection; international classification of industrial designs; and other information (if any).
c) For trademark applications: the trademark specimen and list of goods/services bearing the trademark; information related to the application (conversion of applications, division of applications, original application number of divided applications, etc.); international classification of goods/services; and other information (if any); usage regulations (for collective trademarks, certification trademarks).
d) For geographical indication applications: a summary of the distinctive characteristics of the product bearing the geographical indication and the name of the product bearing the geographical indication; and other information (if any).
Article 11. Handling objections to industrial property registration applications
1. In cases where objections to industrial property registration applications are submitted in accordance with Article 112a of the Intellectual Property Law and meet the requirements stipulated in Clause 9 of this Article, The National Office of Intellectual Property shall accept such objections and notify the applicant thereof, setting a two-month deadline from the date of issuance of the notification for the applicant to respond in writing, except in the cases provided for in Clauses 2 and 5 of this Article.
2. Where the trademark and goods/services in the application are identical to those put forward by the objector or there is clear basis to conclude that the trademark and goods/services objected to are similar and likely to cause confusion or dissimilar and likely to cause confusion with those put forward by the objector, the National Office of Intellectual Property shall handle the objection during the examination of the substantive content of the trademark application and notify the objector of the result of handling the objection together with the result of examining the substantive content of the application.
3. After receiving the response of the applicant within the time limit specified in Clause 1 of this Article, if deemed necessary, the National Office of Intellectual Property shall notify the objector of the applicant's response and set a two-month deadline from the date of issuance of the notification for the objector to respond in writing to the applicant's response.
4. Based on information, evidence, and arguments provided by the parties as stipulated in Clauses 1 and 3 of this Article or/vand the results of direct dialogue between the parties as stipulated in Clause 7 of this Article and the documents contained in the application, the National Office of Intellectual Property shall handle the objection and notify the objector of the result of handling the objection together with the result of examining the substantive content of the application.
5. In cases where the objection concerns the right to apply for registration, the National Office of Intellectual Property shall notify the objector to file a lawsuit with the competent court in accordance with civil procedure laws, except for the following cases:
a) There is clear basis to determine that the applicant does not have the right to submit the application as stipulated in Clause 7 of Article 87 of the Intellectual Property Law;
b) Objections regarding the right to apply for registration of a trademark containing a geographical name or other signs indicating the geographical origin of local specialties of Vietnam as stipulated in Clauses 3 and 4 of Article 87 of the Intellectual Property Law.
6. If within two months from the date the National Office of Intellectual Property issues the notification as stipulated in Clause 5 of this Article, the objector does not send a copy of the case acceptance notice from the court to the National Office of Intellectual Property, the National Office of Intellectual Property shall consider the objection withdrawn and continue processing the application as if no objection had been made. In case the National Office of Intellectual Property receives a copy of the case acceptance notice from the court from the objector within the aforementioned period, the National Office of Intellectual Property shall suspend the processing of the application pending the resolution of the dispute by the court. Upon receipt of the court's decision, the processing of the application will be carried out in accordance with the outcome.
7. The National Office of Intellectual Property shall organize direct dialogue between the objector and the applicant to clarify the issue of the objection if deemed necessary or at the request of both parties.
8. The time limit for the applicant to respond to the objection of the objector and the time limit for the objector to respond to the applicant's response as stipulated in Clauses 1 and 3 of this Article shall not be counted towards the time limit for the National Office of Intellectual Property to carry out related procedures as prescribed.
9. Objections to industrial property registration applications must be made in Vietnamese. Documents accompanying the objection may be in another language but must be translated into Vietnamese upon request by the National Office of Intellectual Property.
Article 12. Content Examination
1. The content examination under Article 114 of the Intellectual Property Law is to assess the eligibility for protection of the subject matter stated in the application according to the conditions of protection, determining the scope (quantity) of protection accordingly. The content examination does not apply to design layout registration applications.
2. The content examination shall be conducted as follows:
a) The contents to be examined include:
(i) Evaluating the suitability of the subject matter stated in the application with the type of intellectual property right requested;
(ii) Evaluating the subject matter according to each condition of protection;
(iii) Checking the principle of first filing.
b) The evaluation according to the conditions of protection shall be carried out sequentially for each subject matter (if the application includes multiple subject matters while ensuring consistency). For each subject matter, the evaluation shall be carried out sequentially according to each condition of protection:
(i) For patent applications, the evaluation shall be carried out sequentially according to each point stated in the scope (claim) of protection;
(ii) For industrial design applications, the evaluation shall be carried out sequentially for the design of each product (if the application refers to a set of products); in case of referring to multiple options, the evaluation shall be carried out sequentially for each option, starting from the basic option (the first option stated in the application);
(iii) For trademark applications, the evaluation shall be carried out sequentially for each component of the trademark for each good or service listed in the goods and services list.
c) The content examination for each subject matter stated in point b of this clause shall be completed when the subject matter has been evaluated with all conditions of protection and there is sufficient basis to conclude that the subject matter does not meet or meets the conditions of protection, specifically:
(i) Finding reasons to conclude that the subject matter does not meet one or some or all conditions of protection; or
(ii) Not finding any reason to conclude that the subject matter does not meet at least one condition of protection.
d) Before issuing a notification of the result of the content examination with the intention to grant an intellectual property right as provided for in points c, d, e of Clause 8, Article 16, points c, d, e of Clause 10, Article 23, points c, d, sub-point (ii) of point e of Clause 13, Article 26, and point b of Clause 7, Article 30 of this Circular, the National Office of Intellectual Property shall check the principle of first filing as provided for in Clauses 7 of Article 16, Clause 9 of Article 23, and Clause 12 of Article 26 of this Circular.
đ) The notification of the result of the content examination with the intention to grant an intellectual property right as provided for in points c, d, e of Clause 8, Article 16, points c, d, e of Clause 10, Article 23, points c, d, sub-point (ii) of point e of Clause 13, Article 26, and point b of Clause 7, Article 30 of this Circular shall be issued for the following applications:
(i) Applications not falling within the cases stipulated in Article 90 of the Intellectual Property Law;
(ii) Applications having the earliest filing date or priority date among patent applications falling within the case stipulated in Clause 1, Article 90 of the Intellectual Property Law;
(iii) Applications having the earliest filing date or priority date among industrial design applications falling within the case stipulated in Clause 1, Article 90 of the Intellectual Property Law;
(iv) Applications having the earliest filing date or priority date among trademark applications falling within the case stipulated in Clause 2, Article 90 of the Intellectual Property Law;
(v) Applications pursuant to the agreement stipulated in Clause 3, Article 90 of the Intellectual Property Law.
e) Applications not falling within the cases stipulated in point đ of this clause shall be handled as follows:
(i) Refused issuance of an intellectual property right due to non-compliance with the principle of first filing, if the application has the earliest filing date or priority date granted an intellectual property right; or
(ii) Considered as an application having the earliest filing date or priority date and handled as the cases stipulated in point đ of this clause, if all applications having earlier filing dates or priority dates are refused issuance of an intellectual property right or withdrawn, considered as withdrawn.
3. During the content examination process, if the application does not fully disclose the essence of the subject matter, the National Office of Intellectual Property may request the applicant to explain the content of the application, provide information within the scope of the essence of the subject matter stated in the application to fully disclose the essence of the subject matter, and set a deadline of three months from the date of the notification for the applicant to rectify.
4. The time limit for content examination of the application is as follows:
a) The time limit for content examination of the application is carried out as provided for in Clause 2, Article 119 of the Intellectual Property Law;
b) The period for the applicant to respond to notifications of the National Office of Intellectual Property as provided for in Clauses 8 of Article 16, Clause 10 of Article 23, Clause 13 of Article 26, and Clause 7 of Article 30 of this Circular will not be counted towards the time limit for content examination. This period is understood as:
(i) The time from the date of issuance of the notification to the date the applicant responds to the notification; or
(ii) The deadline set in the notification (including any extension according to Clause 2 of Article 15 of Decree No. 65/2023/NĐ-CP), in the case where the applicant does not respond to the notification.
c) In the case where the applicant voluntarily requests to amend or supplement the application, or responds to the notification of the National Office of Intellectual Property as provided for in Clauses 8 of Article 16, Clause 10 of Article 23, Clause 13 of Article 26, and Clause 7 of Article 30 of this Circular, the time limit for content examination shall be extended correspondingly with the time limit for processing the amendment or supplementation request or the explanation of the applicant as provided for in Clause 4, Article 119 of the Intellectual Property Law as follows:
(i) For inventions, not exceeding six months;
(ii) For trademarks, not exceeding three months;
(iii) For industrial designs, not exceeding two months and ten days;
(iv) For geographical indications, not exceeding two months.
5. Prior to the end of the time limit for content examination of the application as provided for in Clause 4 of this Article, the National Office of Intellectual Property shall send the applicant one of the notifications as provided for in Clauses 8 of Article 16, Clause 10 of Article 23, Clause 13 of Article 26, and Clause 7 of Article 30 of this Circular.
Article 13. Re-examination
1. The re-examination of industrial property registration applications shall be carried out by the National Office of Intellectual Property in the following cases:
a) Re-examination of an application due to objections raised after the issuance of the notification on the result of substantive examination as stipulated in Clause 2, Article 118 of the Intellectual Property Law, provided that the following conditions are met:
(i) There is a written opinion from the applicant submitted to the National Office of Intellectual Property during the period from the date of issuance of the notification on the result of substantive examination to the date of issuance of the decision granting or refusing the relevant protection certificate; or there is a written objection from a third party against the grant of the protection certificate mentioned in the notification on the result of substantive examination, accompanied by credible evidence proving that the objection could not be made within the time limit prescribed in Article 112a of the Intellectual Property Law due to force majeure or objective obstacles;
(ii) The opinion referred to in item (i) of this point is based on credible grounds, accompanied by evidence or references to reliable sources of information;
(iii) The reasoning and evidence supporting the opinion referred to in item (i) of this point must differ from the reasoning and evidence (if any) presented in previous stages, or although such reasoning and evidence are not different, they have not been considered by the National Office of Intellectual Property as prescribed in Clauses 1, 2, and 3 of Article 11 of this Circular.
b) Re-examination of an application due to requests for amendments or additions to the application after the issuance of the notification on the result of substantive examination, which includes the intention to grant a protection certificate as stipulated in Subpoint c, Clause 3, Article 16 of Decree No. 65/2023/NĐ-CP;
c) Re-examination due to requests to record changes in the applicant due to the transfer of trademark registration applications submitted after the issuance of the notification on the result of substantive examination with the intention to grant a protection certificate as stipulated in Subpoint c, Clause 2, Article 18 of Decree No. 65/2023/NĐ-CP;
d) Re-examination of an application due to the owner of the protection certificate requesting to amend the description or narrow the scope of protection of industrial property rights as stipulated in Subpoint b, Clause 1 and Clause 3, Article 97 of the Intellectual Property Law according to the procedures for amending protection certificates prescribed in Subpoint b, Clause 5, Article 29 of Decree No. 65/2023/NĐ-CP;
đ) Re-examination of an application due to requests to revoke the validity of the protection certificate as stipulated in Subpoint a, Clause 3, Article 32 of Decree No. 65/2023/NĐ-CP;
e) Re-examination of an application due to complaints about decisions or notifications related to the application as stipulated in Clause 4 and Subpoint b, Clause 6, Article 38 of this Circular.
2. The re-examination of an application shall be conducted as follows:
a) The time limit for re-examination of an application as prescribed in Clause 3, Article 119 of the Intellectual Property Law is as follows:
(i) For inventions, not exceeding 12 months;
(ii) For trademarks, not exceeding 6 months;
(iii) For designs, not exceeding 4 months and 20 days;
(iv) For geographical indications, not exceeding 4 months.
In complex cases requiring verification of many details or seeking expert opinions, the re-examination period may be extended but shall not exceed the initial examination period as prescribed in Clause 2, Article 119 of the Intellectual Property Law.
b) The content of re-examination shall be carried out in accordance with the corresponding provisions in Clause 2, Article 12 of this Circular;
c) The re-examination procedure shall be carried out in accordance with the corresponding provisions in Clause 8, Article 16, Clause 10, Article 23, Clause 13, Article 26, and Clause 7, Article 30 of this Circular, except for the cases specified in Subpoints đ and e, Clause 1 of this Article;
d) For each case specified in Clause 1 of this Article, the re-examination of an application shall only be conducted once for the applicant and for each third party.
Section 2. APPLICATIONS AND HANDLING OF PATENT APPLICATIONS
Article 14. Requirements for Patent Applications
1. Patent applications shall be made in accordance with Articles 100 and 102 of the Intellectual Property Law, Clause 48 and Appendix I of Decree No. 65/2023/NĐ-CP, and specifically as provided herein.
2. The application must ensure consistency as prescribed in Clauses 1 and 2 of Article 101 of the Intellectual Property Law. A group of inventions closely related in technology to achieve a single inventive purpose as prescribed in Clause 2 of Article 101 of the Intellectual Property Law shall fall under the following cases:
a) An object used to produce (manufacture, fabricate, prepare) another object;
b) An object used to perform another object;
c) An object used to use another object;
d) Objects of the same type, having the same function to ensure the same result.
3. For patents concerning or relating to biological materials that cannot be described or cannot be described sufficiently for a person with average knowledge in the field of biotechnology to implement according to Clause 2 of Article 102 of the Intellectual Property Law, the applicant may submit samples of biological materials to serve the examination process of the relevant patent application. Submission of samples of biological materials must meet the following requirements:
a) Samples of biological materials must be submitted to the competent authority for storing biological materials not later than the date of filing the patent application related to such biological materials;
b) The competent authority for storing biological materials is an authority in Vietnam or abroad listed in the international authority list under the Budapest Treaty or recognized by the Ministry of Science and Technology for the function of storing biological materials to carry out procedures related to patents;
c) For samples of biological materials stored at an authority outside Vietnam, if it is deemed necessary to clarify the nature of the subject matter sought to be protected or to satisfy third parties' requests for access to such subject matter, the National Office of Intellectual Property may take the following actions:
(i) Request the applicant to submit additional samples of biological materials to a competent authority for storage in Vietnam in case the samples of biological materials have not been stored at an international authority under the Budapest Treaty;
(ii) Request the authority storing the samples of biological materials to provide samples in case the samples of biological materials have been stored at an international authority under the Budapest Treaty.
4. For patent applications directly derived from genetic sources or traditional knowledge, where the applicant does not submit documentation explaining the origin of the genetic source or traditional knowledge that the inventor or applicant has accessed according to Point đ1 Clause 1 of Article 100 of the Intellectual Property Law due to inability to determine the origin of the genetic source or traditional knowledge, they must clearly state this and bear responsibility for the truthfulness thereof.
5. Where there is a basis (information, evidence) to doubt the authenticity of the information stated in the application or the information stated in the application is unclear, the National Office of Intellectual Property may request the applicant to submit documents to verify or clarify such information within two months from the date of issuance of the notification by the National Office of Intellectual Property. Such documents may include legal registration confirmation documents if the applicant benefits from another person's right to file an application (documents proving inheritance rights under civil law, documents proving the transfer of application rights; service contracts or employment contracts, etc.); documents showing the results of human, animal, or plant drug testing mentioned in the description section (when the protected object is a pharmaceutical for humans, animals, or plants), etc.
Article 15. Formal Examination and Publication of Patent Application Forms
The formal examination and publication of patent application forms shall be carried out according to the general procedures stipulated in Articles 9 and 10 of this Circular.
Article 16. Substantive Examination of Patent Applications
1. The applicant has the right to request the National Office of Intellectual Property to conduct a substantive examination of the patent application in accordance with Article 113 of the Intellectual Property Law, following the guidelines below:
a) The request for substantive examination of the patent application must be made in writing using the form prescribed in Appendix I of Decree No. 65/2023/NĐ-CP or stated in the patent application form (if the request is made at the time of filing).
b) The deadline for submitting the request for substantive examination of the patent application shall be in accordance with the provisions of Article 113 of the Intellectual Property Law.
c) The applicant must pay the search fee and the substantive examination fee as prescribed. If the applicant fails to pay all the required fees, the request for substantive examination will be deemed invalid, and the National Office of Intellectual Property will not proceed with the substantive examination of the application.
