CIRCULAR

Regulations on the detailed implementation of competition and reward work

in the Industry and Trade sector

 

 

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as the Law on Competition and Reward);

Based on Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 42/2010/ND-CP); Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 39/2012/ND-CP) and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as Decree No. 65/2014/ND-CP);

PURSUANT TO THE proposal of the Director of the Department of Competition and Rewards;

The Minister of Industry and Trade issues this Circular detailing the implementation of competition and reward work in the Industry and Trade sector.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Circular details the implementation of competition and reward work in the Industry and Trade sector, including: forms and contents of organizing competition movements; titles of honor and criteria for such titles; forms, subjects, and criteria for rewards; authority to decide on granting awards, procedures, and application files for award nominations; Competition and Reward Councils at all levels; competition and reward funds and handling violations related to competition and reward.

Article 2. Applicability

1. Competitors

The subjects of competition under this Circular include: officials, civil servants, public employees, laborers within the establishment, indefinite-term labor contracts, and definite-term labor contracts from 12 to 36 months working in agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade under central cities (hereinafter referred to as individuals); agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade, and enterprises under central cities (hereinafter referred to as groups).

2. Recipients of rewards

a) The subjects specified in Clause 1 of this Article;

b) Individuals and groups with activities related to the Industry and Trade sector in agencies and units under various Ministries, sectors, and localities;

c) Vietnamese individuals and groups abroad and foreign individuals and groups who have made significant contributions to building, protecting, and developing the Industry and Trade sector in Vietnam.

Article 3. Objectives of competition and reward

Competition and reward work aims to create motivation, encourage, and honor groups and individuals who enthusiastically engage in creative labor competitions, striving to complete assigned tasks excellently, contributing to the development of the Industry and Trade sector.

Article 4. Principles of competition and reward

1. Principles of Competition

a) Voluntary, conscientious, transparent; ensuring a spirit of unity, cooperation, and mutual development;

b) Bestowing competition titles must be based on the results of the competition movement;

c) Individuals and groups participating in the competition movement must register for competition, set competition goals, and criteria. Those individuals and groups that do not register for competition will not be considered or recognized for competition titles.

2. Principles of Reward

a) Accurate, transparent, democratic, fair, and timely based on the correct assessment of the performance of groups and individuals; emphasizing quality according to standards rather than forcing quantity; achievements obtained under difficult conditions and having a wide impact are rewarded at a higher level; focusing on rewarding individuals directly involved in labor and work and those with many innovations in labor and work;

b) When considering rewards for the head of an agency, organization, or unit, it must be based on the achievements of the group led by that individual;

c) For female leaders and managers, the period of holding office for consideration of rewards can be reduced by three years compared to the general regulations. For rewards for economic and social achievements, when there are multiple individuals and groups meeting the conditions and criteria, individuals and groups with a female ratio of 70% or more should be selected for rewards;

d) A reward form may be given multiple times to the same subject; multiple reward forms shall not be given for a single achievement;

đ) Ensuring consistency between the nature, form, and recipient of rewards;

e) Combining spiritual encouragement closely with material incentives;

g) The time for proposing rewards for the next round is calculated from the date of the previous reward decision.

Article 5. Responsibilities of Heads of Agencies and Units in Competition and Commendation Work

1. The Minister shall initiate and direct competition movements within the entire Industry and Trade sector. The Ministry's Competition and Commendation Council shall be responsible for advising the Minister on the content of competitions and organizing competition movements.

2. The Head of an agency or unit shall organize the initiation and direction of competition movements within their managed agencies or units.

3. Organizations under agencies and units need to closely coordinate with the Heads of the same level agencies and units to direct the organization of the initiation and maintenance of regular competition movements, expand competition movements and exemplary models within their agencies and units; proactively identify and select collectives and individuals with outstanding achievements for commendation or recommend higher-level commendation according to this Circular.

Article 6. Responsibilities of Industry Media Outlets

Industry newspapers and magazines have the responsibility to regularly publicize competition and commendation work; disseminate and set examples of advanced models, good people and deeds, promote competition movements; identify individuals and collectives with outstanding achievements in competition movements; combat and criticize violations of laws on competition and commendation within the Industry and Trade sector.

Article 7. Rights and Obligations of Individuals and Collectives Receiving Commendation

1. Individuals receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, and material rewards; they may be considered for early promotion according to regulations; they are given priority for research study, work assignments, and professional skill enhancement both domestically and internationally; commendatory titles and forms of commendation serve as one of the bases for evaluation, planning, appointment, and reappointment of cadres annually.

2. Collectives receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, or material rewards on official documents and materials of the agency or unit.

3. Collectives and individuals recognized with commendatory titles and forms of commendation shall be responsible for maintaining and further striving to achieve higher commendatory titles and achievements; they must properly preserve material rewards. It is strictly prohibited to buy, sell, lease, lend, give away, or transfer material rewards in any form.

 

Chapter II

FORMS AND CONTENT OF ORGANIZING COMPETITION MOVEMENTS

COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

 

Article 8. Forms of Organizing Competitions

1. Regular competitions are organized and implemented daily, monthly, quarterly, and annually to achieve set goals, targets, and work programs.

2. Periodic or thematic competitions are organized to enhance the quality and effectiveness of work, strive to excellently complete key and urgent tasks within a specific period, or address difficult, complex issues, weaknesses, and pending matters.

a) The Industry and Trade sector organizes periodic or thematic competitions to strive for successful implementation of five-year and annual socio-economic development plans assigned by the State.

b) Agencies and units within the sector organize competitions to celebrate traditional days of the sector, agency, or unit, and anniversaries of establishment of the sector, agency, or unit.

Article 9. Content of organizing competitive movements

1. Clearly define the objectives, scope, target groups for competition, set out specific targets, slogans, contents of the competition, and the duration of the competition. The determination of the content and criteria for the competition must be scientific, appropriate to the practical conditions of each agency or unit, and feasible.

2. Determine measures to organize competitive movements; adopt suitable forms to launch competitive movements, emphasizing the promotion of the significance of the competition period, and fostering a sense of responsibility.

3. Launch and direct the implementation of competitive movements; have plans to implement measures to mobilize and promote competition, monitor the process of organizing the competition, organize pilot guidance to draw lessons and disseminate good practices for participants in the competition.

4. Summarize and conclude on the competitive movement, evaluate the results of the competition. For long-term competition periods (lasting one year or more), agencies and units must organize mid-term summaries to draw lessons; at the end of short-term competition periods (less than one year) or each phase, conduct summaries and conclusions to evaluate results; publicly select, review, commend, and reward individuals and collectives with outstanding achievements in the competitive movement. Promote and disseminate exemplary models within agencies and units.

Article 10. Registration for Competition Titles

Each year, no later than March 15, agencies and units shall organize for individuals and collectives to register their efforts to achieve competitive movements, competition targets, competition titles, and submit the competition registration form (according to Form 1a and 1b in Appendix 1 issued together with this Circular) to the Ministry for monitoring, serving as the basis for awarding competition titles.

Article 11. Competition Titles

1. For Individuals

a) National Model Competitor;

b) Outstanding Soldier of the Ministry;

c) Grassroots Model Competitor;

d) Advanced Worker.

2. For Collectives

a) Flag of Government Competition;

b) Flag of the Ministry;

c) Outstanding Labor Group;

d) Advanced Labor Group.

Article 12. Criteria for Awarding Competition Titles to Individuals

1. Individuals who achieve the title "National Outstanding Soldier" must meet the following criteria:

a) Have outstanding and excellent achievements selected from those individuals who have continuously achieved the title "Outstanding Soldier of the Ministry" twice;

b) Have innovative ideas, research topics achieving high effectiveness, having national-wide influence, and recognized by the Ministry's Commendation and Reward Council and the Ministry-level Science Council.

The Ministry's Commendation and Reward Council and the Ministry-level Science Council are responsible for assisting the Minister of Industry and Trade in reviewing and recognizing innovative ideas and research topics. These councils are established and operate according to the Council's operational regulations, decided by the Minister.

The time for considering the title "National Outstanding Soldier" is the year immediately following the second year of achieving the title "Outstanding Soldier of the Ministry."

2. Individuals who achieve the title "Outstanding Soldier of the Ministry" must meet the following criteria:

a) Have outstanding achievements among those individuals who have continuously achieved the title "Outstanding Soldier at the Base" three times;

b) Achievements, innovative ideas, work solutions, and research topics of individuals have an impact within the industry of Industry and Trade.

The time for considering the title "Outstanding Soldier of the Ministry" is the year when the individual achieves the title "Outstanding Soldier at the Base" for the third time.

3. Individuals who achieve the title "Outstanding Soldier at the Base" must meet the following criteria:

a) Advanced Worker;

b) Have innovative ideas that are technical solutions, management solutions, operational solutions, or applications of advanced technology to increase labor productivity, improve work efficiency, recognized by the base or have research topics that have been accepted and applied, completed excellently, recognized by the agency, organization, or unit.

The assessment of the impact of innovative ideas and research topics is assisted by the Base Innovation Council and the Base Science Council to help the head of the agency, organization, or unit recognize them. These councils are established and operate according to the Council's operational regulations, decided by the competent authority of the agency, organization, or unit that recognizes the title "Outstanding Soldier at the Base."

The granting of the title "Outstanding Soldier at the Base" is conducted annually, implemented with a ratio of no more than 15% of the number of officers, civil servants, public officials, and workers in the agency or unit who have achieved the title "Advanced Worker."

4. Individuals who achieve the title "Advanced Worker" must meet the criteria stipulated in Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Rewards in 2013.

Individuals who bravely save people or property leading to injuries requiring treatment or convalescence as concluded by medical facilities shall have the treatment and convalescence period counted towards the consideration for the title "Advanced Worker."

Individuals sent for short-term training or development under one year, complying well with the regulations of the training or development institution, shall have their study period counted towards their working time at the agency or unit for the evaluation of the title "Advanced Worker." In cases where individuals are sent for training or development for one year or more, comply well with the regulations of the training or development institution, and have satisfactory academic performance, they may be considered for the title "Advanced Worker."

The maternity leave period as prescribed shall be counted towards the evaluation for the title "Advanced Worker."

For individuals transferred to new agencies, organizations, or units, the new agency, organization, or unit shall be responsible for evaluating and voting for the title "Advanced Worker" (if the individual has worked at the previous agency for six months or more, the opinion of the previous agency must be obtained).

In cases where individuals are temporarily assigned to other agencies or units, the evaluation and voting for the title "Advanced Worker" shall be decided by the agency or unit that assigns them (with comments from the receiving agency or unit).

The title "Advanced Worker" shall not be granted in any of the following cases: newly recruited for less than ten months, absent from work for forty days or more, or disciplined with a warning or higher.

Article 13. Criteria for awarding commendation titles to collectives

1. Collectives awarded the title "Flag of Government Competition" must meet the criteria stipulated in Article 25 of the Law on Competition and Rewards; Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, and Article 6 of Decree No. 65/2014/NĐ-CP.

Collectives eligible for the Flag of Government Competition must be the most outstanding collectives selected among those not exceeding 20% of the collectives awarded the "Flag of Ministry Competition."

The awarding of the title "Flag of Government Competition" is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year).

Annually, based on competition registration with the Government (through the Central Board for Competition and Rewards), the Ministry of Industry and Trade allocates the number of Flags to agencies and units within the sector.

2. Collectives awarded the title "Flag of Ministry Competition" must meet the following criteria:

a) Exceeding all set competition targets and assigned tasks for the year; being exemplary collectives that excel in their work tasks.

b) Having new factors and models for other collectives in the industry to emulate.

c) Internal unity, actively practicing thrift, combating waste, corruption, and other social evils.

The awarding of the Flag of Ministry Competition is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year). Annually, the Ministry issues specific guidelines on allocating the number of Ministry Competition Flags to agencies and units under the Ministry and Provincial Departments of Industry and Trade.

By March 15 each year, units in the industry register for the Flag of Government Competition and the Flag of Ministry Competition with the Department of Competition and Rewards.

3. Collectives awarded the title "Outstanding Labor Collective" must be exemplary collectives chosen from among those awarded the title "Advanced Labor Collective," according to the criteria specified in Clause 1, Article 27 of the Law on Competition and Rewards.

4. Collectives awarded the title "Advanced Labor Collective" must meet the criteria stipulated in Clause 1, Article 28 of the Law on Competition and Rewards.

For newly established agencies, units, and enterprises, they must have been operating for at least one year (12 months) before being eligible for the titles "Advanced Labor Collective" and "Outstanding Labor Collective."

 

Chapter III

FORMS OF REWARD,

CRITERIA FOR REWARD FORMS

 

Article 14. Types of rewards

1. Reward based on achievements and accomplishments is a form of reward for collectives and individuals who achieve outstanding results in implementing annual plans or multi-year plans.

2. Special topic reward (or campaign reward) is a reward for collectives and individuals who achieve outstanding results in work after completing a competition campaign initiated by the President, Prime Minister, Minister, or head of unit, related to the implementation of the unit's tasks.

3. Immediate reward is a reward for collectives and individuals who achieve outstanding results in labor, production, or combat service; bravery in rescuing people or state property (immediate achievement is an achievement made in unforeseen circumstances outside the normal work plan that the collective or individual must undertake).

4. Reward for dedication over time is a reward for individuals who have contributed significantly during various revolutionary stages (holding leadership or management positions in state agencies, public institutions, political organizations, or social-political organizations in the industry), making outstanding contributions to the revolutionary cause of the Party and the nation.

5. Foreign reward is a reward for foreign collectives and individuals who have made significant contributions to the construction and development of the industry.

Article 15. Forms of Reward

1. Forms of reward of the State:

Medals, Orders, National Honorary Titles, Ho Chi Minh Prize, State Prize, and Certificates of Merit from the Prime Minister.

2. Forms of reward of the Ministry:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

3. Forms of reward of the head of an organization or unit with its own account, seal, and legal personality:

Commendation Letter.

Article 16. Criteria for forms of reward

1. Medals, Orders, Certificates of Merit from the Prime Minister, National Honorary Titles, Ho Chi Minh Prize, and State Prize shall be implemented according to the provisions of Clause 1, 2, Article 20; Clause 1, 4, Article 21; Articles 34, 35, 36, 37, 38, 39, 40, 42, 43, 44, 45, 46, 47 of Decree No. 42/2010/ND-CP; from Article 7 to Article 23 of Decree No. 65/2014/ND-CP and Decree No. 123/2014/ND-CP dated December 25, 2014 of the Government on awarding the titles "People's Artist" and "Outstanding Artist" in the field of traditional craft industries.

2. The Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" shall be implemented according to the Regulation on awarding the Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" issued together with Decision No. 46/2008/QD-BCT dated December 17, 2008 of the Minister of Industry and Trade and Circular No. 08/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade on amending and supplementing some articles of administrative procedures in Decision No. 46/2008/QD-BCT.

3. The Women's Scientific Creativity Award in Industry and Trade shall be implemented according to the Regulation on awarding the Women's Scientific Creativity Award in Industry and Trade issued together with Decision No. 38/2008/QD-BCT dated October 21, 2008 of the Minister of Industry and Trade.

4. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to individuals who model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results;

c) Achieving many results with significant influence within their respective fields under the Ministry;

d) Excellently completing tasks for two consecutive years, during which time two recognized and effectively applied initiatives were implemented at the grassroots level;

đ) Having a long-term career with significant contributions to the construction and development of the Industry and Trade sector, recognized on the occasion of celebrating the founding day of the sector, agency, or unit, or before retirement;

e) Other cases to be considered and decided by the Minister.

5. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to groups that model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding and exemplary results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results or many results with significant influence within their respective fields under the Industry and Trade sector;

c) Excellently completing tasks for two consecutive years, maintaining internal unity, implementing democratic regulations at the grassroots level, organizing good competition campaigns, caring for the material and spiritual life of group members, practicing thrift, and fulfilling all systems and policies for every member of the group.

The granting of rewards to agencies, units, and small groups within agencies and units under the Ministry that achieve outstanding and exceptionally excellent results or have made contributions to building and developing their agencies and units on the occasion of celebrating their founding days shall be carried out during the annual summary of work of the Ministry.

6. Commendation Letters from the head of an organization or unit with its own account, seal, and legal personality

Shall be implemented according to the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Campaigns and Rewards 2013.

7. Campaigns can be organized on a large scale within a unit, locality, industry, or ministry

a) When summarizing and concluding campaigns, mainly implement the reward forms of the campaign initiator (Commendation Letters, Certificates of Merit);

b) In cases organized nationwide, when summarizing and concluding campaigns lasting three years or more, the initiating unit selects outstanding and excellent collectives and individuals to recommend to the Prime Minister for the awarding of Certificates of Merit;

c) In cases organized nationwide, when summarizing and concluding campaigns lasting five years or more, the initiating unit selects outstanding and exceptionally excellent collectives and individuals to recommend to the President for the awarding of the "Labor Medal" Class III and mainly reward direct laborers and workers.

 

Chapter IV

AUTHORITY TO DECIDE, AWARDS, PROCEDURES, AND FILES

AND THE PROCESS OF RECOMMENDING AWARDS

 

Article 17. Authority to decide and present awards

1. The authority to decide and present awards for Orders, Medals, Ho Chi Minh Prize, State Prize, National Honorary Titles, Government Flag of Merit, National Model Worker, Prime Minister's Commendation shall be implemented according to the provisions set forth in Articles 77 and 78 of the Law on Competition and Rewards.

