CIRCULAR

Guidelines for Registration, Issuance of License Plates, and Safety Technical Inspection of Construction Vehicles and Machinery

Pursuant to Article 11 and Article 17 of the Regulations issued together with Decree No. 36/CP dated May 29, 1995 of the Government on Ensuring Traffic Order and Safety on Roads and Urban Traffic Order and Safety, and with the agreement of the Ministry of Public Security in Document No. 1123 CV/BCA (V11) dated September 1, 1999, the Ministry of Transport hereby guides the registration, issuance of license plates, and safety technical inspection of construction vehicles and machinery as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1.1. Scope and Applicability

This Circular applies to construction vehicles and machinery when conducting road construction or when granted permission by road management authorities to travel on roads (hereinafter referred to as construction vehicles and machinery).

This Circular does not apply to construction vehicles and machinery used for military purposes by the Ministry of National Defense and for security, traffic order, and social safety purposes by the Ministry of Public Security.

1.2. Types of Construction Vehicles and Machinery Specified in This Circular Include the Following Main Categories:

1.2.1. Self-propelled vehicles equipped with tires:

- Bulldozers

- Graders

- Excavators (all-purpose excavators, transfer excavators)

- Loaders (single bucket, multiple buckets, forward bucket, reverse bucket, bucket dumpers, grab loaders, combined loader-bulldozers...)

- Diggers

- Compactors

- Rollers

- Asphalt Pavers

- Asphalt Removal Machines

- Drilling Machines

- Stone, Sand, and Gravel Spreading Machines

- Earth Drilling Machines

- Plows

- Forklifts

1.2.2. Self-propelled vehicles equipped with tracks (smooth tracks, cleated tracks) or a combination of tires and tracks:

- All types of self-propelled vehicles mentioned in Point 1.2.1 but equipped with tracks or a combination of tires and tracks.

- Cranes

- Hammering Machines

1.2.3. Self-propelled vehicles equipped with iron wheels:

- Rollers

- Combined rollers with iron and tire wheels

- Compactors

1.3. Registration and License Plate Issuing Authorities

1.3.1. The Vietnam Highway Administration uniformly manages the registration, issuance of license plates for construction vehicles and machinery, issues and manages Certificates of Registration and license plates for construction vehicles and machinery nationwide. It organizes the registration and issuance of license plates for construction vehicles and machinery owned by entities under the Ministry of Transport.

1.3.2. Provincial Departments of Transport and Public Works register and issue license plates for construction vehicles and machinery owned by organizations and individuals, both domestic and foreign, whose main offices or permanent residences (for individuals) are located within their jurisdictions, except for those specified in Point 1.3.1 above.

1.4. Safety Technical Inspection Authorities

The Vietnam Vehicle Inspection Bureau conducts safety technical inspections of construction vehicles and machinery nationwide.

1.5. Temporary Movement Permit

For newly imported, domestically produced, or assembled construction vehicles and machinery that need to move independently from the importation, production, or assembly site to the sales location, storage location, or the permanent residence of the owner, they must apply to the traffic police for a temporary movement permit.

2. Registration and License Plate Issuance Regulations for Construction Vehicles and Machinery

2.1. Documents Required for Initial Registration and License Plate Issuance Include:

2.1.1. Application Form for Registration and Issuance of License Plates for Construction Vehicles and Machinery and for Reissuance of License Plates, and Certificate of Registration of License Plates according to Model at Appendix 1.

2.1.2. Documentation Proving Legal Origin of Construction Vehicles and Machinery

a) For construction vehicles and machinery imported after December 31, 1999, the following documents are required:

- Import documents (as stipulated by the General Department of Customs).

- Invoice (as stipulated by the Ministry of Finance).

- Proof of stamp duty payment.

b) For construction vehicles and machinery produced or assembled domestically after December 31, 1999, the following documents are required:

- Invoice (as stipulated by the Ministry of Finance).

- Proof of stamp duty payment.

c) For construction vehicles and machinery that have been put into use before December 31, 1999, the following documents are required:

- Documentation proving legal origin of construction vehicles and machinery as stipulated in items a and b above.

- In case the documentation proving legal origin of construction vehicles and machinery is lost, the owner must submit an application form and a declaration stating that the vehicle or machinery is legally owned. If discrepancies are found, the owner will be fully responsible under the law.

- Proof of stamp duty payment.

2.1.3. Technical Documentation of Construction Vehicles and Machinery

a) For imported construction vehicles and machinery, the following documents are required:

- Technical specifications and drawings with dimensions.

- Additionally, for used imported construction vehicles and machinery, a Quality and Safety Technical Inspection Certificate from the Vietnam Vehicle Inspection Bureau is required.

b) For domestically produced or assembled construction vehicles and machinery, the following document is required:

- Technical specifications and drawings with dimensions.