A request for substantive examination submitted after the publication date of the application will be published in the Industrial Property Gazette in the second month from the date of receipt of the request. A request for substantive examination submitted before the publication date of the application will be published together with the corresponding application.
2. The National Office of Intellectual Property will conduct a substantive examination of the patent application according to the general procedures stipulated in Article 12 of this Circular and in accordance with the specific provisions set forth in Clauses 3, 4, 5, 6, 7, 8, and 9 of this Article.
3. The assessment of the suitability between the subject matter described in the application and the type of intellectual property protection requested (Patent Certificate or Utility Model Certificate) shall be conducted as follows:
a) The subject matter described in the patent application will be considered unsuitable for the type of intellectual property protection requested (Patent Certificate or Utility Model Certificate) if it is not a technical solution, specifically not a product or process. The identification of a technical solution is defined in Clause b of this point.
b) A technical solution – the object protected under the name of a patent – is a complete set of information about the method and/or means of technology (applying natural laws) aimed at solving a specific task (problem). A technical solution may belong to one of the following types:
(i) A product in the form of an object, such as tools, machines, equipment, components, electronic circuits, etc., expressed by a set of information defining a man-made product characterized by technical features regarding its structure, which serves as a means to meet certain human needs; or a product in the form of a substance (including single substances, compounds, and mixtures), such as materials, substances, food, pharmaceuticals, etc., expressed by a set of information defining a man-made product characterized by technical features regarding the presence, ratio, and state of elements, which serves as a means to meet certain human needs; or a product in the form of biological material, such as genes, genetically modified plants/animals, etc., expressed by a set of information about a product containing genetic information altered by humans, capable of self-replication.
(ii) A process (technological process; diagnostic, predictive, testing, treatment methods, etc.) expressed by a set of information defining the method of carrying out a process, a specific job characterized by features regarding the sequence, conditions, participating components, measures, and means to perform operations to achieve a specific purpose.
c) The subject matter described in the application will not be considered a technical solution in the following cases:
(i) The subject matter described in the application is merely an idea or intention, only posing (raising) a problem without providing a solution, unable to answer the questions "how" or "by what means";
(ii) The problem (task) posed for resolution is not a technical problem and cannot be resolved through a technical method;
(iii) Natural products that are not man-made creations.
4. Assessment of Industrial Applicability as stipulated in Article 62 of the Intellectual Property Law
a) A technical solution described in the application will be considered "realizable" if:
(i) Information about the nature of the solution along with instructions on necessary technical conditions is presented clearly and sufficiently to allow a person with average knowledge in the relevant field of technology to create, produce, or use, exploit, or implement the solution;
(ii) Creating, producing, using, exploiting, or implementing the aforementioned solution can be repeated with results identical to those described in the patent description.
b) A technical solution will be considered non-industrially applicable in the following cases:
(i) The nature of the object or instructions to implement the object contradicts fundamental scientific principles (for example, does not follow the principle of conservation of energy, etc.);
(ii) The object includes elements or components that have no technical relationship with each other or cannot be linked (combined, bound, dependent, etc.) with each other;
(iii) The object contains inherent contradictions;
(iv) Instructions on the object can only be implemented a limited number of times (cannot be repeated);
(v) To implement the solution, the person implementing it must possess special skills that cannot be taught or shown to others;
(vi) Results obtained from multiple implementations are inconsistent with each other;
(vii) Results obtained differ from those described in the application;
(viii) There is a complete lack or absence of the most important instructions to implement the solution;
(ix) Other reasonable grounds exist.
5. Assessment of Novelty as stipulated in Article 60 of the Intellectual Property Law
a) To evaluate the novelty of the technical solution stated in the application, at least the following mandatory sources of information must be searched (but not limited to these minimum sources):
(i) All patent applications received by the Intellectual Property Office having the same classification index as the classification index of the subject matter stated in the application under examination - up to the class level (third-level index) and with a priority date or filing date earlier than the priority date or filing date of the application under examination, except for those applications that have not or will not be published;
(ii) Patent applications or patent protection documents issued by other organizations or countries within twenty-five years from the filing date or priority date of the application under examination (if the application claims priority rights), which are stored in the patent database maintained by the Intellectual Property Office and other information sources prescribed by the Intellectual Property Office, with the scope of search as specified in subpoint (i) of this point.
In necessary cases and if possible, the search may be extended to the national database on science and technology and other accessible information sources, including online information sources.
b) The purpose of searching information is to find technical solutions that are essentially similar or identical to the technical solution stated in the application. In this point:
(i) Two technical solutions are considered identical when all basic characteristics (features) are identical or equivalent (substitutable for each other);
(ii) Two technical solutions are considered similar when most of the basic characteristics (features) are identical or equivalent (substitutable for each other);
(iii) "Contrasting technical solution" is the technical solution that is most identical or similar to the technical solution stated in the application;
(iv) "Contrasting document" is a document describing the contrasting technical solution or evidence proving that the contrasting technical solution has been publicly disclosed.
c) The results of the information search must be reflected in the search report, in which the search field, the scope of the search, and the search results within that scope (statistical data on the contrasting technical solutions found, clearly indicating identical characteristics, name of the contrasting document, page number, line number, source of the document, and publication date of the document) must be recorded, and the name of the person preparing the report (the searcher) must be stated.
d) To evaluate the novelty of the technical solution stated in the application, a comparison must be made between the basic characteristics (features) of that technical solution and the basic characteristics of the contrasting technical solutions found during the information search; wherein:
(i) The basic technical characteristics of the technical solution may be structural features (details, detail groups, connections, etc.) or composition features (components (presence, ratio), states of elements, etc.) together with other basic technical characteristics forming a sufficient set to determine the nature (content) of the subject matter.
The above basic technical characteristics may be expressed in the form of a functional characteristic of a component in the structure or composition of the product (called a functional characteristic), provided that such expression is sufficient for a person with average knowledge in the field to easily understand the technical means or method to perform that function under normal conditions without requiring creativity. The function or utility of the protected object is not a basic technical characteristic but may be the purpose or result achieved by that object;
(ii) The basic technical characteristics of the technical solution stated in the application, as shown in the scope (claim) of patent protection, description, or drawings;
(iii) The basic technical characteristics of the technical solution stated in other documents are expressed and discovered according to the descriptive document or the actual form of the technical solution.
đ) To not be deemed to have lost its novelty in the exceptional cases stipulated in Clause 3 and Clause 4, Article 60 of the Intellectual Property Law, the applicant must submit relevant documents regarding the publication to prove eligibility for the exception. The aforementioned documents must be submitted along with the application or supplemented according to the regulations on amending and supplementing the application.
e) For each point of the scope (claim) of protection, the technical solution stated in the application is considered new compared to the state of the art worldwide if:
(i) No contrasting technical solution is found during the information search; or
(ii) A contrasting technical solution is found, but the technical solution stated in the application has at least one basic technical characteristic not present in the contrasting technical solution (and that characteristic is called a differentiating characteristic).
6. Evaluating the inventive step as prescribed in Article 61 of the Intellectual Property Law shall be carried out as follows:
a) When evaluating the inventive step of the technical solution, at least the mandatory sources of information as prescribed in point a, Clause 5 of this Article (except for applications that have not been published as of the priority date or filing date of the application under examination) must be searched (but not limited to these minimum sources);
b) The evaluation of the inventive step of the technical solution stated in the application is conducted by assessing the differentiating characteristics stated in the scope (claim) of protection to draw conclusions:
(i) Whether the differentiating characteristics are considered to have been disclosed in the minimum mandatory information sources; and
(ii) Whether the set of differentiating basic technical characteristics is considered obvious to a person with average knowledge in the corresponding technical field.
Corresponding to a point within the scope (claim) of protection, the technical solution is considered to have an inventive step if incorporating the differentiating basic technical characteristic into the set of basic technical characteristics of the technical solution is the result of creative activity and not an obvious result of common knowledge in the corresponding technical field.
c) In each of the following cases (but not limited to these cases), with respect to a point within the scope of protection, the technical solution shall be deemed to lack inventive step:
(i) A set of basic distinguishing technical features that are obvious (any person with average knowledge in the relevant field of technology would know that such a set of features must necessarily be used to perform the intended function or achieve the intended purpose, and conversely, when using such a set of features, the intended purpose or function will necessarily be achieved);
(ii) A set of basic distinguishing technical features that have been disclosed identically or equivalently in one or more known technical solutions in the minimum required information sources. Two features are considered identical if they have the same nature; two features are considered equivalent if they have similar nature, the same purpose, and the basic method of achieving the purpose is the same;
(iii) A technical solution that is a simple combination of known technical solutions with functions, purposes, and effects that are also simple combinations of the functions, purposes, and effects of each known technical solution.
7. For patent application forms that have been concluded as meeting the conditions for protection, before issuing a notice of the result of substantive examination with the intention of granting a Patent Certificate or Utility Model Certificate as provided for in Points c, d, and e of Clause 8 of this Article, the National Office of Intellectual Property shall check to ensure compliance with the first-to-file principle stipulated in Clause 3 of Article 90 of the Intellectual Property Law.
8. Before the expiration date of the substantive examination period for the application form as prescribed in Clause 4 of Article 12 of this Circular, the National Office of Intellectual Property shall carry out the following tasks:
a) If the subject matter claimed for protection in the application does not meet the conditions for protection or falls under the cases specified in Article 117 of the Intellectual Property Law, or meets the conditions for protection but the application still has deficiencies, the National Office of Intellectual Property shall issue a notice of the result of substantive examination, stating clearly the intention to refuse grant of the protection certificate, the reasons for refusal or deficiencies in the application, and may provide guidance on amending the scope (volume) of protection and setting a deadline of three months from the date of issuance of the notice for the applicant to submit comments;
b) If at the end of the period prescribed in Point a of this Clause, the applicant fails to correct the deficiency or the correction does not meet the requirements, or there is no objection or the objection is not reasonable, then within fifteen days from the end of the aforementioned period, the National Office of Intellectual Property shall issue a decision refusing grant of the protection certificate.
c) If the subject matter claimed for protection in the application partially meets the conditions for protection according to the claim points, the National Office of Intellectual Property shall issue a notice of the result of substantive examination, stating clearly the intention to grant the protection certificate for the part that meets the conditions for protection, subject to the applicant's amendment of the application meeting the requirements, the reasons for refusing grant for the part that does not meet the conditions, and setting a deadline of three months from the date of issuance of the notice for the applicant to submit written comments agreeing to the amendment of the application or opposing the result of substantive examination.
d) If the subject matter claimed for protection in the application meets the conditions for protection or the applicant has corrected the deficiency to meet the requirements or submitted a reasonable explanation of the result of substantive examination and/or amended the application to meet the requirements as provided for in Points a and c of this Clause, the National Office of Intellectual Property shall issue a notice of the result of substantive examination, stating the intention to grant the protection certificate for the whole or the part that meets the conditions for protection, and setting a deadline of three months from the date of issuance of the notice for the applicant to pay the registration fee for the protection certificate, publication fee for the decision to grant the protection certificate, recordation fee for the decision to grant the protection certificate, maintenance fee, and annual usage fee for the first year for the patent.
đ) If at the end of the period prescribed in Point c of this Clause, the applicant does not amend the application or does not submit objections, then within fifteen days from the end of the aforementioned period, the National Office of Intellectual Property shall issue a decision refusing grant of the protection certificate.
e) If at the end of the period prescribed in Point c of this Clause, the applicant's amendment of the application does not meet the requirements or the objection is not reasonable, the National Office of Intellectual Property shall issue a notice of the result of substantive examination, stating clearly the intention to grant the protection certificate for the part that meets the conditions for protection, subject to the applicant's amendment of the application meeting the requirements, and setting a deadline of three months from the date of issuance of the notice for the applicant to amend the application.
If the applicant's amendment of the application meets the requirements, within three months from the date of the applicant's amendment of the application, the National Office of Intellectual Property shall notify the applicant about the intention to grant the protection certificate and the payment of the registration fee for the protection certificate, publication fee for the decision to grant the protection certificate, recordation fee for the decision to grant the protection certificate, maintenance fee, and annual usage fee for the first year for the patent, and setting a deadline of three months from the date of issuance of the notice for the applicant to pay the fees and charges.
g) If the applicant's amendment of the application does not meet the requirements, does not amend the application, or does not pay the registration fee for the protection certificate, publication fee for the decision to grant the protection certificate, and recordation fee for the decision to grant the protection certificate within the time limit prescribed in Points d and e of this Clause, then within three months from the end of the corresponding period, the National Office of Intellectual Property shall issue a decision refusing grant of the protection certificate.
h) For the cases specified in Points d and e of this Clause, if the applicant pays all types of fees and charges as prescribed within the time limit, then within fifteen days from the end of the corresponding period, the National Office of Intellectual Property shall issue a decision granting the protection certificate. If within the prescribed period, the applicant has paid the registration fee for the protection certificate, publication fee for the decision to grant the protection certificate, and recordation fee for the decision to grant the protection certificate but has not paid the maintenance fee and annual usage fee for the first year of the Patent Certificate or Utility Model Certificate, then the certificate will still be granted but its validity will be immediately terminated upon issuance.
9. The use of the results of information searches and the examination of patent application forms from foreign patent offices shall be carried out as follows:
a) During the substantive examination of a patent application form, the National Office of Intellectual Property may refer to the results of information searches and the examination of corresponding applications submitted abroad;
b) The search results and examination results referred to in point a of this clause include one of the following documents:
(i) Search reports, examination reports, and notifications of examination results;
(ii) Publications of patent applications or protection certificates.
c) Before the National Office of Intellectual Property issues a notification of the substantive examination result, the applicant may request the National Office of Intellectual Property to use the substantive examination results of a patent application submitted abroad for evaluation of protectability, if the following conditions are met:
(i) The substantive examination results in the documents mentioned in sub-clause (i) and (ii) of point b of this clause must be issued by agencies included in the list approved by the Minister of Science and Technology based on the proposal of the National Office of Intellectual Property;
(ii) In the substantive examination results of the patent application submitted abroad mentioned above, at least one claim for protection is evaluated as meeting the protection requirements;
(iii) The claims for protection of the application filed in Vietnam initially or after amendment must match the claims for protection evaluated as meeting the protection requirements in the substantive examination results of the patent application submitted abroad mentioned above;
(iv) The applicant submits the following documents to the National Office of Intellectual Property: a request to use the foreign examination results according to the model prescribed in the Appendix of this Circular; copies of the examination results; translations of the examination results (if necessary); claims for protection evaluated by the foreign patent office as meeting the protection requirements and their translations (if necessary); documents cited in the processing results of the foreign patent office (if necessary); amended descriptions, detailed explanations of the amendments and additions compared to the originally submitted description (if there are amendments); and fees as prescribed.
d) If the conditions set forth in point c of this clause are met, the request to use the foreign substantive examination results is accepted, and the National Office of Intellectual Property issues a notification of the substantive examination result within twelve months from the date of receipt of the applicant's request.
Any amendment or addition procedures for the patent application form within the twelve-month period mentioned above that cause one of the conditions set forth in point c of this clause not to be met anymore, the patent application form will be examined according to the regular procedure.
e) If one of the conditions set forth in point c of this clause is not met, the National Office of Intellectual Property rejects the request to use the foreign results and the patent application form will be examined according to the regular procedure.
Section 3. APPLICATIONS AND HANDLING OF APPLICATIONS FOR REGISTRATION OF INDUSTRIAL DESIGNS
Article 17. Requirements for Applications for Registration of Industrial Designs
1. An application for registration of an industrial design must comply with the requirements stipulated in Articles 100, 101, and 104 of the Law on Intellectual Property, Appendix I of Decree No. 65/2023/NĐ-CP, and the guidance provided in this Article.
2. Where there is a basis (information, evidence) to doubt the authenticity of the information stated in the application or where the information stated in the application is unclear, the National Office of Intellectual Property requests the applicant to submit documents to verify or clarify such information within two months from the date the National Office of Intellectual Property issues a notification. Such documents may include confirmation documents of legitimate registration rights, if the applicant enjoys the right to file the application from another person (documents proving inheritance rights, documents proving the transfer of filing rights; service contracts or labor contracts), etc.
Article 18. Confidentiality of Information in the Application for Layout-Design Registration
The Intellectual Property Office shall be bound by confidentiality with respect to information contained in the application for layout-design registration that the applicant requests to be kept confidential pursuant to Appendix I of Decree No. 65/2023/NĐ-CP.