2. The Minister of Industry and Trade decides to award the following commendations:

a) The Flag of Merit of the Ministry;

b) Outstanding Soldier of the Ministry;

c) Outstanding Labor Collectives:

- The Minister decides to award the title "Outstanding Labor Collective" to administrative and public service units under the Ministry; enterprises under the Ministry (excluding economic groups and holding companies);

- The Minister delegates the authority to the Heads of agencies and units with legal personality, separate bank accounts, and their own seals to decide to award the title "Outstanding Labor Collective" to units, departments, rooms, faculties, factories, workshops, teams, squads that are subordinate members.

d) Advanced Workers and Model Workers at the grassroots level for individuals and Advanced Worker Collectives for collectives within units under the Ministry's agencies without legal personality.

3. The Minister of Industry and Trade decides to award the following forms of commendation:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

4. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following commendations:

a) Advanced Labor Collective;

b) Excellent Labor Collective;

c) Advanced Worker;

d) Model Workers at the grassroots level.

5. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following forms of commendation:

Commendation Letter.

Article 18. Ceremony for presenting commendations and awards

Announcing and presenting commendations and awards is an occasion to honor exemplary individuals and outstanding achievements. The ceremony must be solemn, practical, economical, avoiding ostentation and waste.

1. Organizing rallies, commemorative ceremonies, presentations, and receptions of national honorary titles, Orders, Medals, Government Flags of Merit, Prime Minister's Commendations are carried out according to the provisions stipulated in Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on organizing commemorative days; presentation and reception rituals of commendations and commendatory titles; diplomatic ceremonies and welcoming foreign guests.

2. The Minister of Industry and Trade, authorized by Party and State leaders, presents the Government Flag of Merit to agencies and units under the Ministry and directly presents the Ministry's Flag of Merit and the Minister's Commendation to subordinate agencies and units of the Ministry and provincial Departments of Industry and Trade at the annual work summary conference of the Ministry.

3. The Minister of Industry and Trade authorizes the Heads of agencies and units responsible for organizing the presentation of commendations and awards as follows:

a) For Orders and Medals: After receiving notifications from the Department of Competition and Rewards and decisions, reward items, the Head of the agency or unit develops a plan to organize and receive them, reporting to the Minister (through the Department of Competition and Rewards). Following the Minister's instructions, the Department of Competition and Rewards coordinates with relevant agencies and units to announce and present them, possibly combining with other practical programs of the agency or unit to save time and costs. For some special cases, the Department of Competition and Rewards develops a plan to organize the reception and report to the Minister, then organize the announcement and presentation;

b) For the title of National Model Worker and the form of commendation of the Prime Minister's Commendation for individuals and collectives: The Head of the agency or unit proactively develops a plan, organizes the announcement and presentation to individuals and collectives under their responsibility who have been commended, and informs the Department of Competition and Rewards for guidance and monitoring;

c) For commendations and awards within the authority of the Minister of Industry and Trade: The Minister delegates the authority to the Heads of agencies and units to announce and present to individuals and collectives under their management;

d) For individuals and collectives awarded commendations and awards within the authority of the Heads of agencies and units, the agencies and units themselves organize the announcement and presentation.

Article 19. Commendation Procedures

1. The level that initiates a competition campaign shall select outstanding individuals and collectives for commendation or propose to a higher level for commendation.

2. Heads of agencies and units under the Ministry shall be responsible for commending within their authority or proposing to a higher level for commendation for individuals and collectives under their management.

3. Regarding Provincial Departments of Industry and Trade and Municipal Departments of Industry and Trade directly under the Central Government

a) Proposals for awarding commendation titles and forms of commendation by the State shall be reviewed and submitted by the People's Committee of the province or municipality directly under the Central Government according to the provisions of the Law on Competition and Commendation, Decree No. 42/2010/ND-CP, Decree No. 65/2014/ND-CP, and guiding documents issued by the People's Committee of the province or municipality directly under the Central Government;

b) The Ministry of Industry and Trade shall concur with commendations for commendation titles and forms of commendation by the State based on proposals from the People's Committee of the province or municipality directly under the Central Government or the National Competition and Commendation Board;

c) Proposals for the title "Flag of Competition of the Ministry of Industry and Trade" and other forms of commendation within the authority of the Minister of Industry and Trade shall be carried out like other agencies and units under the Ministry when the Ministry launches a specialized competition campaign.

4. Regarding industry associations under the Ministry of Industry and Trade

The Chairman of the Association shall consider and propose commendation within the authority of the Minister of Industry and Trade.

5. Regarding units outside the industry

The head of the agency or unit with activities related to the industry shall propose to the competent authorities for consideration and propose commendation within the authority of the Minister of Industry and Trade.

Article 20. Documents for Proposing Commendation

1. The Department of Competition and Commendation shall be responsible for receiving commendation proposal files from agencies and units both inside and outside the industry.

2. For Certificates of Merit and Flags of Competition of the Ministry of Industry and Trade, one set of files includes:

a) A proposal for commendation by the Director of the Provincial Department of Industry and Trade or the Municipality directly under the Central Government for collectives and individuals under their department or by the head of the agency or unit under the Ministry for collectives and individuals under their agency or unit (Annex 2);

b) Minutes of meetings of the Competition and Commendation Council of the Provincial Department of Industry and Trade or Municipality directly under the Central Government or minutes of meetings of the Competition and Commendation Council of the agency or unit under the Ministry (Annex 3);

c) Reports on achievements of collectives (signed and stamped by the head of the agency or unit) and individuals (signed, clearly stating full name, confirmed by the head of the agency or unit signing and stamping) proposed for commendation (Annexes 4 and 5);

d) Copies of Decisions or Certificates awarding the title "Model Worker at the Grassroots Level" or "Outstanding Labor Collective" by the competent authority;

đ) Confirmation of inventions and scientific research topics recognized by the Invention Council or Scientific Council at the grassroots level; Copies of National or International Awards (if any).

3. For the title "Heroic Laborer", the file shall be implemented according to the provisions of Clause 23, Article 1 of Decree No. 39/2012/ND-CP (Annexes 6 and 7).

4. For the title "National Model Worker", "Flag of Competition of the Government", and forms of commendation such as Orders, Certificates of Merit from the Prime Minister, Medals, the file shall be implemented according to the provisions of Clauses 6, 10, 12, 15, 18, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation (Annex 2);

b) Minutes of meetings of the Competition and Commendation Council (Annex 3);

c) Copies of Decisions or Certificates awarding commendation titles and forms of commendation by the competent authority for collectives and individuals proposed for commendation;

d) Reports on achievements of individuals and collectives proposed for commendation must have signatures, clearly stating full names of the preparers and signatures, stamps (if any) confirming by the head of the agency or unit (Annexes 4 and 5);

đ) Confirmation of inventions and scientific research topics recognized by the Invention Council or Scientific Council at various levels; Copies of National or International Awards (Annex 8);

e) Confirmation of fulfilling state budget payment obligations for collectives and individuals who are heads of agencies or units with state budget payment obligations (confirmed by the tax authority of the province or municipality directly under the Central Government);

g) Opinions of local People's Committees (commune, ward) regarding activities on their territory;

h) For collectives and individuals within the industry (under provinces or municipalities directly under the Central Government), relevant ministries, sectors, and central mass organizations need to send confirmation letters from the Ministry of Industry and Trade only if they submit achievement reports along with a letter requesting confirmation.

5. For sudden commendations, commendations during competition campaigns or specialized competitions

The file shall be implemented according to the provisions of Clause 2, Article 61 of Decree No. 42/2010/ND-CP and Clause 20, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit accompanied by a list of individuals and collectives proposed for commendation (Annex 2);

b) A summary report on achievements prepared by the direct managing agency or unit (stating clear achievements and merits) to propose commendation (Annex 9 or Annex 10).

6. For commendations for long-term contributions, the file shall be implemented according to the provisions of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit managing the cadre before retirement (Annex 2);

b) Report on achievements (Annex 11).

7. For commendations for foreigners, the file shall be implemented according to the provisions of Clause 13, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit where the foreigner works (Annex 2);

b) Report on achievements (Annex 12).

8. Certificates of Merit from the Ministry (Annex 13).

9. Certificates recognizing the title "Excellent Labor Collective", "Advanced Labor Collective" (Annex 14).

10. Certificates recognizing the title "Model Worker at the Grassroots Level" (Annex 15).

Article 21. Time for Receiving Application Files

1. Commendation based on achievements and merits for collectives and individuals under the authority of the Ministry shall be carried out according to the following provisions:

a) For annual commendations for titles of excellence, forms of commendation within the authority of the Minister, and the title "Flag of Excellence of the Government," the application files must be received no later than December 15 each year (based on the postmark).

b) For the title "National Labor Model," the application files must be received no later than February 20 each year (based on the postmark).

c) For Orders, Medals, and Certificates of Merit awarded by the Prime Minister, the time limit for receiving application files will be determined on a case-by-case basis.

d) For the title "Hero of Labor," the review period is every five years, except in cases of outstanding and exceptional achievements.

2. For titles of excellence and forms of commendation prescribed in Clause 4 and Clause 5 of Article 17 of this Circular, which fall under the authority of the Heads of agencies and units, the Heads of these agencies and units shall determine the time for receiving application files.

3. For immediate commendations and commendations on specific topics, the application files must be submitted no later than fifteen days from the date of achieving outstanding results or after the completion of the specific topic work.

Article 22. Procedure for Proposing Commendations

After receiving the application files for commendations or endorsements for commendations, the Department of Mobilization and Reward shall be responsible for reviewing the titles of excellence and forms of commendation according to current regulations, compiling them, and submitting them to the Chairman of the Mobilization and Reward Council for consideration and decision, or seeking opinions from members of the Council in writing. The results of the assessment by the Council shall be compiled and submitted to the Minister for decision. The procedure for proposing commendations for specific subjects is as follows:

1. In cases where commendations for the Golden Star Order, Ho Chi Minh Order, and the title "Hero of Labor" are proposed, the Department of Mobilization and Reward shall report and seek guidance from the Minister and the Chairman of the Mobilization and Reward Council before convening the Mobilization and Reward Council of the Ministry. In the application files submitted to the Prime Minister (through the Central Mobilization and Reward Board for review to submit to the President), there must be a written opinion of the Party Cadre and Civil Servant Committee of the Ministry of Industry and Trade.

2. In cases where titles of excellence and forms of commendation are reviewed for individuals and collectives of agencies and units under the Ministry, the Heads of these agencies and units shall prepare a Report and Minutes of the Meeting of the Mobilization and Reward Council at the grassroots level, and send them to the Department of Mobilization and Reward for review and submission to the Mobilization and Reward Council of the Ministry for consideration.

The Department of Mobilization and Reward shall complete the application files for the Minister's decision on commendations within their authority, or submit them to the Prime Minister for decision (through the Central Mobilization and Reward Board).

3. In cases where titles of excellence and forms of commendation such as the Flag of Excellence of the Ministry and Certificates of Merit from the Minister are reviewed for individuals and collectives under the Provincial Departments of Industry and Trade, the Department of Mobilization and Reward shall compile, review, and submit them to the Mobilization and Reward Council of the Ministry for consideration, and complete the application files for the Minister's decision.

4. In cases where commendations are given to individuals and collectives outside the industry, the Heads of agencies and units with direct relations shall prepare a Report accompanied by a summary report of the achievements of the individuals and collectives proposed for commendation, and send them to the Department of Mobilization and Reward for compilation, review, and submission to the Mobilization and Reward Council of the Ministry for consideration, and complete the application files for the Minister's decision.

5. The Department of Mobilization and Reward shall be responsible for proposing to the Mobilization and Reward Council of the Ministry to submit to the Minister for consideration and proposal to the competent authorities for commendations of titles of excellence and forms of commendation for the Leaders of the Ministry.

 

Chapter V

MOBILIZATION AND REWARD COUNCILS AT ALL LEVELS

 

Article 23. Competition and Reward Councils at all levels in the Industry and Trade Sector

1. Establish the Competition and Reward Council of the Ministry of Industry and Trade to direct competition and reward activities within the Industry and Trade Sector.

2. Establish Competition and Reward Councils at agencies and units under the Ministry to direct competition and reward activities within their respective agencies and units.

Article 24. Authority to Decide on Establishment Competition and Reward Councils at all levels in the Industry and Trade Sector

1. The Minister decides to establish the Competition and Commendation Council of the Ministry.

2. The head of agencies and units under the Ministry that have separate accounts, seals, and legal personality shall decide on the establishment of the Competition and Reward Council for their respective agencies and units.

Article 25. Composition Competition and Reward Councils at all levels in the Industry and Trade Sector

1. The composition of the Competition and Reward Council of the Ministry shall be implemented according to Decision No. 10292/QĐ-BCT dated November 13, 2014 of the Minister of Industry and Trade on the establishment of the Competition and Reward Council of the Ministry of Industry and Trade.

2. The composition of the Competition and Reward Council of agencies and units with separate accounts, seals, and legal personality includes:

a) The Chairman is the Head of the agency or unit;

b) Deputy Chairperson is the Chairman of the Trade Union of the agency or unit;

c) Standing Member is a person holding one of the following positions: Director of the Office, Head of Administrative, Organization, or Consolidation Departments, or an individual responsible for competition and reward work in the agency or unit;

d) Members include representatives from the Party Committee, Ho Chi Minh Communist Youth Union, Heads of departments, divisions, and specialized units, decided by the head of the agency or unit based on the principle of having 3, 5, 7, 9, or 11 members.

Article 26. Principles of Operation, Duties, and Powers of Competition and Reward Councils at All Levels

1. Competition and Reward Councils at all levels assist the head of the agency or unit at the same level in competition and reward work, operate according to the principle of democratic centralism and majority voting. In case the opinions of the members of the Competition and Reward Council are evenly divided, the opinion of the Chairman of the Council is decisive.

2. The principles of operation, duties, and specific powers of the Competition and Reward Council of the Ministry are carried out according to the Regulation on the Operation of the Competition and Reward Council of the Ministry of Industry and Trade issued together with Decision No. 10293/QĐ-BCT dated November 13, 2014 of the Minister of Industry and Trade on the issuance of the Regulation on the Operation of the Competition and Reward Council of the Ministry of Industry and Trade.

3. The principles of operation, duties, and specific powers of the Competition and Reward Council of agencies and units are regulated by the head of the agency or unit without contravening the Regulation on the Operation of the Competition and Reward Council of the Ministry.

 

Chapter VI

ANNOUNCEMENT OF REWARD RESULTS, STORAGE OF AWARD FILES

USE OF COMPETITION AND REWARD FUNDS

 

Article 27. Announcement of Reward Results

1. For collectives and individuals meeting the criteria for rewards and who have been decided upon by the competent authority to receive rewards, the agency reviewing the file must notify the proposing unit of the reward results within a period not exceeding fifteen (15) days from the date of the reward decision.

2. For cases where the criteria for rewards are not met, the reviewing agency must notify (with clear reasons stated) the proposing unit of the reward results within the time limit of fifteen (15) days as stipulated in Clause 1 of this Article.

3. In cases where the file is submitted along the wrong line of approval, the reviewing agency must notify and return the file to the proposing unit of the reward within a period not exceeding five (5) days from the date of receipt of the file.

Article 28. Archiving Commendation Files

1. The Commendation Councils at all levels shall be responsible for archiving commendation files of their respective levels in accordance with regulations to record achievements of generations for the revolutionary cause of the Party and the nation, educate traditions, build agencies and units, and serve the purpose of searching, handling complaints and petitions from citizens or confirming eligibility for beneficiaries when requested.

2. Commendation files must be handed over to the archives of the agency or unit when the retention period expires as prescribed by laws on archiving.

Article 29. Management and Utilization of the Competition and Commendation Fund

1. The Competition and Commendation Fund of the Ministry shall be implemented in accordance with Clause 1, Article 67 of Decree No. 42/2010/ND-CP; Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and utilization of the Competition and Commendation Fund under Decree No. 42/2010/ND-CP.

2. The Ministry of Industry and Trade encourages individuals and organizations both within and outside the industry to support and contribute to supplementing the annual Competition and Commendation Fund of the Ministry.

3. The Competition and Commendation Fund of the Ministry shall be used for:

a) Paying cash awards or commemorative gifts to individuals and groups under the Ministry according to commendation decisions;

b) Allocating 20% of the total Competition and Commendation Fund of the Ministry to cover expenses for organizing and directing competition movements;

c) At year-end, the remaining balance in the Fund shall be transferred to the next year for continued use in competition and commendation activities.

4. Specific amounts of cash awards accompanying commendation titles and forms shall be implemented in accordance with Articles 71 to 76 of Decree No. 42/2010/ND-CP.

5. The Competition and Commendation Fund of the Ministry shall be managed by the Department of Competition and Commendation; the Competition and Commendation Funds of agencies and units with legal personality, separate bank accounts, and individual seals may be used to pay cash awards or commemorative gifts to individuals and groups under the agency or unit that have been commended.

 

Chapter VII

IMPLEMENTATION

 

Article 30. Inspection of Competition and Commendation Activities

1. The Department of Competition and Commendation shall assist the Ministry's Competition and Commendation Council in inspecting competition and commendation activities at agencies and units within the industry.

2. Heads of agencies and units shall be responsible for inspecting competition and commendation activities at agencies and units under their management.

Article 31. Handling Violations and Resolving Complaints and Allegations

1. Individuals and groups who falsify achievements to obtain commendation shall have their commendation decisions revoked, and any awarded items and cash prizes shall be recovered; depending on the nature and severity of the violation, they may be subject to disciplinary action, administrative penalties, or criminal liability pursued, and if damage is caused, compensation must be provided as prescribed.

2. Heads of agencies or organizations who certify false information or forge files for others to request commendation shall be subject to disciplinary action, administrative penalties, or criminal liability pursued, depending on the nature and severity of the violation, and if damage is caused, compensation must be provided as prescribed.

