Strengthening Inspection and Rectifying Vehicle Technical Inspection Work

for Road Motor Vehicles

Implementing Decree No. 36/CP dated May 29, 1995, Decree Amending and Supplementing No. 75/1998/NĐ-CP dated September 26, 1998, and Decree No. 36/2001/NĐ-CP dated July 10, 2001 of the Government on Ensuring Traffic Order and Safety on Roads and Urban Traffic Order, the Ministry of Transport has issued standards and regulations on regular safety technical inspection and environmental protection for road motor vehicles (referred to as inspection), applicable at all Inspection Stations. After more than seven years of implementation, the network of units engaged in inspection work has continuously developed, with 79 Inspection Stations nationwide equipped with 93 inspection lines, all Inspection Stations having been mechanized, contributing to improving the quality of inspections.

Through inspection, it was found that the Vietnam Vehicle Inspection Agency, Departments of Transport, Departments of Transport and Public Works (Transport, Public Works), and Inspection Stations have generally complied with the regulations on inspection work, thereby reducing accidents caused by technical reasons involving road motor vehicles. However, through inspection, some shortcomings in inspection work were also identified, such as some Station Chiefs, Inspectors, and Technical Staff not meeting the standards set out in Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998 of the Minister of Transport; Inspectors and Technical Staff not fully implementing the inspection standards and procedures; in isolated cases, Inspectors have altered inspection results, and the quality of inspections has not been guaranteed.

To strengthen the enforcement of the Road Traffic Law in inspection work and rectify organization and thoroughly address the aforementioned shortcomings, the Minister of Transport instructs:

1. Entrust subordinate agencies, based on their functions and responsibilities, to review all regulatory legal documents issued by the Ministry, promptly advise the Ministry to supplement and adjust the provisions and guidelines for implementing the Road Traffic Law, serving inspection work. Any document lacking must be drafted immediately for issuance and application from February 1, 2003.

The Vietnam Vehicle Inspection Agency shall take the lead and coordinate with relevant agencies to complete the draft Decree on eliminating passenger and cargo transport vehicles that have exceeded their service life by January 2003 for submission to the Government for promulgation.

2. Entrust the Vietnam Vehicle Inspection Agency to take the lead and coordinate with Provincial Departments of Transport (Public Works) to organize a review of all cases where Station Chiefs, Inspectors, and Technical Staff do not meet the standards set out in Decision No. 1643/1998/QĐ-BGTVT of the Ministry of Transport, and send them for supplementary training and strictly handle them according to Decision No. 3165/2002/QĐ-BGTVT dated October 2, 2002 of the Ministry of Transport, aiming to improve their professional, technical, and moral qualities. Strictly prohibit assigning personnel who do not meet the Ministry's regulations to perform inspection work.

The Vietnam Vehicle Inspection Agency will continue to provide training for Inspectors and Technical Staff working at Inspection Stations to meet the training requirements of Inspection Stations nationwide.

The Vietnam Vehicle Inspection Agency will cooperate with the Vietnam Highway Administration and mass media, industry newspapers, to intensify publicity and education for vehicle owners and drivers when bringing their vehicles for inspection, making them aware of their responsibilities and strictly adhering to regulations on vehicle maintenance, repair, and technical upkeep between inspections as stipulated in Clause 5, Article 50 of the Road Traffic Law.

Provincial People's Committees shall continue to create conditions for investment in modern equipment to serve inspection work, thereby enhancing inspection quality, while directing subordinate agencies to strengthen supervision and inspection of Inspection Stations under local management in performing assigned functions and tasks.

Departments of Transport (Public Works) shall be responsible before the Chairmen of Provincial People's Committees and the Minister of Transport for activities of Inspection Stations under their management. In personnel appointment and recruitment for inspection work (Station Chiefs, Deputy Station Chiefs, Inspectors, Technical Staff), they must comply with the standards for inspection staff established by the Ministry of Transport.

4. Inspection Stations must meet the standards set forth in 22 TCN-226-01, Standards for Inspection Stations for Road Motor Vehicles, issued together with Decision No. 4135/2001/QĐ-BGTVT dated December 5, 2001 of the Minister of Transport.

Station Chiefs, Inspectors, and Technical Staff must fully implement all items specified in the inspection procedures and adhere to the inspection standards set out in Decision No. 4105/2001/QĐ-BGTVT dated December 4, 2001, Decision No. 4134/2001/QĐ-BGTVT dated December 5, 2001, and Decision No. 4368/2001/QĐ-BGTVT dated December 19, 2001 of the Minister of Transport.

Inspection Stations shall regularly organize training sessions on relevant standards, procedures, regulations related to inspection work, and guiding legal documents for implementing the Road Traffic Law, aiming to enhance the professional and technical skills of each Inspector and Technical Staff.

Each staff member, Inspector, and Technical Staff must have an action program and commitment to eliminate corruption within their unit.

Station Chiefs of Inspection Stations shall be responsible to higher authorities and the law for violations occurring at Inspection Stations under their management.

6. Entrust the Legal Affairs Department - Transportation to take the lead in preparing necessary contents for the Ministry of Transport to work with the Ministry of Public Security on coordinating state management of road traffic as stipulated in Article 69 of the Road Traffic Law.

7. Direct relevant functional agencies of the Ministry, the Vietnam Motor Vehicle Registration Agency, and the Department of Transport (Transportation Control Center) to strengthen inspection and supervision activities, either regularly or unexpectedly, of certification activities, and to strictly and promptly handle, within their authority, acts of corruption and violations of regulations.

Heads of subordinate agencies and units under the Ministry, Directors of the Departments of Transport (Transportation Control Center), within the scope of their duties and powers, shall immediately organize the implementation of this Directive and report the results in writing to the Ministry of Transport before January 30, 2003 (through the Ministry's Inspectorate for consolidation)./
