DECISION OF THE PRIME MINISTER

On certain regulations for sports coaches and athletes

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Labor Code dated June 23, 1994 and the Law Amending and Supplementing Certain Provisions of the Labor Code dated April 2, 2002;

Considering the proposal of the Minister, Chairman of the Sports Committee, the Minister of Finance, and the Minister of Labor, Invalids and Social Affairs,

DECISION:

Article 1 Payment of daily remuneration for sports coaches and athletes who are Vietnamese citizens during training sessions and competitions shall be as follows:

1. For coaches and athletes not receiving salary from the state budget:

a) Coaches: - National team head coach: 150,000 VND/person/day; - National team coach: 100,000 VND/person/day; - National youth team head coach: 100,000 VND/person/day; - National youth team coach: 75,000 VND/person/day; - Coach of the provincial or centrally-administered city team: 75,000 VND/person/day; - Youth coach of the provincial or centrally-administered city team: 55,000 VND/person/day; - Talent coach of the provincial or centrally-administered city team: 55,000 VND/person/day.

b) Athletes: - National team athlete: 70,000 VND/person/day; - National youth team athlete: 50,000 VND/person/day; - Provincial or centrally-administered city team athlete: 50,000 VND/person/day; - Youth athlete of the provincial or centrally-administered city team: 25,000 VND/person/day; - Talent athlete of the provincial or centrally-administered city team: 15,000 VND/person/day.

2. For coaches and athletes receiving salary from the state budget during training sessions and competitions, if their salary is lower than the daily remuneration specified in Clause 1 of this Article, then the employing agency shall pay the difference to ensure they receive the corresponding amounts.

Article 2. Regulations on social insurance, health insurance, and allowances for coaches and athletes in national teams, national youth teams, provincial or centrally-administered city teams during training sessions and competitions are as follows:

1. Coaches and athletes receiving salary from the state budget and coaches and athletes not receiving salary from the state budget but working at agencies, enterprises, organizations subject to mandatory social insurance during training sessions and competitions shall enjoy social insurance and health insurance benefits according to the laws on social insurance and health insurance. In case coaches and athletes suffer accidents or death while training or competing, the employing agency or organization shall compensate them once according to Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP of the Government dated December 27, 2002 amending and supplementing some provisions of Decree No. 06/CP dated January 20, 1995 of the Government detailing some provisions of the Labor Code on occupational safety and labor hygiene (hereinafter referred to as Decree No. 110/2002/NĐ-CP).

2. Coaches and athletes not receiving salary from the state budget and not subject to mandatory social insurance and health insurance according to the laws on social insurance and health insurance, during training sessions and competitions, if they fall ill, have to stop training or competing, suffer accidents, or die, shall be handled as follows:

a) If they fall ill, all medical examination and treatment costs will be paid, and they will receive an allowance equal to 75% of their current daily remuneration for the days off due to illness (or implementing population planning measures);

b) If they suffer accidents while training or competing, all medical expenses from first aid to stable recovery will be covered, and they will receive an allowance equal to 100% of their daily remuneration during the treatment period;

c) After the injury stabilizes, their work capacity will be assessed; if their work capacity decreases by 5% or more, they will receive an allowance and compensation as follows: - A one-time allowance equivalent to the current level stipulated by the law on social insurance for those subject to mandatory social insurance; - Compensation according to Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP.

d) If coaches or athletes die, the person handling the funeral will receive a burial allowance equivalent to the current level stipulated by the law on social insurance for those subject to mandatory social insurance. If coaches or athletes die due to accidents while training or competing, their relatives will receive a one-time allowance equivalent to the current level stipulated by the law on social insurance for those subject to mandatory social insurance and will be compensated according to Clause 4, Article 1 of Decree No. 110/2002/NĐ-CP.

3. For athletes and coaches not subject to mandatory social insurance, when they stop being athletes or coaches, they will receive a one-time allowance, for each year (12 months) of concentrated work as an athlete or coach (cumulatively), they will receive 1.5 months (26 days/month) of their pre-termination remuneration, but the minimum will be two months' remuneration.

Article 3 Regulations on monetary rewards for athletes and coaches achieving results in competitions are as follows:

1. Athletes achieving results in the following international competitions will receive rewards as follows:

Unit of calculation: million VND

2. Athletes who achieve results at competitions of the Southeast Asian Youth Championships, Asian Youth Championships, and World Youth Championships shall enjoy a maximum reward equal to 50% of the corresponding reward stipulated in Clause 1 of this Article.

3. Athletes who achieve results at national championship competitions shall have the highest reward not exceeding 10 million VND (including medal bonuses and record-breaking bonuses). For national youth championships, the maximum reward shall be 50% of the reward for national championships.

4. Coaches directly training athletes who achieve results in competitions shall receive a total reward equivalent to that of the athletes.

5. For team sports, the number of athletes and coaches eligible for rewards when achieving results shall be determined according to the competition regulations. The total reward shall be the number of people receiving rewards multiplied by the corresponding reward stipulated in Clauses 1, 2, and 3 of this Article.

6. For team events (where individual and team achievements are determined in the same competition), the number of athletes and coaches eligible for rewards when achieving results shall be determined according to the competition regulations. The total reward shall be the number of people receiving rewards multiplied by 50% of the corresponding reward stipulated in Clauses 1, 2, and 3 of this Article.

7. Coaches and athletes who achieve results at Southeast Asian, Asian, and World Paralympic Games and national mass sports competitions shall receive a reward equal to 50% of the corresponding reward stipulated in Clauses 1, 2, 3, 4, 5, and 6 of this Article.

Article 4.

1. The Sports Management Committee shall establish the system of national sports competitions and specify specific rewards for athletes and coaches who achieve results in international competitions of each sport.

2. Ministries, sectors, provincial People's Committees, and municipal People's Committees under the Central Government shall specify specific rewards for athletes and coaches from their respective ministries, sectors, and provincial/municipal People's Committees who achieve results in sports competitions.

Article 5. Source of funds and method of payment:

1. The funds allocated for the provisions set forth in this Decision shall be arranged within the annual budget for physical culture and sports according to the current state regulations on the hierarchical management of the state budget:

a) The Sports Management Committee shall pay salaries, social insurance contributions, health insurance contributions, medical examination and treatment fees, accident compensation, and other allowances as prescribed for coaches and athletes belonging to national teams and junior national teams; and rewards for coaches and athletes of national teams and junior national teams who achieve results in international sports competitions.

b) Ministries, sectors, provincial People's Committees, and municipal People's Committees under the Central Government shall pay salaries, social insurance contributions, health insurance contributions, medical examination and treatment fees, accident compensation, and other allowances as prescribed for coaches and athletes managed by their respective ministries, sectors, and provincial/municipal People's Committees; and rewards for coaches and athletes who achieve results in national competitions and competitions organized by ministries, sectors, and provincial/municipal People's Committees.

2. The State encourages sports federations, associations, and units managing coaches and athletes to utilize legitimate sources of income to supplement salaries, bonuses, medical examination and treatment allowances, accident compensation, and other policies and benefits for coaches and athletes.

Article 6. This Decision shall take effect 15 days after its publication in the Official Gazette. Decree No. 49/1998/QĐ-TTg dated February 28, 1998, issued by the Prime Minister regarding certain policies for athletes and sports coaches, is hereby repealed. Prime Minister of the Government on certain policies for athletes and sports coaches.

Article 7. The Minister of Finance, the Minister of Labor, Invalids and Social Affairs, and the Minister and Chairman of the Sports Management Committee shall be responsible for guiding the implementation of this Decision.

Article 8. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
