THE MINISTER OF TRANSPORTATION

Considering the proposal of the Head of the Cadre and Civil Service Department,

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 209/2004/NĐ-CP dated December 16, 2004 of the Government on Quality Management of Construction Projects;

Pursuant to Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on Managing Investment Projects for Construction Works;

Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on State Management of Product and Goods Quality;

At the proposal of the Director of the Science and Technology Department,

DECISION:

Article 1.

Issued together with this Decision are the "Regulations on the Application of Standards in Road Construction Projects"

Article 2.

This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3.

The Head of the Office, the Inspector General of the Ministry, the Directors of the Science and Technology Department, the Planning and Investment Department, the Inspection and Quality Control Bureau for Road Construction Projects, the Heads of specialized management Bureaus under the Ministry of Transport, the General Managers of Project Management Boards, the Directors of Provincial Departments of Transport and Public Works, the Heads of organizations and individuals related to these matters are responsible for implementing this Decision./.

REGULATIONS

On the Application of Standards in Road Construction Projects

PART I

General Provisions

Article 1. Scope of Regulation and Applicability

Article 1: These regulations stipulate the actions to be taken when applying standards (including technical specifications, procedures, norms, etc., hereinafter referred to collectively as standards) in the construction of road projects to meet the requirements of Decree No. 209/2004/NĐ-CP dated December 16, 2004 of the Government on Quality Management of Construction Projects, Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on Project Management for Investment Construction Projects, Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on State Management of Product and Goods Quality, and other relevant legal documents concerning investment and construction.herein shall be collectively referred to as the standardin the construction of transportation works to meet the requirements of Decree No. 209/2004/NĐ-CP dated December 16, 2004 of the Government on the management of construction project quality, Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on the management of investment construction projects, Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government stipulating state management over product and commodity quality, and other relevant regulatory documents concerning investment in construction.

Article 2: Definitions

Construction Technical Specifications

1. are mandatory provisions applicable in construction activities issued by competent state management authorities in construction. Construction Standards

2. are technical criteria, economic-technical norms, procedural steps for technical tasks, technical indicators, natural indicators established or recognized by authorized agencies or organizations for application in construction activities. Construction standards include mandatory and recommended standards. Mandatory Construction Standards

3. mandatory construction standards related to transportation construction are issued by the Ministry of Construction and the Ministry of Transport in accordance with the provisions of Decree No. 179/2004/NĐ-CP of the Government. are the Foreign Construction Standards

4. are national construction standards of countries around the world, international standard organizations, regional standard organizations. The application of foreign construction standards must comply with the "Regulations on the Application of Foreign Standards in Vietnam's Construction Activities" issued by the Ministry of Construction together with Decision No. 09/2005/QĐ-BXD dated April 7, 2005 of the Minister of Construction. Chapter II

The project investment planning phase for construction works

Article 3. Standard Framework

When preparing project approval documents for investment construction projects of transportation works, the investor must direct and be responsible with consultants to determine "data on natural conditions, loads, and impacts; the list of standards and specifications" (hereinafter referred to as Standard Framework) applicable to the project in accordance with point a) Clause 2, Article 7 of Decree No. 16/2005/NĐ-CP of the Government and Articles 8, 13, 14, and 16 of Decree No. 209/2004/NĐ-CP of the Government. The list of standards applicable to the project shall be selected from construction regulations, mandatory standards issued by the Ministry of Transport and the Ministry of Construction, and recommended standards (including foreign standards) mentioned in Article 2 of this Regulation in accordance with the financial capacity and natural, social, and other relevant conditions.

Article 4. Approval of Standard Framework

During the project preparation phase, Standard Framework as stipulated in Article 3 of this Regulation, must be approved by the Ministry of Transport or authorized agencies or organizations. The basic design documents of the project must comply with this Standard Framework which will be mandatory standards to be applied throughout all subsequent stages of the project including surveying, designing, design document acceptance, construction, quality control and supervision, completion acceptance, and management, maintenance, and operation of the works. Chapter III

Article 5. Design Documents

Construction drawings (in the case of one-step design); basic design and construction drawings (in the case of two-step design) or basic design, technical design, and construction drawings (in the case of three-step design) must comply

with those that have been approved during the project preparation phase. Any changes or additions to the standards at the design document preparation stage different from " Standard Frameworkthose of the project must be approved by the Ministry of Transport or authorized agencies or organizations.Standard FrameworkArticle 6. Technical Regulations and Guidelines

Tender documents (hereinafter referred to as tender documents) in accordance with Decree No. 16/2005/NĐ-CP must include information about the tender package, necessary requirements and guidelines or contract conditions. One of the documents in the tender documents to reflect the content of these requirements is the set of

In cases whereTechnical Regulations and Guidelinesstill need to supplement standards not mentioned inthe Standard Framework that has been approved, a list of supplementary standards must be compiled and submitted to the Ministry of Transport or authorized agencies or organizations for approval.

Article 7. Requirements for Technical Regulations and Guidelines

1) for supervising consultants and investors to monitor quality, stage acceptance, project or work acceptance

2) for contractors to prepare tender documents or bidding documents including drawings, implementation solutions, technical measures, technological designs, on-site laboratories, quality control and self-assurance measures.

3) for agencies or units receiving handover and managing, maintaining, and operating the works.

Chapter IV

Implementation of construction and quality control, supervision

Article 8: Quality Management of Construction by Contractors

The quality management of construction works carried out by contractors shall comply with the provisions of Government Decree No. 209/2004/NĐ-CP dated December 16, 2004, including establishing a quality management system, conducting material, component, and equipment testing, as well as preparing construction methods that must comply with and be based on those approved under Articles 4 and 6 of this Regulation. Article 9. Quality Control, Supervision, and Acceptance

Quality control, supervision, and acceptance must comply with and be based on "Standard Framework" and "of each tender package or the entire project. This is a mandatory document of the tender documents and must be reviewed and approved by the investor. The set" has been approved as stated in Article 4 and Article 6 of this Regulation.

Chapter V

Implementation

Article 10". The Department of Science and Technology is the advisory body to the Minister in organizing the review and approval process for "Standard Framework" as stated in Article 3 and Article 4 of this Regulation.

Article 11". The Directorate for Inspection and Quality Management of Transport Works is the advisory body to the Minister in organizing the review and approval process for "Technical Specifications and Guidelines" as stated in Article 6 of this Regulation for projects where the Ministry of Transport is the principal investor./. as provided in Article 6 of this Regulation for projects where the Ministry of Transport is the investor./.
