CIRCULAR
Regulations on the Basis for Reporting Statistical Data Applicable to Tourist Establishments and Enterprises Managed and Licensed by the Tourism Sector
The tourism sector manages and licenses tourist establishments and enterprises.
Pursuant to the Law on Statistics dated June 26, 2003;
Pursuant to Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decision No. 312/QĐ-TTg dated March 2, 2010 of the Prime Minister approving the Project for Comprehensive Reform of Statistical Indicators Systems;
Pursuant to Decision No. 43/2010/QĐ-TTg dated June 2, 2010 of the Prime Minister promulgating the National Statistical Indicators System;
Considering the proposal of the Director of the Department of Planning and Finance and the General Director of the Vietnam National Administration of Tourism,
The Minister of Culture, Sports and Tourism promulgates this Circular regulating the Basis for Reporting Statistical Data applicable to tourist establishments and enterprises managed and licensed by the Tourism Sector.
Article 1. Scope of Statistics, Applicability
1. Scope of statistics: This Circular guides the forms of statistical reports used at tourist establishments and enterprises regarding their tourism activities results within the territory of Vietnam.
2. Applicability: Tourist establishments and enterprises engaged in tourism activities managed and licensed by the Tourism Sector.
Article 2. Reporting System
b) Agencies and organizations under the management of the district People's Committee that implement HIV/AIDS prevention and control activities report quarterly and annually on intervention activities to reduce harm, HIV testing counseling, HIV/AIDS prevention and control communication, methadone substitution therapy for opiate addiction treatment, antiretroviral therapy (ART) management, co-infection management between HIV and Tuberculosis and Hepatitis C, mother-to-child transmission prevention, pre-exposure prophylaxis (PrEP), and high-risk population counts according to corresponding forms specified in Appendices 2 and 3 attached to this Circular.
The Basis for Reporting Statistical Data applicable to tourist establishments and enterprises is divided into two parts: Part I - Forms (three forms) and Part II - Guidance and Explanation of Forms. Units assigned to report statistics shall implement according to the List of Statistical Report Forms in Appendix 1 and Part II - Guidance and Explanation of How to Fill Out Statistical Report Forms in Appendix 2 attached hereto.
2. Time Limit and Period for Submitting Statistical Reports:
a) Time limit for reporting: The reporting date is specifically noted in the upper left corner of each statistical form. Specifically as follows:
- Monthly report: On the 10th day of the month following the reporting month;
- Annual report: On February 10 of the following year.
b) Period for submitting statistical reports: The period for submitting statistical reports is a fixed time frame during which the reporting entity must reflect its operational results through data according to the criteria set forth in the statistical report forms. The period for submitting statistical reports is calculated based on the Gregorian calendar, including:
- Monthly statistical report: The monthly statistical report covers from the first day to the last day of the month;
- Annual statistical report: The annual statistical report covers from January 1 to December 31 of the reporting year.
3. Method of Submitting Reports:
Reports shall be submitted via two methods as follows:
a) The statistical report shall be in writing and must bear the signature and stamp of the head of the unit;
b) By electronic file (sent via email) to the receiving unit.
Article 3. Reporting Unit, Responsibilities and Obligations of the Reporting Unit
1. Reporting Units:
The reporting unit is specifically noted in the upper right corner of each statistical form. Specifically as follows:
- Tourist accommodation establishments and enterprises are responsible for collecting and summarizing data from Form 01.T/DL-DN and Form 03.N/DL-DN;
- Travel agencies, transportation enterprises, and tourist attractions are responsible for collecting and summarizing data from Form 02.T/DL-DN and Form 03.N/DL-DN;
- In cases where an establishment or enterprise operates both accommodation and travel services or tourist attractions, it shall report all three forms: 01.T/DL-DN, 02.T/DL-DN, and 03.N/DL-DN.
2. Responsibilities and Obligations of the Reporting Unit:
a) To fully and accurately report the indicators specified in each statistical report form;
b) To prepare reports in accordance with the prescribed reporting deadlines and periods;
c) To submit reports to the receiving unit within the prescribed deadline.
Article 4. Units receiving reports
The units receiving reports are specifically recorded in the upper right corner of each statistical form, being the name of the local tourism management authority at the delegated level. It may be the Department of Culture, Sports and Tourism, or the Department of Tourism, or the Cultural and Information Department.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. This Circular takes effect from February 16, 2015.
2. Based on the management, ranking, and licensing work of the tourism management agency, the Departments of Culture, Sports and Tourism or Tourism of localities shall implement this reporting system to tourism businesses within their jurisdiction.
3. Any amendments or supplements to the Statistical Reporting System applicable to tourism establishments and enterprises shall be proposed by the Director of the Planning and Finance Department and the General Director of the Vietnam National Administration of Tourism for consideration and decision by the Minister of Culture, Sports and Tourism.
4. During the implementation of this Circular, if there are any difficulties, they should be reported to the Ministry of Culture, Sports and Tourism (Planning and Finance Department and Vietnam National Administration of Tourism) for timely review and adjustment.
