Pursuant to the Education Law dated June 14, 2005; the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;No. Pursuant to the Sports and Physical Education Law dated December 29, 2006;

Pursuant to DecreeNo. This Circular stipulates the curriculum for the Physical Education subject in university training programs (hereinafter referred to as the Physical Education subject curriculum); inspection, supervision, and handling of violations concerning the Physical Education subject curriculum in higher education institutions.i Pursuant to Decree No. 11/2020/NĐ-CP dated October 15, 2020 of the Government detailing implementation of certain provisions and measures for organizing the implementation of the Law on Petitions;No. Article 1. Pursuant to Decree No. 141/2013/NĐ-CP dated October 24, 2013 of the Government detailing and guiding the implementation of certain provisions of the Higher Education Law;

Article 4. Knowledge Volumei The minimum knowledge volume that students need to accumulate from the Physical Education subject curriculum is 3 (three) credits. Higher education institutions specify the specific knowledge volume of this subject in accordance with the requirements of each training program.development sports;

Pursuant to DecreeNo. Article 5. Curriculum Development Organizationdevelopment 1. The Rector of universities and academies; the President of universities (hereinafter collectively referred to as the Head of Higher Education Institutions) decides on the number of members participating and issues a decision to establish the Physical Education Subject Curriculum Drafting Team (hereinafter referred to as the Drafting Team). The Drafting Team consists of people knowledgeable about physical education and capable of developing and improving curricula, including some physical education lecturers; representatives of physical education departments or majors; representatives of the training department; and some experts and scholars in physical education and sports both inside and outside the institution.

At the proposal of the Director of the Department of Higher Education,

2. The Drafting Team has the following responsibilities:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

a) Based on current regulations on physical education, develop general and specific objectives for each course; determine the structure, build courses under the Physical Education subject curriculum, including mandatory and elective courses; evaluation methods;

Article 2. Scope of Application

b) Design detailed outlines for each course; determine theoretical and practical requirements for each course; determine quality assurance conditions and safety for learners and instructors when implementing courses;

c) Organize seminars to gather opinions on the Physical Education subject curriculum;

Chapter II

d) Finalize the draft of the Physical Education subject curriculum based on feedback and submit it to the scientific council and training board of the institution for review, and proceed with the necessary approval procedures.

Article 3. Objectives

The Physical Education course program aims to provide basic movement knowledge and skills, form the habit of physical exercise and sports practice to enhance health, develop physical strength and stature, perfect personality, improve learning ability, social activity skills with a positive spirit and attitude, contributing to the comprehensive education goals.

Article 4. Volume of Knowledge

The minimum volume of knowledge for the Physical Education course program that students need to accumulate is 3 (three) credits. Universities specify the specific volume of knowledge for this course in accordance with the requirements of each training field.

Article 5. Organization of Program Development

1. The Rector of universities and academies; the President of university (hereinafter referred to collectively as the Head of Higher Education Institution) decides on the number of members participating and issues a decision to establish the Physical Education Course Program Drafting Team (hereinafter referred to as the Drafting Team). The Drafting Team consists of individuals knowledgeable about physical education and capable of building and developing programs, including some physical education lecturers; representatives from the department or discipline of physical education; representatives from the training department; and some scientists and experts in physical education and sports both within and outside the training institution.

2. The Drafting Team has the following responsibilities:

a) Based on current regulations on physical education, establish general and specific objectives for each course component; determine the structure, build course components of the Physical Education course program, including mandatory and elective courses; evaluation methods;

b) Design detailed outlines for each course; determine theoretical and practical requirements for each course; identify quality assurance conditions and safety measures for learners and instructors when implementing the courses;

c) Organize seminars to gather opinions on the Physical Education course program;

d) Finalize the draft of the Physical Education course program based on feedback, and submit it to the Scientific and Training Council of the training institution for review, and proceed with the necessary approval procedures.

Article 6. Examination and issuance of the program

1. The head of the higher education institution issues a decision to establish the Examination Board for the Physical Education course curriculum and the conditions to ensure its implementation (hereinafter referred to as the Examination Board). The Examination Board shall consist of at least three members with a Master's degree or higher in physical education or sports training; members of the drafting team shall not participate in the Examination Board.

