CIRCULAR
Guidelines for the process of establishing, auditing, and finalizing accounts for funding to support demobilized soldiers in vocational training according to Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister Implementing Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister on the operational mechanism of vocational training centers under the Ministry of National Defense and policies supporting demobilized soldiers in vocational training;

Pursuant to Decision No. 257/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating regulations on frequency band allocation for economic and social purposes, national defense, and security;
The Ministry of National Defense hereby issues guidelines for the process of establishing, auditing, and finalizing accounts for funding to support demobilized soldiers in vocational training according to Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister as follows:
This Circular guides the process of establishing, auditing, and finalizing accounts for funding to support demobilized soldiers in vocational training according to Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister.
Article 1. Scope of Regulation
1. Vocational training centers within and outside the military that meet the conditions to provide primary level vocational training for demobilized soldiers;
Article 2. Applicability
2. Vocational training centers within the military that are assigned targets for intermediate and higher level vocational training for demobilized soldiers by the Commander-in-Chief of the General Staff;
3. Demobilized soldiers who wish to participate in vocational training and meet the admission criteria for primary, intermediate, or higher level vocational training.
Article 3. Content and Amount of Funding for Vocational Training for Demobilized Soldiers
The content and amount of funding for vocational training for demobilized soldiers shall be implemented in accordance with Circular No. 245/2010/TT-BQP dated December 20, 2010 of the Ministry of National Defense regarding the establishment of cost standards for vocational training at three levels for demobilized soldiers participating in vocational training according to Decision No. 121.
Article 4. Process of Establishing, Auditing, and Finalizing Accounts for Funding
a) Annually, based on the vocational training targets assigned by the Commander-in-Chief of the General Staff, the number of demobilized soldiers registered for vocational training, and the standard, quota, and value of the vocational training card, vocational training centers shall prepare a budget for funding to support demobilized soldiers in vocational training (according to Table 1 attached to this Circular) and submit it to the immediate superior financial authority (for vocational training centers outside the military, submit to the Provincial Military Command), up to the Financial Department of the Ministry of National Defense for consolidation and submission to the Ministry and the Ministry of Finance in accordance with the State Budget Law.
1. Establishment of budget projections:
b) Based on the decision to open classes issued by the competent authority (accompanied by a list of students with confirmation from the same-level military authority) and the cost standards for vocational training set by the Ministry of National Defense at the time of class opening, vocational training centers shall prepare a budget for funding to support demobilized soldiers in vocational training (according to Table 2 attached to this Circular) and submit it to the immediate superior financial authority (for vocational training centers outside the military, submit to the Provincial Military Command), up to the Financial Department of the Ministry of National Defense; the Financial Department of the Ministry of National Defense shall consolidate and coordinate with relevant agencies to review the budget and ensure funding in accordance with regulations.
2.1. For demobilized soldiers undergoing short-term vocational training (Vocational Training Card)
2. Payment documents.
Upon completion of the course, vocational training centers shall prepare a report summarizing the finalization of funding for supporting demobilized soldiers in vocational training (according to Table 3 attached to this Circular) and simultaneously submit the following documents:
- Discharge Order (certified copy);
- Identity Card (certified copy);
- "Vocational Training Card": Original stamped with "COMPLETED";
- Class Opening Order (copy) accompanied by a list of students with the Card;
- Graduation Recognition Order for students.
2.2. For demobilized soldiers undergoing College and Intermediate Vocational Training
Before December 31 each year or upon completion of the course, vocational training centers shall prepare a report summarizing the finalization of funding for supporting demobilized soldiers in vocational training (according to Table 3 attached to this Circular) and simultaneously submit the following documents:
- Discharge Order (certified copy);
- Identity Card (certified copy);
- Military Personnel Record (certified copy);
- Class Opening Order (copy) accompanied by a list of students;
- Upon completion of the course, submit the Graduation Recognition Order for students.
3. Payment Method
a) Vocational training centers shall submit all required documents stipulated in Clause 2 of this Article to the immediate superior financial authority (for vocational training centers outside the military, submit to the Provincial Military Command) up to the Financial Department of the Ministry of National Defense.
b) Funding for vocational training will be paid to vocational training centers in accordance with the cost standards for vocational training stipulated in Circular No. 245/2010/TT-BQP dated December 20, 2010 of the Ministry of National Defense.
In cases where the cost standards for short-term vocational training are higher than the value of the Card, the student shall pay the difference to the vocational training center themselves; in cases where the cost standards for short-term vocational training are lower than the value of the Card, the student will not be reimbursed for the difference in costs.
c) In cases where the student cannot fully participate in the entire course and does not meet the criteria for graduation certification or vocational certificate as prescribed, the vocational training center will be reimbursed 50% of the cost standards for vocational training (payment documents as stipulated in Clause 2 of this Article, except for the graduation recognition order).
The Financial Department of the Ministry of National Defense shall examine and confirm the finalization of accounts in accordance with current procedures and regulations; consolidate and report to the Ministry and the Ministry of Finance for approval by the Government.
4. Settlement
The source of funding for supporting demobilized soldiers in vocational training stipulated in this Circular shall be allocated in the annual state budget of the Ministry of National Defense and recorded under Category 490 Item 498 Sub-item 7000 Sub-sub-item 7049 Sub-sub-sub-item 00 Sector 00 "Vocational Training Cards for Demobilized Soldiers" in the national budget classification system applicable in the military.
Article 5. Source of Funds
During implementation, if there are any difficulties, units shall reflect them to the Ministry of National Defense (through the Financial Department of the Ministry of National Defense) for consideration and resolution./.
Article 6. Implementation Organization
This Circular takes effect from the date of issuance.