3. The resolution of complaints and allegations regarding competition and commendation activities shall be carried out in accordance with Article 98 of the Law on Competition and Commendation and the relevant provisions of laws on complaints and allegations.

4. The Department of Competition and Commendation shall be responsible for receiving, resolving complaints and allegations regarding competition and commendation activities within its jurisdiction, and coordinating with the Inspectorate of the Ministry, related units to investigate, verify, and report to the Chairman of the Ministry's Competition and Commendation Council and the leadership of the Ministry of Industry and Trade for consideration and decision.

Article 32. Report on Competition and Reward Work

Clause 1. Annually in the fourth quarter, agencies and units under the Ministry of Industry and Trade, Departments of Industry and Trade of centrally governed cities and provinces shall summarize, evaluate competition and reward work, assess rewards for the year, and submit reports to the Ministry of Industry and Trade no later than December 15.

Clause 2. Training institutions under the Ministry of Industry and Trade shall summarize, evaluate competition and reward work, assess rewards for the year, and submit reports to the Ministry of Industry and Trade no later than August 10.

Clause 3. Agencies and units within the industry that initiate competition movements and after each competition period shall be responsible for interim summaries, final summaries, competition assessments, and submitting reports to the Ministry of Industry and Trade.

Article 33. Effective Date

Clause 1. This Circular takes effect from October 3, 2015, and replaces Circular No. 43/2011/TT-BCT dated December 26, 2011, issued by the Ministry of Industry and Trade detailing the implementation of competition and reward work in the industry.

Clause 2. The Competition and Reward Council of the Ministry directs the implementation of this Circular.

Clause 3. The Department of Competition and Reward is responsible for monitoring, urging, and inspecting the implementation of this Circular, and based on the actual situation of annual competition movements, researching and proposing reasonable quantities and ratios of rewards for the Minister's consideration and decision.

Clause 4. Heads of agencies and units shall organize the implementation of this Circular and concretize appropriate standards in accordance with the operational circumstances of their agencies and units.

Clause 5. During the implementation of this detailed regulation on competition and reward work in the industry, if there are difficulties or unsuitable provisions, heads of agencies and units under the Ministry, Directors of Industry and Trade Departments of centrally governed cities and provinces shall report to the Ministry of Industry and Trade for study, supplementation, and amendment./.CIRCULAR

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as the Law on Competition and Reward);

Based on Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 42/2010/ND-CP); Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 39/2012/ND-CP) and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as Decree No. 65/2014/ND-CP);

PURSUANT TO THE proposal of the Director of the Department of Competition and Rewards;

The Minister of Industry and Trade issues this Circular detailing the implementation of competition and reward work in the Industry and Trade sector.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Circular details the implementation of competition and reward work in the Industry and Trade sector, including: forms and contents of organizing competition movements; titles of honor and criteria for such titles; forms, subjects, and criteria for rewards; authority to decide on granting awards, procedures, and application files for award nominations; Competition and Reward Councils at all levels; competition and reward funds and handling violations related to competition and reward.

Article 2. Applicability

1. Competitors

The subjects of competition under this Circular include: officials, civil servants, public employees, laborers within the establishment, indefinite-term labor contracts, and definite-term labor contracts from 12 to 36 months working in agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade under central cities (hereinafter referred to as individuals); agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade, and enterprises under central cities (hereinafter referred to as groups).

2. Recipients of rewards

a) The subjects specified in Clause 1 of this Article;

b) Individuals and groups with activities related to the Industry and Trade sector in agencies and units under various Ministries, sectors, and localities;

c) Vietnamese individuals and groups abroad and foreign individuals and groups who have made significant contributions to building, protecting, and developing the Industry and Trade sector in Vietnam.

Article 3. Objectives of competition and reward

Competition and reward work aims to create motivation, encourage, and honor groups and individuals who enthusiastically engage in creative labor competitions, striving to complete assigned tasks excellently, contributing to the development of the Industry and Trade sector.

Article 4. Principles of competition and reward

1. Principles of Competition

a) Voluntary, conscientious, transparent; ensuring a spirit of unity, cooperation, and mutual development;

b) Bestowing competition titles must be based on the results of the competition movement;

c) Individuals and groups participating in the competition movement must register for competition, set competition goals, and criteria. Those individuals and groups that do not register for competition will not be considered or recognized for competition titles.

2. Principles of Reward

a) Accurate, transparent, democratic, fair, and timely based on the correct assessment of the performance of groups and individuals; emphasizing quality according to standards rather than forcing quantity; achievements obtained under difficult conditions and having a wide impact are rewarded at a higher level; focusing on rewarding individuals directly involved in labor and work and those with many innovations in labor and work;

b) When considering rewards for the head of an agency, organization, or unit, it must be based on the achievements of the group led by that individual;

c) For female leaders and managers, the period of holding office for consideration of rewards can be reduced by three years compared to the general regulations. For rewards for economic and social achievements, when there are multiple individuals and groups meeting the conditions and criteria, individuals and groups with a female ratio of 70% or more should be selected for rewards;

d) A reward form may be given multiple times to the same subject; multiple reward forms shall not be given for a single achievement;

đ) Ensuring consistency between the nature, form, and recipient of rewards;

e) Combining spiritual encouragement closely with material incentives;

g) The time for proposing rewards for the next round is calculated from the date of the previous reward decision.

Article 5. Responsibilities of Heads of Agencies and Units in Competition and Commendation Work

1. The Minister shall initiate and direct competition movements within the entire Industry and Trade sector. The Ministry's Competition and Commendation Council shall be responsible for advising the Minister on the content of competitions and organizing competition movements.

2. The Head of an agency or unit shall organize the initiation and direction of competition movements within their managed agencies or units.

3. Organizations under agencies and units need to closely coordinate with the Heads of the same level agencies and units to direct the organization of the initiation and maintenance of regular competition movements, expand competition movements and exemplary models within their agencies and units; proactively identify and select collectives and individuals with outstanding achievements for commendation or recommend higher-level commendation according to this Circular.

Article 6. Responsibilities of Industry Media Outlets

Industry newspapers and magazines have the responsibility to regularly publicize competition and commendation work; disseminate and set examples of advanced models, good people and deeds, promote competition movements; identify individuals and collectives with outstanding achievements in competition movements; combat and criticize violations of laws on competition and commendation within the Industry and Trade sector.

Article 7. Rights and Obligations of Individuals and Collectives Receiving Commendation

1. Individuals receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, and material rewards; they may be considered for early promotion according to regulations; they are given priority for research study, work assignments, and professional skill enhancement both domestically and internationally; commendatory titles and forms of commendation serve as one of the bases for evaluation, planning, appointment, and reappointment of cadres annually.

2. Collectives receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, or material rewards on official documents and materials of the agency or unit.

3. Collectives and individuals recognized with commendatory titles and forms of commendation shall be responsible for maintaining and further striving to achieve higher commendatory titles and achievements; they must properly preserve material rewards. It is strictly prohibited to buy, sell, lease, lend, give away, or transfer material rewards in any form.

 

Chapter II

FORMS AND CONTENT OF ORGANIZING COMPETITION MOVEMENTS

COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

 

Article 8. Forms of Organizing Competitions

1. Regular competitions are organized and implemented daily, monthly, quarterly, and annually to achieve set goals, targets, and work programs.

2. Periodic or thematic competitions are organized to enhance the quality and effectiveness of work, strive to excellently complete key and urgent tasks within a specific period, or address difficult, complex issues, weaknesses, and pending matters.

a) The Industry and Trade sector organizes periodic or thematic competitions to strive for successful implementation of five-year and annual socio-economic development plans assigned by the State.

b) Agencies and units within the sector organize competitions to celebrate traditional days of the sector, agency, or unit, and anniversaries of establishment of the sector, agency, or unit.

Article 9. Content of organizing competitive movements

1. Clearly define the objectives, scope, target groups for competition, set out specific targets, slogans, contents of the competition, and the duration of the competition. The determination of the content and criteria for the competition must be scientific, appropriate to the practical conditions of each agency or unit, and feasible.

2. Determine measures to organize competitive movements; adopt suitable forms to launch competitive movements, emphasizing the promotion of the significance of the competition period, and fostering a sense of responsibility.

3. Launch and direct the implementation of competitive movements; have plans to implement measures to mobilize and promote competition, monitor the process of organizing the competition, organize pilot guidance to draw lessons and disseminate good practices for participants in the competition.

4. Summarize and conclude on the competitive movement, evaluate the results of the competition. For long-term competition periods (lasting one year or more), agencies and units must organize mid-term summaries to draw lessons; at the end of short-term competition periods (less than one year) or each phase, conduct summaries and conclusions to evaluate results; publicly select, review, commend, and reward individuals and collectives with outstanding achievements in the competitive movement. Promote and disseminate exemplary models within agencies and units.

Article 10. Registration for Competition Titles

Each year, no later than March 15, agencies and units shall organize for individuals and collectives to register their efforts to achieve competitive movements, competition targets, competition titles, and submit the competition registration form (according to Form 1a and 1b in Appendix 1 issued together with this Circular) to the Ministry for monitoring, serving as the basis for awarding competition titles.

Article 11. Competition Titles

1. For Individuals

a) National Model Competitor;

b) Outstanding Soldier of the Ministry;

c) Grassroots Model Competitor;

d) Advanced Worker.

2. For Collectives

a) Flag of Government Competition;

b) Flag of the Ministry;

c) Outstanding Labor Group;

d) Advanced Labor Group.

Article 12. Criteria for Awarding Competition Titles to Individuals

1. Individuals who achieve the title "National Outstanding Soldier" must meet the following criteria:

a) Have outstanding and excellent achievements selected from those individuals who have continuously achieved the title "Outstanding Soldier of the Ministry" twice;

b) Have innovative ideas, research topics achieving high effectiveness, having national-wide influence, and recognized by the Ministry's Commendation and Reward Council and the Ministry-level Science Council.

The Ministry's Commendation and Reward Council and the Ministry-level Science Council are responsible for assisting the Minister of Industry and Trade in reviewing and recognizing innovative ideas and research topics. These councils are established and operate according to the Council's operational regulations, decided by the Minister.

The time for considering the title "National Outstanding Soldier" is the year immediately following the second year of achieving the title "Outstanding Soldier of the Ministry."

2. Individuals who achieve the title "Outstanding Soldier of the Ministry" must meet the following criteria:

a) Have outstanding achievements among those individuals who have continuously achieved the title "Outstanding Soldier at the Base" three times;

b) Achievements, innovative ideas, work solutions, and research topics of individuals have an impact within the industry of Industry and Trade.

The time for considering the title "Outstanding Soldier of the Ministry" is the year when the individual achieves the title "Outstanding Soldier at the Base" for the third time.

3. Individuals who achieve the title "Outstanding Soldier at the Base" must meet the following criteria:

a) Advanced Worker;

b) Have innovative ideas that are technical solutions, management solutions, operational solutions, or applications of advanced technology to increase labor productivity, improve work efficiency, recognized by the base or have research topics that have been accepted and applied, completed excellently, recognized by the agency, organization, or unit.

The assessment of the impact of innovative ideas and research topics is assisted by the Base Innovation Council and the Base Science Council to help the head of the agency, organization, or unit recognize them. These councils are established and operate according to the Council's operational regulations, decided by the competent authority of the agency, organization, or unit that recognizes the title "Outstanding Soldier at the Base."

The granting of the title "Outstanding Soldier at the Base" is conducted annually, implemented with a ratio of no more than 15% of the number of officers, civil servants, public officials, and workers in the agency or unit who have achieved the title "Advanced Worker."

4. Individuals who achieve the title "Advanced Worker" must meet the criteria stipulated in Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Rewards in 2013.

Individuals who bravely save people or property leading to injuries requiring treatment or convalescence as concluded by medical facilities shall have the treatment and convalescence period counted towards the consideration for the title "Advanced Worker."

Individuals sent for short-term training or development under one year, complying well with the regulations of the training or development institution, shall have their study period counted towards their working time at the agency or unit for the evaluation of the title "Advanced Worker." In cases where individuals are sent for training or development for one year or more, comply well with the regulations of the training or development institution, and have satisfactory academic performance, they may be considered for the title "Advanced Worker."

The maternity leave period as prescribed shall be counted towards the evaluation for the title "Advanced Worker."

For individuals transferred to new agencies, organizations, or units, the new agency, organization, or unit shall be responsible for evaluating and voting for the title "Advanced Worker" (if the individual has worked at the previous agency for six months or more, the opinion of the previous agency must be obtained).

In cases where individuals are temporarily assigned to other agencies or units, the evaluation and voting for the title "Advanced Worker" shall be decided by the agency or unit that assigns them (with comments from the receiving agency or unit).

The title "Advanced Worker" shall not be granted in any of the following cases: newly recruited for less than ten months, absent from work for forty days or more, or disciplined with a warning or higher.

Article 13. Criteria for awarding commendation titles to collectives

1. Collectives awarded the title "Flag of Government Competition" must meet the criteria stipulated in Article 25 of the Law on Competition and Rewards; Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, and Article 6 of Decree No. 65/2014/NĐ-CP.

Collectives eligible for the Flag of Government Competition must be the most outstanding collectives selected among those not exceeding 20% of the collectives awarded the "Flag of Ministry Competition."

The awarding of the title "Flag of Government Competition" is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year).

Annually, based on competition registration with the Government (through the Central Board for Competition and Rewards), the Ministry of Industry and Trade allocates the number of Flags to agencies and units within the sector.

2. Collectives awarded the title "Flag of Ministry Competition" must meet the following criteria:

a) Exceeding all set competition targets and assigned tasks for the year; being exemplary collectives that excel in their work tasks.

b) Having new factors and models for other collectives in the industry to emulate.

c) Internal unity, actively practicing thrift, combating waste, corruption, and other social evils.

The awarding of the Flag of Ministry Competition is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year). Annually, the Ministry issues specific guidelines on allocating the number of Ministry Competition Flags to agencies and units under the Ministry and Provincial Departments of Industry and Trade.

By March 15 each year, units in the industry register for the Flag of Government Competition and the Flag of Ministry Competition with the Department of Competition and Rewards.

3. Collectives awarded the title "Outstanding Labor Collective" must be exemplary collectives chosen from among those awarded the title "Advanced Labor Collective," according to the criteria specified in Clause 1, Article 27 of the Law on Competition and Rewards.

4. Collectives awarded the title "Advanced Labor Collective" must meet the criteria stipulated in Clause 1, Article 28 of the Law on Competition and Rewards.

For newly established agencies, units, and enterprises, they must have been operating for at least one year (12 months) before being eligible for the titles "Advanced Labor Collective" and "Outstanding Labor Collective."

 

Chapter III

FORMS OF REWARD,

CRITERIA FOR REWARD FORMS

 

Article 14. Types of rewards

1. Reward based on achievements and accomplishments is a form of reward for collectives and individuals who achieve outstanding results in implementing annual plans or multi-year plans.

2. Special topic reward (or campaign reward) is a reward for collectives and individuals who achieve outstanding results in work after completing a competition campaign initiated by the President, Prime Minister, Minister, or head of unit, related to the implementation of the unit's tasks.

3. Immediate reward is a reward for collectives and individuals who achieve outstanding results in labor, production, or combat service; bravery in rescuing people or state property (immediate achievement is an achievement made in unforeseen circumstances outside the normal work plan that the collective or individual must undertake).

4. Reward for dedication over time is a reward for individuals who have contributed significantly during various revolutionary stages (holding leadership or management positions in state agencies, public institutions, political organizations, or social-political organizations in the industry), making outstanding contributions to the revolutionary cause of the Party and the nation.

5. Foreign reward is a reward for foreign collectives and individuals who have made significant contributions to the construction and development of the industry.

Article 15. Forms of Reward

1. Forms of reward of the State:

Medals, Orders, National Honorary Titles, Ho Chi Minh Prize, State Prize, and Certificates of Merit from the Prime Minister.

2. Forms of reward of the Ministry:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

3. Forms of reward of the head of an organization or unit with its own account, seal, and legal personality:

Commendation Letter.

Article 16. Criteria for forms of reward

1. Medals, Orders, Certificates of Merit from the Prime Minister, National Honorary Titles, Ho Chi Minh Prize, and State Prize shall be implemented according to the provisions of Clause 1, 2, Article 20; Clause 1, 4, Article 21; Articles 34, 35, 36, 37, 38, 39, 40, 42, 43, 44, 45, 46, 47 of Decree No. 42/2010/ND-CP; from Article 7 to Article 23 of Decree No. 65/2014/ND-CP and Decree No. 123/2014/ND-CP dated December 25, 2014 of the Government on awarding the titles "People's Artist" and "Outstanding Artist" in the field of traditional craft industries.

2. The Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" shall be implemented according to the Regulation on awarding the Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" issued together with Decision No. 46/2008/QD-BCT dated December 17, 2008 of the Minister of Industry and Trade and Circular No. 08/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade on amending and supplementing some articles of administrative procedures in Decision No. 46/2008/QD-BCT.

3. The Women's Scientific Creativity Award in Industry and Trade shall be implemented according to the Regulation on awarding the Women's Scientific Creativity Award in Industry and Trade issued together with Decision No. 38/2008/QD-BCT dated October 21, 2008 of the Minister of Industry and Trade.

4. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to individuals who model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results;

c) Achieving many results with significant influence within their respective fields under the Ministry;

d) Excellently completing tasks for two consecutive years, during which time two recognized and effectively applied initiatives were implemented at the grassroots level;

đ) Having a long-term career with significant contributions to the construction and development of the Industry and Trade sector, recognized on the occasion of celebrating the founding day of the sector, agency, or unit, or before retirement;

e) Other cases to be considered and decided by the Minister.

5. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to groups that model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding and exemplary results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results or many results with significant influence within their respective fields under the Industry and Trade sector;

c) Excellently completing tasks for two consecutive years, maintaining internal unity, implementing democratic regulations at the grassroots level, organizing good competition campaigns, caring for the material and spiritual life of group members, practicing thrift, and fulfilling all systems and policies for every member of the group.

The granting of rewards to agencies, units, and small groups within agencies and units under the Ministry that achieve outstanding and exceptionally excellent results or have made contributions to building and developing their agencies and units on the occasion of celebrating their founding days shall be carried out during the annual summary of work of the Ministry.

6. Commendation Letters from the head of an organization or unit with its own account, seal, and legal personality

Shall be implemented according to the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Campaigns and Rewards 2013.

7. Campaigns can be organized on a large scale within a unit, locality, industry, or ministry

a) When summarizing and concluding campaigns, mainly implement the reward forms of the campaign initiator (Commendation Letters, Certificates of Merit);

b) In cases organized nationwide, when summarizing and concluding campaigns lasting three years or more, the initiating unit selects outstanding and excellent collectives and individuals to recommend to the Prime Minister for the awarding of Certificates of Merit;

c) In cases organized nationwide, when summarizing and concluding campaigns lasting five years or more, the initiating unit selects outstanding and exceptionally excellent collectives and individuals to recommend to the President for the awarding of the "Labor Medal" Class III and mainly reward direct laborers and workers.

 

Chapter IV

AUTHORITY TO DECIDE, AWARDS, PROCEDURES, AND FILES

AND THE PROCESS OF RECOMMENDING AWARDS

 

Article 17. Authority to decide and present awards

1. The authority to decide and present awards for Orders, Medals, Ho Chi Minh Prize, State Prize, National Honorary Titles, Government Flag of Merit, National Model Worker, Prime Minister's Commendation shall be implemented according to the provisions set forth in Articles 77 and 78 of the Law on Competition and Rewards.

2. The Minister of Industry and Trade decides to award the following commendations:

a) The Flag of Merit of the Ministry;

b) Outstanding Soldier of the Ministry;

c) Outstanding Labor Collectives:

- The Minister decides to award the title "Outstanding Labor Collective" to administrative and public service units under the Ministry; enterprises under the Ministry (excluding economic groups and holding companies);

- The Minister delegates the authority to the Heads of agencies and units with legal personality, separate bank accounts, and their own seals to decide to award the title "Outstanding Labor Collective" to units, departments, rooms, faculties, factories, workshops, teams, squads that are subordinate members.

d) Advanced Workers and Model Workers at the grassroots level for individuals and Advanced Worker Collectives for collectives within units under the Ministry's agencies without legal personality.

3. The Minister of Industry and Trade decides to award the following forms of commendation:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

4. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following commendations:

a) Advanced Labor Collective;

b) Excellent Labor Collective;

c) Advanced Worker;

d) Model Workers at the grassroots level.

5. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following forms of commendation:

Commendation Letter.

Article 18. Ceremony for presenting commendations and awards

Announcing and presenting commendations and awards is an occasion to honor exemplary individuals and outstanding achievements. The ceremony must be solemn, practical, economical, avoiding ostentation and waste.

1. Organizing rallies, commemorative ceremonies, presentations, and receptions of national honorary titles, Orders, Medals, Government Flags of Merit, Prime Minister's Commendations are carried out according to the provisions stipulated in Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on organizing commemorative days; presentation and reception rituals of commendations and commendatory titles; diplomatic ceremonies and welcoming foreign guests.

2. The Minister of Industry and Trade, authorized by Party and State leaders, presents the Government Flag of Merit to agencies and units under the Ministry and directly presents the Ministry's Flag of Merit and the Minister's Commendation to subordinate agencies and units of the Ministry and provincial Departments of Industry and Trade at the annual work summary conference of the Ministry.

3. The Minister of Industry and Trade authorizes the Heads of agencies and units responsible for organizing the presentation of commendations and awards as follows:

a) For Orders and Medals: After receiving notifications from the Department of Competition and Rewards and decisions, reward items, the Head of the agency or unit develops a plan to organize and receive them, reporting to the Minister (through the Department of Competition and Rewards). Following the Minister's instructions, the Department of Competition and Rewards coordinates with relevant agencies and units to announce and present them, possibly combining with other practical programs of the agency or unit to save time and costs. For some special cases, the Department of Competition and Rewards develops a plan to organize the reception and report to the Minister, then organize the announcement and presentation;

b) For the title of National Model Worker and the form of commendation of the Prime Minister's Commendation for individuals and collectives: The Head of the agency or unit proactively develops a plan, organizes the announcement and presentation to individuals and collectives under their responsibility who have been commended, and informs the Department of Competition and Rewards for guidance and monitoring;

c) For commendations and awards within the authority of the Minister of Industry and Trade: The Minister delegates the authority to the Heads of agencies and units to announce and present to individuals and collectives under their management;

d) For individuals and collectives awarded commendations and awards within the authority of the Heads of agencies and units, the agencies and units themselves organize the announcement and presentation.

Article 19. Commendation Procedures

1. The level that initiates a competition campaign shall select outstanding individuals and collectives for commendation or propose to a higher level for commendation.

2. Heads of agencies and units under the Ministry shall be responsible for commending within their authority or proposing to a higher level for commendation for individuals and collectives under their management.

3. Regarding Provincial Departments of Industry and Trade and Municipal Departments of Industry and Trade directly under the Central Government

a) Proposals for awarding commendation titles and forms of commendation by the State shall be reviewed and submitted by the People's Committee of the province or municipality directly under the Central Government according to the provisions of the Law on Competition and Commendation, Decree No. 42/2010/ND-CP, Decree No. 65/2014/ND-CP, and guiding documents issued by the People's Committee of the province or municipality directly under the Central Government;

b) The Ministry of Industry and Trade shall concur with commendations for commendation titles and forms of commendation by the State based on proposals from the People's Committee of the province or municipality directly under the Central Government or the National Competition and Commendation Board;

c) Proposals for the title "Flag of Competition of the Ministry of Industry and Trade" and other forms of commendation within the authority of the Minister of Industry and Trade shall be carried out like other agencies and units under the Ministry when the Ministry launches a specialized competition campaign.

4. Regarding industry associations under the Ministry of Industry and Trade

The Chairman of the Association shall consider and propose commendation within the authority of the Minister of Industry and Trade.

5. Regarding units outside the industry

The head of the agency or unit with activities related to the industry shall propose to the competent authorities for consideration and propose commendation within the authority of the Minister of Industry and Trade.

Article 20. Documents for Proposing Commendation

1. The Department of Competition and Commendation shall be responsible for receiving commendation proposal files from agencies and units both inside and outside the industry.

2. For Certificates of Merit and Flags of Competition of the Ministry of Industry and Trade, one set of files includes:

a) A proposal for commendation by the Director of the Provincial Department of Industry and Trade or the Municipality directly under the Central Government for collectives and individuals under their department or by the head of the agency or unit under the Ministry for collectives and individuals under their agency or unit (Annex 2);

b) Minutes of meetings of the Competition and Commendation Council of the Provincial Department of Industry and Trade or Municipality directly under the Central Government or minutes of meetings of the Competition and Commendation Council of the agency or unit under the Ministry (Annex 3);

c) Reports on achievements of collectives (signed and stamped by the head of the agency or unit) and individuals (signed, clearly stating full name, confirmed by the head of the agency or unit signing and stamping) proposed for commendation (Annexes 4 and 5);

d) Copies of Decisions or Certificates awarding the title "Model Worker at the Grassroots Level" or "Outstanding Labor Collective" by the competent authority;

đ) Confirmation of inventions and scientific research topics recognized by the Invention Council or Scientific Council at the grassroots level; Copies of National or International Awards (if any).

3. For the title "Heroic Laborer", the file shall be implemented according to the provisions of Clause 23, Article 1 of Decree No. 39/2012/ND-CP (Annexes 6 and 7).

4. For the title "National Model Worker", "Flag of Competition of the Government", and forms of commendation such as Orders, Certificates of Merit from the Prime Minister, Medals, the file shall be implemented according to the provisions of Clauses 6, 10, 12, 15, 18, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation (Annex 2);

b) Minutes of meetings of the Competition and Commendation Council (Annex 3);

c) Copies of Decisions or Certificates awarding commendation titles and forms of commendation by the competent authority for collectives and individuals proposed for commendation;

d) Reports on achievements of individuals and collectives proposed for commendation must have signatures, clearly stating full names of the preparers and signatures, stamps (if any) confirming by the head of the agency or unit (Annexes 4 and 5);

đ) Confirmation of inventions and scientific research topics recognized by the Invention Council or Scientific Council at various levels; Copies of National or International Awards (Annex 8);

e) Confirmation of fulfilling state budget payment obligations for collectives and individuals who are heads of agencies or units with state budget payment obligations (confirmed by the tax authority of the province or municipality directly under the Central Government);

g) Opinions of local People's Committees (commune, ward) regarding activities on their territory;

h) For collectives and individuals within the industry (under provinces or municipalities directly under the Central Government), relevant ministries, sectors, and central mass organizations need to send confirmation letters from the Ministry of Industry and Trade only if they submit achievement reports along with a letter requesting confirmation.

5. For sudden commendations, commendations during competition campaigns or specialized competitions

The file shall be implemented according to the provisions of Clause 2, Article 61 of Decree No. 42/2010/ND-CP and Clause 20, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit accompanied by a list of individuals and collectives proposed for commendation (Annex 2);

b) A summary report on achievements prepared by the direct managing agency or unit (stating clear achievements and merits) to propose commendation (Annex 9 or Annex 10).

6. For commendations for long-term contributions, the file shall be implemented according to the provisions of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit managing the cadre before retirement (Annex 2);

b) Report on achievements (Annex 11).

7. For commendations for foreigners, the file shall be implemented according to the provisions of Clause 13, Article 1 of Decree No. 39/2012/ND-CP, including:

a) A proposal for commendation by the agency or unit where the foreigner works (Annex 2);

b) Report on achievements (Annex 12).

8. Certificates of Merit from the Ministry (Annex 13).

9. Certificates recognizing the title "Excellent Labor Collective", "Advanced Labor Collective" (Annex 14).

10. Certificates recognizing the title "Model Worker at the Grassroots Level" (Annex 15).

Article 21. Time for Receiving Application Files

1. Commendation based on achievements and merits for collectives and individuals under the authority of the Ministry shall be carried out according to the following provisions:

a) For annual commendations for titles of excellence, forms of commendation within the authority of the Minister, and the title "Flag of Excellence of the Government," the application files must be received no later than December 15 each year (based on the postmark).

b) For the title "National Labor Model," the application files must be received no later than February 20 each year (based on the postmark).

c) For Orders, Medals, and Certificates of Merit awarded by the Prime Minister, the time limit for receiving application files will be determined on a case-by-case basis.

d) For the title "Hero of Labor," the review period is every five years, except in cases of outstanding and exceptional achievements.

2. For titles of excellence and forms of commendation prescribed in Clause 4 and Clause 5 of Article 17 of this Circular, which fall under the authority of the Heads of agencies and units, the Heads of these agencies and units shall determine the time for receiving application files.

3. For immediate commendations and commendations on specific topics, the application files must be submitted no later than fifteen days from the date of achieving outstanding results or after the completion of the specific topic work.

Article 22. Procedure for Proposing Commendations

After receiving the application files for commendations or endorsements for commendations, the Department of Mobilization and Reward shall be responsible for reviewing the titles of excellence and forms of commendation according to current regulations, compiling them, and submitting them to the Chairman of the Mobilization and Reward Council for consideration and decision, or seeking opinions from members of the Council in writing. The results of the assessment by the Council shall be compiled and submitted to the Minister for decision. The procedure for proposing commendations for specific subjects is as follows:

1. In cases where commendations for the Golden Star Order, Ho Chi Minh Order, and the title "Hero of Labor" are proposed, the Department of Mobilization and Reward shall report and seek guidance from the Minister and the Chairman of the Mobilization and Reward Council before convening the Mobilization and Reward Council of the Ministry. In the application files submitted to the Prime Minister (through the Central Mobilization and Reward Board for review to submit to the President), there must be a written opinion of the Party Cadre and Civil Servant Committee of the Ministry of Industry and Trade.

2. In cases where titles of excellence and forms of commendation are reviewed for individuals and collectives of agencies and units under the Ministry, the Heads of these agencies and units shall prepare a Report and Minutes of the Meeting of the Mobilization and Reward Council at the grassroots level, and send them to the Department of Mobilization and Reward for review and submission to the Mobilization and Reward Council of the Ministry for consideration.

The Department of Mobilization and Reward shall complete the application files for the Minister's decision on commendations within their authority, or submit them to the Prime Minister for decision (through the Central Mobilization and Reward Board).

3. In cases where titles of excellence and forms of commendation such as the Flag of Excellence of the Ministry and Certificates of Merit from the Minister are reviewed for individuals and collectives under the Provincial Departments of Industry and Trade, the Department of Mobilization and Reward shall compile, review, and submit them to the Mobilization and Reward Council of the Ministry for consideration, and complete the application files for the Minister's decision.

4. In cases where commendations are given to individuals and collectives outside the industry, the Heads of agencies and units with direct relations shall prepare a Report accompanied by a summary report of the achievements of the individuals and collectives proposed for commendation, and send them to the Department of Mobilization and Reward for compilation, review, and submission to the Mobilization and Reward Council of the Ministry for consideration, and complete the application files for the Minister's decision.

5. The Department of Mobilization and Reward shall be responsible for proposing to the Mobilization and Reward Council of the Ministry to submit to the Minister for consideration and proposal to the competent authorities for commendations of titles of excellence and forms of commendation for the Leaders of the Ministry.

 

Chapter V

MOBILIZATION AND REWARD COUNCILS AT ALL LEVELS

 

Article 23. Competition and Reward Councils at all levels in the Industry and Trade Sector

1. Establish the Competition and Reward Council of the Ministry of Industry and Trade to direct competition and reward activities within the Industry and Trade Sector.

2. Establish Competition and Reward Councils at agencies and units under the Ministry to direct competition and reward activities within their respective agencies and units.

Article 24. Authority to Decide on Establishment Competition and Reward Councils at all levels in the Industry and Trade Sector

1. The Minister decides to establish the Competition and Commendation Council of the Ministry.

2. The head of agencies and units under the Ministry that have separate accounts, seals, and legal personality shall decide on the establishment of the Competition and Reward Council for their respective agencies and units.

Article 25. Composition Competition and Reward Councils at all levels in the Industry and Trade Sector

1. The composition of the Competition and Reward Council of the Ministry shall be implemented according to Decision No. 10292/QĐ-BCT dated November 13, 2014 of the Minister of Industry and Trade on the establishment of the Competition and Reward Council of the Ministry of Industry and Trade.

2. The composition of the Competition and Reward Council of agencies and units with separate accounts, seals, and legal personality includes:

a) The Chairman is the Head of the agency or unit;

b) Deputy Chairperson is the Chairman of the Trade Union of the agency or unit;

c) Standing Member is a person holding one of the following positions: Director of the Office, Head of Administrative, Organization, or Consolidation Departments, or an individual responsible for competition and reward work in the agency or unit;

d) Members include representatives from the Party Committee, Ho Chi Minh Communist Youth Union, Heads of departments, divisions, and specialized units, decided by the head of the agency or unit based on the principle of having 3, 5, 7, 9, or 11 members.

Article 26. Principles of Operation, Duties, and Powers of Competition and Reward Councils at All Levels

1. Competition and Reward Councils at all levels assist the head of the agency or unit at the same level in competition and reward work, operate according to the principle of democratic centralism and majority voting. In case the opinions of the members of the Competition and Reward Council are evenly divided, the opinion of the Chairman of the Council is decisive.

2. The principles of operation, duties, and specific powers of the Competition and Reward Council of the Ministry are carried out according to the Regulation on the Operation of the Competition and Reward Council of the Ministry of Industry and Trade issued together with Decision No. 10293/QĐ-BCT dated November 13, 2014 of the Minister of Industry and Trade on the issuance of the Regulation on the Operation of the Competition and Reward Council of the Ministry of Industry and Trade.

3. The principles of operation, duties, and specific powers of the Competition and Reward Council of agencies and units are regulated by the head of the agency or unit without contravening the Regulation on the Operation of the Competition and Reward Council of the Ministry.

 

Chapter VI

ANNOUNCEMENT OF REWARD RESULTS, STORAGE OF AWARD FILES

USE OF COMPETITION AND REWARD FUNDS

 

Article 27. Announcement of Reward Results

1. For collectives and individuals meeting the criteria for rewards and who have been decided upon by the competent authority to receive rewards, the agency reviewing the file must notify the proposing unit of the reward results within a period not exceeding fifteen (15) days from the date of the reward decision.

2. For cases where the criteria for rewards are not met, the reviewing agency must notify (with clear reasons stated) the proposing unit of the reward results within the time limit of fifteen (15) days as stipulated in Clause 1 of this Article.

3. In cases where the file is submitted along the wrong line of approval, the reviewing agency must notify and return the file to the proposing unit of the reward within a period not exceeding five (5) days from the date of receipt of the file.

Article 28. Archiving Commendation Files

1. The Commendation Councils at all levels shall be responsible for archiving commendation files of their respective levels in accordance with regulations to record achievements of generations for the revolutionary cause of the Party and the nation, educate traditions, build agencies and units, and serve the purpose of searching, handling complaints and petitions from citizens or confirming eligibility for beneficiaries when requested.

2. Commendation files must be handed over to the archives of the agency or unit when the retention period expires as prescribed by laws on archiving.

