REGULATIONS ON EQUIPMENT FOR FIRE PREVENTION, FIRE FIGHTING AND RESCUE FOR CITIZEN PROTECTION FORCES, BASIC FIRE PREVENTION AND FIRE FIGHTING FORCES, AND SPECIALIZED FIRE PREVENTION AND FIRE FIGHTING FORCES

Circular No. 150/2020/TT-BCA dated December 31, 2020 of the Minister of Public Security on equipment for fire prevention, fire fighting and rescue for citizen protection forces, basic fire prevention and fire fighting forces, and specialized fire prevention and fire fighting forces, which took effect from February 20, 2021, has been amended and supplemented by:

Pursuant to the Law on Fire Prevention and Fire Fighting dated June 29, 2001; the Law Amending and Supplementing Certain Articles of the Law on Fire Prevention and Fire Fighting dated November 22, 2013;

Pursuant to Decree No. 83/2017/NĐ-CP dated July 18, 2017 of the Government on rescue work of fire prevention and fire fighting forces;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures for the implementation of the Law on Fire Prevention and Fire Fighting and the Law Amending and Supplementing Certain Articles of the Law on Fire Prevention and Fire Fighting;

Pursuant to the proposal of the Director of the Fire Prevention, Firefighting, and Rescue Police Department;

The Minister of Public Security issues this Circular on equipment for fire prevention, fire fighting and rescue for citizen protection forces, basic fire prevention and fire fighting forces, and specialized fire prevention and fire fighting forces.[1]

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the list, quantity, funding guarantee, and responsibilities of agencies, organizations, and individuals related to the provision of equipment for fire prevention, fire fighting and rescue for citizen protection forces, basic fire prevention and fire fighting forces, and specialized fire prevention and fire fighting forces.

Article 2. Applicability

This Circular applies to:

1. Citizen protection forces;

2. Basic fire prevention and fire fighting forces;

3. Specialized fire prevention and fire fighting forces;

4. Public Security units and localities;

5. Agencies, organizations, and individuals related to the provision of equipment for fire prevention, fire fighting and rescue for citizen protection forces, basic fire prevention and fire fighting forces, and specialized fire prevention and fire fighting forces.

Article 3. Principles for equipping fire prevention, firefighting, and rescue equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.

1. Compliance with the provisions of this Circular and relevant laws.

2. Ensuring the quality and effectiveness of fire prevention, firefighting, and rescue operations of civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.

3. Ensuring compliance with standards, purposes, and intended users.

4. Being appropriate to the local budget conditions and the capacity to ensure funding of the facilities.

Chapter II

EQUIPPING FIRE PREVENTION, FIREFIGHTING, AND RESCUE EQUIPMENT FOR CIVILIAN DEFENSE FORCES, GRASSROOTS FIRE PREVENTION AND FIREFIGHTING FORCES, AND SPECIALIZED FIRE PREVENTION AND FIREFIGHTING FORCES

Article 4. List and quantity of fire prevention, firefighting, and rescue equipment to be equipped for civilian defense forces.

1. The list and quantity of fire prevention, firefighting, and rescue equipment to be equipped for one civilian defense team are specified in Appendix I issued together with this Circular.

2. Depending on the nature, geographical characteristics, production, business, living conditions, requirements of fire prevention, firefighting, and rescue work within the jurisdiction of each commune-level administrative unit, and the financial capacity of the locality, civilian defense forces may be additionally equipped with necessary fire prevention, firefighting, and rescue equipment as stipulated in Appendix VI issued together with Decree No. 50/2020/NĐ-CP.

3. Based on the list and quantity of fire prevention, firefighting, and rescue equipment to be equipped for civilian defense forces as specified in Appendix I issued together with this Circular and the practical requirements of fire prevention, firefighting, and rescue work within the jurisdiction of each commune-level administrative unit, public security agencies shall advise and propose to the People's Committee at the same level to submit to the People's Council at the same level for consideration and decision on the quantity of fire prevention, firefighting, and rescue equipment to be equipped for civilian defense forces in accordance with regulations and for additional consideration and decision on the provision of necessary fire prevention, firefighting, and rescue equipment.

Article 5. List and quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.

