Pursuant to the Law on Science and Technology dated June 18, 2013;

||| Pursuant to Decree No. 20/201||| 3/ND-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology,of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs||| and Technology,ngtechnology;

||| Pursuant to Decree No. 11/201||| 4/ND-CP dated February 18,amend||| 2014 of the Government on scientific and technological information activities;

The entities subject to the reporting of basic science and technology statistics (hereinafter referred to collectively as reporting units) include:ngtechnology;

At the proposal of the Director of the National Science and Technology Information Center and the Head of the Legal Department;

Article 1. Scope of Regulation

||| - Service organizations organized in the form of centers, offices, testing rooms, and other forms prescribed by the Minister of Science and Technology;

Article 2. Applicability

||| b) State agencies and public service units including:

||| - Public service units and state management units under the Ministry of Science and Technology;

||| - Provincial Departments of Science and Technology under the People's Committees of provinces and centrally-administered cities, public service units under provincial Departments of Science and Technology, and county-level specialized agencies on science and technology;

||| c) Enterprises and other public service units using state budget funds for scientific and technological activities;

||| d) Organizations: political, political-social, political-social-professional, social, social-professional, and their affiliated units using state budget funds for scientific and technological activities;

||| đ) Agencies, organizations, and individuals related thereto.

||| 2. This Circular does not apply to administrative agencies, public service units, enterprises, and scientific and technological organizations under the management of the Ministry of National Defense and the Ministry of Public Security.

||| Basic science and technology statistics report

||| is a report prepared by the reporting unit from officially recorded data according to a unified set of forms and submitted to the receiving unit.

||| The reporting system for basic science and technology statistics

||| includes provisions on the scope of application; scope; content and forms of reports; reporting periods and deadlines for submitting reports, methods of submitting reports; rights and responsibilities of the reporting unit and the receiving unit; appendices of forms attached with instructions for filling out the report forms.

||| Article 4. Scope of Statistics

Article 3. Explanation of Terms

1. "BJune 2024;oJune 2024;||| The scope of statistics includes data on human resources, finance, scientific and technological tasks, international cooperation, and awards in the field of science and technology of the reporting unit.No.statistical report on science and technology" is a report prepared by the reporting entity from officially recorded data according to a unified system of forms and submitted to the receiving entity.

2. "Statistical Reporting System for Basic Data on Science and Technology" includes provisions on the scope of application; scope; content and forms of reports; reporting periods and deadlines for submitting reports, methods of submitting reports; rights and responsibilities of the reporting entity and the receiving entity; appendices of forms attached with instructions for filling out the forms.

Article 4. Scope of Statistics

The scope of statistics includes data on human resources, finance, scientific and technological tasks, international cooperation, and awards in the field of science and technology of the reporting entity.

Article 5. Content and Reporting Form

1. The content of the report includes:

a) General information about the reporting unit;

b) Human resources for scientific and technological activities;

c) Expenditure on science and technology;

d) Scientific and technological tasks;

đ) International cooperation in scientific and technological activities;

e) Science and technology awards.

2. Reporting units shall implement the form and guidance for filling out the basic science and technology statistical report form (abbreviated as the statistical report) attached to this Circular.

Article 6. Reporting Period and Deadline for Submitting Reports

1. The reporting period is one year, from January 1 to December 31 of the reporting year.

2. Reporting units must submit reports to the receiving unit no later than February 1 of the following year of the reporting year.

Article 7. Method of Submitting Reports

1. The statistical report consists of a written report and a data file (sent via email). The written report must be signed and stamped with the confirmation seal of the Head of the reporting unit for ease of verification, comparison, and data processing. The data file must be saved in Excel spreadsheet format using Vietnamese Unicode font (Times New Roman) according to national standard TCVN 6909:2001 and must not be password protected.

2. The statistical report shall be sent directly or through postal services and electronic means to the receiving unit as stipulated in Article 6 of this Circular.

Article 8. Receiving Unit

1. Reporting units under the management of provinces and centrally governed cities shall submit their reports to the Department of Science and Technology under the People's Committee of the province or centrally governed city.

2. Reporting units not covered by Clause 1 of this Article shall submit their reports to the National Center for Information on Science and Technology under the Ministry of Science and Technology.

Article 9. Rights and Responsibilities of Reporting Units and Receiving Units

1. Rights and responsibilities of reporting units:

a) Ensuring the confidentiality of provided information in accordance with the law;

b) Reporting fully, accurately, objectively, and in accordance with the prescribed content in the basic science and technology statistical reporting system and bearing legal responsibility for the reported contents;

c) Submitting reports within the deadline;

d) Checking, resubmitting reports and providing related information when requested by the receiving unit.

đ) Bearing responsibility for the consistency between the written report and the data file.

2. Rights and responsibilities of receiving units:

a) Directing, organizing, and inspecting the implementation of the basic science and technology statistical reporting system;

b) Verifying, comparing, processing, and compiling data from basic statistical reports into comprehensive statistical reports;

c) Requesting reporting units to verify and resubmit reports and related information when necessary;

d) Providing comprehensive statistical information on the receiving unit’s website or online portal;

đ) Providing data to higher-level state management agencies regarding science and technology as prescribed by law;

e) Ensuring the publication, use, and security of statistical information in accordance with the law on statistics.

Article 10. Effective Date

1. This Circular takes effect from January 11, 2016.

2. This Circular replaces Circular No. 05/2010/TT-BKHCN dated July 2, 2010, issued by the Minister of Science and Technology, which stipulates the basic science and technology statistical reporting system, and Circular No. 35/2011/TT-BKHCN dated December 16, 2011, issued by the Minister of Science and Technology, which provides guidance on the basic science and technology statistical reporting system for technology transfer.

Article 11. Responsibility for Implementation

1. Ministries, sectors, and localities are responsible for establishing lists of entities subject to basic statistical reporting within their jurisdiction and sending them to the National Center for Information on Science and Technology no later than October 1 of the reporting year.

2. The National Center for Information on Science and Technology is responsible for coordinating with functional units of the Ministry of Defense and the Ministry of Public Security to collect and compile statistical data in the field of science and technology under the management of the Ministry of Defense and the Ministry of Public Security.

3. The National Center for Information on Science and Technology is responsible for guiding and implementing this Circular.

4. Heads of relevant agencies, organizations, and individuals are responsible for enforcing this Circular.

5. In case of difficulties during implementation, agencies and organizations are requested to reflect these issues to the Ministry of Science and Technology for research, amendment, and supplementation./.
