Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Electricity Law on December 3, 2004; the Law Amending and Supplementing Certain Provisions of the Electricity Law on November 20, 2012; lon the 20th day of November, 2012;

Pursuant to Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law; Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law, Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No.

At the proposal of the Minister of Industry and Trade;

The Prime Minister promulgates this Decision on the mechanism for adjusting the average retail electricity price level.

Article 1. Scope of Regulation and Applicability

1. This Decision stipulates the mechanism for adjusting the average retail electricity price level.

2. This Decision applies to organizations and individuals participating in the electricity sector and using electricity.

Article 2. Interpretation of Terms

In this Decision, the following terms shall be understood as follows:

1. Average electricity price is the average retail electricity price within the range of the average retail electricity price ceiling set by the Prime Minister.2. Current average electricity price is the average electricity price at the time of considering the adjustment of the electricity price.

3. Electricity purchase cost on the power market is the payment made to power generation units participating in the competitive power generation market according to the power market operation regulations issued by the Ministry of Industry and Trade, including the following items:

a) Market energy payment;councillORS b) Market capacity payment;

c) Payment under different types of power purchase contracts;

d) Other payments as stipulated in the Power Market Operation Regulations.

4. Price range is the interval between the minimum price and the maximum price of the average retail electricity price set by the Prime Minister.

5. Basic input parameters in the power generation stage are factors directly affecting power generation costs that power companies cannot control, including fuel prices, foreign exchange rates, production volume structure, and electricity purchase cost on the power market.

1. Annually, after reviewing the production and business cost of Vietnam Electricity Corporation, the average electricity price will be reviewed and adjusted based on the objective changes in input parameters of all stages (power generation, transmission, distribution-retail, dispatch-management of the industry and system ancillary services) compared to the parameters used to determine the current average electricity price.

2. During the year, the average electricity price will be reviewed and adjusted when basic input parameters in the power generation stage change significantly compared to those used to determine the current average electricity price.

Article 3. Principles for Adjusting the Average Retail Electricity Price

3. When the input parameters as prescribed in Clause 1 and Clause 2 of this Article change, causing the average electricity price to decrease compared to the current average electricity price, the electricity price will be adjusted downward.ru4. When the input parameters as prescribed in Clause 1 and Clause 2 of this Article change, causing the average electricity price to increase by 3% or more compared to the current average electricity price, the electricity price may be adjusted upward.

5. The minimum time for adjusting the average electricity price is six months from the last electricity price adjustment.No. đ6. Vietnam Electricity Corporation may adjust the average electricity price up or down within the price range set by the Prime Minister.âIf the calculated average electricity price exceeds the current average electricity price by 10% or more, or falls outside the price range, or affects the macroeconomic situation, the Ministry of Industry and Trade shall take the lead, coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments on the level of adjustment of the average electricity price. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Price Management Steering Committee before reporting to the Prime Minister.policiescompared to the information;No. that has been used;development to determine the current average electricity selling price.

3. When the input parameters as prescribed in Clause 1 and Clause 2 of this Article change, causing the average electricity selling price to decrease compared to the current average electricity selling price, the electricity price shall be adjusted downward.

4. When the input parameters as prescribed in Clause 1 and Clause 2 of this Article change, causing the average electricity selling price to increase by 3% or more compared to the current average electricity selling price, the electricity price may be adjusted upward.

5. The minimum time for adjusting the average electricity selling price is six months from the last electricity price adjustment.

6. The Vietnam Electricity Corporation is allowed to adjust the average electricity selling price up or down within the price range specified by the Prime Minister.

In case the calculated average electricity selling price is higher than the current average electricity selling price by 10% or more, outside the price range, or affecting the macroeconomic situation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments on the level of adjustment of the average electricity selling price. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Steering Committee for Price Management before reporting to the Prime Minister.N ||| declaration of customs import procedures. 3. In case the average electricity selling price needs to be adjusted upward by 3% to less than 5% compared to the current average electricity selling price and within the specified price range, the Vietnam Electricity Corporation shall decide to adjust the average electricity selling price upward at the corresponding level. 7. Adjustments to the average retail electricity price must be conducted openly and transparently.

