Pursuant to the Road Traffic Law number 23/2008/QH12 dated November 13, 2008;

Pursuant to the Price Law number 11/2012/QH13 dated June 20, 2012;

Pursuant to the Fees and Charges Law number 97/2015/QH13 dated November 25, 2015;

Pursuant to the Government Decree number 177/2013/NĐ-CP dated November 14, 2013 detailing and guiding the implementation of certain provisions of the Price Law and the Government Decree number 149/2016/NĐ-CP dated November 11, 2016 amending and supplementing certain provisions of the Government Decree number 177/2013/NĐ-CP dated November 14, 2013;

Pursuant to the Government Decree number 215/2013/NĐ-CP dated December 23, 2013 stipulating the functions, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Price Management Department,

The Minister of Finance promulgates this Circular regulating the price of technical safety inspection and environmental protection services for motor vehicles, equipment, and specialized motorcycles in circulation; evaluation and calibration of vehicle testing equipment.

Article 1. Scope of Regulation

This Circular regulates the price of technical safety inspection and environmental protection services for motor vehicles, equipment, and specialized motorcycles in circulation; evaluation and calibration of vehicle testing equipment.

Article 2. Applicability

1. Organizations, entities, and individuals subject to technical safety inspection and environmental protection services for motor vehicles, equipment, and specialized motorcycles in circulation by the registration inspection unit shall be responsible for paying the service fee to the registration inspection unit in accordance with the provisions of this Circular.

2. The registration inspection unit shall conduct technical safety inspection and environmental protection services for motor vehicles, equipment, and specialized motorcycles in circulation.

3. Other related organizations and individuals.

1. The prices prescribed in this Circular include value-added tax at a rate of ten percent (10%) and costs for issuing Technical Safety Inspection and Environmental Protection Certificates for motor vehicles and specialized motorcycles; they do not include accommodation, travel, and communication expenses for inspection work at locations more than 100 kilometers away from the inspection unit's headquarters. If such expenses occur, they shall be implemented according to the current regulations of the Ministry of Finance regarding travel allowances for state agencies and public service units.

The service prices prescribed in this Circular include value-added tax but do not include the licensing fee for issuing the Technical Safety Inspection and Environmental Protection Certificate for motor vehicles and specialized motorcycles according to the regulations of the Ministry of Finance and travel expenses, accommodation costs, and communication fees for inspection work at locations more than 100 kilometers away from the registration inspection unit's headquarters. Travel expenses, accommodation costs, and communication fees for inspection work at locations more than 100 kilometers away from the registration inspection unit's headquarters (if applicable) shall be implemented in accordance with the current regulations of the Ministry of Finance regarding travel allowances for state agencies and public institutions.

2. When collecting service fees, the registration inspection unit shall use sales invoices in accordance with the Government Decree number 51/2010/NĐ-CP dated May 14, 2010 on sales invoices and service provision invoices; the Government Decree number 04/2014/NĐ-CP dated January 17, 2014 amending and supplementing certain provisions of the Government Decree number 51/2010/NĐ-CP dated May 14, 2010 on sales invoices and service provision invoices; the Circular number 39/2014/TT-BTC dated March 31, 2014 issued by the Minister of Finance guiding the implementation of the Government Decree number 51/2010/NĐ-CP dated May 14, 2010 and the Government Decree number 04/2014/NĐ-CP dated January 17, 2014 on sales invoices and service provision invoices and any subsequent amendments or supplements (if applicable).

The registration inspection unit has the obligation to publicly disclose information and post service prices, pay taxes on the amount collected, and have the right to manage and use the remaining amount after tax payment in accordance with the law.

Article 4. Organization of Implementation

1. This Circular takes effect from January 1, 2017 and replaces the Circular number 114/2013/TT-BTC dated August 20, 2013 issued by the Minister of Finance stipulating the collection, management, and use of fees for technical safety inspection and quality parts inspection for motor vehicles and various types of equipment and specialized motorcycles and the Circular number 132/2014/TT-BTC dated September 20, 2014 issued by the Minister of Finance stipulating the collection, management, and use of fees for technical safety inspection and environmental protection for three-wheeled motorcycles and similar vehicles in circulation.

2. During the implementation process, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Finance for research and guidance./.

SERVICE PRICE LIST

TECHNICAL SAFETY INSPECTION AND ENVIRONMENTAL PROTECTION

FOR MOTOR VEHICLES, EQUIPMENT, AND SPECIALIZED MOTORCYCLES IN CIRCULATION; EVALUATION AND CALIBRATION OF VEHICLE TESTING EQUIPMENT

(Annexed to the Circular number 238/2016/TT-BTC dated November 11, 2016 issued by the Minister of Finance)

I. Service price levels for technical safety inspection and environmental protection for motor vehicles in circulation

1. Table 1:

Unit of measurement: 1,000 VND per vehicle

2. Motor vehicles that fail to meet the technical safety and environmental standards must undergo maintenance and repair before being re-inspected. The cost of re-inspection will be calculated as follows:

a) If the re-inspection is conducted on the same day (during working hours) as the first inspection, then: the first and second re-inspections are exempted; for re-inspections from the third time onwards, each re-inspection is charged at 50% of the price specified in Table 1.

b) If the re-inspection is conducted after one day but within seven days (excluding holidays according to the system) from the date of the first inspection, each re-inspection is charged at 50% of the price specified in Table 1.

c) If the re-inspection is conducted after seven days (excluding holidays according to the system) from the date of the first inspection, the inspection fee is calculated as if it were the first inspection.

3. Inspection of motor vehicles to issue a Certificate of Technical Safety and Environmental Protection (valid for up to 15 days) is charged at 100% of the price specified in Table 1.

4. Technical appraisal inspections and quality assessments upon request of organizations or individuals are charged at an agreed price but not exceeding three times the price specified in Table 1.

II. Fee levels for technical safety and environmental protection inspection services for equipment and specialized motorcycles in operation

2. Equipment and specialized motorcycles that fail to meet technical safety and environmental standards must be repaired and maintained for re-inspection of non-compliant items. The charges for subsequent inspections are calculated as follows:

a) If the re-inspection is conducted on the same day (during working hours) as the first inspection, then: the first and second re-inspections are exempted; for re-inspections from the third time onwards, each re-inspection is charged at 50% of the price specified in Table 2.

b) If the re-inspection is conducted after one day but within seven days (excluding holidays according to the system) from the date of the first inspection, each re-inspection is charged at 50% of the price specified in Table 2.

Note:c) If the re-inspection is conducted after seven days (excluding holidays according to the system) from the date of the first inspection, the inspection fee is calculated as if it were the first inspection. 3. In cases where there are other equipment and specialized motorcycles not specified in this pricing table, the relevant parties shall determine the specific inspection fees based on state regulations, ensuring harmonization of interests among all parties.

4. Technical appraisal inspections and quality assessments upon request of organizations or individuals are charged at an agreed price but not exceeding three times the price specified in Table 2.

III. Fee levels for technical safety and quality inspection services for motor vehicles and specialized motorcycles during renovation

IV. Level of service fees for evaluating and calibrating vehicle inspection equipment

2. In case the equipment does not meet the manufacturer's standards upon inspection, it must be repaired, calibrated, and re-evaluated and recalibrated, or if the inspection equipment suddenly malfunctions, it must be repaired and re-evaluated and recalibrated ahead of schedule. The cost of re-evaluation and recalibration shall be calculated according to the prescribed fee set forth in Table 4./.
