RESOLUTION
ON SOME SPECIAL AND SUPERIOR MECHANISMS AND POLICIES TO ACHIEVE BREAKTHROUGH DEVELOPMENT IN EDUCATION AND TRAINING
OF THE NATIONAL ASSEMBLY
WHEREAS,ứ The Constitution of the Socialist Republic of Vietnam has been amended and supplemented with some articles pursuant to Resolution No. 203/2025/QH15;
WHEREAS,ứ Law on Organization of the National Assembly No. 57/2014/QH13 has been amended and supplemented with some articles pursuant to Law No. 65/2020/QH14 and Law No. 62/2025/QH15;
WHEREAS,ứ Law on Enacting Legal Normative Documents number 64/2025/QH15 has been amended and supplemented with some articles according to Law number 87/2025/QH15;
RESOLUTION:
Article 1. Scope of Regulation and Applicability
1. This Resolution stipulates some special and superior mechanisms and policies to achieve breakthrough development in education and training.
2. This Resolution applies to educational institutions within the national education system, relevant organizations, and individuals.
Article 2. Development of Human Resources in the Education Sector
1. The recruitment, utilization, and management mechanisms for human resources in the education sector are regulated as follows:
a) The Director of the Department of Education and Training has the authority to recruit and accept teachers, managers of educational institutions, and staff in public preschool, primary, secondary, and vocational schools, and specialized schools on the provincial territory; implement the authority to transfer, reassign, detail, appoint, and change job positions for teachers, managers of educational institutions, and staff in public educational institutions under their management and related public educational institutions covering two or more administrative units at the commune level within the province;
b) The Chairman of the People's Committee at the commune level has the authority to transfer, reassign, detail, appoint, dismiss, and change job positions for teachers, managers of educational institutions, and staff in public educational institutions under their management;
c) Vocational education and higher education institutions have autonomy to determine job positions, recruit, and enter into labor contracts with foreign experts and scientists holding doctoral degrees according to internal regulations of the unit; decide and bear responsibility for recruiting foreign experts and scientists without work permits for up to three years to perform teaching and scientific research tasks.
2. Special and superior incentive policies for human resources in the education sector are regulated as follows:
a) Professional allowances are implemented according to the roadmap prescribed by the Government for public preschool and primary-secondary schools, with a minimum of 70% for teachers, 30% for staff, and 100% for teachers working in border areas, islands, ethnic minority regions, mountainous areas, and areas with extremely difficult socio-economic conditions;
b) Vocational education and higher education institutions have autonomy to decide additional income for teachers, civil servants, and workers from legitimate sources outside the state budget, in accordance with internal financial regulations and the performance of the unit.
Article 3. Development of Educational Programs
1. The Minister of Education and Training decides on a unified set of textbooks for general education to be used nationwide starting from the 2026-2027 academic year; by 2030, complete the provision of free textbooks for students, prioritizing border areas, islands, ethnic minority regions, mountainous areas, and areas with extremely difficult socio-economic conditions.
The State ensures resources to waive tuition fees and textbooks for the National Defense and Security Education course at vocational and higher education institutions according to the roadmap prescribed by the Government, in line with the state budget balance capacity and relevant laws.
2. Educational institutions can cooperate with scientific and technological organizations, research institutes, businesses, and other organizations to implement educational programs or training programs linked to labor market demands, scientific research, and innovation.
Article 4. Digital Transformation and International Cooperation
1. The State prioritizes investment in building a national database on education and training, digital infrastructure, and shared platforms. By 2030, all higher education institutions will complete synchronized digital infrastructure and platforms, interconnected and interoperable. Encourage businesses to invest in developing digital educational products and services through public-private partnerships.
2. Vocational education and higher education institutions, scientific and technological organizations can independently organize international conferences and seminars and notify the direct supervisory agency before organizing such events in fields such as mathematics and statistics, computer science and information technology, engineering technology, engineering, natural sciences, life sciences, environmental sciences, environment protection, economics, business management, production and processing, architecture and construction, agriculture, forestry, fisheries, veterinary medicine, health, education science and teacher training, transportation services, and international conferences and seminars addressing urgent tasks as required, directed, or commissioned by the Party, National Assembly, Government, Ministries, and sectors.
In cases where international conferences and seminars involve participants at the ministerial level or above from countries, territories, or international organizations; or if the topics and contents relate to issues of borders, territories, national sovereignty, defense, security, ethnicity, religion, human rights, or matters classified as state secrets, they shall be organized in accordance with the Prime Minister's regulations and laws on protecting state secrets.
