CIRCULAR
Amending Circular No. 522/1999/TT-BGTVT dated October 20, 1999
Guidelines for registration, issuance of license plates, and technical safety inspection
of construction vehicles and machinery.
Implementing Article 11 and Article 17 of the Regulations promulgated together with Decree No. 36/CP dated May 29, 1995 of the Government on ensuring traffic order and safety on roads and urban traffic order;
Implementing Decree No. 176/1999/NĐ-CP dated December 21, 1999 of the Government on stamp duty, and Circular No. 28/2000/TT-BTC dated April 18, 2000 of the Ministry of Finance guiding Decree No. 176/1999/NĐ-CP;
The Ministry of Transport amends Circular No. 522/1999/TT-BGTVT dated October 20, 1999 guiding registration, issuance of license plates, and technical safety inspection of construction vehicles and machinery as follows:
1. Remove the provisions related to stamp duty receipts in Sections 2.1.2 and 2.2 of Circular No. 522/1999/TT-BGTVT.
1.1. Section 2.1.2 of Circular No. 522/1999/TT-BGTVT is amended and now reads as follows:
2.1.2. Documents proving the lawful origin of construction vehicles and machinery
a) For construction vehicles and machinery imported from January 1, 2000 onwards, the following documents are required:
- Import certificate (as prescribed by the General Department of Customs).
- Invoice (as prescribed by the Ministry of Finance).
b) For construction vehicles and machinery produced or assembled domestically from January 1, 2000 onwards, the following document is required: Invoice (as prescribed by the Ministry of Finance).
c) For construction vehicles and machinery that have been put into use before December 31, 1999, the following documents are required:
- Documents proving the lawful origin of construction vehicles and machinery as stipulated in paragraphs a and b above.
- In case the documents proving the lawful origin of construction vehicles and machinery are lost, the owner must submit a declaration form and a statement affirming that the construction vehicles and machinery are lawful property, and if discrepancies are found, the owner will bear full responsibility under the law.
1.2. Section 2.2 of Circular No. 522/1999/TT-BGTVT is amended and now reads as follows:
2.2. Documents for application for transfer of ownership registration and issuance of license plates
For construction vehicles and machinery that have been registered and issued license plates and need to transfer ownership, the following documents are required:
- Application form for registration and issuance of license plates for construction vehicles and machinery and request for reissuance of license plates, Certificate of Registration according to the model prescribed in Appendix 1 of Circular No. 522/1999/TT-BGTVT
- Invoice (according to the model of the Ministry of Finance).
- Transfer and relocation form according to the model prescribed in Appendix 2 of Circular No. 522/1999/TT-BGTVT, accompanied by original documents when first registering and issuing license plates.
2. The Vietnam Highway Administration and the Vietnam Vehicle Inspection Center shall, based on their functions and responsibilities, be responsible for guiding and coordinating with relevant agencies to organize inspections and implement this Circular.
3. This Circular takes effect fifteen days from the date of signature./.