Article 4. Method for Establishing the Annual Average Electricity Selling Price

1. The annual average electricity selling price is established annually based on the cost of purchasing electricity from power generation units, the standard costs and profits of each stage of electricity transmission, distribution - retail, system dispatching, and electricity market operation management, system ancillary service costs, and the general management costs of Vietnam Electricity Corporation to ensure operational capacity, electricity supply, and investment needs according to plans issued by competent state management agencies.No.2. The annual average electricity selling price (N) is determined according to the following formula:No.: Total power generation cost for year N (VND), calculated according to the following formula:

: Total electricity purchase cost for year N from direct and indirect power plants participating in the electricity market (VND);ofBQ: Total electricity purchase cost and standard profit for year N from multi-purpose hydropower plants (VND);

Where:

: Total cost of electricity purchase for the year (VND) from direct and indirect power plants participating in the electricity market, as specified in Clause 2 of this Article;= C: Total electricity purchase cost for year N from BOT power plants (VND);

CTTN: T, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP: Total electricity purchase cost for year N from imported electricity (VND);

Cfrom direct and indirect power plants participating in the electricity market (in dong), is determined according to the provisions of Clause 2 of this Article;: Total electricity purchase cost and standard profit for year N from power plants providing ancillary services, including trial run costs of power plants (VND);

CNK: T, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPTotal transmission service purchase cost and standard profit for year

Ca) CTotal distribution-retail service purchase cost and standard profit for year

c) CDVPT: Total general management cost and standard profit, only including costs directly serving electricity production and supply for year

c) CNo.: : Total system dispatching service purchase cost and electricity market operation management cost plus standard profit, including market regulation costs for year N ||| including costs of mobilizing customer-owned backup power sources to supplement national grid supply in emergency situations threatening serious disruption of power supply;

(VND) from power plants using renewable and new energy including storage systems, as specified in Clause 2 of this Article;PP-BL: Other total costs not included in the electricity price, including exchange rate differences not yet allocated, are included in the production and business cost of electricity for year N ||| including costs of mobilizing customer-owned backup power sources to supplement national grid supply in emergency situations threatening serious disruption of power supply;

(VND) from imported electricity, as specified in Clause 2 of this Article.) are determined according to the following formula:(VND) reviewed and decided annually by the Ministry of Industry and Trade and the Ministry of Finance; N ||| including costs of mobilizing customer-owned backup power sources to supplement national grid supply in emergency situations threatening serious disruption of power supply;

a) Power plant production volume: as stipulated in Article 3 of this Circular;) is the total allowable dispatching and operation revenue for the System Operation Unit and the electricity market in year(VND/kWh), determined based on the annual electricity supply plan and system operation plan issued by the Ministry of Industry and Trade. N ||| including costs of mobilizing customer-owned backup power sources to supplement national grid supply in emergency situations threatening serious disruption of power supply;

g) Ck3. The cost of purchasing electricity from power generation units is implemented according to the electricity market operation regulations at each level issued by the Ministry of Industry and Trade and the Power Purchase Agreement signed between the power generation unit and the electricity buyer.: 4. The cost of purchasing transmission services, distribution-retail services, general management costs, system dispatching service purchase costs, and electricity market operation management costs are determined based on the costs and standard profits of each stage of electricity transmission, distribution-retail, system dispatching, and electricity market operation management, system ancillary service costs, and general management costs of Vietnam Electricity Corporation as prescribed by the Ministry of Industry and Trade. N ||| Article 5. Mechanism for Adjusting the Annual Average Electricity Selling Price

(kWh).TP3. Costs of purchasing electricity from the electricity seller shall be carried out in accordance with the rules of electricity market operations at each level issued by the Ministry of Industry and Trade and the Power Purchase Agreement signed between the electricity seller and the electricity buyer. N ||| 1. Based on the annual electricity supply plan and system operation plan issued by the Ministry of Industry and Trade and the results of the previous year's electricity production and business cost audit as stipulated in Article 7 of this Decision, Vietnam Electricity Corporation calculates the annual average electricity selling price according to the formula specified in Clause 2 of Article 4 of this Decision.