1. The list and quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces are specified in Appendices II and III issued together with this Circular.

2. In cases where facilities are equipped with dedicated firefighting and rescue motor vehicles, the type and quantity of fire prevention, firefighting, and rescue equipment installed on such motor vehicles shall be carried out in accordance with current technical regulations and standards.

3. The head of the agency or organization directly managing the facility shall base their decision on the nature, characteristics of activities, production, business operations, and requirements of fire prevention, firefighting, and rescue work at the facility to determine the quantity of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces in accordance with Appendices II and III issued together with this Circular, and to decide specifically on the types of fire prevention, firefighting, and rescue equipment to be provided for the positions within the grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces when performing fire prevention, firefighting, and rescue tasks.

4. In addition to the list of fire prevention, firefighting, and rescue equipment to be equipped for grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces as specified in Appendices II and III issued together with this Circular, the head of the agency or organization directly managing the facility may decide to equip additional necessary fire prevention, firefighting, and rescue equipment for grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces under their management based on the nature and degree of fire and explosion hazards at the facility and the financial capacity, as stipulated in Appendix VI issued together with Decree No. 50/2024/NĐ-CP.

Article 6. Funding for equipping firefighting, rescue, and emergency response equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces

Clause 1. Funding for equipping firefighting, rescue, and emergency response equipment for civilian defense forces shall be implemented in accordance with points b and c, Clause 4, Article 48 of Decree No. 136/2020/ND-CP and point c, Clause 1, Article 29 and Clause 2, Article 42 of Decree No. 83/2017/ND-CP dated July 18, 2017 of the Government on rescue and emergency response work of fire prevention and firefighting forces.

Clause 2. The head of agencies and organizations directly managing facilities shall ensure funding for equipping firefighting, rescue, and emergency response equipment for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces in accordance with Clause 2, Article 31 of Decree No. 136/2020/ND-CP and point b, Clause 1, Article 29 of Decree No. 83/2017/ND-CP dated July 18, 2017 of the Government on rescue and emergency response work of fire prevention and firefighting forces.

Funding for equipping firefighting, rescue, and emergency response equipment for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces under agencies and organizations benefiting from state budget shall be guaranteed by the state budget and implemented in accordance with the provisions of the State Budget Law.

Chapter III

IMPLEMENTATION

Article 7. Effective Date

Clause 1. This Circular takes effect from February 20, 2021 and replaces Circular No. 56/2014/TT-BCA dated November 12, 2014 of the Minister of Public Security on equipping firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.

Clause 2. Civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces that have been equipped with firefighting, rescue, and emergency response equipment according to standards equal to or higher than those stipulated in this Circular before the date this Circular takes effect shall continue to use such equipment until it is damaged and needs replacement; in cases where they have not been equipped or have been equipped but with quantities lower than those stipulated in this Circular, they shall implement this Circular. It is encouraged for organizations and individuals to invest in equipping firefighting, rescue, and emergency response equipment to promote socialization in fire prevention and firefighting.

Article 8. Responsibility for Implementation

Clause 1. Director Fire Prevention and Fighting Police Department shall be responsible for directing, inspecting, and urging the implementation of this Circular.

Clause 2. Local public security organs ; are responsible for:

a) Guide, inspect, and report annually by the end of November to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department) on the implementation of regulations on equipping firefighting equipment, firefighting and rescue and emergency response for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.

b) Summarize proposals and recommendations for amending and supplementing the list and quantity of firefighting, firefighting and rescue and emergency response equipment provided to civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces and report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department).

c) Advise the People's Committee at the same level to issue regulations on managing and using firefighting, rescue, and emergency response equipment for civilian defense forces within their jurisdiction with the following contents: Principles of management and use of equipment; responsibilities of the People's Committee of communes, civilian defense forces equipped and using equipment; conditions and responsibilities of officers and members of civilian defense forces assigned to use equipment; conditions and responsibilities of persons assigned to manage warehouses and storage places for equipment; various positions in civilian defense forces authorized to use equipment and types of equipment provided and used; other related contents.3. Heads of units subordinate to the Ministry of Public Security, Provincial Public Security Directors, and relevant organizations and individuals are responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, local public security organs, relevant agencies, organizations, and individuals should report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department) for timely guidance.

