DECISION OF THE MINISTER OF TRADE
Regarding the delegation of authority to the Management Board of Industrial Zones of Ben Tre Province to manage
internal control activities import and export activities and commercial operations of enterprises
with foreign investment capital in industrial zones of Ben Tre Province
THE MINISTER OF TRADE
Based on Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Commerce;
Pursuant to the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Industrial Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government;
Pursuant to Decision No. 178/2005/QĐ-TTg dated July 15, 2005 of the Prime Minister on the establishment of the Management Board of Industrial Zones of Ben Tre Province;
At the request of the People's Committee of Ben Tre Province in Official Letter No. 2138/TTr-UBND dated October 3, 2005,
DECISION:
Article 1. Delegates authority to the Management Board of Industrial Zones of Ben Tre Province (hereinafter referred to as the Management Board) to manage import and export activities and commercial operations of foreign-invested enterprises and joint ventures based on business cooperation contracts for investment in industrial zones of Ben Tre Province (hereinafter referred to as foreign-invested enterprises).
Article 2. The Management Board of Industrial Zones of Ben Tre Province shall examine and approve plans for imports and manage commercial activities of foreign-invested enterprises as follows:
1. The Management Board examines and approves plans for imports and exports of foreign-invested enterprises, ensuring compliance with the Law on Foreign Investment Enterprises dated November 12, 1996, the Law Amending and Supplementing Certain Provisions of the Law on Foreign Investment Enterprises dated June 19, 2000, Decree No. 24/2000/NĐ-CP dated July 31, 2000, and Decree No. 27/2003/NĐ-CP dated March 19, 2003 of the Government, Decision No. 46/2001/QĐ-TTg dated April 4, 2001 of the Prime Minister regarding management of export and import goods during the period from 2001 to 2005, and other relevant legal documents consistent with the Investment License, Business License, Economic and Technical Justification, and technical design. The examination and approval of import plans include the following contents:
1.1 Approves import plans and confirms exemption from import duties for machinery, equipment, transportation means, construction materials, spare parts for installation and investment to create fixed assets including financial leasing import methods.
1.2 Approves temporary import plans for machinery, equipment, transportation means leased from abroad that are not part of the production line to serve enterprise operations.
1.3 Approves import plans for raw materials and supplies for production and business operations of enterprises.
2 Approves the liquidation of machinery, equipment, transportation means, materials, and raw materials of foreign-invested enterprises in accordance with Circular No. 01/2005/TT-BTM dated January 6, 2005 of the Ministry of Industry and Trade.
3. Approve import plans for finished products to be combined with exported products of foreign-invested enterprises.
Article 3. Quarterly, the Management Board reports to the Ministry of Industry and Trade on the implementation of export and import activities of foreign-invested enterprises in accordance with the guidelines of the Ministry of Industry and Trade in Circular No. 22/2000/TT-BTM dated December 15, 2000 of the Ministry of Industry and Trade.
Article 4. The Ministry of Trade shall periodically inspect the implementation of the provisions in this delegation decision in accordance with the law.
Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette./.