2. In cases where the annual average electricity selling price decreases compared to the current annual average electricity selling price and within the price range, Vietnam Electricity Corporation is responsible for reducing the annual average electricity selling price accordingly, preparing a report to submit to the Ministry of Industry and Trade and the Ministry of Finance for review and supervision.

3. In cases where the annual average electricity selling price needs to be increased by 3% to less than 5% compared to the current annual average electricity selling price and within the price range, Vietnam Electricity Corporation decides to increase the annual average electricity selling price accordingly. After the increase, Vietnam Electricity Corporation prepares a report to submit to the Ministry of Industry and Trade and the Ministry of Finance for review and supervision. l4. In cases where the annual average electricity selling price needs to be increased by 5% to less than 10% compared to the current annual average electricity selling price and within the price range, Vietnam Electricity Corporation is permitted to increase the annual average electricity selling price accordingly after reporting and obtaining approval from the Ministry of Industry and Trade. Within 15 working days, the Ministry of Industry and Trade has the responsibility to respond in writing for Vietnam Electricity Corporation to implement. After implementing the adjustment, Vietnam Electricity Corporation is responsible for reporting to the Ministry of Industry and Trade and the Ministry of Finance.

5. In cases where the annual average electricity selling price needs to be increased by 10% or more compared to the current annual average electricity selling price or adjusted outside the price range or affecting macroeconomic conditions, based on the pricing plan proposal submitted by Vietnam Electricity Corporation, the Ministry of Industry and Trade takes the lead, coordinates with the Ministry of Finance to review and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade coordinates with the Ministry of Finance to report to the Price Management Steering Committee before reporting to the Prime Minister.

1. Before the first day of the second, third, and fourth quarters, based on the basic input data in the power generation stage of the previous quarter, Vietnam Electricity Corporation determines the power generation cost of the previous quarter, cumulative power generation cost from the beginning of the year, actual electricity sales volume of the previous quarter, cumulative total electricity sales volume, estimated remaining monthly electricity sales volume for the year, recalculates the annual average electricity selling price according to the formula specified in Clause 2 of Article 4 of this Decision (other parameters remain unchanged).

2. In cases where the recalculated annual average electricity selling price is lower than the current annual average electricity selling price and within the price range, Vietnam Electricity Corporation is responsible for reducing the annual average electricity selling price accordingly, preparing a report to submit to the Ministry of Industry and Trade and the Ministry of Finance for review and supervision.

4. In case the average electricity selling price needs to be adjusted upward by 5% to less than 10% compared to the current average electricity selling price and within the specified price range, the Vietnam Electricity Corporation is permitted to adjust the average electricity selling price upward at the corresponding level after reporting and obtaining approval from the Ministry of Industry and Trade. Within fifteen working days, the Ministry of Industry and Trade shall have the responsibility to reply in writing to allow the Vietnam Electricity Corporation to implement. After implementing the adjustment, the Vietnam Electricity Corporation shall have the responsibility to report to the Ministry of Industry and Trade, the Ministry of Finance.

5. In case the average electricity selling price needs to be adjusted upward by 10% or more compared to the current average electricity selling price or adjusted outside the specified price range or affecting the macroeconomic situation, based on the electricity pricing plan submitted by the Vietnam Electricity Corporation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Steering Committee for Price Management before reporting to the Prime Minister.

1. Before the 25th day of the first month of the second, third, and fourth quarters, based on the consolidation of basic input parameters in the power generation stage of the previous quarter, the Vietnam Electricity Corporation shall determine the power generation cost of the previous quarter, the cumulative power generation cost from the beginning of the year, the actual power sales volume of the previous quarter, the total cumulative power sales volume, the estimated power sales volume for the remaining months of the year, and recalculate the average electricity selling price according to the formula prescribed in Clause 2 of Article 4 of this Decision (other parameters remain unchanged).