3. The Minister of Education and Training decides to establish branch offices or public higher education institutions of Vietnam abroad based on approved proposals by the direct supervisory agency, in compliance with the laws of the host country. The organization of training, issuance, or joint issuance of diplomas is carried out according to the proposal content and the laws of the host country.
Article 5. Support for Students and High-Level Human Resource Training
1. Students have access to preferential policy loans from the Social Policy Bank to cover study and living expenses in accordance with the law.
The Government shall examine and submit to the competent authority for priority consideration of additional funding mechanisms for the Social Policy Bank to implement credit policies for students at the Social Policy Bank in accordance with the provisions of the law.
2. The Government shall stipulate the national key program for full-time doctoral training. Research fellows participating in the key program under state orders and assignments, linked to national priority science and technology tasks, shall be granted scholarships and living expense support.
3. The support policy for education and training in special fields within the arts and high-performance sports sectors shall be regulated as follows:
a) Early identification, selection, and nurturing of talent through a continuous pathway between educational levels and training degrees; linking training with national achievements and international integration needs; developing high-quality human resources for traditional arts.
b) The Ministry of Culture, Sports and Tourism shall implement a mechanism for assigning long-term training tasks and placing orders for institutions of education and training that offer special fields within the arts and high-performance sports sectors; allowing the inclusion of specific costs into the unit price of orders according to regulations.
c) Vocational education and higher education institutions that train special fields within the arts and high-performance sports sectors may enter into contracts to perform specialized tasks with artisans, artists, and coaches; funding for payments under these contracts, job-related allowances, and other expenses for tasks as prescribed shall be guaranteed from the state budget and other lawful sources of income of the training institution; individuals entering into such contracts shall be allowed to participate in professional training and seminars as provided by law.
Article 6. Investment incentives for education and training
1. The People's Council of a province shall decide on supplementing mid-term investment projects in the field of education and training and supplementing land use plans already approved without waiting for the next adjustment period. The procedures and formalities for changing land use purposes, allocating land, and leasing land for these projects shall be carried out according to simplified procedures prescribed by the Government.
2. The People's Committee of a province shall have the responsibility to prioritize allocating sufficient land funds for educational and training institutions within provincial planning and provincial land use planning; prioritizing allocation of land funds from surplus state-owned agency and organization premises to attract investment projects in the field of education and training; allowing organizations and individuals to lease surplus state-owned premises and facilities for educational and training activities.
3. Permission is granted to convert residential land, land for building administrative offices and public works that are not educational facilities, agricultural production and non-agricultural business land to educational and training purposes without being based on land use planning and land use plans.
4. The State shall ensure a minimum expenditure of 20% of the total state budget for education and training; allocate budgets from increased revenue for education and training development, prioritizing border areas, islands, ethnic minority regions, mountainous areas, and regions with particularly difficult economic and social conditions.
Article 7. Handling of transitional content upon termination of school council operations at public educational institutions
1. Within six months from the date of termination of the school council's operation, the direct management agency of kindergartens, primary schools, secondary schools, vocational education institutions, and public higher education institutions (hereinafter referred to as educational institutions) shall decide on management and operational tasks previously handled by the school council related to organizational work and personnel; base decisions on the criteria and conditions for the heads of educational institutions prescribed by the Minister of Education and Training to appoint the head of the institution.
2. The direct management agency of the educational institution shall determine the number of deputy positions for the head during the personnel restructuring phase; allow more than the maximum number of deputies prescribed by law for five years from the date of termination of the school council's operation and develop a plan to gradually reduce the number in accordance with the law.
Article 8. Implementation Organization
1. The Government shall guide the implementation of this Resolution; annually report to the National Assembly on the results of implementing this Resolution in the Report on Educational Activities and the Implementation of the Education Budget.
2. The Ministry of Education and Training shall be the lead agency, responsible to the Government; take the lead and coordinate with ministries, ministerial-level agencies, government agencies, provincial people's committees to guide, monitor, urge, inspect, summarize, and evaluate the implementation of this Resolution.
3. The National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of the National Assembly, National Assembly deputies, People's Councils, Committees of People's Councils, People's Council deputies, the Vietnam Fatherland Front, within their respective duties and powers, supervise the implementation of this Resolution.
Article 9. Implementation Provisions
1. This Resolution shall take effect from January 1, 2026.
2. In cases where there are different provisions on the same issue between this Resolution and other laws or resolutions of the National Assembly, the provisions of this Resolution shall apply, except as provided in Clause 3 of this Article.
3. In cases where subsequent documents issued by the National Assembly provide more favorable mechanisms or policies than those stipulated in this Resolution, such mechanisms or policies shall be applied.
RESOLUTIONThis Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the 15th term, the 10th session, on December 10, 2025.
