Circular No. 23/2024/TT-BYT on the List of Professional Techniques in Medical Examination and Treatment issued by the Minister of Health

CIRCULAR

Issuing the Technical List for Medical Examination and Treatment

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to the Price Law dated June 19, 2023;

Pursuant to Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment;

Pursuant to Decree No. 85/2024/NĐ-CP dated July 10, 2024 of the Government detailing certain provisions of the Price Law;

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Medical Examination and Treatment;

The Minister of Health issues this Circular to issue the Technical List for Medical Examination and Treatment.

Article 1. Technical List and Economic-Technical Characteristics in Medical Examination and Treatment

a) Two Register models (Annex I);

a) The Technical List for Medical Examination and Treatment implemented until June 30, 2026, as specified in Appendix No. 01 attached hereto;

b) The Technical List for Medical Examination and Treatment implemented from July 1, 2026, as specified in Appendix No. 02 attached hereto.

2. The economic-technical characteristics of technical services in medical examination and treatment are determined according to specialties as specified in the appendices under Clause 1 of this Article.

3. A technique specified in Appendix No. 01 attached hereto is arranged in the most suitable specialty or field but may be performed in different specialties or fields.

4. Techniques specified in Appendix No. 02 attached hereto are arranged according to organ systems and anatomical structures.

Article 2. Reference Provisions

In case the referenced documents in this Circular are replaced, amended, or supplemented, they shall be applied according to the replaced, amended, or supplemented documents.

Article 3. Implementation Provisions

1. This Circular takes effect from October 18, 2024.

2. The following circulars cease to be effective from the date this Circular takes effect:

a) Circular No. 43/2013/TT-BYT dated December 11, 2013, issued by the Minister of Health detailing the classification of specialized technical levels for the medical examination and treatment system;

b) Circular No. 21/2017/TT-BYT dated May 10, 2017, issued by the Minister of Health amending and supplementing the Technical List for Medical Examination and Treatment issued together with Circular No. 43/2021/TT-BYT dated December 11, 2013, issued by the Minister of Health detailing the classification of specialized technical levels for the medical examination and treatment system.

Article 4. Transitional Provisions

1. Techniques specified in Appendix No. 01 attached hereto have been classified according to surgery and procedure categories as specified in Circular No. 50/2014/TT-BYT dated December 26, 2014, issued by the Minister of Health on the classification of surgeries and procedures and staffing standards for each surgery and procedure, shall continue to apply these surgery and procedure classifications.

2. Individuals who have been granted practice certificates or licenses before the date this Circular takes effect may continue to perform techniques approved according to Circular No. 32/2023/TT-BYT dated December 31, 2023, issued by the Minister of Health detailing certain provisions of the Law on Medical Examination and Treatment and techniques in the Technical List issued together with this Circular within their scope of practice.

3. Medical examination and treatment facilities that have been granted operating permits by competent authorities before the date this Circular takes effect may continue to perform techniques approved within their scope of specialized activities until June 30, 2026, without having to go through permit adjustment procedures.

Article 4. Organization of Implementation

1. The Department of Medical Examination and Treatment shall be responsible for:

a) Serve as the main coordinator to organize and implement this Circular and guide professional content within their assigned functions and tasks;

b) Monitor and urge medical examination and treatment facilities under their management to prepare conditions to implement the technical list specified in Appendix No. 02 attached hereto from July 1, 2026.

2. The Traditional Medicine Management Department, the Maternal and Child Health Department, and the Health Insurance Department shall be responsible for directing, guiding, inspecting, and urging the implementation of this Circular according to their assigned functions and tasks.

3. Departments of Health of provinces and centrally-administered cities shall be responsible for:

a) Directing, guiding, inspecting, and urging the implementation of this Circular for healthcare facilities under their management;

b) Monitor and urge medical examination and treatment facilities under their management to prepare conditions to implement the technical list specified in Appendix No. 02 attached hereto from July 1, 2026.

4. Medical examination and treatment facilities shall be responsible for:

a) Ensuring material resources, human resources, and equipment to implement the technical list approved by competent authorities;

b) Preparing conditions to implement the technical list specified in Appendix No. 02 attached hereto from July 1, 2026. During the implementation process, if there are difficulties or obstacles, organizations, entities, or individuals shall promptly report to the Ministry of Health (Medical Examination and Treatment Management Department) for consideration and resolution./.