1. Before the first day of the second, third, and fourth quarters, Vietnam Electricity Group shall determine the actual electricity sales volume of the previous quarter and the cumulative electricity sales volume from the beginning of the year; estimate the remaining monthly electricity sales volume for the year; determine the generation cost of the immediately preceding quarter and the cumulative generation cost from the beginning of the year (including the cost of purchasing electricity from auxiliary service providers); estimate the generation cost for the remaining months of the year based on basic input parameters in the generation stage; update other costs not included in the electricity price for recalculating the annual average electricity selling price according to the formula prescribed in Clause 2, Article 4 of this Decision (other parameters remain unchanged); and comply with the requirements for documentation as stipulated in Clause 2 of this Article:

2. In case, after recalculating and updating, the recalculated average electricity selling price is lower than the current average electricity selling price and within the price range, the Vietnam Electricity Corporation shall be responsible for adjusting the average electricity selling price downward at the corresponding level, prepare a report to the Ministry of Industry and Trade and the Ministry of Finance for verification and supervision.No. 3. In case, after recalculating and updating, the average electricity selling price needs to be adjusted upward by more than 10% compared to the current average electricity selling price, outside the price range, or affecting the macroeconomic situation, based on the electricity pricing plan submitted by the Vietnam Electricity Corporation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Steering Committee for Price Management before reporting to the Prime Minister.onsive con4. 3. In case the recalculated average electricity selling price needs to be increased by more than 3% but less than 5% compared to the current average electricity selling price and within the prescribed price range, Vietnam Electricity Corporation shall decide to increase the average electricity selling price at the corresponding level. ənAfter the price increase, Vietnam Electricity Corporation shall prepare a report for the Ministry of Industry and Trade and the Ministry of Finance for inspection and supervision.

4. In case the recalculated average electricity selling price needs to be increased by more than 5% but less than 10% compared to the current average electricity selling price and within the prescribed price range, Vietnam Electricity Corporation is permitted to adjust the average electricity selling price at the corresponding level after reporting and obtaining approval from the Ministry of Industry and Trade. Within 15 working days, the Ministry of Industry and Trade shall have the responsibility to respond in writing to Vietnam Electricity Corporation to implement the adjustment. After implementing the adjustment, Vietnam Electricity Corporation shall be responsible for reporting to the Ministry of Industry and Trade and the Ministry of Finance.5. In case the recalculated average electricity selling price needs to be increased by 10% or more compared to the current average electricity selling price, or outside the prescribed price range, or affecting the macroeconomic situation, based on the electricity pricing plan submitted by Vietnam Electricity Corporation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to inspect, review, and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Price Control Steering Committee before reporting to the Prime Minister.amendelling price at the corresponding level after reporting and obtaining approval from the Ministry of Industry and Trade. Within fifteen working days, the Ministry of Industry and Trade shall have the responsibility to reply in writing to allow the Vietnam Electricity Corporation to implement. In case, after recalculating and updating, the average electricity selling price needs to be adjusted upward by 10% or more compared to the current average electricity selling price, outside the price range, or affecting the macroeconomic situation, based on the electricity pricing plan submitted by the Vietnam Electricity Corporation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Steering Committee for Price Management before reporting to the Prime Minister.development 6. In case, after recalculating and updating, the average electricity selling price needs to be adjusted upward by 10% or more compared to the current average electricity selling price, outside the price range, or affecting the macroeconomic situation, based on the electricity pricing plan submitted by the Vietnam Electricity Corporation, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to review and report to the Prime Minister for consideration and comments. If necessary, the Ministry of Industry and Trade shall coordinate with the Ministry of Finance to report to the Steering Committee for Price Management before reporting to the Prime Minister.

c) In case any errors are found in the calculation results of the electricity price, the Ministry of Industry and Trade shall have the responsibility to request the Vietnam Electricity Corporation to stop the adjustment or adjust the average electricity selling price again.ì- The Secretariat of the Politburo;- Central agencies of mass organizations;