- A Quality and Safety Technical Inspection Certificate issued by the Vietnam Vehicle Inspection Bureau.

c) For construction vehicles and machinery put into use before December 31, 1999, if technical documentation is lost, a Quality and Safety Technical Inspection Certificate from the Vietnam Vehicle Inspection Bureau is required.

When transferring ownership of registered and licensed construction vehicles and machinery, the following documents are required:

2.2. Documents for application for transfer of ownership registration and issuance of license plates

- Application Form for Registration and Issuance of License Plates for Construction Vehicles and Machinery and for Reissuance of License Plates, and Certificate of Registration according to Model at Appendix 1.

- Transfer and Relocation Form according to Model at Appendix 2, accompanied by original registration documents.

- Invoice (as prescribed by the Ministry of Finance).

- Proof of stamp duty payment for transfer of ownership.

2.3. Documents Required for Owners of Construction Vehicles and Machinery Authorized to Register and Obtain License Plates

When applying for initial registration and issuance of license plates or for registration and issuance of license plates upon transfer of ownership, in addition to the documents specified in Sections 2.1 and 2.2 above, the following documents must also be presented:

- For construction vehicles and machinery owned by Vietnamese individuals, a national identity card or household registration book is required.

- For construction vehicles and machinery owned by domestic or foreign organizations and enterprises, a letter of introduction or a document clearly stating the name of the authorized person to register and obtain license plates is required.

2.4. Identification Check for Registration and License Plate Issuance

During registration and issuance of license plates, the registration and license plate issuing authority must inspect the identification of construction vehicles and machinery at the registration and license plate issuing location or where the vehicles and machinery are parked to verify: engine number, chassis number (if available), or production series number.

Motor construction vehicles, when registering and receiving license plates, must be inspected by the registration and license plate issuance authority at the registration and license plate issuance location or at the parking location of the construction machinery to determine: engine number, frame number (if any) or production series number.

In cases where there is no engine number or frame number and production series number, the registration authority must affix the engine number and frame number for management purposes according to the model in Appendix 3. The Vietnam Highway Administration shall be responsible for managing and guiding the affixing of engine numbers and frame numbers on construction vehicles and machinery.

2.5. Registration Number Plates

- Construction vehicle and machinery number plates shall be made according to the model in Appendix 4. The registration number code for construction vehicles and machinery of each province and city shall follow the model in Appendix 5.

- Each construction vehicle and machinery must be equipped with two registration number plates, one at the front and one at the rear.

- The registration authority, when issuing number plates, shall determine the position of the number plates based on the specific structure of the construction vehicle and machinery to ensure clear visibility.

2.6. Certificate of Registration for Construction Vehicles and Machinery

The Certificate of Registration for construction vehicles and machinery shall be made according to the model in Appendix 6.

2.7. Provisions on Reissuing Registration Number Plates and Certificates of Registration for Construction Vehicles and Machinery

In cases where construction vehicles and machinery lose their number plates or suffer damage, or if the Certificate of Registration for construction vehicles and machinery is torn, damaged, or lost, the owner must immediately report to the registration authority and submit an application form for reissuing number plates or the Certificate of Registration according to the model in Appendix 1 to be considered for reissue.

3. Provisions on Safety Technical Inspection of Construction Vehicles and Machinery

All types of construction vehicles and machinery must undergo safety technical inspection according to the "Safety Technical Standards and Environmental Protection Standards for Specialized Construction Vehicles and Machinery" stipulated by the Ministry of Transport, which includes the following contents:

3.1. Safety Technical Inspection for Registration and Issuance of Number Plates

Prior to registration and issuance of number plates, the following construction vehicles and machinery must undergo safety technical inspection:

- Imported construction vehicles and machinery that have been previously used.

- Construction vehicles and machinery that were put into use before December 31, 1999, and have lost their technical documentation.

3.2. Periodic Safety Technical Inspection

Registered construction vehicles and machinery must undergo periodic safety technical inspection every twelve months.

- For newly imported construction vehicles and machinery that have not been used or newly manufactured and assembled domestically, the first safety technical inspection cycle from the date of issuance of number plates is twenty-four months.

3.3. Safety Technical Certificate

Construction vehicles and machinery meeting the criteria set forth in the "Safety Technical Standards and Environmental Protection Standards for Specialized Construction Vehicles and Machinery" issued by the Ministry of Transport will be granted a "Safety Technical Certificate," serving as the basis for registration, issuance of number plates, and road construction or participation in road traffic.

4. Fees for Safety Technical Inspection and Registration Number Plate Issuance Fees

Fees for safety technical inspection and registration number plate issuance for construction vehicles and machinery shall be implemented according to current regulations.

5. Implementation

5.1. The Vietnam Highway Administration and the Vietnam Vehicle Inspection Bureau, based on their functions and responsibilities, shall be responsible for guiding and coordinating with relevant agencies to organize the implementation of this Circular.

5.2. This Circular shall take effect from January 1, 2000./.
