Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment, which has been amended and supplemented by Decree No. 19/2010/NĐ-CP dated March 5, 2010 and Decree No. 89/2010/NĐ-CP dated August 16, 2010;

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Amending and supplementing some points of Clauses 4, 5, 6, 7, and 8 of Article 2 of Decision No. 134/2008/QĐ-TTg dated October 2, 2008 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Department of Land Administration under the Ministry of Natural Resources and Environment as follows:

1. Amending and supplementing Points b and đ of Clause 4 of Article 2 as follows:

CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,

DECISION:

Article 1. “b) Submitting to the Minister of Natural Resources and Environment for issuance of guiding documents on the preparation and adjustment of land use plans and plans for land use for national defense and security purposes; the recovery of land, allocation of land, leasing of land, and change of land use purpose;”

“đ) Organizing inspections on the implementation of land use plans and plans for land use for national defense and security purposes of provinces and centrally-administered cities; the use of land according to sectoral and field plans approved after review; the recovery of land, allocation of land, leasing of land, and change of land use purpose;”

2. Amending and supplementing Points b, d, and đ of Clause 5 of Article 2 as follows:

“b) Directing and inspecting specialized activities in accordance with the provisions of law concerning the Office of Land Registration; the issuance of certificates of land use rights, ownership of houses, and other property attached to land;”

“d) Organizing the issuance and inspecting the management and use of certificate blanks for land use rights, ownership of houses, and other property attached to land;”

“đ) Compiling data on: land registration, cadastral survey and map making, issuance of certificates of land use rights, ownership of houses, and other property attached to land, establishment of cadastral files, statistics, and inventory of land of provinces and centrally-administered cities;”

3. Amending and supplementing Points a, b, c, and d of Clause 6 of Article 2 as follows:

“a) Drafting and submitting to the Minister of Natural Resources and Environment for submission to the Government for issuance of regulations on adjusting the framework of land prices, principles, and methods for determining land prices, and procedures for establishing and adjusting land price lists;”

“b) Submitting to the Minister of Natural Resources and Environment for issuance of guiding documents and organizing inspections on the application of principles, methods, and procedures for establishing and adjusting land price lists;”

“c) Taking the lead and coordinating with relevant ministries, sectors, and agencies in resolving or submitting to competent authorities for resolution of recommendations regarding the establishment, adjustment, and application of land price lists by provincial People's Committees;”

“d) Inspecting the creation of land price maps;”

4. Amending and supplementing Points b and c of Clause 7 of Article 2 as follows:

“b) Submitting to the Minister of Natural Resources and Environment for issuance of guiding documents on identifying land users eligible for compensation, support, or not eligible for compensation or support as the basis for calculating compensation and support;”

“c) Directing and inspecting sectors, localities, and organizations in resolving difficulties and obstacles related to compensation, support, and resettlement; post-clearance land management and use; guiding the issuance of certificates of land use rights, ownership of houses, and other property attached to land for resettled persons; guiding land management in resettlement areas.”

5. Amending and supplementing Point a of Clause 8 of Article 2 as follows:

“a) Drafting and submitting to the Minister of Natural Resources and Environment for issuance within his/her authority or submission to competent authorities for issuance of guiding documents and inspections on the implementation of mechanisms and policies for developing land funds according to planning; auctioning land use rights, bidding projects using land; managing and developing the land use rights market in the real estate market;”

This Decision shall take effect from June 15, 2011.

Article 2. Effective Date

1. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities, and the Director of the Department of Land Administration are responsible for implementing this Decision./.

2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and the Director of the Land Administration General Department shall be responsible for implementing this Decision./.