Article 7. Inspection and Supervision

1. Annual inspection of production and business costs for electricity

a) Annually, after receiving the final cost report of production and business activities for electricity, the financial statements of Vietnam Electricity Corporation and its subsidiaries that have been audited independently, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance to inspect the production and business costs of electricity of the previous year. During the inspection process, the Central Committee of the Vietnam Fatherland Front, the Vietnam Chamber of Commerce and Industry, relevant associations, and related state management agencies may be invited to participate. The Ministry of Industry and Trade may invite independent consultants to audit the final cost report of production and business activities for electricity and the financial statements of Vietnam Electricity Corporation and its subsidiaries;

b) Within 30 days after the end of the inspection, the Ministry of Industry and Trade shall convene a press conference to publicly announce the inspection results. The inspection results shall be publicly announced on the Ministry of Industry and Trade's electronic information website and the Electricity Regulatory Authority; đ"3. A pumped-storage hydropower plant is a hydropower plant that uses water storage systems at different elevation levels to store hydro energy and generate electricity, where water is pumped from low-elevation storage areas to higher-elevation storage areas during non-generation periods to store hydro energy and released through turbines to generate electricity when the power system requires it."

c) The contents of inspection, supervision, and public announcement include:

- Actual costs of power generation, transmission, distribution-retail, general management, system ancillary services, and other costs as stipulated in Clause 2 of Article 4 of this Decision;

- - Profit and loss results of Vietnam Electricity Corporation;

- Costs included in the production and business cost structure of Vietnam Electricity Corporation;

- Costs not included in the production and business cost structure of Vietnam Electricity Corporation.

d) Other costs include exchange rate differences re-evaluated but not included in the electricity cost in previous years, which now need to be included in the production and business cost structure and must be audited by an independent auditor and reported separately as the basis for inspection and supervision.developmentPMO, Director of the Government Portal, Departments, Bureaus, subordinate units, Official Gazette;

2. Electricity price adjustment inspection

a) In case Vietnam Electricity Corporation decides to adjust the average electricity selling price according to Clause 2, Clause 3 of Article 5 and Clause 2, Clause 3 of Article 6 of this Decision, or in case Vietnam Electricity Corporation submits to the Ministry of Industry and Trade and the Ministry of Finance the electricity pricing plan according to Clause 5 of Article 5 and Clause 5 of Article 6 of this Decision, the Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Finance and related units to examine and check the reports and calculations of Vietnam Electricity Corporation;

b) In case the average electricity selling price needs to be reduced but Vietnam Electricity Corporation does not reduce it, the Ministry of Industry and Trade shall have the responsibility to require Vietnam Electricity Corporation to reduce the average electricity selling price;ìc) If errors are found in the electricity pricing calculation results, the Ministry of Industry and Trade shall have the responsibility to require Vietnam Electricity Corporation to stop adjusting or adjust the average electricity selling price again.

- To be filed: VT, K.TTH (3b).policiesIf the Ministry of Industry and Trade discovers errors in the calculation results for electricity prices, it has the responsibility to request Vietnam Electricity to stop the adjustment or to adjust again the average selling price of electricity.

Violations of the regulations on adjusting and calculating the average electricity selling price as stipulated in Point b and Point c of Clause 2 of Article 7 of this Decision shall be handled according to the provisions of Decree No. 109/2013/ND-CP dated September 24, 2013 of the Government on administrative penalties for violations in price, fee, and invoice management, and Decree No. 49/2016/ND-CP dated May 27, 2016 of the Government amending and supplementing some articles of Decree No. 109/2013/ND-CP dated September 24, 2013 of the Government, or any replacing legal documents (if any).

Article 8. Implementation organization

1. The Ministry of Industry and Trade shall be responsible for:

a) Guiding the Vietnam Electricity Corporation to calculate the average retail electricity price according to Article 4 of this Decision;

b) Implementing the adjustment of electricity prices according to Articles 5 and 6 of this Decision;

c) To take the lead in inspecting and supervising according to the provisions of Article 7 of this Decision.

2. The Ministry of Finance shall be responsible for coordinating with the Ministry of Industry and Trade to implement this Decision.

3. Vietnam Electricity Corporation shall be responsible for calculating the average electricity selling price, adjusting the average electricity selling price, and reporting according to the provisions of Articles 4, 5, 6, and 7 of this Decision.

Article 9. Effective Date

1. This Decision takes effect from August 15, 2017, replacing Decision No. 69/2013/QĐ-TTg dated November 19, 2013 of the Prime Minister on the mechanism for adjusting the average retail electricity price.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees under central city administrations, Vietnam Electricity Corporation, and organizations and individuals concerned shall be responsible for implementing this Decision./. l- Central Party Committee;