Article 19. Formal Examination of the Application for Layout-Design Registration
1. The formal examination of the application for layout-design registration shall be conducted in accordance with the general provisions set forth in Clauses 1, 2, 3, 4, and 8 of Article 9 of this Circular and specific provisions applicable to the application for layout-design registration as stipulated herein.
2. The notification of the result of the formal examination shall be carried out as follows:
a) If the application falls under any of the cases specified in Clause 2 of Article 9 of this Circular, the Intellectual Property Office shall carry out the procedures prescribed in Point a of Clause 5 of Article 9 of this Circular.
b) If the application is valid, the Intellectual Property Office shall send the applicant a notice of its intention to grant the Certificate of Registration for Layout-Design and set a deadline of three months from the date of issuance of the notice for the applicant to pay the fees and charges as prescribed.
3. In the case where the applicant has been sent by the Intellectual Property Office a notice of the result of the formal examination indicating deficiencies and the intention to reject the application as prescribed in Point a of Clause 5 of Article 9 of this Circular, but the applicant fails to correct the deficiencies or does not meet the requirements for correction or does not provide any objection or provides an objection that is not substantiated within the prescribed time limit, or the applicant does not pay the full fees and charges for granting the Certificate of Registration for Layout-Design as prescribed, the Intellectual Property Office shall issue a decision rejecting the grant of the Certificate of Registration for Layout-Design and send it to the applicant.
Article 20. Publication of the Application for Layout-Design Registration
1. An application for layout-design registration that has been accepted as valid shall be published in accordance with the provisions of Clause 4 of Article 110 of the Intellectual Property Law.
2. Access to detailed information about a valid layout-design registration application
a) From the date of publication of the application, anyone may access detailed information about the nature of the layout-design described in the published application, except for information subject to confidentiality as provided for in Article 18 of this Circular.
b) Only authorized agencies implementing procedures to revoke the validity of a protection certificate or to handle acts of infringement against layout-designs may access confidential information about layout-designs.
Section 4. APPLICATIONS AND HANDLING OF APPLICATIONS FOR INDUSTRIAL DESIGNS REGISTRATION
Article 21. Requirements for Applications for Industrial Design Registration
1. An application for industrial design registration must comply with the general requirements prescribed in Articles 100 and 103 of the Intellectual Property Law, Appendix I of Decree No. 65/2023/NĐ-CP, and the guidance provided herein.
2. An application for industrial design registration must ensure consistency as prescribed in Clauses 1 and 3 of Article 101 of the Intellectual Property Law. Where an application seeks protection for an industrial design of a product or component for assembly into a composite product accompanied by one or more variant designs of the same industrial design, the variants of the industrial design must not significantly differ from the basic design and must not significantly differ from each other.
Herein, a product refers to an object, tool, equipment, means, produced by industrial or handicraft methods, having a clear structure and function; a component for assembly into a composite product is a part capable of independent circulation, removable from the composite product; a composite product is a product formed by multiple replaceable parts that can be disassembled and reassembled. Products and components for assembly into composite products mentioned above are collectively referred to as products unless otherwise specified.
3. In the event there is a basis (information, evidence) to doubt the authenticity of the information stated in the application or if the information stated in the application is unclear, the Intellectual Property Office shall request the applicant to submit documents to verify or clarify such information within two months from the date the Intellectual Property Office issues a notice. Such documents may include legal registration confirmation documents if the applicant enjoys the right to file the application from another person (documents proving inheritance rights, documents proving the transfer of filing rights; contracts for work assignments or employment contracts, etc.).
4. The distinctive features of an industrial design are understood as follows:
a) The distinctive features of an industrial design are elements expressed in the form of lines, shapes, colors, positional relationships, or size relationships that when combined with other characteristics (marks) create the industrial design;
b) Basic distinctive features are easily recognizable/memorable features that are necessary and sufficient to identify the essence of the industrial design and distinguish the industrial design from other industrial designs used for similar products.
Similar products are those with the same or similar intended uses or functions. Composite products and components used to assemble into composite products are different types of products.
c) The following factors shall not be considered as basic distinctive features of an industrial design:
(i) Shapes and lines determined by the technical function of the product itself (for example, the flat shape of a data storage disc is determined by the relative motion between the disc and the reading head, etc.);
(ii) Factors whose presence in the set of marks does not sufficiently create an aesthetic impression (the appearance of the product does not change whether the factor is present or absent; for example, a familiar shape or line changes but the change is not enough to be recognized, so the changed shape or line is still only recognized as the original shape or line);
(iii) Materials used to manufacture the product;
(iv) Marks attached, affixed, etc., to the product solely to perform informational functions regarding the origin, characteristics, construction, utility, method of use, etc., of the product; for example, information on product labels (such as manufacturer, trade mark, place of origin, barcode, etc.), trademarks, geographical indications, etc.;
(v) The size of the product, except in cases where the decorative size of fabric samples and similar materials is changed;
(vi) Unobservable design features during the exploitation of the product's utility (for industrial designs of products) or complex products (for industrial designs of components assembled into complex products);
(vii) Other elements that do not meet the conditions set forth in point b of this clause.
Article 22. Examination of Form, Publication of Industrial Design Application
The examination of form and publication of industrial design applications shall be carried out according to the general procedures stipulated in Articles 9 and 10 of this Circular.
Article 23. Examination of Content of Industrial Design Applications
1. The examination of the content of industrial design applications shall be conducted according to the general procedures stipulated in Article 12 of this Circular and according to the specific provisions of this Article.
2. The subject matter stated in the application shall be deemed unsuitable for the type of industrial design right if:
a) It is not the external shape of the product. The external shape of the product is a collection of design features (shape, lines, colors, or combinations of these elements) visible during the exploitation of the product's utility (for industrial designs of products) or complex products (for industrial designs of components assembled into complex products). In which, exploiting the product's utility, complex products means putting those products into use according to their functions and utilities, without considering maintenance, repair, or repair work on the products or complex products.
b) The subject matter stated in the application is:
(i) The external shape of the product required by the technical characteristics of the product;
(ii) The external shape of civil or industrial buildings, except for the external shapes of modules or individual units that can be used independently or assembled together to form buildings such as shops, kiosks, mobile houses, or similar products.
3. Information searches shall be conducted as follows:
a) The purpose of the information search is to find in the minimum mandatory information sources industrial designs identical or similar to the industrial design stated in the application.
b) The minimum mandatory information sources used in the examination of the content of the application include the following documents:
(i) Industrial design applications received by the Intellectual Property Office and published earlier than the filing date or priority date of the application being examined (if the application claims priority);
(ii) Industrial design applications and industrial design rights granted by other organizations or countries published within 25 years before the filing date or priority date of the application being examined (if the application claims priority), stored in the existing industrial design database at the Intellectual Property Office;
(iii) Other information related to industrial designs collected and retained by the Intellectual Property Office;
(iv) Industrial design applications received by the Intellectual Property Office, international industrial design applications designating Vietnam with filing dates or priority dates (if the application claims priority) earlier than the filing date or priority date of the application being examined (used to check the first-to-file principle stipulated in Clause 9 of this Article).
c) If necessary and possible, the search may be expanded beyond the minimum mandatory information sources, such as the national database of patents, trademarks, and other accessible information sources.
4. The results of the search must be reflected in the search report, in which the field of search, scope of search, search results within that scope (statistics and identification of corresponding industrial designs found, source of information, date of publication of the information) must be clearly recorded, and the name of the person preparing the report (the searcher) must be stated.
In which, "comparative industrial design" is an industrial design identical or similar to the industrial design stated in the application, compared with the industrial design stated in the application when assessing novelty and creativity.
5. The assessment of the degree of difference between industrial designs is carried out according to the following regulations:
a) Two industrial designs are considered identical when they are used for the same type of product and have the same basic and non-basic design features;
b) Two industrial designs are considered not significantly different from each other when they are used for the same type of product and have the same basic design features;
c) Two industrial designs are considered similar when they are used for the same type of product and have at least one basic design feature identical or not significantly different from each other;
d) Two industrial designs among similar industrial designs are considered the most similar when they have the highest number of identical or not significantly different basic design features compared to all other similar industrial designs;
đ) Two industrial designs are considered significantly different from each other when they are used for different types of products, or used for the same type of product but have at least one basic design feature different from each other.
6. The assessment of the novelty of industrial designs as prescribed in Article 65 of the Intellectual Property Law is carried out as follows:
a) To assess the novelty of the industrial design stated in the application, a comparison must be made between the collection of basic design features of that industrial design and the collection of basic design features of each comparative industrial design found during the information search.
b) The industrial design stated in the application is considered new if:
(i) No comparative industrial design is found in the minimum mandatory information sources; or
(ii) Although the industrial design for comparison is found in the minimum required source of information, the industrial design stated in the application is considered to be significantly different from the industrial designs for comparison; or
(iii) The industrial design for comparison is precisely the industrial design stated in the application that has been published or disclosed under the provisions of Clause 3 and Clause 4 of Article 65 of the Intellectual Property Law.
7. The assessment of the creativity of the industrial design as prescribed in Article 66 of the Intellectual Property Law shall be carried out as follows:
a) To assess the creativity of the industrial design stated in the application, it is necessary to compare the set of basic design features of such industrial design with the set of basic design features of the industrial designs for comparison found during the information search process.
b) In the following cases, the industrial design stated in the application is considered not to have creativity:
(i) The industrial design is merely a combination of known design features (known design features are simply arranged or assembled together, such as substitution, change of position, increase or decrease in quantity, etc.);
(ii) The industrial design is a reproduction or imitation of part or all of the natural shape of plants, fruits, animals, etc., or the shape of known geometric figures (such as circles, ellipses, triangles, squares, rectangles, regular polygons, prisms whose cross-sections are the aforementioned shapes, etc.);
(iii) The industrial design is a simple reproduction of the shape of products or works that are famous or well-known in Vietnam or worldwide;
(iv) The industrial design imitates an industrial design from another field if such imitation is known in practice (for example, toys imitating cars, motorcycles, etc.).
If none of the above situations apply, the industrial design is considered to have creativity.
8. The assessment of the industrial applicability of the industrial design as prescribed in Article 67 of the Intellectual Property Law shall be carried out as follows:
a) The industrial design stated in the application is considered to have industrial applicability if, based on the information about the industrial design presented in the application, a person with average knowledge in the relevant field can use such industrial design as a model to manufacture products with an outer shape identical to the industrial design by either industrial or manual methods.
b) In the following cases, the subject matter stated in the application is considered not to have industrial applicability:
(i) The subject matter stated in the application is the shape of a product in an unstable state (products in gaseous or liquid form, etc.);
(ii) It is only possible to create a product with a shape like the subject matter stated in the application through special skills or it is not possible to repeat the creation of a product with a shape like the subject matter stated in the application;
(iii) Other reasonable grounds.
9. For applications for registration of industrial designs that have been concluded to meet the conditions for protection, before issuing the notice of intention to grant the Certificate of Design Protection as prescribed in Points c, d, and e of Clause 10 of this Article, the National Office of Intellectual Property shall conduct a check to ensure the priority filing principle prescribed in Clause 1 and Clause 3 of Article 90 of the Intellectual Property Law according to the following provisions:
a) To check the priority filing principle, it is necessary to carry out a search for information in the mandatory sources prescribed in Item (iv) of Point b of Clause 3 of this Article;
b) The search is to find applications for registration of industrial designs for similar products that are identical or not significantly different from each other, or to find applications for registration of industrial designs for composite products containing parts with industrial designs that are identical or not significantly different from the registered industrial design, and to determine the application with the earliest filing date or priority date;
c) If there are multiple applications falling under the situation described in Point b of this Clause, the Certificate of Design Protection may only be granted to the valid application with the earliest filing date or priority date among those meeting the conditions for obtaining a certificate of protection;
d) Among the applications falling under the situation described in Point b of this Clause for similar products, if there are multiple applications with the same earliest filing date or priority date, the Certificate of Design Protection may only be granted to a single application among them upon agreement of all applicants; if no agreement is reached, all such applications will be refused protection.
10. Before the end of the deadline for substantive examination of the application as prescribed in Clause 4 of Article 12 of this Circular, the National Office of Intellectual Property shall perform the following tasks:
a) If the subject matter claimed for protection in the application does not meet the conditions for protection or falls under the cases specified in Article 117 of the Intellectual Property Law, or meets the conditions for protection but the application still has deficiencies, the National Office of Intellectual Property shall issue a notice of the result of substantive examination, stating clearly the intention to refuse grant of the protection certificate, the reasons for refusal or deficiencies in the application, and may provide guidance on amending the scope (volume) of protection and setting a deadline of three months from the date of issuance of the notice for the applicant to submit comments;
b) If the deadline prescribed in Point a of this Clause ends and the applicant does not correct the deficiencies or corrections are not satisfactory, or there is no objection or there is an objection but it is not reasonable, then within 15 days from the end of the aforementioned deadline, the National Office of Intellectual Property issues a Decision refusing to grant a certificate of protection;
c) If the subject matter claimed for protection in the application partially meets the protection conditions, the National Office of Intellectual Property issues a notice of the result of the substantive examination, specifying the intention to grant a certificate of protection for the part that meets the protection conditions provided that the applicant modifies the application satisfactorily, the reasons for refusing protection for the non-compliant part, and setting a deadline of three months from the date of issuance of the notice for the applicant to submit written comments on agreement and modification of the application or objection to the result of the substantive examination.
d) If the subject matter requested for protection in the application meets the conditions for protection or the applicant has corrected deficiencies to meet the requirements or provided a reasonable explanation regarding the results of the substantive examination and/or amended the application in accordance with points a and c of this clause, the National Office of Intellectual Property shall issue a notification of the results of the substantive examination, stating its intention to grant a certificate of protection for the entire or part thereof that meets the conditions for protection, and setting a deadline of three months from the date of issuance of the notification for the applicant to pay the registration fee, publication fee, and recordation fee for the decision on granting the certificate of protection.
đ) If at the end of the period prescribed in Point c of this Clause, the applicant does not amend the application or does not submit objections, then within fifteen days from the end of the aforementioned period, the National Office of Intellectual Property shall issue a decision refusing grant of the protection certificate.
e) If at the end of the period specified in point c of this clause, the applicant's amendment of the application does not meet the requirements or there is an objection but it is not reasonable, the National Office of Intellectual Property shall issue a notification of the results of the substantive examination, stating its intention to grant a certificate of protection for the part that meets the conditions for protection, subject to the applicant amending the application to meet the requirements, and setting a deadline of three months from the date of issuance of the notification for the applicant to amend the application.
In case the applicant's amendment of the application meets the requirements within two months from the date of the amendment, the National Office of Intellectual Property shall notify the applicant about the payment of the registration fee, publication fee, and recordation fee for the decision on granting the certificate of protection, and set a deadline of three months from the date of issuance of the notification for the applicant to pay these fees.
g) If the applicant's amendment of the application does not meet the requirements, does not amend the application, or fails to pay the registration fee, publication fee, and recordation fee for the decision on granting the certificate of protection within the time limit specified in points d and e of this clause, then within two months from the end of the corresponding time limit, the National Office of Intellectual Property shall issue a decision refusing to grant the certificate of protection.
h) For cases specified in points d and e of this clause, if the applicant pays all required fees and charges within the prescribed deadlines, the National Office of Intellectual Property shall issue a decision granting the certificate of protection within fifteen days from the end of the corresponding time limit.
Section 5. APPLICATION AND HANDLING OF APPLICATIONS FOR REGISTRATION OF TRADEMARKS
Article 24. Requirements for trademark registration applications
1. The trademark registration application must comply with the general requirements for application documents stipulated in Articles 100 and 105 of the Intellectual Property Law, Appendix I of Decree No. 65/2023/ND-CP, and the guidance provided in this Article.
2. The application must ensure consistency as prescribed in Clause 1 and Clause 4 of Article 101 of the Intellectual Property Law. Each application may only request registration of one trademark for one or more goods or services.