Article 29. Management and Utilization of the Competition and Commendation Fund

1. The Competition and Commendation Fund of the Ministry shall be implemented in accordance with Clause 1, Article 67 of Decree No. 42/2010/ND-CP; Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and utilization of the Competition and Commendation Fund under Decree No. 42/2010/ND-CP.

2. The Ministry of Industry and Trade encourages individuals and organizations both within and outside the industry to support and contribute to supplementing the annual Competition and Commendation Fund of the Ministry.

3. The Competition and Commendation Fund of the Ministry shall be used for:

a) Paying cash awards or commemorative gifts to individuals and groups under the Ministry according to commendation decisions;

b) Allocating 20% of the total Competition and Commendation Fund of the Ministry to cover expenses for organizing and directing competition movements;

c) At year-end, the remaining balance in the Fund shall be transferred to the next year for continued use in competition and commendation activities.

4. Specific amounts of cash awards accompanying commendation titles and forms shall be implemented in accordance with Articles 71 to 76 of Decree No. 42/2010/ND-CP.

5. The Competition and Commendation Fund of the Ministry shall be managed by the Department of Competition and Commendation; the Competition and Commendation Funds of agencies and units with legal personality, separate bank accounts, and individual seals may be used to pay cash awards or commemorative gifts to individuals and groups under the agency or unit that have been commended.

 

Chapter VII

IMPLEMENTATION

 

Article 30. Inspection of Competition and Commendation Activities

1. The Department of Competition and Commendation shall assist the Ministry's Competition and Commendation Council in inspecting competition and commendation activities at agencies and units within the industry.

2. Heads of agencies and units shall be responsible for inspecting competition and commendation activities at agencies and units under their management.

Article 31. Handling Violations and Resolving Complaints and Allegations

1. Individuals and groups who falsify achievements to obtain commendation shall have their commendation decisions revoked, and any awarded items and cash prizes shall be recovered; depending on the nature and severity of the violation, they may be subject to disciplinary action, administrative penalties, or criminal liability pursued, and if damage is caused, compensation must be provided as prescribed.

2. Heads of agencies or organizations who certify false information or forge files for others to request commendation shall be subject to disciplinary action, administrative penalties, or criminal liability pursued, depending on the nature and severity of the violation, and if damage is caused, compensation must be provided as prescribed.

3. The resolution of complaints and allegations regarding competition and commendation activities shall be carried out in accordance with Article 98 of the Law on Competition and Commendation and the relevant provisions of laws on complaints and allegations.

4. The Department of Competition and Commendation shall be responsible for receiving, resolving complaints and allegations regarding competition and commendation activities within its jurisdiction, and coordinating with the Inspectorate of the Ministry, related units to investigate, verify, and report to the Chairman of the Ministry's Competition and Commendation Council and the leadership of the Ministry of Industry and Trade for consideration and decision.

Article 32. Report on Competition and Reward Work

Clause 1. Annually in the fourth quarter, agencies and units under the Ministry of Industry and Trade, Departments of Industry and Trade of centrally governed cities and provinces shall summarize, evaluate competition and reward work, assess rewards for the year, and submit reports to the Ministry of Industry and Trade no later than December 15.

Clause 2. Training institutions under the Ministry of Industry and Trade shall summarize, evaluate competition and reward work, assess rewards for the year, and submit reports to the Ministry of Industry and Trade no later than August 10.

Clause 3. Agencies and units within the industry that initiate competition movements and after each competition period shall be responsible for interim summaries, final summaries, competition assessments, and submitting reports to the Ministry of Industry and Trade.

Article 33. Effective Date

Clause 1. This Circular takes effect from October 3, 2015, and replaces Circular No. 43/2011/TT-BCT dated December 26, 2011, issued by the Ministry of Industry and Trade detailing the implementation of competition and reward work in the industry.

Clause 2. The Competition and Reward Council of the Ministry directs the implementation of this Circular.

Clause 3. The Department of Competition and Reward is responsible for monitoring, urging, and inspecting the implementation of this Circular, and based on the actual situation of annual competition movements, researching and proposing reasonable quantities and ratios of rewards for the Minister's consideration and decision.

Clause 4. Heads of agencies and units shall organize the implementation of this Circular and concretize appropriate standards in accordance with the operational circumstances of their agencies and units.

Clause 5. During the implementation of this detailed regulation on competition and reward work in the industry, if there are difficulties or unsuitable provisions, heads of agencies and units under the Ministry, Directors of Industry and Trade Departments of centrally governed cities and provinces shall report to the Ministry of Industry and Trade for study, supplementation, and amendment./.CIRCULAR

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as the Law on Competition and Reward);

Based on Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 42/2010/ND-CP); Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 39/2012/ND-CP) and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013 (hereinafter referred to as Decree No. 65/2014/ND-CP);

PURSUANT TO THE proposal of the Director of the Department of Competition and Rewards;

The Minister of Industry and Trade issues this Circular detailing the implementation of competition and reward work in the Industry and Trade sector.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Circular details the implementation of competition and reward work in the Industry and Trade sector, including: forms and contents of organizing competition movements; titles of honor and criteria for such titles; forms, subjects, and criteria for rewards; authority to decide on granting awards, procedures, and application files for award nominations; Competition and Reward Councils at all levels; competition and reward funds and handling violations related to competition and reward.

Article 2. Applicability

1. Competitors

The subjects of competition under this Circular include: officials, civil servants, public employees, laborers within the establishment, indefinite-term labor contracts, and definite-term labor contracts from 12 to 36 months working in agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade under central cities (hereinafter referred to as individuals); agencies and units under the Ministry of Industry and Trade, Provincial Departments of Industry and Trade, and enterprises under central cities (hereinafter referred to as groups).

2. Recipients of rewards

a) The subjects specified in Clause 1 of this Article;

b) Individuals and groups with activities related to the Industry and Trade sector in agencies and units under various Ministries, sectors, and localities;

c) Vietnamese individuals and groups abroad and foreign individuals and groups who have made significant contributions to building, protecting, and developing the Industry and Trade sector in Vietnam.

Article 3. Objectives of competition and reward

Competition and reward work aims to create motivation, encourage, and honor groups and individuals who enthusiastically engage in creative labor competitions, striving to complete assigned tasks excellently, contributing to the development of the Industry and Trade sector.

Article 4. Principles of competition and reward

1. Principles of Competition

a) Voluntary, conscientious, transparent; ensuring a spirit of unity, cooperation, and mutual development;

b) Bestowing competition titles must be based on the results of the competition movement;

c) Individuals and groups participating in the competition movement must register for competition, set competition goals, and criteria. Those individuals and groups that do not register for competition will not be considered or recognized for competition titles.

2. Principles of Reward

a) Accurate, transparent, democratic, fair, and timely based on the correct assessment of the performance of groups and individuals; emphasizing quality according to standards rather than forcing quantity; achievements obtained under difficult conditions and having a wide impact are rewarded at a higher level; focusing on rewarding individuals directly involved in labor and work and those with many innovations in labor and work;

b) When considering rewards for the head of an agency, organization, or unit, it must be based on the achievements of the group led by that individual;

c) For female leaders and managers, the period of holding office for consideration of rewards can be reduced by three years compared to the general regulations. For rewards for economic and social achievements, when there are multiple individuals and groups meeting the conditions and criteria, individuals and groups with a female ratio of 70% or more should be selected for rewards;

d) A reward form may be given multiple times to the same subject; multiple reward forms shall not be given for a single achievement;

đ) Ensuring consistency between the nature, form, and recipient of rewards;

e) Combining spiritual encouragement closely with material incentives;

g) The time for proposing rewards for the next round is calculated from the date of the previous reward decision.

Article 5. Responsibilities of Heads of Agencies and Units in Competition and Commendation Work

1. The Minister shall initiate and direct competition movements within the entire Industry and Trade sector. The Ministry's Competition and Commendation Council shall be responsible for advising the Minister on the content of competitions and organizing competition movements.

2. The Head of an agency or unit shall organize the initiation and direction of competition movements within their managed agencies or units.

3. Organizations under agencies and units need to closely coordinate with the Heads of the same level agencies and units to direct the organization of the initiation and maintenance of regular competition movements, expand competition movements and exemplary models within their agencies and units; proactively identify and select collectives and individuals with outstanding achievements for commendation or recommend higher-level commendation according to this Circular.

Article 6. Responsibilities of Industry Media Outlets

Industry newspapers and magazines have the responsibility to regularly publicize competition and commendation work; disseminate and set examples of advanced models, good people and deeds, promote competition movements; identify individuals and collectives with outstanding achievements in competition movements; combat and criticize violations of laws on competition and commendation within the Industry and Trade sector.

Article 7. Rights and Obligations of Individuals and Collectives Receiving Commendation

1. Individuals receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, and material rewards; they may be considered for early promotion according to regulations; they are given priority for research study, work assignments, and professional skill enhancement both domestically and internationally; commendatory titles and forms of commendation serve as one of the bases for evaluation, planning, appointment, and reappointment of cadres annually.

2. Collectives receiving commendatory titles and forms of commendation shall be awarded Certificates of Merit, Letters of Commendation, Certificates of Recognition, and monetary or material rewards as prescribed; they have the right to retain, display, and use Certificates of Merit, Letters of Commendation, Certificates of Recognition, or material rewards on official documents and materials of the agency or unit.

3. Collectives and individuals recognized with commendatory titles and forms of commendation shall be responsible for maintaining and further striving to achieve higher commendatory titles and achievements; they must properly preserve material rewards. It is strictly prohibited to buy, sell, lease, lend, give away, or transfer material rewards in any form.

 

Chapter II

FORMS AND CONTENT OF ORGANIZING COMPETITION MOVEMENTS

COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

 

Article 8. Forms of Organizing Competitions

1. Regular competitions are organized and implemented daily, monthly, quarterly, and annually to achieve set goals, targets, and work programs.

2. Periodic or thematic competitions are organized to enhance the quality and effectiveness of work, strive to excellently complete key and urgent tasks within a specific period, or address difficult, complex issues, weaknesses, and pending matters.

a) The Industry and Trade sector organizes periodic or thematic competitions to strive for successful implementation of five-year and annual socio-economic development plans assigned by the State.

b) Agencies and units within the sector organize competitions to celebrate traditional days of the sector, agency, or unit, and anniversaries of establishment of the sector, agency, or unit.

Article 9. Content of organizing competitive movements

1. Clearly define the objectives, scope, target groups for competition, set out specific targets, slogans, contents of the competition, and the duration of the competition. The determination of the content and criteria for the competition must be scientific, appropriate to the practical conditions of each agency or unit, and feasible.

2. Determine measures to organize competitive movements; adopt suitable forms to launch competitive movements, emphasizing the promotion of the significance of the competition period, and fostering a sense of responsibility.

3. Launch and direct the implementation of competitive movements; have plans to implement measures to mobilize and promote competition, monitor the process of organizing the competition, organize pilot guidance to draw lessons and disseminate good practices for participants in the competition.

4. Summarize and conclude on the competitive movement, evaluate the results of the competition. For long-term competition periods (lasting one year or more), agencies and units must organize mid-term summaries to draw lessons; at the end of short-term competition periods (less than one year) or each phase, conduct summaries and conclusions to evaluate results; publicly select, review, commend, and reward individuals and collectives with outstanding achievements in the competitive movement. Promote and disseminate exemplary models within agencies and units.

Article 10. Registration for Competition Titles

Each year, no later than March 15, agencies and units shall organize for individuals and collectives to register their efforts to achieve competitive movements, competition targets, competition titles, and submit the competition registration form (according to Form 1a and 1b in Appendix 1 issued together with this Circular) to the Ministry for monitoring, serving as the basis for awarding competition titles.

Article 11. Competition Titles

1. For Individuals

a) National Model Competitor;

b) Outstanding Soldier of the Ministry;

c) Grassroots Model Competitor;

d) Advanced Worker.

2. For Collectives

a) Flag of Government Competition;

b) Flag of the Ministry;

c) Outstanding Labor Group;

d) Advanced Labor Group.

Article 12. Criteria for Awarding Competition Titles to Individuals

1. Individuals who achieve the title "National Outstanding Soldier" must meet the following criteria:

a) Have outstanding and excellent achievements selected from those individuals who have continuously achieved the title "Outstanding Soldier of the Ministry" twice;

b) Have innovative ideas, research topics achieving high effectiveness, having national-wide influence, and recognized by the Ministry's Commendation and Reward Council and the Ministry-level Science Council.

The Ministry's Commendation and Reward Council and the Ministry-level Science Council are responsible for assisting the Minister of Industry and Trade in reviewing and recognizing innovative ideas and research topics. These councils are established and operate according to the Council's operational regulations, decided by the Minister.

The time for considering the title "National Outstanding Soldier" is the year immediately following the second year of achieving the title "Outstanding Soldier of the Ministry."

2. Individuals who achieve the title "Outstanding Soldier of the Ministry" must meet the following criteria:

a) Have outstanding achievements among those individuals who have continuously achieved the title "Outstanding Soldier at the Base" three times;

b) Achievements, innovative ideas, work solutions, and research topics of individuals have an impact within the industry of Industry and Trade.

The time for considering the title "Outstanding Soldier of the Ministry" is the year when the individual achieves the title "Outstanding Soldier at the Base" for the third time.

3. Individuals who achieve the title "Outstanding Soldier at the Base" must meet the following criteria:

a) Advanced Worker;

b) Have innovative ideas that are technical solutions, management solutions, operational solutions, or applications of advanced technology to increase labor productivity, improve work efficiency, recognized by the base or have research topics that have been accepted and applied, completed excellently, recognized by the agency, organization, or unit.

The assessment of the impact of innovative ideas and research topics is assisted by the Base Innovation Council and the Base Science Council to help the head of the agency, organization, or unit recognize them. These councils are established and operate according to the Council's operational regulations, decided by the competent authority of the agency, organization, or unit that recognizes the title "Outstanding Soldier at the Base."

The granting of the title "Outstanding Soldier at the Base" is conducted annually, implemented with a ratio of no more than 15% of the number of officers, civil servants, public officials, and workers in the agency or unit who have achieved the title "Advanced Worker."

4. Individuals who achieve the title "Advanced Worker" must meet the criteria stipulated in Clause 6 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Rewards in 2013.

Individuals who bravely save people or property leading to injuries requiring treatment or convalescence as concluded by medical facilities shall have the treatment and convalescence period counted towards the consideration for the title "Advanced Worker."

Individuals sent for short-term training or development under one year, complying well with the regulations of the training or development institution, shall have their study period counted towards their working time at the agency or unit for the evaluation of the title "Advanced Worker." In cases where individuals are sent for training or development for one year or more, comply well with the regulations of the training or development institution, and have satisfactory academic performance, they may be considered for the title "Advanced Worker."

The maternity leave period as prescribed shall be counted towards the evaluation for the title "Advanced Worker."

For individuals transferred to new agencies, organizations, or units, the new agency, organization, or unit shall be responsible for evaluating and voting for the title "Advanced Worker" (if the individual has worked at the previous agency for six months or more, the opinion of the previous agency must be obtained).

In cases where individuals are temporarily assigned to other agencies or units, the evaluation and voting for the title "Advanced Worker" shall be decided by the agency or unit that assigns them (with comments from the receiving agency or unit).

The title "Advanced Worker" shall not be granted in any of the following cases: newly recruited for less than ten months, absent from work for forty days or more, or disciplined with a warning or higher.

Article 13. Criteria for awarding commendation titles to collectives

1. Collectives awarded the title "Flag of Government Competition" must meet the criteria stipulated in Article 25 of the Law on Competition and Rewards; Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, and Article 6 of Decree No. 65/2014/NĐ-CP.

Collectives eligible for the Flag of Government Competition must be the most outstanding collectives selected among those not exceeding 20% of the collectives awarded the "Flag of Ministry Competition."

The awarding of the title "Flag of Government Competition" is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year).

Annually, based on competition registration with the Government (through the Central Board for Competition and Rewards), the Ministry of Industry and Trade allocates the number of Flags to agencies and units within the sector.

2. Collectives awarded the title "Flag of Ministry Competition" must meet the following criteria:

a) Exceeding all set competition targets and assigned tasks for the year; being exemplary collectives that excel in their work tasks.

b) Having new factors and models for other collectives in the industry to emulate.

c) Internal unity, actively practicing thrift, combating waste, corruption, and other social evils.

The awarding of the Flag of Ministry Competition is conducted annually during the year-end work summary of the Ministry (for educational institutions, it is at the end of the academic year). Annually, the Ministry issues specific guidelines on allocating the number of Ministry Competition Flags to agencies and units under the Ministry and Provincial Departments of Industry and Trade.

By March 15 each year, units in the industry register for the Flag of Government Competition and the Flag of Ministry Competition with the Department of Competition and Rewards.

3. Collectives awarded the title "Outstanding Labor Collective" must be exemplary collectives chosen from among those awarded the title "Advanced Labor Collective," according to the criteria specified in Clause 1, Article 27 of the Law on Competition and Rewards.

4. Collectives awarded the title "Advanced Labor Collective" must meet the criteria stipulated in Clause 1, Article 28 of the Law on Competition and Rewards.

For newly established agencies, units, and enterprises, they must have been operating for at least one year (12 months) before being eligible for the titles "Advanced Labor Collective" and "Outstanding Labor Collective."

 

Chapter III

FORMS OF REWARD,

CRITERIA FOR REWARD FORMS

 

Article 14. Types of rewards

1. Reward based on achievements and accomplishments is a form of reward for collectives and individuals who achieve outstanding results in implementing annual plans or multi-year plans.

2. Special topic reward (or campaign reward) is a reward for collectives and individuals who achieve outstanding results in work after completing a competition campaign initiated by the President, Prime Minister, Minister, or head of unit, related to the implementation of the unit's tasks.