[2] The phrase "Appendix VI issued together with Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures to implement the Fire Prevention and Fighting Law and the Law Amending and Supplementing Certain Provisions of the Fire Prevention and Fighting Law(hereinafter referred to as Decree No. 136/2020/NĐ-CP)" shall be replaced by the phrase "Appendix VI issued together with Decree No. 50/2020/NĐ-CP" pursuant to Clause 8, Article 6 of Circular No. 55/2024/TT-BCA dated October 31, 2024 of the Minister of Public Security amending and supplementing some articles of Circular No. 141/2020/TT-BCA dated December 23, 2020 of the Minister of Public Security on inspection work related to fire prevention, firefighting and rescue operations of the People's Police; Circular No. 150/2020/TT-BCA dated December 31, 2020 of the Minister of Public Security on equipping fire prevention, firefighting and rescue equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and professional fire prevention and firefighting forces; Circular No. 82/2021/TT-BCA dated August 6, 2021 of the Minister of Public Security on standards, tasks, training, and inspection of professional duties related to design review and acceptance of fire prevention and firefighting of the Fire Prevention and Fighting Police Force; Circular No. 06/2022/TT-BCA dated January 17, 2022 of the Minister of Public Security on procedures for implementing fire prevention, firefighting, and rescue tasks within the People's Police, which takes effect from December 16, 2024.

[3] This clause has been amended in accordance with Clause 1, Article 2 of Circular No. 55/2024/TT-BCA dated October 31, 2024, issued by the Minister of Public Security to amend and supplement some articles of Circular No. 141/2020/TT-BCA dated December 23, 2020, issued by the Minister of Public Security on fire prevention, firefighting, and rescue work of the People's Public Security force; Circular No. 150/2020/TT-BCA dated December 31, 2020, issued by the Minister of Public Security on equipping fire prevention, firefighting, and rescue equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces; Circular No. 82/2021/TT-BCA dated August 6, 2021, issued by the Minister of Public Security on standards, tasks, training, and inspection of fire prevention and firefighting design review and acceptance business of the Fire Prevention, Firefighting, and Rescue Police Force; Circular No. 06/2022/TT-BCA dated January 17, 2022, issued by the Minister of Public Security on procedures for performing fire prevention, firefighting, and rescue tasks in the People's Public Security force, which shall take effect from December 16, 2024.

“Article 7. Effective Date

This Circular takes effect from December 16, 2024.

Article 8. Responsibility for Implementation

1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall be responsible for directing, inspecting, and urging the implementation of this Circular.

2. Heads of units under the Ministry, Directors of Provincial Public Security Departments, and directly subordinate city-level public security departments, and related organizations and individuals shall be responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, relevant units, local public security agencies, organizations, and individuals shall report to the Ministry of Public Security (through the Fire Prevention, Firefighting, and Rescue Police Department) for timely guidance.

[7] This Appendix is replaced according to Clause 2, Article 5 of 19/2018/TT-BGTVT) which has been amended and supplemented by Clause 7, Article 1 of Circular No. 08/2024/TT-BGTVT dated April 4, 2024, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 19/2018/TT-BGTVT 55/2024/TT-BCA dated 31 the 10 2024 issued by the Minister of Public Security to amend and supplement certain provisions of Circular No. 141/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security on fire prevention, firefighting, and rescue work of the People's Public Security force; Circular No. 150/2020/TT-BCA dated December 31, 2020 issued by the Minister of Public Security on equipping fire prevention, firefighting, and rescue equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces; Circular No. 82/2021/TT-BCA dated August 6, 2021 issued by the Minister of Public Security on standards, tasks, training, and inspection of fire prevention and firefighting design review and acceptance work of the Fire Prevention, Firefighting, and Rescue Police Force; Circular No. 06/2022/TT-BCA dated January 17, 2022 issued by the Minister of Public Security on procedures for implementing fire prevention, firefighting, and rescue tasks in the People's Public Security force, which shall take effect from January 16 of the Government stipulating the list, management, use of technical equipment and procedures for collecting and using data obtained from such equipment provided by individuals or organizations to detect administrative violations;2 2024.