3. Where there is a basis (information, evidence) to doubt the authenticity of the information stated in the application or the information in the application is unclear, the National Office of Intellectual Property shall notify the applicant to submit documents to verify or clarify such information within two months from the date of issuance of the notification by the National Office of Intellectual Property. Such documents may include the following:
a) Documents proving the applicant's status:
(i) Certificate of business registration, contract, or other documents confirming the production activities or provision of services by the applicant as prescribed in Clause 1 of Article 87 of the Intellectual Property Law;
(ii) Agreement or document confirming that the manufacturer does not use the trademark and does not oppose the registration of the trademark by the person conducting commercial activities of the manufacturer's products as prescribed in Clause 2 of Article 87 of the Intellectual Property Law;
(iii) Decision or license for establishment, organizational charter confirming the functions and authority to manage collective trademarks, quality certification trademarks, geographical indication trademarks for goods and services as prescribed in Clauses 3 and 4 of Article 87 of the Intellectual Property Law;
(iv) Agreement, business registration certificate, or related documents concerning the registration of trademarks by co-owners as prescribed in Clause 5 of Article 87 of the Intellectual Property Law;
(v) Documents confirming that the applicant has inherited the right to register the trademark from another party as prescribed in Clause 6 of Article 87 of the Intellectual Property Law;
(vi) Agreement or consent document of the trademark owner confirming the right to register the trademark by the representative or agent as prescribed in Clause 7 of Article 87 of the Intellectual Property Law and Article 6septies of the Paris Convention.
b) Documents proving the representative status of the applicant: original power of attorney of the applicant; documents confirming that the representative of the applicant is the legal representative of the organization registering the trademark or is authorized by that person; documents confirming that the person authorized by the applicant meets the requirements to be named as the representative of the applicant as prescribed in Article 4 of this Circular;
c) Documents proving the right to use or register trademarks containing special signs as prescribed in Clause 2, Clause 4, and Clause 7 of Article 73, Point p of Clause 2 of Article 74 of the Intellectual Property Law; documents proving that the use of trade names, origin indicators, awards, medals, or distinctive symbols of a specific product on the trademark does not mislead consumers or cause confusion or deception;
d) Documents proving priority rights;
đ) Documents proving the supervisory and certification functions of the organization registering certification trademarks;
e) Information necessary to clarify or confirm the contents stated in the rules of use of collective trademarks, certification trademarks, or other application documents;
g) Other appropriate documents to verify the authenticity of the information in the application.
4. Organizations eligible to register collective trademarks as prescribed in Clause 3 of Article 87 of the Intellectual Property Law include:
a) Cooperative unions; cooperatives as prescribed by the Law on Cooperatives, if members have independent production and business activities;
b) Associations as prescribed by laws on associations, if members of the association have independent production and business activities;
c) Other collective organizations established according to the law with at least two members, where members have independent production and business activities and their own goods or services.
5. An organization has the right to register a certification trademark according to the provisions of Clause 4, Article 87 of the Intellectual Property Law if it has the function of supervising and certifying the characteristics (quality, origin, etc.) of goods and services bearing the trademark, and its activities of supervision and certification are carried out by itself or delegated, hired, authorized, etc., to other organizations in accordance with the functions prescribed by law, or recorded in the business registration certificate, charter, establishment decision, task assignment decision, etc., of that organization.
6. The regulations on the use of collective trademarks and the regulations on the use of certification trademarks must include corresponding contents prescribed in Clauses 4 and 5, Article 105 of the Intellectual Property Law. The applicant is responsible for ensuring that the information stated in these regulations complies with relevant laws.
7. Documents proving permission to register a collective trademark or a certification trademark containing a geographical name or other sign indicating the geographical origin of a local specialty of Vietnam, as provided for in Clauses 3 and 4, Article 87 of the Intellectual Property Law, shall include a permit document for use in accordance with Point a and a map of the corresponding geographical area in accordance with Point b of this clause.
a) A permit document for using a geographical name or other sign indicating the geographical origin of a local specialty to register a collective trademark or a certification trademark containing such elements shall be issued by the following competent authority:
(i) The People's Committee of the province or centrally governed city where the corresponding geographical area is located (in the case where the geographical area belongs to one locality);
(ii) All People's Committees of provinces or centrally governed cities where the corresponding geographical area is located (in the case where the geographical area belongs to multiple localities).
b) The map of the corresponding geographical area must fully reflect information sufficient to accurately identify the geographical region and must be confirmed by the competent authority mentioned in Point a of this clause.
8. The determination of geographical names and other signs indicating the geographical origin of products shall be carried out based on the following criteria:
a) A sign indicating the geographical origin of a product is a sign used for products of a locality and has the meaning of indicating the geographical origin of the product (indicating that the product originates from that locality).
A sign indicating the geographical origin of a product can be a geographical name, or a symbol representing the locality (images of typical objects of the locality, such as symbols, maps, flags, emblems, scenic spots, special constructions of the locality, etc.), or may be any other sign.
A geographical name can be the current name, historical name, official name, or folk name of a geographical area being used to replace the current geographical name or widely known (defined by administrative boundaries or geographical methods).
b) A geographical name or a symbol representing a locality used for ordinary products (not specialties) may or may not have the meaning of indicating the geographical origin of the product, depending on the product and the actual use of the geographical name or symbol representing the locality.
c) A geographical name or a symbol representing a locality has the meaning of indicating the geographical origin of a product in the following cases:
(i) Used for local specialties (products with particular characteristics and reputation produced in the locality);
(ii) Used for typical crops and livestock of the locality and products processed from them;
(iii) Used for natural resource extraction products (coal, iron, steel, aluminum, cement, stone, salt, wood, etc.) in the locality;
(iv) Used for products belonging to industries developed in the locality;
(v) Used for special services (services with a reputation linked to specific characteristics in the locality);
(vi) Other cases determined based on the product and the actual use of the geographical name or symbol representing the locality for the product.
d) A geographical name or a symbol representing a locality does not have the meaning of indicating the geographical origin of a product in the following cases:
(i) It has been used as a common trademark and widely recognized, i.e., it has achieved a commercial origin indication (distinctiveness) and lost its descriptive meaning of geographical origin, for example: Hanoi Beer, Saigon Beer;
(ii) The corresponding locality cannot be the place where the product is produced, for example: Arctic Tobacco, etc.
Geographical names and symbols representing a locality that do not have the meaning of indicating the geographical origin of a product may be protected as common trademarks without requiring permission from local authorities.
đ) Geographical names and symbols representing a locality that are part of general geographical knowledge known to many people (for example, names of provinces, cities, scenic spots) used for ordinary products of the locality (including products that the locality has a business advantage but lack fame or quality characteristics), used by many business entities in the locality for their goods and services to describe the production location (but do not meet the criteria set forth in Points c and d of this clause) are signs that are not protected as trademarks but may be used as secondary components forming common trademarks of organizations and individuals in the corresponding locality, provided that the geographical name is excluded from protection (not protected separately) and does not require permission from local authorities.
Article 25. Examination of Form and Publication of Trademark Registration Application
1. The examination of form and publication of trademark registration application shall be carried out according to the general procedures stipulated in Articles 9 and 10 of this Circular.
2. The examination of form of certification trademark registration application and collective trademark registration application does not include the assessment of specific characteristics of goods and services certified by the trademark, methods for assessing such characteristics, methods for controlling the use of the trademark, costs that users must pay for certification and protection of the trademark (if any), and conditions for using the trademark, measures for handling violations of the usage regulations of those trademarks as stated in their usage regulations.
Article 26. Examination of Content of Trademark Registration Application
1. The examination of content of trademark registration application shall be conducted according to the general procedures stipulated in Article 12 of this Circular and according to the specific provisions of this Article.
2. The evaluation of the suitability between the subject matter specified in the trademark registration application and the requirements for issuing the Certificate of Trademark Registration shall be carried out as follows:
a) In accordance with Clause 1 of Article 72 of the Intellectual Property Law, the sign registered as a trademark must be visible in the form of letters, numerals, words, drawings, images, including three-dimensional shapes or a combination thereof expressed in one or several specific colors or sound signs expressible in graphic form.
b) The following signs shall not be protected as trademarks:
(i) Signs consisting solely of color without being combined with letter signs (letter-type signs, numeral signs) or drawing signs or not expressed in the form of letter signs or drawing signs; or sound signs not expressible in graphic form;
(ii) Signs falling within the category not protected as trademarks under Article 73 of the Intellectual Property Law;
(iii) Signs contrary to social ethics, public order, harmful to national defense and security as provided for in Article 8 of the Intellectual Property Law.
3. Evaluation of the distinguishing capacity of letter signs as prescribed in Clause 2 of Article 74 of the Intellectual Property Law.
Except for the exceptional cases prescribed in Clause 5 of this Article, the following letter signs shall be considered as lacking distinguishing capacity:
a) Characters from languages that ordinary Vietnamese consumers cannot recognize and remember (cannot read, understand, or remember) such as non-Latin characters: Arabic, Slavic, Sanskrit, Chinese, Japanese, Korean, Thai, etc., unless the characters from these languages are accompanied by other elements forming a distinguishable whole or presented in graphic or special forms;
b) Latin-based characters but only consisting of a single letter or only consisting of numerals or even though they consist of two letters but cannot be read as a word - even when accompanied by numerals, except when the signs are presented in graphic or special forms;
c) A set of too many letters or words making it impossible to recognize and remember as a series of too many unarranged characters or a text, a paragraph of text;
d) Latin-based characters but a word having a meaning and that meaning has been widely used in Vietnam in the relevant field to the extent of losing distinguishing capacity;
đ) A word or a set of words used in Vietnam as the common name of the related goods or services;
e) A word or a set of words carrying descriptive content about the main goods or services bearing the trademark such as signs indicating time, place, method of production, type, quantity, quality, nature, composition, utility, value of goods or services;
g) A word or a set of words carrying descriptive content about the geographical origin of goods or services;
h) A word or a set of words describing the legal form or business field of the trademark owner;
i) Letter signs identical or similar to one of the objects within the scope of intellectual property rights protection as prescribed in Points e, g, h, i, k, l, m, o, p of Clause 2 of Article 74 of the Intellectual Property Law.
4. Evaluation of the distinguishing capacity of shape signs (including image signs, drawings, shapes, etc.) as prescribed in Clause 2 of Article 74 of the Intellectual Property Law shall be carried out as follows:
Except for the exceptional cases prescribed in Clause 5 of this Article, shape signs shall be considered as lacking distinguishing capacity if:
a) Shape signs are common shapes such as circles, ellipses, triangles, quadrilaterals, etc. or simple drawings; drawings, images used merely as backgrounds or decorative lines on products or product packaging;
b) Shape signs are overly complex and difficult for consumers to perceive and remember their features such as containing too many images or lines combined or overlapping;
c) Drawings, images, symbols, representative signs, typical shapes of goods or parts of goods, typical shapes of product packaging or containers have been frequently used and widely recognized;
d) Shape signs are descriptive of the main goods or services bearing the trademark such as place, method of production, type, quantity, quality, nature, composition, utility, value or other characteristics of the goods or services bearing the trademark, or signs increasing the value of the goods significantly;
đ) Drawings, images describing the geographical origin of goods or services;
e) Shape signs identical or not notably different from designs already or currently protected by others;
g) Shape signs identical or similar to objects within the scope of intellectual property rights protection as prescribed in Points e, g, h, i, l, m, and p of Clause 2 of Article 74 of the Intellectual Property Law.
5. Exceptions applicable when evaluating the distinguishing capacity of letter signs and shape signs:
a) The signs mentioned in points a, b, c, e, g Clause 3 of this Article and points a, b, d, đ Clause 4 of this Article have been and are being used with the function of a trademark and are widely recognized by consumers regarding the ability of the sign to distinguish goods and services related to it before the filing date. To apply the exceptions provided for in this clause, the applicant must provide evidence of widespread use of the sign with the function of a trademark (the number of related consumers who know about it, the start time of use, scope, degree of use before the filing date, sales from selling goods or providing services, etc.), and therefore the sign has the ability to distinguish the goods and services related to the applicant. In this case, the sign must be continuously and extensively used in lawful production, business, trade, advertising, marketing activities in the form as shown in the application.
b) The sign mentioned in point g Clause 3 and point đ Clause 4 of this Article is registered as a certification mark for the geographical origin of goods or services or a collective mark.
6. The assessment of the distinctive capability of a combined sign consisting of a word sign and a figurative sign (hereinafter referred to as "combined sign") shall be carried out as follows:
A combined sign is considered to have distinctive capability when the word sign and the figurative sign combine to form a whole that has distinctive capability, specifically:
a) Both the word sign and the figurative sign have distinctive capability and form a whole that has distinctive capability;
b) The strong component of the trademark (the factor that strongly affects consumer perception, attracts attention and leaves an impression on the trademark when observed) is either the word sign or the figurative sign having distinctive capability, even though the remaining components do not have or have little distinctive capability;
c) In the case where the combined sign consists of word signs and figurative signs that do not have or have little distinctive capability but the unique way they are combined creates a distinct impression, the overall combination is still considered to have distinctive capability;
d) A combined sign consisting of word and figurative components that do not have or have little distinctive capability but which has acquired distinctive capability through use as provided for in Clause 5 of this Article.
7. Minimum sources of information to ensure compliance with the following provisions:
a) To assess the likelihood of confusion caused by the sign mentioned in the application, at least the Intellectual Property Office shall search in the minimum sources of information as follows:
(i) Trademark applications already filed with the Intellectual Property Office with filing dates or priority dates earlier than the filing date or priority date of the application under examination and international trademark applications designating Vietnam of which the Intellectual Property Office has been notified by the International Bureau with filing dates or priority dates earlier than the filing date or priority date of the application under examination for identical or similar goods or services;
(ii) Registered trademarks or trademarks acknowledged for protection that are still valid in Vietnam (including well-known trademarks) used for identical, similar, or related goods or services;
(iii) Registered trademarks that have ceased to be effective within three years, except in cases where the trademark was canceled due to non-use as stipulated in Point d Clause 1 Article 95 of the Intellectual Property Law, used for identical or similar goods or services;
(iv) Geographical indications currently protected in Vietnam;
(v) Place names, symbols, or other signs indicating the geographical origin of goods or services; geographical names, quality marks, inspection marks, warranty marks of international organizations; national flags, emblems, anthems of the Socialist Republic of Vietnam and other countries, international anthems; flags, names, symbols of state agencies, political organizations, political-social organizations, political-social-professional organizations, social organizations, social-professional organizations of Vietnam and the world; names and images of leaders, national heroes, names and images of prominent figures from Vietnam and abroad, etc., collected and retained by the Intellectual Property Office.
b) If necessary, the Intellectual Property Office may search additional reference sources outside the minimum sources of information mentioned in Point a of this clause, such as design applications, trade names, lists of plant varieties protected in Vietnam, etc.;
8. The assessment of the similarity to the extent of causing confusion between the sign requested for registration and another trademark is carried out as follows:
a) To assess whether the sign requested for registration mentioned in the application is identical or similar to the extent of causing confusion with another trademark (hereinafter referred to as "counterfeit trademark"), it is necessary to compare the pronunciation, meaning (for word signs), structure, and mode of representation of the sign (for both word signs and figurative signs) as stipulated in Points b and c of this clause, while also comparing the goods or services bearing the sign with those bearing the counterfeit trademark as stipulated in Article 9 of this Law.
b) The sign is considered identical to the counterfeit trademark if the sign is identical to the counterfeit trademark in structure and mode of representation.
c) The sign is considered similar to the extent of causing confusion with the counterfeit trademark if:
(i) The sign is nearly identical to the counterfeit trademark in structure or pronunciation or meaning or form of representation to the extent that consumers would mistakenly believe that the two objects are the same or that one object is a variant of the other or that the two objects have the same source;
(ii) The sign is merely a phonetic transcription or translation of the meaning of the counterfeit trademark if the counterfeit trademark is a well-known trademark.
9. The assessment of the similarity of goods and services is carried out as follows:
a) Two goods or two services are considered identical (of the same kind) when the two goods or two services have the following characteristics:
(i) They have the same nature (composition, structure, etc.) and the same function and purpose of use; or
(ii) They have a similar nature and the same function and purpose of use;
b) Two goods or two services shall be considered similar if they fall under any of the following circumstances:
(i) They are similar in nature and are brought to market through the same trade channel (distributed through the same method, sold together or side by side, in the same type of store, relevant public/consumers, etc.);
(ii) They are similar in function and purpose and are brought to market through the same trade channel (distributed through the same method, sold together or side by side, in the same type of store, relevant public/consumers, etc.).
c) A good and a service shall be considered similar if they fall under any of the following circumstances:
(i) There is a relationship between them in terms of nature (the goods, services, or materials/components of the goods, services are formed from the other goods, services); or
(ii) There is a relationship between them in terms of function (to complete the function of the goods, services, the other goods, services must be used or they are usually used together); or
(iii) There is a close relationship between them in terms of execution method (the goods, services are the result of using, exploiting the other goods, services, etc.).