3. Immediate reward is a reward for collectives and individuals who achieve outstanding results in labor, production, or combat service; bravery in rescuing people or state property (immediate achievement is an achievement made in unforeseen circumstances outside the normal work plan that the collective or individual must undertake).

4. Reward for dedication over time is a reward for individuals who have contributed significantly during various revolutionary stages (holding leadership or management positions in state agencies, public institutions, political organizations, or social-political organizations in the industry), making outstanding contributions to the revolutionary cause of the Party and the nation.

5. Foreign reward is a reward for foreign collectives and individuals who have made significant contributions to the construction and development of the industry.

Article 15. Forms of Reward

1. Forms of reward of the State:

Medals, Orders, National Honorary Titles, Ho Chi Minh Prize, State Prize, and Certificates of Merit from the Prime Minister.

2. Forms of reward of the Ministry:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

3. Forms of reward of the head of an organization or unit with its own account, seal, and legal personality:

Commendation Letter.

Article 16. Criteria for forms of reward

1. Medals, Orders, Certificates of Merit from the Prime Minister, National Honorary Titles, Ho Chi Minh Prize, and State Prize shall be implemented according to the provisions of Clause 1, 2, Article 20; Clause 1, 4, Article 21; Articles 34, 35, 36, 37, 38, 39, 40, 42, 43, 44, 45, 46, 47 of Decree No. 42/2010/ND-CP; from Article 7 to Article 23 of Decree No. 65/2014/ND-CP and Decree No. 123/2014/ND-CP dated December 25, 2014 of the Government on awarding the titles "People's Artist" and "Outstanding Artist" in the field of traditional craft industries.

2. The Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" shall be implemented according to the Regulation on awarding the Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam" issued together with Decision No. 46/2008/QD-BCT dated December 17, 2008 of the Minister of Industry and Trade and Circular No. 08/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade on amending and supplementing some articles of administrative procedures in Decision No. 46/2008/QD-BCT.

3. The Women's Scientific Creativity Award in Industry and Trade shall be implemented according to the Regulation on awarding the Women's Scientific Creativity Award in Industry and Trade issued together with Decision No. 38/2008/QD-BCT dated October 21, 2008 of the Minister of Industry and Trade.

4. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to individuals who model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results;

c) Achieving many results with significant influence within their respective fields under the Ministry;

d) Excellently completing tasks for two consecutive years, during which time two recognized and effectively applied initiatives were implemented at the grassroots level;

đ) Having a long-term career with significant contributions to the construction and development of the Industry and Trade sector, recognized on the occasion of celebrating the founding day of the sector, agency, or unit, or before retirement;

e) Other cases to be considered and decided by the Minister.

5. The Certificate of Merit from the Minister of Industry and Trade shall be awarded to groups that model exemplary compliance with the Party’s policies and State laws and achieve one of the following criteria:

a) Achieving outstanding and exemplary results recognized during campaign periods initiated by the Ministry of Industry and Trade;

b) Achieving outstanding and exceptionally excellent results or many results with significant influence within their respective fields under the Industry and Trade sector;

c) Excellently completing tasks for two consecutive years, maintaining internal unity, implementing democratic regulations at the grassroots level, organizing good competition campaigns, caring for the material and spiritual life of group members, practicing thrift, and fulfilling all systems and policies for every member of the group.

The granting of rewards to agencies, units, and small groups within agencies and units under the Ministry that achieve outstanding and exceptionally excellent results or have made contributions to building and developing their agencies and units on the occasion of celebrating their founding days shall be carried out during the annual summary of work of the Ministry.

6. Commendation Letters from the head of an organization or unit with its own account, seal, and legal personality

Shall be implemented according to the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Campaigns and Rewards 2013.

7. Campaigns can be organized on a large scale within a unit, locality, industry, or ministry

a) When summarizing and concluding campaigns, mainly implement the reward forms of the campaign initiator (Commendation Letters, Certificates of Merit);

b) In cases organized nationwide, when summarizing and concluding campaigns lasting three years or more, the initiating unit selects outstanding and excellent collectives and individuals to recommend to the Prime Minister for the awarding of Certificates of Merit;

c) In cases organized nationwide, when summarizing and concluding campaigns lasting five years or more, the initiating unit selects outstanding and exceptionally excellent collectives and individuals to recommend to the President for the awarding of the "Labor Medal" Class III and mainly reward direct laborers and workers.

 

Chapter IV

AUTHORITY TO DECIDE, AWARDS, PROCEDURES, AND FILES

AND THE PROCESS OF RECOMMENDING AWARDS

 

Article 17. Authority to decide and present awards

1. The authority to decide and present awards for Orders, Medals, Ho Chi Minh Prize, State Prize, National Honorary Titles, Government Flag of Merit, National Model Worker, Prime Minister's Commendation shall be implemented according to the provisions set forth in Articles 77 and 78 of the Law on Competition and Rewards.

2. The Minister of Industry and Trade decides to award the following commendations:

a) The Flag of Merit of the Ministry;

b) Outstanding Soldier of the Ministry;

c) Outstanding Labor Collectives:

- The Minister decides to award the title "Outstanding Labor Collective" to administrative and public service units under the Ministry; enterprises under the Ministry (excluding economic groups and holding companies);

- The Minister delegates the authority to the Heads of agencies and units with legal personality, separate bank accounts, and their own seals to decide to award the title "Outstanding Labor Collective" to units, departments, rooms, faculties, factories, workshops, teams, squads that are subordinate members.

d) Advanced Workers and Model Workers at the grassroots level for individuals and Advanced Worker Collectives for collectives within units under the Ministry's agencies without legal personality.

3. The Minister of Industry and Trade decides to award the following forms of commendation:

a) Commemorative Medal "For the Development of the Industry and Trade Sector of Vietnam";

b) Women's Scientific Creativity Award in Industry and Trade;

c) Certificate of Merit from the Minister of Industry and Trade.

4. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following commendations:

a) Advanced Labor Collective;

b) Excellent Labor Collective;

c) Advanced Worker;

d) Model Workers at the grassroots level.

5. The Heads of agencies and units with legal personality, separate bank accounts, and their own seals decide to award the following forms of commendation:

Commendation Letter.

Article 18. Ceremony for presenting commendations and awards

Announcing and presenting commendations and awards is an occasion to honor exemplary individuals and outstanding achievements. The ceremony must be solemn, practical, economical, avoiding ostentation and waste.

1. Organizing rallies, commemorative ceremonies, presentations, and receptions of national honorary titles, Orders, Medals, Government Flags of Merit, Prime Minister's Commendations are carried out according to the provisions stipulated in Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on organizing commemorative days; presentation and reception rituals of commendations and commendatory titles; diplomatic ceremonies and welcoming foreign guests.

2. The Minister of Industry and Trade, authorized by Party and State leaders, presents the Government Flag of Merit to agencies and units under the Ministry and directly presents the Ministry's Flag of Merit and the Minister's Commendation to subordinate agencies and units of the Ministry and provincial Departments of Industry and Trade at the annual work summary conference of the Ministry.

3. The Minister of Industry and Trade authorizes the Heads of agencies and units responsible for organizing the presentation of commendations and awards as follows:

a) For Orders and Medals: After receiving notifications from the Department of Competition and Rewards and decisions, reward items, the Head of the agency or unit develops a plan to organize and receive them, reporting to the Minister (through the Department of Competition and Rewards). Following the Minister's instructions, the Department of Competition and Rewards coordinates with relevant agencies and units to announce and present them, possibly combining with other practical programs of the agency or unit to save time and costs. For some special cases, the Department of Competition and Rewards develops a plan to organize the reception and report to the Minister, then organize the announcement and presentation;

b) For the title of National Model Worker and the form of commendation of the Prime Minister's Commendation for individuals and collectives: The Head of the agency or unit proactively develops a plan, organizes the announcement and presentation to individuals and collectives under their responsibility who have been commended, and informs the Department of Competition and Rewards for guidance and monitoring;

c) For commendations and awards within the authority of the Minister of Industry and Trade: The Minister delegates the authority to the Heads of agencies and units to announce and present to individuals and collectives under their management;

d) For individuals and collectives awarded commendations and awards within the authority of the Heads of agencies and units, the agencies and units themselves organize the announcement and presentation.

Article 19. Commendation Procedures

1. The level that initiates a competition campaign shall select outstanding individuals and collectives for commendation or propose to a higher level for commendation.

2. Heads of agencies and units under the Ministry shall be responsible for commending within their authority or proposing to a higher level for commendation for individuals and collectives under their management.

3. Regarding Provincial Departments of Industry and Trade and Municipal Departments of Industry and Trade directly under the Central Government

a) Proposals for awarding commendation titles and forms of commendation by the State shall be reviewed and submitted by the People's Committee of the province or municipality directly under the Central Government according to the provisions of the Law on Competition and Commendation, Decree No. 42/2010/ND-CP, Decree No. 65/2014/ND-CP, and guiding documents issued by the People's Committee of the province or municipality directly under the Central Government;

b) The Ministry of Industry and Trade shall concur with commendations for commendation titles and forms of commendation by the State based on proposals from the People's Committee of the province or municipality directly under the Central Government or the National Competition and Commendation Board;

c) Proposals for the title "Flag of Competition of the Ministry of Industry and Trade" and other forms of commendation within the authority of the Minister of Industry and Trade shall be carried out like other agencies and units under the Ministry when the Ministry launches a specialized competition campaign.

4. Regarding industry associations under the Ministry of Industry and Trade

The Chairman of the Association shall consider and propose commendation within the authority of the Minister of Industry and Trade.

5. Regarding units outside the industry

The head of the agency or unit with activities related to the industry shall propose to the competent authorities for consideration and propose commendation within the authority of the Minister of Industry and Trade.

Điều 20. Hồ sơ đề nghị khen thưởng

1. Vụ Thi đua - Khen thưởng có trách nhiệm tiếp nhận hồ sơ đề nghị khen thưởng của các cơ quan, đơn vị trong và ngoài ngành.

2. Đối với Bằng khen và Cờ thi đua của Bộ Công Thương, 01 (một) bộ hồ sơ gồm:

a) Tờ trình đề nghị khen thưởng của Giám đốc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương đối với tập thể, cá nhân thuộc Sở hoặc Thủ trưởng cơ quan, đơn vị thuộc Bộ đối với tập thể và cá nhân thuộc cơ quan, đơn vị đó (Phụ lục 2);

b) Biên bản họp Hội đồng Thi đua - Khen thưởng của Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương hoặc biên bản họp của Hội đồng Thi đua - Khen thưởng cơ quan, đơn vị thuộc Bộ (Phụ lục 3);

c) Báo cáo thành tích của tập thể (ký và đóng dấu của Thủ trưởng cơ quan, đơn vị) và cá nhân (ký, ghi rõ họ tên, có xác nhận của Thủ trưởng cơ quan, đơn vị ký tên và đóng dấu) được đề nghị khen thưởng (Phụ lục 4 và Phụ lục 5);

d) Bản sao Quyết định hoặc Chứng nhận tặng danh hiệu “Chiến sĩ thi đua cơ sở”, “Tập thể lao động xuất sắc” của cấp có thẩm quyền;

đ) Xác nhận sáng kiến, đề tài nghiên cứu khoa học được Hội đồng sáng kiến, Hội đồng khoa học cấp cơ sở công nhận; Bản sao Giải thưởng quốc gia, quốc tế (nếu có).

3. Đối với danh hiệu “Anh hùng Lao động”, hồ sơ được thực hiện theo quy định tại Khoản 23, Điều 1 của Nghị định số 39/2012/NĐ-CP (Phụ lục 6 và Phụ lục 7).

4. Đối với danh hiệu “Chiến sĩ thi đua toàn quốc”, “Cờ thi đua của Chính phủ” và các hình thức khen thưởng Huân chương, Bằng khen của Thủ tướng Chính phủ, Huy chương, hồ sơ được thực hiện theo quy định tại các Khoản 6, 10, 12, 15, 18, Điều 1 của Nghị định số 39/2012/NĐ-CP, hồ sơ gồm:

a) Tờ trình đề nghị (Phụ lục 2);

b) Biên bản họp Hội đồng Thi đua - Khen thưởng (Phụ lục 3);

c) Bản sao Quyết định hoặc Chứng nhận tặng các danh hiệu thi đua và các hình thức khen thưởng của cấp có thẩm quyền cho tập thể, cá nhân được đề nghị khen thưởng;

d) Báo cáo thành tích của cá nhân, tập thể được đề nghị khen thưởng phải có chữ ký, ghi rõ họ tên người lập và có chữ ký, đóng dấu (nếu có) xác nhận của Thủ trưởng cơ quan, đơn vị (Phụ lục 4 và Phụ lục 5);

đ) Xác nhận sáng kiến, đề tài nghiên cứu khoa học được Hội đồng sáng kiến, Hội đồng khoa học các cấp công nhận; Bản sao Giải thưởng quốc gia, quốc tế (Phụ lục 8);

e) Xác nhận hoàn thành nghĩa vụ nộp ngân sách nhà nước đối với tập thể, cá nhân là Thủ trưởng cơ quan, đơn vị doanh nghiệp có nghĩa vụ nộp ngân sách nhà nước (có xác nhận hoàn thành nghĩa vụ thuế của cơ quan thuế tỉnh, thành phố trực thuộc Trung ương);

g) Ý kiến của Ủy ban nhân dân địa phương (xã, phường) về các mặt hoạt động trên địa bàn;

h) Đối với các tập thể, cá nhân trong ngành (thuộc các tỉnh, thành phố trực thuộc Trung ương), các Bộ, ngành, đoàn thể Trung ương cần có hiệp y của Bộ Công Thương chỉ cần gửi báo cáo thành tích kèm theo công văn đề nghị xin ý kiến hiệp y.

5. Đối với khen thưởng đột xuất, khen thưởng thi đua theo đợt hoặc theo chuyên đề

Hồ sơ được thực hiện theo quy định tại Khoản 2, Điều 61 của Nghị định số 42/2010/NĐ-CP và Khoản 20, Điều 1 của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị kèm theo danh sách cá nhân, tập thể được đề nghị khen thưởng (Phụ lục 2);

b) Báo cáo tóm tắt thành tích do cơ quan, đơn vị quản lý trực tiếp lập, (nêu rõ thành tích, công trạng lập được) để đề nghị khen thưởng (Phụ lục 9 hoặc Phụ lục 10).

6. Đối với khen thưởng quá trình cống hiến, hồ sơ được thực hiện theo quy định của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị quản lý cán bộ trước khi nghỉ hưu (Phụ lục 2);

b) Báo cáo thành tích (Phụ lục 11).

7. Đối với khen thưởng cho người nước ngoài, hồ sơ được thực hiện theo quy định tại Khoản 13, Điều 1 của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị có người nước ngoài công tác (Phụ lục 2);

b) Báo cáo thành tích (Phụ lục 12).

8. Bằng khen của cấp Bộ, Bằng chứng nhận danh hiệu “Chiến sĩ thi đua cấp Bộ” (Phụ lục 13).

9. Bằng chứng nhận danh hiệu “Tập thể lao động xuất sắc”, “Tập thể lao động tiên tiến” (Phụ lục 14).

10. Bằng chứng nhận danh hiệu “Chiến sĩ thi đua cơ sở” (Phụ lục 15).

Điều 21. Thời gian nhận hồ sơ

1. Khen thưởng theo công trạng và thành tích đạt được đối với tập thể, cá nhân thuộc thẩm quyền của Bộ

a) Đối với khen thưởng hàng năm cho các danh hiệu thi đua, hình thức khen thưởng thuộc thẩm quyền của Bộ trưởng và danh hiệu “Cờ thi đua của Chính phủ”, chậm nhất ngày 15 tháng 12 hàng năm (tính theo dấu bưu điện);

b) Đối với khen thưởng danh hiệu “Chiến sĩ thi đua toàn quốc”, chậm nhất ngày 20 tháng 02 hàng năm (tính theo dấu bưu điện);

c) Đối với Huân chương, Huy chương, Bằng khen của Thủ tướng Chính phủ, thời hạn nhận hồ sơ theo từng trường hợp cụ thể.

d) Đối với danh hiệu “Anh hùng Lao động”, 5 năm xét một lần, trừ trường hợp có thành tích đặc biệt xuất sắc đột xuất.

2. Đối với các danh hiệu thi đua, hình thức khen thưởng được quy định tại Khoản 4 và Khoản 5 Điều 17 Thông tư này thuộc thẩm quyền của Thủ trưởng cơ quan, đơn vị, do Thủ trưởng cơ quan, đơn vị xem xét, quyết định thời gian nhận hồ sơ.

3. Khen thưởng đột xuất, khen thưởng theo chuyên đề, hồ sơ được gửi chậm nhất không quá 15 (mười lăm) ngày kể từ khi lập được thành tích đột xuất hoặc sau khi kết thúc chuyên đề công tác.

Điều 22. Quy trình đề nghị khen thưởng

Sau khi tiếp nhận hồ sơ đề nghị khen thưởng hoặc hiệp y khen thưởng, Vụ Thi đua - Khen thưởng có trách nhiệm thẩm định các danh hiệu thi đua, các hình thức khen thưởng theo quy định hiện hành và tổng hợp trình Chủ tịch Hội đồng Thi đua - Khen thưởng xem xét, quyết định hoặc xin ý kiến các thành viên Hội đồng bằng văn bản. Kết quả bình xét của Hội đồng được tổng hợp trình Bộ trưởng quyết định. Quy trình đề nghị khen thưởng cho các đối tượng cụ thể như sau:

1. Đối với các trường hợp đề nghị khen thưởng Huân chương Sao Vàng, Huân chương Hồ Chí Minh và danh hiệu “Anh hùng Lao động”, Vụ Thi đua - Khen thưởng báo cáo xin ý kiến chỉ đạo của Bộ trưởng, Chủ tịch Hội đồng Thi đua - Khen thưởng trước khi họp Hội đồng Thi đua - Khen thưởng Bộ và trong hồ sơ trình Thủ tướng Chính phủ (thông qua Ban Thi đua - Khen thưởng Trung ương thẩm định để Thủ tướng Chính phủ trình Chủ tịch nước) phải có ý kiến bằng văn bản của Ban cán sự Đảng Bộ Công Thương.

