CIRCULAR
Guidelines for the process of identifying near-poor households as prescribed in Clause 4, Article 1 of Decision No. 117/2008/QĐ-TTg dated August 27, 2008 of the Prime Minister
Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decision No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister on issuing the poverty standard applicable during the period from 2006 to 2010;
Pursuant to Clause 4, Article 4 of Decision No. 117/2008/QĐ-TTg dated August 27, 2008 of the Prime Minister on adjusting health insurance contributions for social policy beneficiaries;
The Ministry of Labor, Invalids and Social Affairs hereby issues guidelines for the process of identifying near-poor households as prescribed in Clause 4, Article 1 of Decision No. 117/2008/QĐ-TTg dated August 27, 2008 of the Prime Minister on adjusting health insurance for social policy beneficiaries as follows:
I. PROCEDURE FOR IDENTIFYING NEAR-POOR HOUSEHOLDS
1. Near-poor households as defined in this Circular are those with an average monthly income per capita not exceeding 130% of the average monthly income per capita of poor households as stipulated in Decision No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister on issuing the poverty standard applicable during the period from 2006 to 2010, specifically as follows:
a. Rural areas: from VND 201,000 to VND 260,000 per person per month.
b. Urban areas: from VND 261,000 to VND 338,000 per person per month.
In cases where the Government adjusts the poverty standard to suit economic and social conditions at different times, the income level of near-poor households will be calculated based on the adjusted poverty standard.
2. The organization of annual reviews to identify near-poor households shall be carried out concurrently with the annual review of poor households as prescribed in Circular No. 04/2007/TT-BLDTBXH dated February 28, 2007 of the Ministry of Labor, Invalids and Social Affairs on the procedure for annual reviews of poor households (referred to as Circular No. 04/2007/TT-BLDTBXH).
3. Steps for reviewing and identifying near-poor households:
a. Preparation work for the review: implemented and applied according to the provisions of Point 1, Part II of Circular No. 04/2007/TT-BLDTBXH.
b. Compiling a list of households for review to identify near-poor households:
To ensure timely implementation of annual reviews to identify near-poor households, save time and costs, the review board at the commune, ward, town level (referred to as the commune level) selects households with the following characteristics to compile a list for review:
- Households that have escaped poverty in previous years.
- Households that have separated from households that have escaped poverty and non-poor households.
- Non-poor households but have children studying at vocational training centers, colleges, universities who have borrowed funds under Decision No. 157/2007/QĐ-TTg dated September 27, 2007 of the Prime Minister on credit for students and trainees.
- Non-poor households but show signs of reduced income due to objective and subjective reasons such as the aftermath of natural disasters, typhoons, floods; the main laborer losing their ability to work; having a member in the household suffering from prolonged illness; encountering misfortunes...being unemployed or having a disability; having a member of the household suffer from a long-term serious illness; encountering risks...
c. Methods and organization of reviewing and identifying near-poor households according to the compiled list:
- Reviewing the income level of households according to Model Form No. 1 in this Circular.
- The procedures and contents of the work are implemented according to the provisions of Point 3, Section II of Circular No. 04/2007/TT-BLDTBXH.
d. Compiling a list of households proposed for consideration as near-poor households after the survey, the list is compiled according to Model No. 2 issued in this Circular. The procedures and contents of the steps are implemented and applied according to the provisions of Point 4, Part II of Circular No. 04/2007/TT-BLDTBXH.
II. AUTHORITY AND RESPONSIBILITY FOR CONFIRMING NEAR-POOR HOUSEHOLDS
Authority and responsibility for confirming near-poor households are applied as the authority and responsibility of each level in the review of poor households as stipulated in Point 3, Section I of Circular No. 04/2007/TT-BLDTBXH.
III. IMPLEMENTATION
1. This Circular takes effect 15 days from the date of publication in the Official Gazette.
2. During the implementation process, if any difficulties arise, please report to the Ministry of Labor, Invalids and Social Affairs for prompt resolution.