10. A sign shall be considered identical or similar to the extent that it causes confusion with the compared trademark for identical or similar goods in the following cases:
a) The sign is identical with the compared trademark and the goods or services bearing the identical or similar sign are identical or similar to the goods or services bearing the compared trademark;
b) The sign is similar to the extent that it causes confusion with the compared trademark and the goods or services bearing the identical or similar sign are identical or similar to the goods or services bearing the compared trademark and have the potential to cause confusion among consumers;
c) The sign is identical or similar to the compared famous trademark and the goods or services bearing the sign, although not identical or similar to the goods or services bearing the compared trademark, may lead consumers to believe that there exists a relationship between the goods or services bearing the sign and the owner of the famous trademark, thereby potentially diminishing the distinctive character of the famous trademark or damaging its reputation.
11. The assessment of other confusing capabilities of the sign shall be carried out in accordance with Article 73 and Clause 2 of Article 74 of the Intellectual Property Law and the specific provisions below:
a) The sign shall be considered capable of causing confusion about the origin, place of production of the goods or services in the following cases:
(i) The sign is identical or similar to the extent that it causes confusion with the name, symbol of a country, a region (national flag, national emblem, national title, country name, local name, etc.), leading to the misconception that the goods or services bearing the sign originate from that country or region but actually originate from another country or region;
(ii) The sign is identical or similar to a geographical indication that is protected if the use of the sign can mislead consumers about the geographical origin of the goods; the sign is identical to a geographical indication or contains a geographical indication or is translated/transliterated from a protected geographical indication for wine or spirits, if the sign requested to be registered as a trademark for wine or spirits does not originate from the geographical area indicated by the geographical indication;
(iii) The sign is a term identical or similar to the trade name of another person legally used for the same kind of goods or services and has the potential to mislead consumers into believing that the goods or services bearing the sign are produced or performed by the person with the mentioned trade name;
(iv) The sign is identical or similar to the real name, pseudonym, pen name, image of leaders, national heroes, prominent figures of Vietnam and foreign countries; the sign is identical or similar to the name or image of characters, distinctive images of widely known works, if the use of the sign can mislead consumers into believing that the goods or services bearing the sign are produced or performed by the owner of the work;
(v) The sign is identical or substantially different from the design of another person already and currently protected on the basis of a design application filing date or priority date earlier than the filing date or priority date of the trademark application.
b) In the following cases, the sign shall be considered capable of causing confusion or misleading about the nature, value of the goods or services:
(i) The sign is a term, picture, image, symbol, etc., which creates a misleading impression about the characteristics, functions of the goods or services, such as being identical or similar to a trademark or another widely used sign to the extent that it is associated with a particular function or characteristic of a certain type of goods or services, leading consumers to believe that the goods or services bearing the sign also have those characteristics or functions;
(ii) The sign is a term, image which creates a misleading impression about the composition, structure of the goods or services, such as describing related goods or services that give the false impression that the goods or services bearing the sign are made up of or have the nature of the described goods or services.
12. For trademark registration applications that have been concluded to meet the conditions for protection, before issuing a notice of the results of the substantive examination with the intention of granting a Certificate of Trademark Registration in accordance with point c, d, sub-item (ii) point e Clause 13 of this Article, the National Office of Intellectual Property shall conduct a check to ensure the first-to-file principle stipulated in Clause 2 and Clause 3 of Article 90 of the Intellectual Property Law as follows:
a) To check the first-to-file principle, a search must be conducted for all trademark registration applications received by the National Office of Intellectual Property (up to the time of the check) with an earlier filing date or priority date (if the application enjoys priority) than the filing date or priority date (if the application enjoys priority) of the application under examination.
b) The search is to identify cases where multiple applications (including those currently under examination) from different individuals register trademarks that are identical or similar enough to cause confusion for goods or services that are identical or similar to each other, or where multiple applications from the same individual register identical trademarks for identical goods or services; and to determine the application with the earliest filing date or priority date.
c) If there are multiple applications falling under the circumstances described in point b of this clause, the Certificate of Trademark Registration shall only be issued to the trademark in the valid application with the earliest filing date or priority date among the applications meeting the conditions for issuance of the protection certificate.
d) Among the applications falling under the circumstances described in point b of this clause, if there are multiple applications with the same earliest filing date or priority date, the Certificate of Trademark Registration shall only be issued to the trademark in a single application among those applications, according to the agreement of all applicants; if no agreement can be reached, then all corresponding objects of those applications will be refused issuance of the protection certificate.
13. Before the end of the deadline for examining the content of the application as stipulated in Clause 4, Article 12 of this Circular, the Intellectual Property Office shall perform the following tasks:
a) If the object of protection stated in the application does not meet the conditions for protection or falls under the circumstances specified in Article 117 of the Intellectual Property Law, or if it meets the conditions for protection but the application still has deficiencies, the Intellectual Property Office shall issue a notice of the result of the content examination, stating clearly its intention to refuse issuance of the Certificate of Trademark Registration, the reasons for refusal or the deficiencies in the application, and setting a deadline of three months from the date of issuance of the notice for the applicant to provide comments.
b) If the applicant fails to correct the deficiencies or the corrections do not meet the requirements, or does not provide comments or provides comments that are not reasonable within the deadline specified in point a of this clause, the Intellectual Property Office shall issue a decision to refuse issuance of the Certificate of Trademark Registration within fifteen days from the end of the deadline specified in point a of this clause.
c) If the object of protection stated in the application meets the conditions for protection or the applicant has corrected the deficiencies satisfactorily or provided reasonable explanations for all or part of the results of the content examination within the deadline specified in point a of this clause, the Intellectual Property Office shall issue a notice of the result of the content examination, stating its intention to issue the Certificate of Trademark Registration for all or part of the object that meets the conditions for protection, and setting a deadline of three months from the date of issuance of the notice for the applicant to pay the registration fee, publication fee, and recordation fee for the decision to issue the Certificate of Trademark Registration.
d) If the object of protection stated in the application has a portion (by product/service group) that does not meet the conditions for protection (or is not protected separately), the Intellectual Property Office shall issue a notice of the result of the content examination, stating clearly its intention to issue the Certificate of Trademark Registration for the portion that meets the conditions, the registration fee, and other fees and charges that the applicant must pay if they agree with the entire result of the content examination, the reasons for refusing issuance for the remaining portion (or the portion not protected separately), and setting a deadline of three months from the date of issuance of the notice for the applicant to provide written comments (agreement or explanation of the content examination results).
đ) If at the end of the deadline specified in point d of this clause, the applicant does not provide comments or submit the required fees and charges in writing, within fifteen days from the end of the aforementioned deadline, the Intellectual Property Office shall issue a decision to refuse issuance of the Certificate of Trademark Registration.
e) If at the end of the deadline specified in point d of this clause, the applicant provides written comments, the Intellectual Property Office shall proceed as follows:
(i) In the case where the applicant provides a reasonable explanation for the entire result of the content examination, the Intellectual Property Office shall issue a notice of the result of the content examination with the intention to issue the Certificate of Trademark Registration and set a deadline of three months from the date of issuance of the notice for the applicant to pay the registration fee, publication fee, and recordation fee for the decision to issue the Certificate of Trademark Registration;
(ii) In the case where the applicant provides an explanation that is not reasonable or provides a reasonable explanation for only part of the result of the content examination, the Intellectual Property Office shall issue a notice of the result of the content examination with the intention to issue the Certificate of Trademark Registration for the portion that meets the conditions for protection, the reasons for refusing issuance for the remaining portion (or the portion not protected separately), and set a deadline of three months from the date of issuance of the notice for the applicant to pay the registration fee, publication fee, and recordation fee for the decision to issue the Certificate of Trademark Registration.
g) If the applicant fails to pay the full registration fee, publication fee, and recordation fee for the decision to issue the Certificate of Trademark Registration within the deadlines specified in points c and e of this clause, within fifteen days from the end of the respective deadlines, the Intellectual Property Office shall issue a decision to refuse issuance of the Certificate of Trademark Registration.
h) For the cases specified in points c, d, and e of this clause, if the applicant pays all types of fees and charges as required and on time, within fifteen days from the end of the respective deadlines, the Intellectual Property Office shall issue a decision to issue the Certificate of Trademark Registration. The decision to issue the Certificate of Trademark Registration as specified in sub-item (ii) of point e of this clause must state clearly the reasons for refusing issuance for the corresponding portion that is refused.
Article 27. Recognition of Well-Known Marks
1. Well-known marks protected under the provisions of Article 75 of the Intellectual Property Law of Vietnam and consistent with the provisions of Article 6bis of the Paris Convention.bis Paris Convention.
2. Rights to well-known marks are protected and belong to the owner of such marks without the need for registration procedures. The owner of the mark may use the documents specified in Clause 3 of this Article to prove their ownership of the mark and demonstrate that the mark meets the conditions to be considered well-known.
3. Documents proving ownership of the mark and demonstrating the fame of the mark may include information on the scope, scale, level, and continuity of the use of the mark, including descriptions of its origin, history, and continuous usage period; the number of countries where the mark has been registered or recognized as a well-known mark; the list of goods and services bearing the mark; the territorial scope within which the mark is circulated, sales figures for products or service provision; the quantity of goods and services bearing the mark that have been produced and consumed; the value of the mark's assets, transfer prices or assignment rights, investment capital contribution values of the mark; investments and costs for advertising and marketing the mark, including participation in national and international exhibitions; infringement cases, disputes, and decisions or judgments of courts or competent authorities; consumer survey data regarding awareness of the mark through purchase, use, and advertising; rankings and reputation assessments of the mark by national and international organizations and mass media; awards and medals won by the mark; and results of intellectual property appraisal organization inspections.
4. In cases where recognition of a well-known mark leads to a decision to handle infringement of rights to that well-known mark according to point d, Clause 1, Article 129 of the Intellectual Property Law or leads to a decision not to protect another mark according to point i, Clause 2, Article 74 of the Intellectual Property Law, then that well-known mark will be recorded in the List of Well-Known Marks maintained by the National Office of Intellectual Property for reference purposes to serve the establishment and protection of intellectual property rights.
Section 6. APPLICATIONS AND HANDLING OF APPLICATIONS FOR GEOGRAPHICAL INDICATIONS
Article 28. Requirements for Applications for Geographical Indications
Applications for geographical indications must comply with the requirements stipulated in Articles 100, 101, and 106 of the Intellectual Property Law and Appendix I of Decree No. 65/2023/NĐ-CP.
Article 29. Formal Examination and Publication of Applications for Geographical Indications
The formal examination and publication of applications for geographical indications shall be carried out according to the general procedures prescribed in Articles 9 and 10 of this Circular.
Article 30. Substantive Examination of Applications for Geographical Indications
1. The substantive examination of applications for geographical indications shall be conducted according to the general procedures prescribed in Article 12 of this Circular and specific provisions set forth in this Article.
2. The assessment of the consistency between the subject matter stated in the application and the Certificate of Registration for Geographical Indication shall be carried out as follows:
The subject matter stated in the application for a geographical indication shall be deemed inconsistent with the type of certificate for geographical indication if it is not a visible sign used to indicate the geographical origin of a product from a specific region, locality, territory, or country as provided for in Clause 22, Article 4 of the Intellectual Property Law.
3. Minimum sources of information in the substantive examination of applications for geographical indications include:
a) Trademarks currently protected in Vietnam for products identical or similar to those bearing the geographical indication, with the date of protection starting earlier than the filing date of the geographical indication application, including trademarks protected under international treaties to which Vietnam is a party;
b) Trademarks in trademark applications filed in Vietnam with an earlier filing date or priority date for products identical or similar to those bearing the geographical indication;
c) Trademarks recognized as well-known marks by the National Office of Intellectual Property;
d) Geographical indications currently protected in Vietnam for products identical to those bearing the geographical indication.
4. Evaluation of geographical indications based on the conditions for protection shall be carried out according to the following provisions:
a) The subject matter stated in the application, in accordance with the conditions stipulated in Article 79 of the Intellectual Property Law and not falling under the circumstances specified in Article 80 of the Intellectual Property Law, specifically must prove the following conditions:
(i) There exists a corresponding geographical area for the geographical indication stated in the application;
(ii) The product originates from the aforementioned geographical area;
(iii) The product has distinctive characteristics/quality determined by the geographical conditions of the aforementioned geographical area as provided for in Article 82 of the Intellectual Property Law;
b) A geographical indication that causes confusion among consumers about the true geographical origin of the product bearing the geographical indication, as provided for in Clause 4, Article 80 of the Intellectual Property Law, shall be considered identical or similar to a sign known to Vietnamese consumers as indicating the geographical origin of goods or services.
The sign is considered to indicate the geographical origin of goods or services and is applied similarly as provided for in Clause 8, Article 27 of this Circular.
c) The evaluation of geographical indications based on the conditions for protection as set forth in points a and b of this clause shall be based on the information provided by the applicant and on the information found from the minimum sources of information stipulated in Clause 3 of this Article.
5. If a conflicting or similar trademark is found, the National Office of Intellectual Property shall notify the owner of the trademark to provide comments according to Article 112 or 112a of the Intellectual Property Law.
6. In case the geographical indication in the application is determined to be homonymous with a geographical indication that is currently protected under Clause 22a, Article 4 of the Intellectual Property Law, the National Office of Intellectual Property shall notify the applicant and request the submission of explanatory documents regarding the conditions for use and presentation of the geographical indication to ensure distinguishability between the geographical indications. The explanatory documents must comply with the provisions set out in Appendix I of Decree No. 65/2023/NĐ-CP.
7. Before the expiration date of the period for examining the content of the application as stipulated in Clause 4, Article 12 of this Circular, the National Office of Intellectual Property shall send one of the following notifications to the applicant:
a) If the subject matter requested for protection in the application does not meet the conditions for protection or falls within the cases specified in Article 117 of the Intellectual Property Law, or if it meets the conditions for protection but the application still has deficiencies, the National Office of Intellectual Property shall issue a notification on the result of the examination of the content, stating clearly the intention to refuse issuance of the Certificate of Registration of Geographical Indication, the reasons for refusal or deficiencies in the application, and setting a deadline of three months from the date of issuance of the notification for the applicant to provide comments.
b) If the subject matter requested for protection in the application meets the conditions for protection or the applicant has corrected deficiencies satisfactorily or provided credible explanations regarding the examination results within the time limit specified in point a of this clause, the National Office of Intellectual Property shall issue a notification on the result of the examination of the content of the application, stating the intention to issue the Certificate of Registration of Geographical Indication and setting a deadline of three months from the date of issuance of the notification for the applicant to pay the registration fee, publication fee, and recordation fee for the decision to issue the Certificate of Registration of Geographical Indication.
c) If at the end of the period specified in point a of this clause, the applicant fails to correct deficiencies satisfactorily, does not provide objections or provides non-credible objections, or if at the end of the period specified in point b of this clause, the applicant fails to submit all required fees and charges as prescribed, then within fifteen working days from the end of such period, the National Office of Intellectual Property shall issue a decision to refuse issuance of the Certificate of Registration of Geographical Indication.
d) Đối với các trường hợp nêu tại điểm b khoản này, nếu người nộp đơn nộp đầy đủ và đúng hạn các loại phí, lệ phí theo quy định thì trong thời hạn 15 ngày kể từ ngày kết thúc thời hạn tương ứng, Cục Sở hữu trí tuệ ra quyết định cấp Giấy chứng nhận đăng ký chỉ dẫn địa lý.
Chương III
VĂN BẰNG BẢO HỘ
Điều 31. Từ chối cấp, cấp văn bằng bảo hộ
1. Cục Sở hữu trí tuệ tiến hành thủ tục từ chối cấp văn bằng bảo hộ theo quy định tại khoản 3 Điều 117 của Luật Sở hữu trí tuệ đối với các trường hợp quy định tại khoản 1, 1a và khoản 2 Điều 117 của Luật Sở hữu trí tuệ.