2. Đối với các trường hợp xét tặng danh hiệu thi đua và các hình thức khen thưởng cho các cá nhân, tập thể của các cơ quan, đơn vị thuộc Bộ, Thủ trưởng cơ quan, đơn vị lập Tờ trình, Biên bản họp Hội đồng Thi đua - Khen thưởng cơ sở gửi về Vụ Thi đua - Khen thưởng để thẩm định trình Hội đồng Thi đua - Khen thưởng Bộ xem xét.

Vụ Thi đua - Khen thưởng hoàn tất hồ sơ trình Bộ trưởng quyết định khen thưởng theo thẩm quyền hoặc trình Thủ tướng Chính phủ quyết định (thông qua Ban Thi đua - Khen thưởng Trung ương).

3. Đối với các trường hợp xét tặng danh hiệu thi đua và các hình thức khen thưởng Cờ thi đua của Bộ, Bằng khen của Bộ trưởng cho các cá nhân và tập thể thuộc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương, Vụ Thi đua - Khen thưởng tổng hợp, thẩm định, trình Hội đồng Thi đua - Khen thưởng Bộ xem xét và hoàn tất hồ sơ trình Bộ trưởng quyết định.

4. Đối với các trường hợp khen thưởng cho cá nhân, tập thể ngoài ngành, Thủ trưởng cơ quan, đơn vị có quan hệ trực tiếp lập Tờ trình kèm báo cáo tóm tắt thành tích của cá nhân, tập thể được đề nghị khen thưởng, gửi về Vụ Thi đua - Khen thưởng để tổng hợp, thẩm định trình Hội đồng Thi đua - Khen thưởng Bộ xem xét và hoàn tất hồ sơ trình Bộ trưởng quyết định.

5. Vụ Thi đua - Khen thưởng chịu trách nhiệm đề xuất với Hội đồng Thi đua - Khen thưởng Bộ để trình Bộ trưởng xem xét đề nghị cấp có thẩm quyền khen thưởng các danh hiệu thi đua và các hình thức khen thưởng đối với Lãnh đạo Bộ.

 

Chương V

HỘI ĐỒNG THI ĐUA - KHEN THƯỞNG CÁC CẤP

 

Điều 23. Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Thành lập Hội đồng Thi đua - Khen thưởng Bộ Công Thương để chỉ đạo hoạt động thi đua, khen thưởng của ngành Công Thương.

2. Thành lập Hội đồng Thi đua - Khen thưởng tại các cơ quan, đơn vị thuộc Bộ để chỉ đạo hoạt động thi đua, khen thưởng ở cơ quan, đơn vị.

Điều 24. Thẩm quyền quyết định thành lập Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Bộ trưởng quyết định thành lập Hội đồng Thi đua - Khen thưởng Bộ.

2. Thủ trưởng cơ quan, đơn vị thuộc Bộ có tài khoản riêng, con dấu riêng, có tư cách pháp nhân quyết định thành lập Hội đồng Thi đua - Khen thưởng của cơ quan, đơn vị mình phụ trách.

Điều 25. Thành phần Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Thành phần Hội đồng Thi đua - Khen thưởng Bộ thực hiện theo Quyết định số 10292/QĐ-BCT ngày 13 tháng 11 năm 2014 của Bộ trưởng Bộ Công Thương về việc thành lập Hội đồng Thi đua - Khen thưởng Bộ Công Thương.

2. Thành phần Hội đồng Thi đua - Khen thưởng của cơ quan, đơn vị có tài khoản riêng, con dấu riêng, có tư cách pháp nhân gồm:

a) Chủ tịch là Thủ trưởng cơ quan, đơn vị;

b) Phó Chủ tịch là Chủ tịch Công đoàn cơ quan, đơn vị;

c) Ủy viên Thường trực là người đảm nhận một trong các chức danh sau: Chánh Văn phòng, Trưởng phòng, ban Hành chính, Tổ chức, Tổng hợp hoặc cá nhân phụ trách công tác thi đua, khen thưởng của cơ quan, đơn vị;

d) Các uỷ viên gồm đại diện cấp uỷ Đảng, Đoàn Thanh niên cộng sản Hồ Chí Minh, Trưởng các phòng, ban, bộ phận chuyên môn do Thủ trưởng cơ quan, đơn vị quyết định trên nguyên tắc số lượng là 3, 5, 7, 9 hoặc 11 thành viên.

Điều 26. Nguyên tắc làm việc, nhiệm vụ, quyền hạn của Hội đồng Thi đua - Khen thưởng các cấp

1. Hội đồng Thi đua - Khen thưởng các cấp có chức năng giúp cho Thủ trưởng cơ quan, đơn vị cùng cấp về công tác thi đua, khen thưởng, làm việc theo nguyên tắc tập trung dân chủ và biểu quyết theo đa số. Trường hợp ý kiến các thành viên Hội đồng Thi đua - Khen thưởng ngang nhau thì ý kiến của Chủ tịch Hội đồng là quyết định.

2. Nguyên tắc làm việc, nhiệm vụ và quyền hạn cụ thể của Hội đồng Thi đua - Khen thưởng Bộ thực hiện theo Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ Công Thương ban hành kèm theo Quyết định số 10293/QĐ-BCT ngày 13 tháng 11 năm 2014 của Bộ trưởng Bộ Công Thương về việc ban hành Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ Công Thương.

3. Nguyên tắc làm việc, nhiệm vụ và quyền hạn cụ thể của Hội đồng Thi đua - Khen thưởng cơ quan, đơn vị do Thủ trưởng cơ quan, đơn vị quy định không trái với Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ.

 

Chương VI

THÔNG BÁO KẾT QUẢ KHEN THƯỞNG, LƯU TRỮ HỒ SƠ KHEN THƯỞNG

SỬ DỤNG QUỸ THI ĐUA, KHEN THƯỞNG

 

Điều 27. Thông báo kết quả khen thưởng

1. Các tập thể, cá nhân đủ tiêu chuẩn khen thưởng và đã được cấp có thẩm quyền Quyết định khen thưởng, trong thời hạn không quá 15 (mười lăm) ngày, kể từ ngày có Quyết định khen thưởng, cơ quan thẩm định hồ sơ phải thông báo cho đơn vị đề nghị khen thưởng biết.

2. Đối với các trường hợp không đủ tiêu chuẩn khen thưởng, cơ quan thẩm định phải thông báo (có nêu rõ lý do) cho đơn vị đề nghị khen thưởng biết trong thời gian 15 (mười lăm) ngày như quy định tại Khoản 1, Điều này.

3. Trường hợp hồ sơ được gửi không đúng tuyến trình, cơ quan thẩm định phải thông báo và trả hồ sơ cho đơn vị đề nghị khen thưởng trong thời hạn không quá 05 (năm) ngày, kể từ ngày nhận được hồ sơ.

Điều 28. Lưu trữ hồ sơ khen thưởng

1. Hội đồng Thi đua - Khen thưởng các cấp có trách nhiệm lưu trữ hồ sơ khen thưởng của cấp mình theo quy định để ghi nhận thành tích của các thế hệ đối với sự nghiệp cách mạng của Đảng, dân tộc, giáo dục truyền thống, xây dựng cơ quan, đơn vị và phục vụ cho việc tra cứu, giải quyết đơn, thư khiếu nại của công dân hoặc xác nhận cho các đối tượng được hưởng chính sách khi có yêu cầu.

2. Hồ sơ khen thưởng phải được bàn giao cho Lưu trữ của cơ quan, đơn vị khi hết thời hạn lưu trữ theo quy định của pháp luật về lưu trữ.

Điều 29. Quản lý và sử dụng quỹ thi đua, khen thưởng

1. Quỹ thi đua, khen thưởng của Bộ được thực hiện theo quy định tại Khoản 1, Điều 67 của Nghị định số 42/2010/NĐ-CP; Thông tư số 71/2011/TT-BTC ngày 24 tháng 5 năm 2011 của Bộ Tài chính hướng dẫn việc trích lập, quản lý và sử dụng Quỹ thi đua, khen thưởng theo Nghị định số 42/2010/NĐ-CP.

2. Bộ Công Thương khuyến khích các cá nhân, tập thể trong và ngoài ngành hỗ trợ, đóng góp để bổ sung Quỹ thi đua, khen thưởng hàng năm của Bộ.

3. Quỹ thi đua, khen thưởng của Bộ được sử dụng để:

a) Chi tiền thưởng hoặc tặng phẩm lưu niệm cho các cá nhân, tập thể thuộc cơ quan Bộ theo các quyết định khen thưởng;

b) Trích 20% trong tổng Quỹ thi đua, khen thưởng của Bộ để chi cho công tác tổ chức, chỉ đạo các phong trào thi đua;

c) Cuối năm số dư trong Quỹ được chuyển sang năm sau để tiếp tục sử dụng cho công tác thi đua, khen thưởng.

4. Mức chi tiền thưởng cụ thể kèm theo các danh hiệu thi đua, hình thức khen thưởng thực hiện theo quy định từ Điều 71 đến Điều 76 của Nghị định số 42/2010/NĐ-CP.

5. Quỹ thi đua, khen thưởng của Bộ do Vụ Thi đua - Khen thưởng chịu trách nhiệm quản lý; Quỹ thi đua, khen thưởng của các cơ quan, đơn vị có tư cách pháp nhân, có tài khoản riêng, con dấu riêng được sử dụng chi tiền thưởng hoặc tặng phẩm lưu niệm cho các cá nhân, tập thể thuộc cơ quan, đơn vị được khen thưởng.

 

Chương VII

TỔ CHỨC THỰC HIỆN

 

Điều 30. Kiểm tra công tác thi đua, khen thưởng

1. Vụ Thi đua - Khen thưởng có trách nhiệm giúp Hội đồng Thi đua - Khen thưởng Bộ kiểm tra công tác thi đua, khen thưởng tại các cơ quan, đơn vị trong ngành.

2. Thủ trưởng cơ quan, đơn vị có trách nhiệm kiểm tra công tác thi đua, khen thưởng tại cơ quan, đơn vị do mình quản lý.

Điều 31. Xử lý vi phạm và giải quyết khiếu nại, tố cáo

1. Cá nhân, tập thể gian dối trong việc kê khai thành tích để được khen thưởng thì bị huỷ bỏ quyết định khen thưởng, bị thu hồi hiện vật và tiền thưởng đã nhận; tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định.

2. Thủ trưởng cơ quan, tổ chức xác nhận sai sự thật hoặc làm giả hồ sơ cho người khác để đề nghị khen thưởng thì tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định.

3. Việc giải quyết khiếu nại, tố cáo về công tác thi đua, khen thưởng thực hiện theo Điều 98 của Luật Thi đua, Khen thưởng và theo các quy định của pháp luật về khiếu nại, tố cáo.

4. Vụ Thi đua - Khen thưởng có trách nhiệm tiếp nhận, giải quyết các khiếu nại, tố cáo về công tác thi đua, khen thưởng thuộc thẩm quyền và phối hợp với Thanh tra Bộ, các đơn vị có liên quan kiểm tra, xác minh và báo cáo Chủ tịch Hội đồng Thi đua - Khen thưởng Bộ, Lãnh đạo Bộ Công Thương xem xét, quyết định.

Điều 32. Báo cáo công tác thi đua, khen thưởng

1. Định kỳ quý IV hàng năm, các cơ quan, đơn vị thuộc Bộ Công Thương, Sở Công Thương các tỉnh thành phố trực thuộc Trung ương tổng kết, đánh giá công tác thi đua, khen thưởng, bình xét khen thưởng năm và gửi báo cáo về Bộ Công Thương chậm nhất là ngày 15 tháng 12.

2. Các cơ sở đào tạo thuộc Bộ Công Thương tổng kết, đánh giá công tác thi đua, khen thưởng, bình xét khen thưởng năm và gửi báo cáo về Bộ Công Thương chậm nhất là ngày 10 tháng 8.

3. Các cơ quan, đơn vị trong ngành có phát động phong trào thi đua và sau một đợt thi đua, có trách nhiệm sơ kết, tổng kết, bình xét thi đua và gửi báo cáo về Bộ Công Thương.

Điều 33. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 03 tháng 10 năm 2015 và thay thế Thông tư số 43/2011/TT-BCT ngày 26 tháng 12 năm 2011 của Bộ Công Thương về việc quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương.

2. Hội đồng Thi đua - Khen thưởng Bộ chỉ đạo thực hiện Thông tư này.

3. Giao Vụ Thi đua - Khen thưởng chịu trách nhiệm theo dõi, đôn đốc, kiểm tra việc thực hiện Thông tư này và căn cứ tình hình thực tiễn phong trào thi đua hàng năm, nghiên cứu đề xuất số lượng và tỷ lệ khen thưởng hợp lý để Bộ trưởng xem xét, quyết định.

4. Thủ trưởng các cơ quan, đơn vị tổ chức triển khai thực hiện Thông tư này và cụ thể hoá các tiêu chuẩn phù hợp với tình hình hoạt động của cơ quan, đơn vị.

5. Trong quá trình thực hiện Thông tư quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương, nếu có vướng mắc hoặc những điều chưa phù hợp, Thủ trưởng các cơ quan, đơn vị thuộc Bộ, Giám đốc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương phản ánh về Bộ Công Thương để nghiên cứu, bổ sung, sửa đổi./.THÔNG TƯ

Căn cứ Nghị định số 95/2012/NĐ-CP ngày 12 tháng 11 năm 2012 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công Thương;

 

Căn cứ Luật Thi đua, Khen thưởng ngày 26 tháng 11 năm 2003; Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng ngày 14 tháng 6 năm 2005 và Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng năm 2013 (dưới đây gọi tắt là Luật Thi đua, Khen thưởng);

Căn cứ Nghị định số 42/2010/NĐ-CP ngày 15 tháng 4 năm 2010 của Chính phủ quy định chi tiết thi hành một số điều của Luật Thi đua, Khen thưởng và Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng (dưới đây gọi tắt là Nghị định số 42/2010/NĐ-CP);          Nghị định số 39/2012/NĐ-CP ngày 27 tháng 4 năm 2012 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 42/2010/NĐ-CP quy định chi tiết thi hành một số điều của Luật Thi đua, Khen thưởng và Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng (dưới đây gọi tắt là Nghị định số 39/2012/NĐ-CP) và Nghị định số 65/2014/NĐ-CP ngày 01 tháng 7 năm 2014 của Chính phủ quy định chi tiết thi hành Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng năm 2013 (dưới đây gọi tắt là Nghị định số 65/2014/NĐ-CP);

Theo đề nghị của Vụ trưởng Vụ Thi đua - Khen thưởng;

Bộ trưởng Công Thương ban hành Thông tư quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương.

 

Chương I

NHỮNG QUY ĐỊNH CHUNG

 

Điều 1. Phạm vi điều chỉnh

Thông tư này quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương, bao gồm: hình thức, nội dung tổ chức phong trào thi đua; danh hiệu, tiêu chuẩn danh hiệu thi đua; hình thức, đối tượng và tiêu chuẩn khen thưởng; thẩm quyền quyết định trao tặng, thủ tục, hồ sơ đề nghị khen thưởng; Hội đồng Thi đua - Khen thưởng các cấp; quỹ thi đua, khen thưởng và xử lý vi phạm về thi đua, khen thưởng.

Điều 2. Đối tượng áp dụng

1. Đối tượng thi đua

Đối tượng thi đua áp dụng theo Thông tư này, bao gồm: cán bộ, công chức, viên chức, người lao động trong biên chế, hợp đồng lao động không xác định thời hạn và hợp đồng lao động xác định thời hạn từ 12 tháng đến 36 tháng đang làm việc tại các cơ quan, đơn vị thuộc Bộ Công Thương, Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương (dưới đây gọi tắt là cá nhân); các cơ quan, đơn vị thuộc Bộ Công Thương, Sở Công Thương, các doanh nghiệp thuộc các tỉnh, thành phố trực thuộc Trung ương (dưới đây gọi tắt là tập thể).

2. Đối tượng khen thưởng

a) Các đối tượng quy định tại khoản 1 của Điều này;

b) Cá nhân và tập thể có hoạt động liên quan đến lĩnh vực Công Thương ở các cơ quan, đơn vị thuộc các Bộ, ban, ngành và địa phương;

c) Cá nhân, tập thể người Việt Nam ở nước ngoài và cá nhân, tập thể người nước ngoài có nhiều thành tích góp phần xây dựng, bảo vệ và phát triển ngành Công Thương Việt Nam.

Điều 3. Mục tiêu thi đua, khen thưởng

Công tác thi đua, khen thưởng nhằm tạo động lực, động viên, khuyến khích và tôn vinh các tập thể, cá nhân hăng hái thi đua lao động sáng tạo, vươn lên hoàn thành tốt nhiệm vụ được giao, góp phần vào sự nghiệp phát triển của ngành Công Thương.

