DECREE
Determining ethnic groups still facing many difficulties,
with special difficulties during the period 2026-2030
Pursuant to Law on Government Organization No. 63/2025/QH15;
Pursuant to Law on Local Administration Organization No. 72/2025/QH15;
Pursuant to Resolution No. 120/2020/QH14 of the National Assembly approving the investment orientation plan for the Target Program on socio-economic development in ethnic minority and mountainous areas for the period 2021-2030;
At the proposal of the Minister of Ethnic Minorities and Religion;
The Government promulgates this Decree determining ethnic groups still facing many difficulties, with special difficulties during the period 2026-2030.
Article 1. Scope of Regulation
This Decree stipulates the objects, principles, criteria, and procedures for determining ethnic groups still facing many difficulties, with special difficulties during the period 2026-2030.
Article 2. Applicability
1. Ethnic groups throughout the country.
2. Relevant agencies and organizations.
Article 3. Principles
1. Objectivity, accuracy, transparency, and clarity, ensuring consistency with reality.
2. Based on official data updated at the specified time points, with clear legal basis and reviewed by competent authorities.
3. Ensuring control over power, preventing corruption, negative practices, and group interests during the process of determining ethnic groups still facing many difficulties, with special difficulties.
Article 4. Criteria for determining ethnic groups still facing many difficulties, with special difficulties during the period 2026-2030
1. An ethnic group still facing many difficulties is an ethnic group with a higher multidimensional poverty rate than the national average for ethnic minorities.
2. An ethnic group with special difficulties is an ethnic group with a population nationwide under 10,000 people according to population management data and meeting at least one of the following two criteria:
a) Having a higher multidimensional poverty rate than the national average for ethnic minorities;
b) Having a population nationwide according to population management data decreased compared to the population nationwide according to the results of the 2019 Population and Housing Census.
Article 5. Procedures for determining ethnic groups still facing many difficulties, with special difficulties during the period 2026-2030
1. Commune level: People's Committees of communes, wards, and special administrative zones (hereinafter referred to as People's Committee at commune level) organize reviews and statistics of data on total population, total households, poor households, near-poor households of each ethnic group in their locality according to Model No. 01 issued together with this Decree, submit the results including one electronic file and one paper file to the People's Committee at provincial level within 15 working days from the date the People's Committee at provincial level directs the implementation. Among which:
a) Data on population review of each ethnic group in the locality is statistically compiled based on population management data within 15 days from the date this Decree takes effect;
b) Data on total households, poor households, near-poor households of each ethnic group in the locality is statistically compiled based on the results of the 2024 household poverty review.
2. Provincial level: After receiving complete reports from the People's Committee at commune level, the People's Committee at provincial level directs relevant agencies to compile, review, verify, and bear full responsibility for the reported data according to Model No. 02 issued together with this Decree, submit the results including one electronic file and one paper file to the Ministry of Ethnic Minorities and Religion within 30 working days from the date this Decree takes effect.
3. Central level (Ministry of Ethnic Minorities and Religion): Within 30 working days from the date of receiving complete reports on total population, total households, poor households, near-poor households of each ethnic group from provinces, the Minister of Ethnic Minorities and Religion, based on the provisions of Article 4 of this Decree, directs the review, compilation, and issuance of the Decision approving the list of ethnic groups still facing many difficulties, with special difficulties during the period 2026-2030 nationwide.
Article 6. Funding for Implementation

Article 7. Implementation Organization
1. The Ministry of Ethnic Affairs and Religion
a) Chair and coordinate with relevant ministries and sectors to guide, urge, inspect, and evaluate localities in implementing the process of identifying ethnic groups still facing many difficulties with special difficulties during the period from 2026 to 2030;
b) Compile and issue the Decision of the Minister approving the list of ethnic groups still facing many difficulties and having special difficulties during the period from 2026 to 2030 nationwide in accordance with Clause 3, Article 5 of this Decree.
2. Provincial People's Committees
a) Direct and organize the implementation of this Decree;
b) Report in accordance with Clause 2, Article 5 of this Decree.
3. Commune People's Committees shall be responsible for organizing the implementation in accordance with Clause 1, Article 5 of this Decree.
4. Data for reviewing and determining criteria
a) Utilize population management data within 15 days from the date this Decree takes effect to ensure accuracy of population statistics of ethnic groups as a basis for comparison with the population of each ethnic group nationwide based on the results of the 2019 Population and Housing Census; encourage the application of science, technology, and digital transformation in identifying and managing lists of ethnic groups still facing many difficulties and having special difficulties;
b) Utilize poverty and near-poverty household data according to the results of the 2024 review of poverty and near-poverty households to determine the number of poor and near-poor households of each ethnic group in the locality, serving as a basis for determining the multidimensional poverty rate of each ethnic group.
Article 8. Effectiveness of Application
1. The list of ethnic groups still facing many difficulties, with special difficulties, approved in accordance with this Decree shall take effect during the period from 2026 to 2030.
2. The list of ethnic groups still facing many difficulties, with special difficulties during the period from 2021 to 2025, approved by Decision No. 1227/QD-TTg dated July 14, 2021 of the Prime Minister in accordance with Decision No. 39/2020/QD-TTg dated December 31, 2020 of the Prime Minister, shall continue to be effective until a decision approving the list of ethnic groups still facing many difficulties, with special difficulties during the period from 2026 to 2030 is issued.
Article 9. Effective Date
1. This Decree shall take effect from November 15, 2025.
2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, cities, and related agencies, organizations, and individuals shall be responsible for implementing this Decree.