2. Cục Sở hữu trí tuệ tiến hành thủ tục cấp văn bằng bảo hộ theo quy định tại khoản 1 Điều 118 của Luật Sở hữu trí tuệ và tại Phụ lục II của Nghị định số 65/2023/NĐ-CP.
Điều 32. Sổ đăng ký quốc gia về sở hữu công nghiệp, về đại diện sở hữu công nghiệp
1. Sổ đăng ký quốc gia về sở hữu công nghiệp được lập phù hợp với các quy định dưới đây:
a) Sổ đăng ký quốc gia về sở hữu công nghiệp là cơ sở dữ liệu chính thức, công khai của Nhà nước, thể hiện đầy đủ thông tin về tình trạng pháp lý của quyền sở hữu công nghiệp đã được xác lập. Sổ đăng ký quốc gia về sở hữu công nghiệp gồm các loại như sau:
(i) Sổ đăng ký quốc gia về sáng chế;
(ii) Sổ đăng ký quốc gia về giải pháp hữu ích;
(iii) Sổ đăng ký quốc gia về kiểu dáng công nghiệp;
(iv) Sổ đăng ký quốc gia về thiết kế bố trí mạch tích hợp bán dẫn;
(v) Sổ đăng ký quốc gia về nhãn hiệu;
(vi) Sổ đăng ký quốc gia về chỉ dẫn địa lý.
b) Đối với các đối tượng sở hữu công nghiệp được đăng ký theo thủ tục quốc gia, Sổ đăng ký quốc gia quy định tại điểm a khoản này bao gồm các mục tương ứng với từng văn bằng bảo hộ, mỗi mục bao gồm :
(i) Thông tin về văn bằng bảo hộ: số, ngày cấp văn bằng bảo hộ; tên đối tượng được bảo hộ, phạm vi/khối lượng bảo hộ, thời hạn hiệu lực; tên và địa chỉ của chủ văn bằng bảo hộ/người đăng ký chỉ dẫn địa lý, tổ chức quản lý chỉ dẫn địa lý, tên và quốc tịch của tác giả sáng chế, thiết kế bố trí, kiểu dáng công nghiệp;
(ii) Thông tin về đơn yêu cầu cấp văn bằng bảo hộ (số đơn, ngày nộp đơn, ngày ưu tiên của đơn, tên tổ chức dịch vụ đại diện sở hữu công nghiệp (nếu có));
(iii) Mọi sửa đổi liên quan đến thông tin về việc sửa đổi văn bằng bảo hộ, tình trạng hiệu lực văn bằng bảo hộ (duy trì hiệu lực, gia hạn hiệu lực, chấm dứt hiệu lực, hủy bỏ hiệu lực); chuyển giao quyền sở hữu, quyền sử dụng đối tượng sở hữu công nghiệp; số lần cấp lại, ngày cấp lại, cấp phó bản, số phó bản (cho chủ sở hữu chung nào), ngày cấp phó bản, thay đổi tổ chức dịch vụ đại diện sở hữu công nghiệp (nếu có), v.v.
c) Đối với nhãn hiệu, kiểu dáng công nghiệp được chấp nhận bảo hộ theo thủ tục đăng ký quốc tế, tại Phần Nhãn hiệu đăng ký quốc tế và Phần Kiểu dáng công nghiệp đăng ký quốc tế trong các Sổ đăng ký quốc gia tương ứng quy định tại tiết (iii) và tiết (v) điểm a khoản này bao gồm các mục sau đây:
(i) Thông tin về tình trạng bảo hộ: số quyết định, ngày ra quyết định hoặc ngày chấp nhận bảo hộ; tên đối tượng được bảo hộ, phạm vi bảo hộ, thời hạn hiệu lực; tên và địa chỉ của chủ văn bằng bảo hộ, tên và quốc tịch của tác giả kiểu dáng công nghiệp;
(ii) Thông tin về đơn yêu cầu cấp văn bằng bảo hộ (số đơn, ngày nộp đơn, ngày ưu tiên của đơn, tên tổ chức dịch vụ đại diện sở hữu công nghiệp (nếu có));
d) Đối với chỉ dẫn địa lý được chấp nhận bảo hộ theo điều ước quốc tế, Phần Chỉ dẫn địa lý quốc tế tại Sổ đăng ký quốc gia quy định tại tiết (vi) điểm a khoản này bao gồm các mục sau đây:
(i) Thông tin về tình trạng bảo hộ: tên điều ước quốc tế, ngày có hiệu lực của điều ước quốc tế hoặc ngày chấp nhận bảo hộ chỉ dẫn địa lý theo điều ước quốc tế; chỉ dẫn địa lý được bảo hộ, phạm vi/khối lượng bảo hộ; tên và địa chỉ của tổ chức quản lý chỉ dẫn địa lý;
(ii) Thông tin về hồ sơ, tài liệu liên quan đến chỉ dẫn địa lý yêu cầu bảo hộ (điều ước quốc tế, thỏa thuận quốc tế về việc bảo hộ, cơ sở dữ liệu liên quan đến chỉ dẫn địa lý yêu cầu bảo hộ (nếu có));
(iii) Mọi sửa đổi liên quan đến tình trạng pháp lý của chỉ dẫn địa lý được bảo hộ: tình trạng hiệu lực, phạm vi/khối lượng bảo hộ, chuyển giao quyền quản lý, v.v.
2. Sổ đăng ký quốc gia về đại diện sở hữu công nghiệp bao gồm các mục tương ứng với từng tổ chức dịch vụ đại diện sở hữu công nghiệp, cụ thể là:
(i) Thông tin về tổ chức dịch vụ đại diện sở hữu công nghiệp (tên đầy đủ, tên giao dịch, địa chỉ, ghi nhận, xóa tên, sửa đổi các thông tin về tổ chức dịch vụ đại diện sở hữu công nghiệp);
(ii) Thông tin về danh sách người đại diện sở hữu công nghiệp của tổ chức (họ tên, địa chỉ thường trú, số chứng chỉ hành nghề của từng thành viên trong danh sách);
(iii) Thông tin về việc thay đổi danh sách người đại diện sở hữu công nghiệp (cấp mới, cấp lại, thu hồi chứng chỉ hành nghề, xóa tên, v.v.).
3. Các sổ đăng ký quốc gia nêu tại khoản 1 và khoản 2 Điều này do Cục Sở hữu trí tuệ lập và lưu giữ dưới dạng giấy hoặc điện tử. Bất kỳ người nào cũng có thể tra cứu sổ đăng ký điện tử (nếu có) hoặc yêu cầu Cục Sở hữu trí tuệ cấp bản sao hoặc bản trích lục sổ đăng ký, với điều kiện phải nộp phí dịch vụ cấp bản sao hoặc bản trích lục sổ đăng ký.
Điều 33. Công bố quyết định cấp văn bằng bảo hộ
1. Mọi quyết định cấp văn bằng bảo hộ, quyết định chấp nhận bảo hộ đăng ký quốc tế kiểu dáng công nghiệp, quyết định chấp nhận bảo hộ nhãn hiệu đăng ký quốc tế đều được Cục Sở hữu trí tuệ công bố trên Công báo sở hữu công nghiệp trong thời hạn 60 ngày kể từ ngày ra quyết định và người nộp đơn phải nộp phí công bố theo quy định.
2. Các thông tin được công bố theo quy định tại khoản 1 Điều này gồm thông tin ghi trong quyết định tương ứng (bao gồm cả số quyết định và ngày quyết định) và các thông tin dưới đây:
a) Đối với Bằng độc quyền sáng chế và Bằng độc quyền giải pháp hữu ích: tên, quốc tịch của tác giả sáng chế; bản tóm tắt sáng chế; hình vẽ đặc trưng kèm theo bản tóm tắt (nếu có); phân loại quốc tế sáng chế; các thông tin liên quan đến chuyển đổi đơn, tách đơn, số đơn ban đầu của đơn tách/đơn chuyển đổi v.v. (nếu có); và các thông tin khác (nếu có);
b) Đối với Bằng độc quyền kiểu dáng công nghiệp: tên, quốc tịch của tác giả kiểu dáng công nghiệp; bộ ảnh chụp hoặc bản vẽ kiểu dáng công nghiệp; số phương án yêu cầu bảo hộ; phân loại quốc tế kiểu dáng công nghiệp; các thông tin liên quan đến tách đơn, số đơn ban đầu của đơn tách v.v. (nếu có); và các thông tin khác (nếu có);
c) Đối với quyết định chấp nhận bảo hộ kiểu dáng công nghiệp đăng ký quốc tế: tên, quốc tịch của tác giả kiểu dáng công nghiệp; bộ ảnh chụp hoặc bản vẽ kiểu dáng công nghiệp; số phương án yêu cầu bảo hộ; phân loại quốc tế kiểu dáng công nghiệp; các thông tin liên quan đến tách đơn, số đơn ban đầu của đơn tách v.v. (nếu có); và các thông tin khác (nếu có);
d) Đối với Giấy chứng nhận đăng ký nhãn hiệu: mẫu nhãn hiệu và danh mục hàng hoá, dịch vụ mang nhãn hiệu theo bảng phân loại quốc tế hàng hóa, dịch vụ; các thông tin liên quan đến chuyển đổi đơn, tách đơn, số đơn ban đầu của đơn tách v.v. (nếu có); quy chế sử dụng nhãn hiệu tập thể, nhãn hiệu chứng nhận (đối với nhãn hiệu tập thể, nhãn hiệu chứng nhận); và các thông tin khác (nếu có);
đ) Đối với quyết định chấp nhận bảo hộ nhãn hiệu đăng ký quốc tế: mẫu nhãn hiệu; nhóm hàng hóa, dịch vụ mang nhãn hiệu theo bảng phân loại quốc tế hàng hóa, dịch vụ; và các thông tin khác (nếu có);
e) Đối với Giấy chứng nhận đăng ký chỉ dẫn địa lý: tóm tắt tính chất đặc thù của sản phẩm mang chỉ dẫn địa lý và tên sản phẩm mang chỉ dẫn địa lý; và các thông tin khác (nếu có);
g) Đối với Giấy chứng nhận đăng ký thiết kế bố trí mạch tích hợp bán dẫn: tên, quốc tịch của tác giả thiết kế bố trí; và các thông tin khác (nếu có), trừ các thông tin được bảo mật theo quy định.
3. Chỉ dẫn địa lý được chấp nhận bảo hộ theo điều ước quốc tế được Cục Sở hữu trí tuệ công bố trên Công báo sở hữu công nghiệp trong thời hạn 60 ngày kể từ ngày chấp nhận bảo hộ. Các thông tin cần thiết liên quan đến các chỉ dẫn địa lý nêu trên được công bố theo quy định tại khoản 2 Điều 11 của Nghị định số 65/2023/NĐ-CP bao gồm tên chỉ dẫn địa lý: tóm tắt tính chất đặc thù của sản phẩm mang chỉ dẫn địa lý và tên sản phẩm mang chỉ dẫn địa lý; phạm vi/khu vực bảo hộ chỉ dẫn địa lý; và các thông tin khác (nếu có).
Điều 34. Căn cứ hủy bỏ hiệu lực văn bằng bảo hộ
1. Văn bằng bảo hộ sáng chế bị hủy bỏ hiệu lực do sáng chế được cấp văn bằng bảo hộ vượt quá phạm vi bộc lộ trong bản mô tả ban đầu của đơn đăng ký sáng chế theo quy định tại điểm đ khoản 2 Điều 96 của Luật Sở hữu trí tuệ trong các trường hợp so với bản mô tả ban đầu và đối với người có hiểu biết trung bình về lĩnh vực kỹ thuật tương ứng, bản mô tả sáng chế có sự thay đổi về nội dung và sự thay đổi này làm xuất hiện thông tin không có nguồn gốc trực tiếp và rõ ràng từ bản mô tả ban đầu của đơn, cụ thể như sau:
a) Trong quá trình sửa đổi, bổ sung đơn, người nộp đơn đưa vào bản mô tả dấu hiệu kỹ thuật hoặc các dấu hiệu kỹ thuật không thể xác định được một cách trực tiếp và rõ ràng từ bản mô tả ban đầu;
b) Bổ sung thông tin (bao gồm: thông tin về mục đích, hiệu quả v.v.) không thể xác định được một cách trực tiếp và rõ ràng từ phần mô tả ban đầu (kể cả hình vẽ) và/hoặc yêu cầu bảo hộ ban đầu để bộc lộ rõ sáng chế hoặc bộc lộ đầy đủ yêu cầu bảo hộ;
c) Nội dung bổ sung vào bản mô tả là các dấu hiệu kỹ thuật liên quan đến thông số về kích thước thu được bằng cách đo thông số về kích thước trên các hình vẽ;
d) Đưa vào bản mô tả chi tiết hoặc thành phần bổ sung không được đề cập đến trong bản mô tả ban đầu của đơn mà điều này dẫn đến những hiệu quả và/hoặc tác dụng đặc biệt không có trong đơn ban đầu;
đ) Bổ sung vào bản mô tả những hiệu quả và/hoặc tác dụng (lợi ích) mà người có hiểu biết trung bình về lĩnh vực kỹ thuật tương ứng không thể xác định được từ đơn ban đầu;
e) Thay đổi dấu hiệu kỹ thuật của yêu cầu bảo hộ mà dấu hiệu kỹ thuật thay đổi này không được bộc lộ hoặc không được xác định một cách trực tiếp và rõ ràng từ bản mô tả ban đầu;
g) Đưa vào các nội dung mới bằng cách thay đổi các nội dung không xác định thành các nội dung xác định và cụ thể;
h) Kết hợp các dấu hiệu kỹ thuật riêng biệt của đơn ban đầu lại thành một dấu hiệu kỹ thuật mới trong khi mối quan hệ giữa các dấu hiệu kỹ thuật này không được bộc lộ trong đơn ban đầu;
i) Thay đổi một hoặc nhiều dấu hiệu kỹ thuật trong phần mô tả để làm cho các dấu hiệu kỹ thuật thay đổi khác với các dấu hiệu kỹ thuật nêu trong bản mô tả ban đầu;
k) Loại bỏ một dấu hiệu kỹ thuật ra khỏi điểm yêu cầu bảo hộ mà dấu hiệu kỹ thuật này là cần thiết đối với đối tượng yêu cầu bảo hộ để đạt được mục đích đề ra và/hoặc việc loại bỏ dấu hiệu kỹ thuật này làm thay đổi dấu hiệu kỹ thuật hoặc (các) dấu hiệu kỹ thuật khác.
2. Văn bằng bảo hộ nhãn hiệu bị hủy bỏ hiệu lực do người nộp đơn đăng ký nhãn hiệu với dụng ý xấu theo quy định tại điểm a khoản 1 Điều 96 của Luật Sở hữu trí tuệ trong trường hợp sau đây:
a) Có căn cứ cho rằng, tại thời điểm nộp đơn, người nộp đơn biết hoặc có cơ sở để biết nhãn hiệu mình đăng ký trùng hoặc tương tự đến mức khó phân biệt với một nhãn hiệu đang được sử dụng rộng rãi tại Việt Nam hoặc nhãn hiệu nổi tiếng tại các nước khác cho hàng hóa, dịch vụ trùng hoặc tương tự; và
b) Việc đăng ký này nhằm lợi dụng danh tiếng, uy tín của nhãn hiệu đó để thu lợi; hoặc chủ yếu nhằm mục tiêu bán lại, cấp phép hoặc chuyển giao quyền đăng ký cho người có các nhãn hiệu nêu tại điểm a khoản này; hoặc nhằm mục tiêu ngăn chặn khả năng gia nhập thị trường của người có các nhãn hiệu nêu tại điểm a khoản này để hạn chế cạnh tranh; hoặc các hành vi trái với tập quán thương mại lành mạnh khác.
