Issuing the List of Plant Protection Chemicals Permitted for Use in Vietnam

and the List of Plant Protection Chemicals Prohibited from Use in Vietnam

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;

At the proposal of the Director of the Plant Protection Department;

Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: The Ministry of Agriculture and Rural Development issues the Circular on the List of Pesticides Permitted for Use in Vietnam and the List of Pesticides Prohibited from Use in Vietnam.

Article 1. Attached herewith are

1. The List of Plant Protection Chemicals Permitted for Use in Vietnam, Appendix I attached herewith, including:

a) Pesticides used in agriculture: - Insecticides: 753 active ingredients with 1834 trade names. - Fungicides: 725 active ingredients with 1676 trade names. - Herbicides: 273 active ingredients with 853 trade names. - Rodenticides: 08 active ingredients with 49 trade names. - Plant growth regulators: 63 active ingredients with 187 trade names. - Insect attractants: 08 active ingredients with 08 trade names. - Snail killers: 31 active ingredients with 154 trade names. - Adjuvants (coating agents): 05 active ingredients with 06 trade names.

b) Termite control pesticides: 16 active ingredients with 27 trade names.

c) Timber preservation chemicals: 07 active ingredients with 08 trade names.

d) Warehouse disinfectants: 03 active ingredients with 10 trade names.

đ) Pesticides used for golf courses: - Fungicides: 02 active ingredients with 02 trade names. - Plant growth regulators: 01 active ingredient with 01 trade name.

e) Seed treatment pesticides: - Insecticides: 10 active ingredients with 16 trade names. - Fungicides: 12 active ingredients with 12 trade names.

g) Post-harvest crop protection pesticides - 01 active ingredient with 01 trade name.

2. The List of Plant Protection Chemicals Prohibited from Use in Vietnam, Appendix II attached herewith, includes:

a) Insecticides, timber preservation chemicals: 23 active ingredients.

b) Fungicides: 06 active ingredients.

c) Rodenticides: 01 active ingredient.

d) Herbicides: 01 active ingredient.

3. The Harmonized System (HS) code list for pesticides permitted for use and prohibited from use in Vietnam shall be implemented according to Section 23, Section 24 of Appendix I issued together with Circular No. 01/2024/TT-BNNPTNT dated February 2, 2024 of the Minister of Agriculture and Rural Development on the issuance of the HS code list for goods under the management authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspection upon import and export in the agricultural sector and rural development.

Article 2. Effective Date

1. This Circular takes effect from January 30, 2025.

2. Circular No. 09/2023/TT-BNNPTNT dated October 24, 2023 of the Minister of Agriculture and Rural Development on the issuance of the List of Pesticides Permitted for Use in Vietnam and the List of Pesticides Prohibited from Use in Vietnam shall cease to be effective from the date this Circular takes effect.

Article 3. Responsibility for Implementation

1. The Director of the Plant Protection Department, Heads of units under the Ministry, Directors of Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and relevant organizations and individuals are responsible for implementing this Circular.

2. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Agriculture and Rural Development (through the Plant Protection Department) for consideration and prompt resolution./.
