Amending and supplementing some articles of Circular No. 12/2011/TT-BTP dated June 27, 2011 of the Ministry of Justice on the issuance and guidance for recording, storing, and using adoption forms

Pursuant to the Law on Adoption dated June 17, 2010;

Pursuant to Decree No. 58/2013/NĐ-CP dated June 11, 2013

On the basis of Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Adoption Bureau,

The Minister of the Ministry of Justice issues this Circular to amend and supplement some articles of Circular No. 12/2011/TT-BTP dated June 27, 2011 of the Ministry of Justice on the issuance and guidance for recording, storing, and using adoption forms (hereinafter referred to as Circular No. 12/2011/TT-BTP) as follows:

Article 1. Amending and supplementing some articles of Circular No. 12/2011/TT-BTP

3. Article 8 shall be amended as follows:

"1. Issuing 27 types of adoption forms with symbols as specified in the list below:

2. The types of forms prescribed in Clause 1 of this Article shall be designed for printing or photocopying on A4 paper according to the models attached to this Circular.

The use of forms must comply with the format, content, and form prescribed in this Circular."

c) Form No. 09b: Permit for Vietnamese individuals residing abroad to perform artistic performances, fashion shows.

"1. The Department of Justice shall print and distribute forms from number 01 to number 02 in Section I of the list prescribed in Clause 1, Article 3 of this Circular. Form number 01 shall be printed in volumes of 100 pages and 200 pages.
2. The Ministry of Justice shall print and issue forms numbered from 03 to 04 in Section II of the list specified in Clause 1, Article 3 of this Circular.
3. Forms numbered from 02 to 04 in the list specified in Clause 1, Article 3 of this Circular shall be printed in color with decorative patterns.
4. Publishing on the Ministry of Justice's website (www.moj.gov.vn) 23 forms from number 05 to number 27 in Section III of the list prescribed in Clause 1, Article 3 of this Circular so that agencies, organizations, and individuals who need to use them can access the Ministry of Justice's website to print and use them free of charge. For areas without internet access conditions, the Department of Justice or the Justice Office shall organize printing and distribution of these forms free of charge to meet the needs of their localities."

3. Clause 2 of Article 5 is amended as follows:

"2. Form TP/CN-2014/CN.07.a, which records the opinion of the Director of the care facility regarding the adoption of a child, is used for both domestic and international adoptions."

4. Point c of Clause 3 of Article 6 is amended as follows:

"c) In cases of domestic adoption where the biological parents have agreed in writing with the adoptive parents about retaining certain rights and obligations towards the child after the adoption according to Clause 4, Article 24 of the Adoption Law, it must clearly state what rights and obligations the biological parents retain, and what rights and obligations the adoptive parents have among the rights and obligations of caring for, raising, providing maintenance, representing legally, compensating for damages, managing, and disposing of personal property of the adopted child."

5. Article 7 is supplemented as follows:

"7. The person recording the Register must clearly indicate whether the child adopted has normal health or special needs in the Remarks column."

Article 2. Effectiveness

This Circular takes effect from February 11, 2015.