3. Quy định tại khoản 1 và 2 Điều này cũng được áp dụng trong quá trình xử lý đơn đăng ký sáng chế và nhãn hiệu.
Chương IV
KHIẾU NẠI VÀ GIẢI QUYẾT KHIẾU NẠI LIÊN QUAN ĐẾN CÁC THỦ TỤC VỀ SỞ HỮU CÔNG NGHIỆP
Điều 35. Người có quyền khiếu nại, đối tượng bị khiếu nại, thời hiệu khiếu nại và người giải quyết khiếu nại
1. Người có quyền khiếu nại là tổ chức, cá nhân theo quy định tại Điều 119a của Luật Sở hữu trí tuệ.
2. Các quyết định, thông báo có thể bị khiếu nại quy định tại khoản 1 Điều 119a của Luật Sở hữu trí tuệ là các quyết định, thông báo chính thức của Cục Sở hữu trí tuệ liên quan đến các thủ tục về sở hữu công nghiệp theo các quy định tương ứng của Thông tư này, bao gồm các quyết định, thông báo sau đây:
a) Thông báo từ chối tiếp nhận đơn;
b) Quyết định chấp nhận đơn hợp lệ;
c) Quyết định từ chối chấp nhận đơn;
d) Thông báo chấp nhận hoặc từ chối yêu cầu sửa đổi, bổ sung đơn/chuyển đổi đơn/thay đổi người nộp đơn/rút đơn;
đ) Quyết định từ chối cấp văn bằng bảo hộ; Quyết định cấp văn bằng bảo hộ;
e) Quyết định từ chối chấp nhận bảo hộ kiểu dáng công nghiệp đăng ký quốc tế; Quyết định từ chối chấp nhận bảo hộ nhãn hiệu đăng ký quốc tế; Quyết định chấp nhận bảo hộ kiểu dáng công nghiệp đăng ký quốc tế; và Quyết định chấp nhận bảo hộ nhãn hiệu đăng ký quốc tế;
g) Quyết định cấp phó bản văn bằng bảo hộ, quyết định cấp lại văn bằng bảo hộ; quyết định từ chối cấp phó bản văn bằng bảo hộ, quyết định từ chối cấp lại văn bằng bảo hộ;
h) Thông báo về việc duy trì hiệu lực văn bằng bảo hộ, quyết định từ chối duy trì hiệu lực văn bằng bảo hộ;
i) Quyết định gia hạn hiệu lực văn bằng bảo hộ, quyết định từ chối gia hạn hiệu lực văn bằng bảo hộ;
k) Quyết định sửa đổi văn bằng bảo hộ, quyết định từ chối yêu cầu sửa đổi văn bằng bảo hộ;
l) Quyết định chấm dứt hoặc hủy bỏ một phần hoặc toàn bộ hiệu lực văn bằng bảo hộ, thông báo từ chối chấm dứt/hủy bỏ hiệu lực văn bằng bảo hộ;
m) Quyết định, thông báo về việc xử lý đơn yêu cầu chấm dứt, hủy bỏ hiệu lực đăng ký quốc tế nhãn hiệu; Quyết định, thông báo về việc xử lý đơn yêu cầu chấm dứt, hủy bỏ hiệu lực đăng ký quốc tế kiểu dáng công nghiệp;
n) Quyết định hành chính liên quan đến đại diện sở hữu công nghiệp, giám định sở hữu công nghiệp, chuyển giao quyền sở hữu công nghiệp;
o) Quyết định giải quyết khiếu nại lần đầu của Cục Sở hữu trí tuệ;
p) Các quyết định, thông báo và hành vi khác đáp ứng điều kiện là đối tượng bị khiếu nại theo quy định của pháp luật về khiếu nại.
Các thông báo mang tính chất thông tin, yêu cầu hoàn thiện hồ sơ không phải là quyết định hành chính nên không là đối tượng khiếu nại, ví dụ thông báo kết quả thẩm định, thông báo thiếu sót, yêu cầu sửa đổi, bổ sung tài liệu, dự định từ chối, thông báo tạm thời từ chối bảo hộ nhãn hiệu đăng ký quốc tế, thông báo từ chối bảo hộ kiểu dáng công nghiệp đăng ký quốc tế.
3. Những nội dung sau đây không được chấp nhận trong quá trình giải quyết khiếu nại:
a) Yêu cầu sửa đổi, bổ sung đơn đăng ký xác lập quyền sở hữu công nghiệp là đối tượng của quyết định, thông báo bị khiếu nại (như yêu cầu sửa đổi bản mô tả sáng chế (bao gồm yêu cầu bảo hộ); yêu cầu sửa đổi bộ ảnh chụp hoặc bộ bản vẽ và bản mô tả kiểu dáng công nghiệp; yêu cầu sửa đổi mẫu nhãn hiệu và danh mục hàng hoá, dịch vụ mang nhãn hiệu; yêu cầu sửa đổi tên sản phẩm mang chỉ dẫn địa lý và bản mô tả tính chất đặc thù của sản phẩm mang chỉ dẫn địa lý và bản đồ khu vực địa lý tương ứng với chỉ dẫn địa lý đối với đơn đăng ký chỉ dẫn địa lý), trừ trường hợp các điều ước quốc tế mà Việt Nam là thành viên có quy định khác;
b) Tình tiết đã tồn tại trong quá trình thẩm định đơn đăng ký sở hữu công nghiệp nhưng vì lý do khách quan nào đó, Cục Sở hữu trí tuệ và tổ chức, cá nhân liên quan chỉ có thể biết được sau khi đã có quyết định cấp/từ chối cấp văn bằng bảo hộ (sau đây gọi là tình tiết mới) trừ trường hợp tình tiết này được người thứ ba đưa ra theo quy định tại điểm b khoản 6 Điều 38 của Thông tư này.
4. Đơn khiếu nại phải được nộp trong thời hiệu quy định tại các Điều 9 và 33 của Luật Khiếu nại.
5. Người có thẩm quyền giải quyết khiếu nại lần đầu là Cục trưởng Cục Sở hữu trí tuệ; người có thẩm quyền giải quyết khiếu nại lần hai là Bộ trưởng Bộ Khoa học và Công nghệ (sau đây gọi chung là “người giải quyết khiếu nại”).
Điều 36. Đơn khiếu nại
1. Đơn khiếu nại được thực hiện theo quy định tại khoản 1 Điều 3 của Nghị định số 124/2020/NĐ-CP ngày 19 tháng 10 năm 2020 quy định chi tiết một số điều và biện pháp thi hành Luật Khiếu nại (sau đây gọi là Nghị định số 124/2020/NĐ-CP), trong đó nêu đầy đủ các thông tin theo quy định tại Điều 119a của Luật Sở hữu trí tuệ và các tài liệu liên quan đến nội dung khiếu nại theo quy định tại khoản 2 Điều 8 của Luật Khiếu nại, cụ thể như sau:
a) Bản sao quyết định hoặc thông báo bị khiếu nại của Cục Sở hữu trí tuệ và bản sao đơn đăng ký sở hữu công nghiệp là đối tượng của quyết định hoặc thông báo đó (trong trường hợp người nộp đơn khiếu nại lần hai); hoặc tài liệu chỉ dẫn thông tin về các tài liệu nêu trên;
b) Bản sao quyết định giải quyết khiếu nại lần đầu (đối với khiếu nại lần hai);
c) Chứng cứ (bằng chứng hoặc vật chứng) dùng để chứng minh, làm rõ lập luận khiếu nại.
Chứng cứ có thể được nộp bổ sung trong thời hạn 01 tháng kể từ ngày nộp đơn khiếu nại.
2. Trường hợp nộp đơn khiếu nại thông qua đại diện hợp pháp tại Việt Nam theo quy định tại khoản 2 Điều 119a của Luật Sở hữu trí tuệ, đơn phải kèm theo văn bản ủy quyền; đối với khiếu nại lần hai, bản sao văn bản ủy quyền thuộc trường hợp quy định tại khoản 5 Điều 3 của Thông tư này phải có xác nhận của Cục Sở hữu trí tuệ.
Điều 37. Rút đơn khiếu nại và đình chỉ giải quyết khiếu nại
1. Người nộp đơn khiếu nại có thể rút đơn khiếu nại theo quy định tại Điều 10 của Luật Khiếu nại. Nếu việc rút đơn khiếu nại được thực hiện theo sự ủy quyền của người nộp đơn thì việc ủy quyền rút đơn khiếu nại phải được nêu rõ trong văn bản ủy quyền. Đơn đã rút bị coi như không được nộp. Người khiếu nại không được hoàn trả đơn khiếu nại và các khoản phí cung cấp dịch vụ để giải quyết khiếu nại đã nộp, trừ trường hợp đơn khiếu nại được rút trước ngày ra thông báo về việc thụ lý hoặc không thụ lý đơn.
2. Người giải quyết khiếu nại ra quyết định đình chỉ việc giải quyết khiếu nại trong trường hợp:
a) Người khiếu nại rút đơn khiếu nại;
b) Văn bằng bảo hộ, đăng ký quốc tế nhãn hiệu, đăng ký quốc tế kiểu dáng công nghiệp tại Việt Nam đã bị hủy bỏ hiệu lực hoặc đăng ký quốc tế nhãn hiệu bị mất hiệu lực theo quy định của điều ước quốc tế liên quan.
Điều 38. Trình tự, thủ tục giải quyết khiếu nại
1. Việc thụ lý giải quyết đơn khiếu nại được thực hiện theo quy định tại Điều 27 của Luật Khiếu nại và khoản 1 Điều 119a của Luật Sở hữu trí tuệ, cụ thể như sau:
a) Trong thời hạn 10 ngày kể từ ngày nhận đơn khiếu nại, người giải quyết khiếu nại phải:
(i) Ra thông báo không thụ lý giải quyết khiếu nại nếu đơn thuộc một trong các trường hợp quy định tại điểm b khoản này, trong đó nêu rõ lý do từ chối; hoặc
(ii) Ra thông báo thụ lý giải quyết khiếu nại nếu đơn không thuộc các trường hợp quy định tại điểm b khoản này, trong đó ghi nhận ngày thụ lý đơn và xác định phí tra cứu và/hoặc phí thẩm định đối với trường hợp phải thẩm định lại để phục vụ việc giải quyết khiếu nại tương ứng với nội dung khiếu nại (nếu có) và ấn định thời hạn 01 tháng để người khiếu nại nộp phí.
b) Đơn khiếu nại không được thụ lý giải quyết nếu thuộc một trong các trường hợp sau đây:
(i) Đối tượng bị khiếu nại không phải là các quyết định hoặc thông báo chính thức quy định tại khoản 2 Điều 35 của Thông tư này;
(ii) Quyết định, thông báo, hành vi bị khiếu nại không liên quan trực tiếp đến quyền, lợi ích hợp pháp của người khiếu nại;
(iii) Đơn khiếu nại không được nộp theo đúng quy định tại khoản 2 Điều 36 của Thông tư này;
(iv) Đơn khiếu nại được nộp ngoài thời hiệu quy định, trừ trường hợp quy định tại khoản 3 và 4 Điều 15 của Nghị định số 65/2023/NĐ-CP;
(v) Việc khiếu nại đã có quyết định giải quyết khiếu nại lần hai;
(vi) Việc khiếu nại đã được Tòa án thụ lý hoặc đã được giải quyết bằng bản án, quyết định của Tòa án, trừ trường hợp có quyết định đình chỉ giải quyết vụ án hành chính của Tòa án;
(vii) Người khiếu nại tiếp tục khiếu nại khi đã hết thời hạn 30 ngày kể từ ngày có quyết định đình chỉ việc giải quyết khiếu nại theo quy định tại Điều 10 và khoản 8 Điều 11 của Luật Khiếu nại;
(viii) Đơn khiếu nại không chỉ ra yếu tố trái pháp luật của quyết định, thông báo, hành vi bị khiếu nại và chỉ có yêu cầu sửa đổi, bổ sung đơn là đối tượng của quyết định, thông báo đó.
(ix) Đơn khiếu nại đối với thông báo, quyết định hành chính, hành vi liên quan đến đối tượng sở hữu công nghiệp thuộc phạm vi bí mật nhà nước.
c) Nếu người khiếu nại không nộp phí thẩm định đối với trường hợp phải thẩm định lại để phục vụ việc giải quyết khiếu nại theo thông báo thụ lý giải quyết khiếu nại quy định tại tiết (ii) điểm a khoản này, đơn khiếu nại được giải quyết trên cơ sở các tài liệu có trong hồ sơ.
2. Thời hạn giải quyết khiếu nại được thực hiện theo quy định tại Điều 119a của Luật Sở hữu trí tuệ và các Điều 28 và 37 của Luật Khiếu nại.
3. Để xác minh nội dung khiếu nại, người giải quyết khiếu nại lấy ý kiến của người có quyền, nghĩa vụ liên quan trực tiếp đến đơn khiếu nại đã được thụ lý theo quy định tại Điều 21 của Nghị định số 124/2020/NĐ-CP (sau đây gọi là “bên liên quan”) như sau:
a) Người giải quyết khiếu nại thông báo bằng văn bản về nội dung khiếu nại cho bên liên quan và ấn định thời hạn 01 tháng kể từ ngày ra thông báo để người đó có ý kiến (nếu có);
b) Bên liên quan có quyền cung cấp thông tin, chứng cứ chứng minh cho lý lẽ của mình trong thời hạn nêu tại điểm a khoản này, người giải quyết khiếu nại có trách nhiệm xem xét các thông tin, chứng cứ đó khi giải quyết khiếu nại;
c) Người giải quyết khiếu nại thông báo bằng văn bản về nội dung ý kiến của bên liên quan và ấn định thời hạn 02 tháng kể từ ngày ra thông báo để người khiếu nại có ý kiến phản hồi ý kiến của bên liên quan;
d) Nếu kết thúc thời hạn ấn định mà một bên không có ý kiến thì đơn khiếu nại sẽ được giải quyết trên cơ sở các tài liệu có trong đơn, bao gồm cả tài liệu thể hiện ý kiến của bên kia.
4. Trong quá trình giải quyết khiếu nại lần đầu đối với các vụ việc khiếu nại phức tạp, người giải quyết khiếu nại lần đầu có thể chủ động hoặc theo yêu cầu của người khiếu nại thực hiện việc thẩm định lại theo quy định tại khoản 4 Điều 119a của Luật Sở hữu trí tuệ và hướng dẫn tại Điều 13 của Thông tư này. Trong quá trình thẩm định lại, người giải quyết khiếu nại lần đầu có thể tham khảo ý kiến của chuyên gia độc lập hoặc Hội đồng tư vấn phù hợp với quy định sau đây:
a) Người giải quyết khiếu nại lần đầu có thể tham khảo ý kiến chuyên gia tư vấn độc lập, Hội đồng tư vấn trong quá trình thẩm định lại tùy theo mức độ phức tạp của nội dung cần thẩm định lại.
Hội đồng tư vấn gồm chủ tịch và các thành viên. Chuyên gia tư vấn độc lập, Hội đồng tư vấn có vai trò tư vấn cho người giải quyết khiếu nại về vấn đề kỹ thuật, vấn đề pháp lý của nội dung cần thẩm định lại và về phương án giải quyết.
Chuyên gia tư vấn độc lập, chủ tịch và các thành viên Hội đồng tư vấn là những người có trình độ chuyên môn phù hợp, được chọn từ Danh sách chuyên gia tư vấn sở hữu công nghiệp và từ các nguồn khác (trong trường hợp không có chuyên gia thích hợp trong Danh sách đó).
Danh sách chuyên gia tư vấn sở hữu công nghiệp do Cục Sở hữu trí tuệ chủ trì, phối hợp với Thanh tra Bộ Khoa học và Công nghệ lập và công bố trên Công báo sở hữu công nghiệp.
b) Hội đồng tư vấn được tổ chức và hoạt động theo các nguyên tắc sau đây:
(i) Hội đồng tư vấn được thành lập theo quyết định của người giải quyết khiếu nại lần đầu;
(ii) Hội đồng tư vấn làm việc dưới hình thức các cuộc họp, thảo luận tập thể và biểu quyết theo đa số;
(iii) Các bên trong vụ việc khiếu nại, bên có quyền và nghĩa vụ liên quan có thể được mời tham gia cuộc họp của Hội đồng tư vấn để làm rõ tình tiết vụ việc.
c) Những người sau đây không tham gia Hội đồng tư vấn và không làm chuyên gia tư vấn độc lập trong vụ việc khiếu nại:
(i) Người bị khiếu nại (người ban hành quyết định, thông báo bị khiếu nại);
(ii) Người đã thẩm định đơn đăng ký xác lập quyền sở hữu công nghiệp liên quan đến quyết định, thông báo bị khiếu nại;
(iii) Người có quyền, lợi ích liên quan trực tiếp đến vụ việc khiếu nại;
(iv) Người có thể không khách quan trong vụ việc khiếu nại, nếu có căn cứ để xác định điều đó.