2. The Examination Board consists of: chairman, secretary member, and reviewing members, including at least two persons outside the educational institution.

3. The Examination Board conducts the examination of the Physical Education course curriculum and the conditions to ensure quality for its implementation; concludes whether to approve or not to approve the Physical Education course curriculum of the higher education institution.

4. The head of the higher education institution issues the Physical Education course curriculum based on the conclusion of the Examination Board and the proposal of the scientific council and training board.

Article 7. Assessment of learning outcomes

The evaluation of course components, assessment of learning outcomes of the Physical Education course curriculum are specified in the course curriculum and according to the provisions of Clause 4, Article 8 of this Circular; they are not included in the overall grade point average of the semester, academic year, or academic period. The head of the higher education institution recognizes the learning outcomes for students after they have completed the Physical Education course curriculum.

Article 8. Implementation of the program

1. The head of the higher education institution is responsible for directing the organization of compiling or selecting, approving textbooks according to the Physical Education course curriculum for use as teaching and learning materials; organizing updates, evaluating the Physical Education course curriculum in accordance with current regulations, suitable to practical conditions and advancements in specialized science; publicly announcing the Physical Education course curriculum from the beginning of the academic period for students to choose course components and register for study; arranging lecturers, ensuring facilities that meet the requirements of the Physical Education course curriculum and physical exercise, sports practice to improve health and develop physical fitness for students, ensuring comprehensive educational goals and other contents prescribed in this Circular.

2. Lecturers are responsible for checking and recommending to the higher education institution about the conditions to ensure quality and safety before organizing teaching.

3. Lecturers and students have the right to refuse to participate in teaching and learning when safety conditions stipulated in the Physical Education course curriculum are not guaranteed.

4. Students with disabilities or insufficient health to study certain contents in the Physical Education course curriculum may be exempted, reduced, or substituted with appropriate alternative contents. The head of the higher education institution specifies the exemption, reduction, and alternative learning contents for disabled and unhealthy students.

Chapter III

INSPECTION, AUDIT AND VIOLATION HANDLING

Article 9. Inspection and supervision

1. Higher education institutions are responsible for internal inspection, self-assessment of the implementation of the Physical Education course curriculum in accordance with this Circular.

2. The Ministry of Education and Training organizes inspections and supervision of the implementation of the Physical Education course curriculum of higher education institutions in accordance with this Circular.

Article 10. Handling of violations

1. Higher education institutions, organizations, and individuals violating the provisions of this Circular will be subject to disciplinary action, administrative penalties in the field of education, and other legal responsibilities as prescribed by current laws depending on the nature and severity of the violation.

2. The head of the higher education institution and those directly violating will be subject to disciplinary action in the following cases:

a) Failing to ensure the volume of the Physical Education course curriculum and not implementing the requirements for building, examining, and issuing the Physical Education course curriculum;

b) Not organizing the implementation and assessing the learning outcomes of the Physical Education course curriculum in accordance with the issued regulations;

c) Failing to ensure the lecturer standards and quality and safety conditions for teaching and learning the Physical Education course curriculum;

d) Not storing documents and evidence for the implementation of the provisions of this Circular.

Chapter IV

IMPLEMENTING PROVISIONS

Article 11. Effective Date

This Circular takes effect from November 29, 2015, replacing the provisions on the Physical Education course curriculum for undergraduate level in Decision No. 3244/GD-ĐT dated September 12, 1995 of the Minister of Education and Training on temporarily promulgating the General University Curriculum (Phase I) for universities and teacher training colleges; Decision No. 1262/GD-ĐT dated April 12, 1997 of the Minister of Education and Training on promulgating the Physical Education Curriculum Phase II for universities and colleges (non-sports majors); and replacing the training and certification provisions for Physical Education at point b clause 2 Article 13, point d clause 1 Article 17, clause 4 Article 18 of Decision No. 25/2006/QĐ-BGDĐT dated June 26, 2006 of the Minister of Education and Training on the Regulations on undergraduate and college regular system training.

Article 12. Responsibility for Implementation

The Director of the Office, the Head of the Department of Higher Education; heads of relevant units under the Ministry of Education and Training; Directors of national universities, regional universities, academies; Principals of universities and related agencies, organizations, and individuals are responsible for enforcing this Circular./.
