CIRCULAR

AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE REGULATIONS ON UNIVERSITY AND COLLEGE ENROLLMENT FOR FULL-TIME STUDENTS ISSUED TOGETHER WITH CIRCULAR NO. 09/2012/TT-BGDĐT OF THE MINISTER OF EDUCATION AND TRAINING ON MARCH 5, 2012

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; and Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government;

At the proposal of the Director of the Department of Testing and Quality Assurance,

The Minister of Education and Training issues this Circular Amending and Supplementing Certain Provisions of the Regulations on University and College Enrollment for Full-Time Students issued together with Circular No. 09/2012/TT-BGDĐT dated March 5, 2012 of the Minister of Education and Training.

Article 1. Amending and supplementing certain provisions of the Regulations on University and College Enrollment for Full-Time Students issued together with Circular No. 09/2012/TT-BGDĐT dated March 5, 2012 of the Minister of Education and Training as follows:

1. Point d, Clause 3, Article 9 is supplemented as follows:

"Organizing the reception and handling of information reflecting negative aspects during the examination period pursuant to Article 36a"

2. Point d, Clause 3, Article 25 is amended and supplemented as follows:

“d) Shall not bring weapons, explosives, flammable materials, beer, alcohol, carbon paper, erasers, study materials, communication devices, or any other items containing information that could be exploited for cheating during the examination process and marking process into the examination room.

e) Shall not smoke in the examination room.”

3. Amend Chapter V to read: HANDLING INFORMATION REFLECTING NEGATIVE ASPECTS DURING THE EXAMINATION PERIOD AND REPORTING AND RECORD KEEPING SYSTEMS

Chapter V

4. Add Article 36a before

"Article 36a: Article 37 as follows:

1. The place to receive information and evidence of violations of the enrollment regulations:

a) The National Steering Committee for Enrollment of the Ministry of Education and Training;

b) The Enrollment Boards of universities and colleges.

c) Examination inspection bodies at all levels.

2. Evidence of violations of the enrollment regulations, once verified for authenticity, shall serve as the basis for dealing with violators.

3. Providing information and evidence of violations of the enrollment regulations:

a) Encouraging candidates, those involved in the enrollment process, and the general public to detect and report violations of the enrollment regulations.

b) Those who discover violations of the enrollment regulations must promptly report them to the designated places as provided for in Sub-clause 1 of this Article so that appropriate measures can be taken.

c) Those who have evidence of violations of the enrollment regulations must submit such evidence to the designated places as provided for in Sub-clause 1 of this Article within seven days from the end of the examination day for processing.

d) Those providing information and evidence of violations of the enrollment regulations must bear legal responsibility for the authenticity of the information and evidence they provide, and must not abuse such actions to negatively impact the examination period.

4. For organizations and individuals receiving information and evidence of violations of the enrollment regulations:

b) Promptly implementing measures to prevent negative aspects and violations of the enrollment regulations based on the provided information.

a) Organize the receipt of information and evidence in accordance with regulations; protect the original state of evidence; verify the authenticity of the provided information and evidence.

c) Dealing with violators within their authority or reporting to competent authorities for handling and publicly announcing the results of the handling of individuals and organizations that violate the enrollment regulations.

d) Protecting the confidentiality of information and the identity of those providing information."

Clause 1, Article 39 is amended and supplemented as follows:

5. “1. The Chairperson of the National Steering Committee for Enrollment of the Ministry of Education and Training, and the Chairperson of the Enrollment Boards of universities and colleges shall commend or propose competent authorities to commend:

a) Those who have excellently completed assigned tasks;

b) Those who have made significant contributions to the examination period.”

Point b, Clause 3, Article 41 is amended as follows:

6. “b) Bringing prohibited items as specified in Point d, Clause 3, Article 25 into the examination room”

Directors of the Office, Heads of the Inspectorate, Directors of the Testing and Quality Assurance Department, Heads of the Higher Education Department, Heads of relevant units under the Ministry of Education and Training; Ministers of Ministries, Heads of ministerial-level agencies and agencies under the Government; Chairpersons of People's Committees of provinces and centrally-administered cities; Directors of provincial Departments of Education and Training; Directors of universities and academies; Principals of universities and colleges are responsible for implementing this Circular.

Article 2. This Circular takes effect from the date of signature. All previous regulations contrary to this Circular are abolished./.