Những người nêu tại điểm này có trách nhiệm giải trình, giải thích, cung cấp thông tin liên quan đến công việc mà mình đã thực hiện thuộc nội dung khiếu nại.
d) Ý kiến của chuyên gia tư vấn độc lập, ý kiến của chủ tịch và thành viên Hội đồng tư vấn và kết quả làm việc của Hội đồng tư vấn phải được thể hiện thành văn bản.
5. Người giải quyết khiếu nại lần đầu tổ chức buổi đối thoại theo quy định tại Điều 30 của Luật Khiếu nại. Chuyên gia tư vấn độc lập, thành viên Hội đồng tư vấn về việc thẩm định lại trong quá trình giải quyết khiếu nại lần đầu (nếu có) có thể được mời tham dự buổi đối thoại.
6. Người có thẩm quyền giải quyết khiếu nại lần đầu ra quyết định giải quyết khiếu nại theo quy định như sau:
a) Căn cứ vào kết quả xem xét lại quyết định, thông báo bị khiếu nại, người giải quyết khiếu nại lần đầu ra quyết định giải quyết khiếu nại, trong đó phải có các nội dung quy định tại khoản 2 Điều 31 của Luật Khiếu nại.
b) Đối với trường hợp người khiếu nại không phải là người nộp đơn hoặc người yêu cầu xác lập quyền sở hữu công nghiệp hoặc đăng ký hợp đồng chuyển giao quyền sở hữu công nghiệp là đối tượng của quyết định, thông báo bị khiếu nại cung cấp tình tiết mới có khả năng ảnh hưởng đến kết luận giải quyết khiếu nại, Cục Sở hữu trí tuệ thực hiện việc thẩm định lại đối với nội dung liên quan đến tình tiết mới theo trình tự thẩm định lại đơn đăng ký xác lập quyền sở hữu công nghiệp được quy định tại điểm b và c khoản 2 Điều 13 của Thông tư này. Căn cứ vào kết quả thẩm định đó, người có thẩm quyền giải quyết khiếu nại lần đầu ra quyết định giải quyết khiếu nại theo điểm a khoản này.
7. Các quy định về giải quyết khiếu nại lần đầu tại Thông tư này cũng được áp dụng cho việc giải quyết khiếu nại lần hai, trừ các quy định liên quan về tham khảo ý kiến chuyên gia trong thẩm định lại nội dung đơn tại khoản 4 Điều này. Đối với vụ việc khiếu nại phức tạp, nếu thấy cần thiết, người giải quyết khiếu nại lần hai thành lập Hội đồng tư vấn theo hướng dẫn tại khoản 4 Điều này để tham khảo ý kiến trong quá trình giải quyết khiếu nại.
Điều 39. Công bố quyết định giải quyết khiếu nại
Quyết định giải quyết khiếu nại được công bố trên Cổng thông tin điện tử của cơ quan giải quyết khiếu nại trong thời hạn 15 ngày và trên Công báo sở hữu công nghiệp trong thời hạn 02 tháng kể từ ngày ra quyết định.
Điều 40. Hiệu lực của quyết định, thông báo bị khiếu nại và quyết định giải quyết khiếu nại
1. Quyết định, thông báo bị khiếu nại vẫn có hiệu lực trong thời gian giải quyết khiếu nại, trừ trường hợp bị tạm đình chỉ thi hành theo quyết định bằng văn bản của người giải quyết khiếu nại theo quy định tại Điều 35 của Luật Khiếu nại hoặc theo đề nghị của Tòa án theo quy định của pháp luật về tố tụng.
2. Cục Sở hữu trí tuệ có trách nhiệm thi hành ngay quyết định giải quyết khiếu nại có hiệu lực pháp luật theo quy định tại Điều 44 của Luật Khiếu nại, cụ thể như sau:
a) Quyết định giải quyết khiếu nại lần đầu của Cục trưởng Cục Sở hữu trí tuệ có hiệu lực pháp luật sau thời hạn 30 ngày kể từ ngày ký mà người khiếu nại không khiếu nại lần hai; đối với vùng sâu, vùng xa đi lại khó khăn thì thời hạn có thể kéo dài hơn nhưng không quá 45 ngày;
b) Quyết định giải quyết khiếu nại lần hai của Bộ trưởng Bộ Khoa học và Công nghệ có hiệu lực pháp luật sau thời hạn 30 ngày kể từ ngày ký; đối với vùng sâu, vùng xa đi lại khó khăn thì thời hạn có thể kéo dài hơn nhưng không quá 45 ngày.
3. Việc thụ lý đơn khiếu nại lần hai phải được thông báo cho người giải quyết khiếu nại lần đầu trong thời hạn 10 ngày kể từ ngày thụ lý đơn. Trong trường hợp này, quyết định giải quyết khiếu nại lần đầu không có hiệu lực pháp luật. Quyết định, thông báo bị khiếu nại tiếp tục có hiệu lực cho đến khi quyết định giải quyết khiếu nại lần hai có hiệu lực pháp luật.
4. Người khiếu nại lần hai có thể thông báo ngay cho người giải quyết khiếu nại lần đầu về việc nộp đơn khiếu nại đó để bảo đảm quyền và lợi ích của mình.
Điều 41. Các biện pháp hạn chế phát sinh khiếu nại
1. Cục Sở hữu trí tuệ có trách nhiệm kiểm tra, xem xét lại các quyết định, thông báo đã ban hành, nếu thấy có dấu hiệu trái pháp luật thì kịp thời sửa chữa, khắc phục, tránh phát sinh khiếu nại trừ trường hợp quyết định, thông báo đó đang là đối tượng bị khiếu nại.
2. Trong quá trình giải quyết khiếu nại, người giải quyết khiếu nại khuyến khích và tạo điều kiện cho các bên tranh chấp hòa giải theo quy định của pháp luật.
Chương V
BẢO ĐẢM THÔNG TIN SỞ HỮU CÔNG NGHIỆP
Điều 42. Xây dựng và quản lý cơ sở dữ liệu quốc gia về sở hữu công nghiệp
1. Cục Sở hữu trí tuệ có trách nhiệm thực hiện việc xây dựng, quản lý các cơ sở dữ liệu thông tin sở hữu công nghiệp, xây dựng các công cụ phân loại, tra cứu, hướng dẫn cách tra cứu và sử dụng thông tin sở hữu công nghiệp trong và ngoài nước; tổ chức việc cung ứng thông tin đầy đủ, kịp thời, chính xác, bảo đảm khả năng tiếp cận các cơ sở dữ liệu thông tin cho các đối tượng có nhu cầu dùng tin phục vụ các hoạt động xác lập và bảo vệ quyền sở hữu công nghiệp, nghiên cứu, phát triển và kinh doanh; quản lý và tổ chức thực hiện việc chia sẻ, kết nối, khai thác, hợp tác quốc tế và các hoạt động khác liên quan đến cơ sở dữ liệu quốc gia về sở hữu công nghiệp.
2. Cơ sở dữ liệu quốc gia về sở hữu công nghiệp bao gồm thông tin thư mục và thông tin toàn văn (nếu có), được tập hợp một cách chọn lọc, có hệ thống, phù hợp với các mục đích tra cứu, liên quan đến:
a) Các đơn đăng ký sở hữu công nghiệp đã công bố;
b) Các văn bằng bảo hộ đã được cấp và các quyền sở hữu công nghiệp đã được thừa nhận bảo hộ tại Việt Nam.
Điều 43. Tiếp cận và khai thác thông tin thuộc cơ sở dữ liệu quốc gia về sở hữu công nghiệp
Mọi tổ chức, cá nhân đều có quyền tiếp cận và khai thác các thông tin thuộc cơ sở dữ liệu quốc gia về sở hữu công nghiệp dưới hai hình thức:
1. Tự tra cứu, tìm kiếm thông tin trong những cơ sở dữ liệu do Cục Sở hữu trí tuệ đặt công khai tại các cơ sở tra cứu thông tin cho công chúng tiếp cận hoặc công bố trên Internet.
2. Sử dụng dịch vụ tra cứu, cung cấp thông tin, tư liệu của Cục Sở hữu trí tuệ, với điều kiện phải trả chi phí theo quy định.
Điều 44. Dịch vụ tra cứu thông tin, cung cấp tư liệu
Cục Sở hữu trí tuệ tổ chức thực hiện dịch vụ tra cứu thông tin, cung cấp tư liệu cho tổ chức, cá nhân có nhu cầu quy định tại khoản 2 Điều 43 của Thông tư này.
Điều 45. Bảo đảm thông tin sở hữu công nghiệp tại các địa phương
1. Tùy theo điều kiện và khả năng của mình, cơ quan quản lý nhà nước về sở hữu công nghiệp tại địa phương có thể thiết lập và quản lý cơ sở dữ liệu sở hữu công nghiệp nhằm bảo đảm thông tin sở hữu công nghiệp cho các hoạt động nghiên cứu, ứng dụng, phát triển sản xuất, kinh doanh và bảo vệ quyền sở hữu công nghiệp tại địa phương.
2. Cơ quan quản lý nhà nước về sở hữu công nghiệp tại các tỉnh, thành phố trực thuộc Trung ương có trách nhiệm và có quyền tiến hành các hoạt động bảo đảm thông tin sở hữu công nghiệp theo quy định của Thông tư này.
3. Cục Sở hữu trí tuệ có trách nhiệm thống kê thông tin thuộc cơ sở dữ liệu quốc gia về sở hữu công nghiệp để phục vụ công tác quản lý nhà nước về sở hữu công nghiệp của các tỉnh, thành phố trực thuộc Trung ương theo định kỳ (tối thiểu 6 tháng một lần).
Điều 46. Cấp bản sao tài liệu, xác nhận đơn đầu tiên để hưởng quyền ưu tiên
1. Mọi tổ chức, cá nhân có liên quan đều có quyền yêu cầu Cục Sở hữu trí tuệ cấp bản sao các tài liệu do Cục Sở hữu trí tuệ phát hành hoặc bản sao từ sổ gốc do Cục Sở hữu trí tuệ lập ra hoặc bản sao các tài liệu do chính tổ chức, cá nhân đó lập ra và nộp cho Cục Sở hữu trí tuệ trong quá trình xác lập quyền sở hữu công nghiệp. Người yêu cầu cấp bản sao phải trả chi phí cho việc sao tài liệu.
2. Người nộp đơn có quyền yêu cầu Cục Sở hữu trí tuệ xác nhận vào bản sao của đơn đầu tiên dùng để hưởng quyền ưu tiên (kể cả đơn bị từ chối chấp nhận đơn hợp lệ hoặc người nộp đơn đã rút đơn) với điều kiện phải trả chi phí cho việc sao tài liệu.
3. Cục Sở hữu trí tuệ tổ chức thực hiện dịch vụ cung cấp bản sao, xác nhận đơn đầu tiên cho tổ chức, cá nhân có nhu cầu theo quy định tại khoản 2 Điều này.
Chương VI
ĐIỀU KHOẢN THI HÀNH
Điều 47. Quy định chuyển tiếp
1. Ý kiến phản đối đơn được nộp cho Cục Sở hữu trí tuệ từ ngày 01 tháng 01 năm 2023 phù hợp với quy định của Điều 112a của Luật Sở hữu trí tuệ nhưng Cục Sở hữu trí tuệ chưa xử lý xong được xử lý theo quy định tại Điều 11 của Thông tư này.
2. Ý kiến của người thứ ba theo quy định tại Điều 112 của Luật Sở hữu trí tuệ nộp cho Cục Sở hữu trí tuệ trước ngày 23 tháng 8 năm 2023 nhưng Cục Sở hữu trí tuệ chưa xử lý xong được tiếp tục xử lý theo quy định của Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 của Bộ Khoa học và Công nghệ hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP ngày 22 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Sở hữu trí tuệ về sở hữu công nghiệp, được sửa đổi, bổ sung theo Thông tư số 13/2010/TT-BKHCN ngày 30 tháng 7 năm 2010, Thông tư số 18/2011/TT-BKHCN ngày 22 tháng 7 năm 2011, Thông tư số 05/2013/TT-BKHCN ngày 20 tháng 02 năm 2013 và Thông tư số 16/2016/TT-BKHCN ngày 30 tháng 6 năm 2016.
3. Quy định của Thông tư này được áp dụng đối với các đơn xác lập quyền sở hữu công nghiệp nộp từ ngày 23 tháng 8 năm 2023 trừ trường hợp quy định tại các khoản 4, 5 và 6 Điều này.
4. Quy định về hình thức đơn khiếu nại của Thông tư này được áp dụng đối với đơn nộp từ ngày Thông tư này có hiệu lực.
5. Quy định tại khoản 8 Điều 16, khoản 10 Điều 23, khoản 13 Điều 26 của Thông tư này được áp dụng đối với đơn đăng ký sở hữu công nghiệp nộp trước ngày Thông tư có hiệu lực nhưng chưa có thông báo kết quả thẩm định nội dung.
6. Quy định tại Điều 34 của Thông tư này được áp dụng đối với các đơn đăng ký sáng chế, nhãn hiệu được nộp từ ngày 01 tháng 01 năm 2023.
Điều 48. Hiệu lực thi hành
1. Thông tư này có hiệu lực kể từ ngày 30 tháng 11 năm 2023.
2. Các Thông tư sau đây hết hiệu lực kể từ ngày Thông tư này có hiệu lực:
a) Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 của Bộ trưởng Bộ Khoa học và Công nghệ hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP ngày 22 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Sở hữu trí tuệ về sở hữu công nghiệp;
b) Thông tư số 18/2011/TT-BKHCN ngày 22 tháng 7 năm 2011 sửa đổi, bổ sung một số quy định của Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP ngày 22 tháng 9 năm 2006, được sửa đổi, bổ sung theo Thông tư số 13/2010/TT-BKHCN và Thông tư số 01/2008/TT-BKHCN ngày 25 tháng 02 năm 2008 hướng dẫn việc cấp, thu hồi Thẻ giám định viên sở hữu công nghiệp và Giấy chứng nhận tổ chức đủ điều kiện hoạt động giám định sở hữu công nghiệp, được sửa đổi, bổ sung theo Thông tư số 04/2009/TT-BKHCN ngày 27 tháng 3 năm 2009;
c) Thông tư số 05/2013/TT-BKHCN ngày 20 tháng 02 năm 2013 sửa đổi, bổ sung một số quy định của Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP quy định chi tiết một số điều của Luật Sở hữu trí tuệ về sở hữu công nghiệp, được sửa đổi, bổ sung theo Thông tư số 13/2010/TT-BKHCN ngày 30 tháng 7 năm 2010 và Thông tư số 18/2011/TT-BKHCN ngày 22 tháng 7 năm 2011;
d) Thông tư số 16/2016/TT-BKHCN ngày 30 tháng 06 năm 2016 sửa đổi, bổ sung một số điều của Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP ngày 22 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Sở hữu trí tuệ về sở hữu công nghiệp, được sửa đổi, bổ sung theo Thông tư số 13/2010/TT-BKHCN ngày 30 tháng 7 năm 2010, Thông tư số 18/2011/TT-BKHCN ngày 22 tháng 7 năm 2011 và Thông tư số 05/2013/TT-BKHCN ngày 20 tháng 02 năm 2013.
3. Các quy định về sở hữu công nghiệp tại Điều 2 của Thông tư số 13/2010/TT-BKHCN ngày 30 tháng 7 năm 2010 sửa đổi, bổ sung một số quy định của Thông tư số 17/2009/TT-BKHCN ngày 18 tháng 6 năm 2009 hướng dẫn kiểm tra nhà nước về chất lượng hàng hoá nhập khẩu thuộc trách nhiệm quản lý của Bộ Khoa học và Công nghệ và Thông tư số 01/2007/TT-BKHCN ngày 14 tháng 02 năm 2007 hướng dẫn thi hành Nghị định số 103/2006/NĐ-CP ngày 22 tháng 9 năm 2006 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật Sở hữu trí tuệ về sở hữu công nghiệp hết hiệu lực kể từ ngày Thông tư này có hiệu lực.
4. Trong quá trình thực hiện nếu có vướng mắc, đề nghị cơ quan, tổ chức, cá nhân phản ánh kịp thời về Bộ Khoa học và Công nghệ để được hướng dẫn./.