Điều 4. Nguyên tắc thi đua, khen thưởng

1. Nguyên tắc thi đua

a) Tự nguyện, tự giác, công khai; đảm bảo tinh thần đoàn kết, hợp tác và cùng phát triển;

b) Xét tặng các danh hiệu thi đua phải căn cứ vào kết quả phong trào thi đua;

c) Cá nhân, tập thể tham gia phong trào thi đua phải đăng ký thi đua, xác định mục tiêu thi đua, tiêu chí thi đua. Những cá nhân, tập thể không đăng ký thi đua sẽ không được xem xét, công nhận các danh hiệu thi đua.

2. Nguyên tắc khen thưởng

a) Chính xác, công khai, dân chủ, công bằng và kịp thời trên cơ sở đánh giá đúng hiệu quả công tác của các tập thể, cá nhân; coi trọng chất lượng theo tiêu chuẩn, không gò ép để đạt số lượng; thành tích đạt được trong điều kiện khó khăn và có phạm vi ảnh hưởng lớn được khen thưởng mức cao hơn; chú trọng khen thưởng cá nhân là người trực tiếp lao động, công tác và cá nhân có nhiều sáng tạo trong lao động, công tác;

b) Khi xét khen thưởng người đứng đầu cơ quan, tổ chức, đơn vị phải căn cứ vào thành tích của tập thể do cá nhân đó lãnh đạo;

c) Đối với nữ là cán bộ lãnh đạo, quản lý, thời gian giữ chức vụ để xét khen thưởng có quá trình cống hiến được giảm 03 năm so với quy định chung. Đối với khen thưởng thành tích thực hiện nhiệm vụ kinh tế - xã hội, khi có nhiều cá nhân, tập thể cùng đủ điều kiện, tiêu chuẩn thì lựa chọn cá nhân nữ và tập thể có tỷ lệ nữ từ 70% trở lên để xét khen thưởng;

d) Một hình thức khen thưởng có thể tặng nhiều lần cho một đối tượng; không tặng thưởng nhiều hình thức cho một thành tích đạt được;

đ) Bảo đảm thống nhất giữa tính chất, hình thức và đối tượng khen thưởng;

e) Kết hợp chặt chẽ giữa động viên tinh thần với khuyến khích bằng lợi ích vật chất;

g) Thời gian để đề nghị khen thưởng cho lần tiếp theo được tính từ khi có quyết định khen thưởng lần trước.

Điều 5. Trách nhiệm của thủ trưởng cơ quan, đơn vị trong công tác thi đua, khen thưởng

1. Bộ trưởng phát động và chỉ đạo phong trào thi đua trong phạm vi toàn ngành Công Thương. Hội đồng Thi đua - Khen thưởng Bộ có trách nhiệm tham mưu giúp Bộ trưởng về nội dung thi đua và tổ chức phong trào thi đua.

2. Thủ trưởng cơ quan, đơn vị tổ chức phát động và chỉ đạo phong trào thi đua trong cơ quan, đơn vị mình quản lý.

3. Các tổ chức đoàn thể thuộc cơ quan, đơn vị cần phối hợp chặt chẽ với Thủ trưởng cơ quan, đơn vị cùng cấp chỉ đạo tổ chức phát động và duy trì thường xuyên phong trào thi đua, nhân rộng các phong trào thi đua và các gương điển hình tiên tiến trong phạm vi cơ quan, đơn vị; chủ động phát hiện, lựa chọn tập thể, cá nhân có thành tích xuất sắc để khen thưởng hoặc đề nghị cấp trên khen thưởng theo hướng dẫn tại Thông tư này.

Điều 6. Trách nhiệm các cơ quan báo chí của ngành

Các báo, tạp chí của ngành Công Thương có trách nhiệm thường xuyên tuyên truyền công tác thi đua, khen thưởng; phổ biến, nêu gương các điển hình tiên tiến, gương người tốt, việc tốt, cổ động các phong trào thi đua; phát hiện các cá nhân, tập thể có thành tích xuất sắc trong phong trào thi đua; đấu tranh, phê phán các hành vi vi phạm pháp luật về thi đua, khen thưởng trong ngành Công Thương.

Điều 7. Quyền lợi và nghĩa vụ của cá nhân, tập thể được khen thưởng

1. Cá nhân được tặng các danh hiệu thi đua, các hình thức khen thưởng được cấp Bằng khen, Giấy khen, Giấy chứng nhận và tiền thưởng hoặc hiện vật theo quy định; có quyền lưu giữ, trưng bày và sử dụng Bằng khen, Giấy khen, Giấy chứng nhận, hiện vật khen thưởng; được xét nâng bậc lương trước thời hạn theo quy định; ưu tiên cử đi nghiên cứu học tập, công tác, bồi dưỡng nâng cao trình độ chuyên môn ở trong và ngoài nước; các danh hiệu thi đua, các hình thức khen thưởng là một trong những căn cứ để đánh giá, quy hoạch, bổ nhiệm, bổ nhiệm lại cán bộ hàng năm.

2. Tập thể được tặng các danh hiệu thi đua, các hình thức khen thưởng được cấp Bằng khen, Giấy khen, Giấy chứng nhận và tiền thưởng hoặc hiện vật theo quy định; có quyền lưu giữ, trưng bày và sử dụng Bằng khen, Giấy khen, Giấy chứng nhận hoặc hiện vật khen thưởng trên các văn bản tài liệu chính thức của cơ quan, đơn vị.

3. Tập thể, cá nhân được công nhận các danh hiệu thi đua, các hình thức khen thưởng có trách nhiệm phát huy thành tích đã đạt được tiếp tục phấn đấu để lập thành tích và danh hiệu thi đua cao hơn; bảo quản các hiện vật khen thưởng. Nghiêm cấm các hành vi mua, bán, cho thuê, cho mượn, tặng hoặc cho hiện vật khen thưởng dưới mọi hình thức.

 

Chương II

HÌNH THỨC, NỘI DUNG TỔ CHỨC PHONG TRÀO THI ĐUA

DANH HIỆU THI ĐUA VÀ TIÊU CHUẨN DANH HIỆU THI ĐUA

 

Điều 8. Hình thức tổ chức thi đua

1. Thi đua thường xuyên được tổ chức thực hiện hàng ngày, hàng tháng, hàng quý, hàng năm nhằm thực hiện mục tiêu, chỉ tiêu và chương trình công tác đề ra.

2. Thi đua theo đợt, theo chuyên đề được tổ chức nhằm thực hiện và nâng cao chất lượng, hiệu quả công tác, phấn đấu hoàn thành xuất sắc nhiệm vụ công tác trọng tâm, đột xuất trong một thời gian nhất định, hoặc giải quyết những công việc khó khăn, phức tạp, những việc còn yếu kém, tồn đọng.

a) Ngành Công Thương tổ chức phát động thi đua theo đợt, theo chuyên đề nhằm phấn đấu thực hiện thắng lợi kế hoạch phát triển kinh tế xã hội 5 năm và hàng năm được Nhà nước giao.

b) Các cơ quan, đơn vị trong ngành tổ chức phát động thi đua lập thành tích chào mừng Ngày truyền thống của ngành, cơ quan, đơn vị, kỷ niệm ngày thành lập ngành, cơ quan, đơn vị.

Điều 9. Nội dung tổ chức phong trào thi đua

1. Xác định rõ mục tiêu, phạm vi, đối tượng thi đua, đề ra các chỉ tiêu, khẩu hiệu, nội dung thi đua và thời hạn thi đua. Việc xác định nội dung và tiêu chí thi đua phải khoa học, phù hợp với thực tiễn của từng cơ quan, đơn vị và có tính khả thi.

2. Xác định biện pháp tổ chức phong trào thi đua; có hình thức tổ chức phát động phong trào thi đua phù hợp, coi trọng việc tuyên truyền ý nghĩa của đợt thi đua, phát huy tinh thần trách nhiệm.

3. Phát động, chỉ đạo thực hiện phong trào thi đua; có kế hoạch triển khai các biện pháp tổ chức vận động thi đua, theo dõi quy trình tổ chức thi đua, tổ chức chỉ đạo điểm để rút kinh nghiệm và phổ biến kinh nghiệm làm tốt cho các đối tượng tham gia thi đua.

4. Sơ kết, tổng kết phong trào, đánh giá kết quả thi đua. Đối với các đợt thi đua dài ngày (thời gian từ một năm trở lên), các cơ quan, đơn vị phải tổ chức sơ kết vào giữa đợt để rút kinh nghiệm; kết thúc các đợt thi đua ngắn ngày (thời gian dưới một năm) hoặc từng đợt phải tiến hành sơ kết, tổng kết đánh giá kết quả; công khai lựa chọn, bình xét, biểu dương, khen thưởng những cá nhân, tập thể đạt thành tích xuất sắc trong phong trào thi đua. Tuyên truyền, phổ biến, nhân rộng các gương điển hình tiên tiến trong cơ quan, đơn vị.

Điều 10. Đăng ký danh hiệu thi đua

Hàng năm, chậm nhất ngày 15 tháng 3, các cơ quan, đơn vị tổ chức cho cá nhân, tập thể đăng ký phấn đấu thực hiện các phong trào thi đua, các chỉ tiêu thi đua, các danh hiệu thi đua và gửi bản đăng ký thi đua (theo mẫu số 1a và 1b Phụ lục 1 ban hành kèm theo Thông tư này) về Bộ để theo dõi, làm căn cứ xét tặng các danh hiệu thi đua.

Điều 11. Danh hiệu thi đua

1. Đối với cá nhân

a) Chiến sĩ thi đua toàn quốc;

b) Chiến sĩ thi đua cấp Bộ;

c) Chiến sĩ thi đua cơ sở;

d) Lao động tiên tiến.

2. Đối với tập thể

a) Cờ thi đua của Chính phủ;

b) Cờ thi đua của Bộ;

c) Tập thể lao động xuất sắc;

d) Tập thể lao động tiên tiến.

Điều 12. Tiêu chuẩn xét tặng các danh hiệu thi đua đối với cá nhân

1. Cá nhân đạt danh hiệu “Chiến sĩ thi đua toàn quốc” phải đáp ứng các tiêu chuẩn sau:

a) Có thành tích tiêu biểu xuất sắc nhất được lựa chọn trong số những cá nhân có 02 (hai) lần liên tục đạt danh hiệu “Chiến sĩ thi đua cấp Bộ”;

b) Có sáng kiến, đề tài nghiên cứu khoa học đạt hiệu quả cao, có phạm vi ảnh hưởng trong toàn quốc và được Hội đồng Thi đua - Khen thưởng Bộ, Hội đồng Khoa học cấp Bộ xem xét, công nhận.

Hội đồng Thi đua - Khen thưởng Bộ, Hội đồng khoa học cấp Bộ có trách nhiệm giúp Bộ trưởng Bộ Công Thương xem xét, công nhận sáng kiến, đề tài nghiên cứu khoa học. Hội đồng Thi đua - Khen thưởng Bộ, Hội đồng khoa học cấp Bộ do Bộ trưởng quyết định thành lập và làm việc theo Quy chế hoạt động của Hội đồng.

Thời điểm xét danh hiệu “Chiến sĩ thi đua toàn quốc” là năm liền kề với năm đạt danh hiệu “Chiến sĩ thi đua cấp Bộ” lần thứ hai.

2. Cá nhân đạt danh hiệu “Chiến sĩ thi đua cấp Bộ” phải đáp ứng các tiêu chuẩn sau:

a) Có thành tích xuất sắc, tiêu biểu trong số những cá nhân có 03 (ba) lần liên tục đạt danh hiệu “Chiến sĩ thi đua cơ sở”;

b) Thành tích, sáng kiến, giải pháp công tác, đề tài nghiên cứu khoa học của cá nhân có tác dụng ảnh hưởng trong ngành Công Thương.

Thời điểm xét danh hiệu “Chiến sĩ thi đua cấp Bộ” là năm đạt danh hiệu “Chiến sĩ thi đua cơ sở” lần thứ ba.

3. Cá nhân đạt danh hiệu “Chiến sĩ thi đua cơ sở” phải đáp ứng các tiêu chuẩn sau:

a) Là Lao động tiên tiến;

b) Có sáng kiến là giải pháp kỹ thuật, giải pháp quản lý, giải pháp tác nghiệp hoặc giải pháp ứng dụng tiến bộ kỹ thuật để tăng năng suất lao động, tăng hiệu quả công tác được cơ sở công nhận hoặc có đề tài nghiên cứu khoa học đã nghiệm thu được áp dụng, hoàn thành xuất sắc nhiệm vụ được cơ quan, tổ chức, đơn vị công nhận.

Việc đánh giá mức độ ảnh hưởng của sáng kiến, đề tài nghiên cứu khoa học do Hội đồng sáng kiến, Hội đồng khoa học cấp cơ sở giúp người đứng đầu cơ quan, tổ chức, đơn vị xem xét công nhận. Hội đồng sáng kiến, Hội đồng khoa học cấp cơ sở do Thủ trưởng cơ quan, tổ chức, đơn vị có thẩm quyền công nhận danh hiệu “Chiến sĩ thi đua cơ sở” quyết định thành lập và làm việc theo Quy chế hoạt động của Hội đồng.

Việc xét tặng danh hiệu “Chiến sĩ thi đua cơ sở” được tiến hành thường xuyên hàng năm, thực hiện với tỷ lệ bình bầu không quá 15% số cán bộ, công chức, viên chức, người lao động trong cơ quan, đơn vị đạt danh hiệu “Lao động tiên tiến”.

4. Cá nhân đạt danh hiệu “Lao động tiên tiến” phải đáp ứng các tiêu chuẩn theo quy định tại Khoản 6 Điều 1 của Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng năm 2013.

Cá nhân có hành động dũng cảm cứu người, cứu tài sản dẫn đến bị thương tích cần điều trị, điều dưỡng theo kết luận của cơ sở y tế thì thời gian điều trị, điều dưỡng được tính để xét tặng danh hiệu “Lao động tiên tiến”.

Cá nhân được cử tham gia đào tạo, bồi dưỡng ngắn hạn dưới 01 (một) năm, chấp hành tốt quy định của cơ sở đào tạo, bồi dưỡng thì thời gian học tập được tính vào thời gian công tác tại cơ quan, đơn vị để được bình xét danh hiệu “Lao động tiên tiến”. Trường hợp cá nhân được cử tham gia đào tạo, bồi dưỡng từ 01 (một) năm trở lên, chấp hành tốt quy định của cơ sở đào tạo, bồi dưỡng, có kết quả học tập từ loại khá trở lên thì được xét tặng danh hiệu “Lao động tiên tiến”.

Thời gian nghỉ thai sản theo quy định được tính để bình xét danh hiệu “Lao động tiên tiến”.

Đối với cá nhân chuyển công tác, cơ quan, tổ chức, đơn vị mới có trách nhiệm xem xét, bình bầu danh hiệu “Lao động tiên tiến” (trường hợp có thời gian công tác ở cơ quan cũ từ 06 (sáu) tháng trở lên phải có ý kiến nhận xét của cơ quan cũ).

Trường hợp được điều động, biệt phái đến cơ quan, đơn vị khác trong một thời gian nhất định thì việc xem xét, bình bầu danh hiệu “Lao động tiên tiến” do cơ quan, đơn vị điều động, biệt phái xem xét quyết định (có ý kiến nhận xét của cơ quan, đơn vị tiếp nhận cá nhân được điều động, biệt phái).

Không xét tặng danh hiệu “Lao động tiên tiến” đối với một trong các trường hợp: Mới tuyển dụng dưới 10 (mười) tháng, nghỉ từ 40 (bốn mươi) ngày làm việc trở lên, bị kỷ luật từ hình thức khiển trách trở lên.

Điều 13. Tiêu chuẩn xét tặng các danh hiệu thi đua đối với tập thể

1. Tập thể đạt danh hiệu “Cờ thi đua của Chính phủ” phải đáp ứng các tiêu chuẩn theo quy định tại Điều 25 của Luật Thi đua, Khen thưởng; Khoản 7, Điều 1 Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng và Điều 6 của Nghị định số 65/2014/NĐ-CP.

Tập thể được xét tặng Cờ thi đua của Chính phủ phải là tập thể tiêu biểu xuất sắc nhất được xét chọn không quá 20% trong số những tập thể được xét tặng “Cờ thi đua của Bộ”.

Việc xét tặng danh hiệu “Cờ thi đua của Chính phủ” được tiến hành hàng năm vào dịp tổng kết công tác năm của Bộ (đối với các cơ sở đào tạo được xét tặng vào dịp kết thúc năm học).

Hàng năm, trên cơ sở đăng ký thi đua với Chính phủ (qua Ban Thi đua, Khen thưởng Trung ương), Bộ Công Thương phân bổ số lượng Cờ cho các cơ quan, đơn vị trong ngành.

2. Tập thể đạt danh hiệu “Cờ thi đua của Bộ” phải đáp ứng các tiêu chuẩn sau:

a) Hoàn thành vượt mức các chỉ tiêu thi đua và nhiệm vụ được giao trong năm; là những tập thể tiêu biểu, hoàn thành xuất sắc nhiệm vụ công tác;

b) Có nhân tố mới, mô hình mới để các tập thể khác trong ngành Công Thương học tập;

c) Nội bộ đoàn kết, tích cực thực hành tiết kiệm, chống lãng phí, chống tham nhũng và các tệ nạn xã hội khác.

Việc xét tặng danh hiệu Cờ thi đua của Bộ được tiến hành hàng năm vào dịp tổng kết công tác năm của Bộ (đối với các cơ sở đào tạo được xét tặng vào dịp kết thúc năm học). Hàng năm, Bộ có văn bản hướng dẫn cụ thể về phân bổ số lượng Cờ thi đua của Bộ cho các cơ quan, đơn vị thuộc Bộ và Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương.

Trước ngày 15 tháng 3 hàng năm, các đơn vị trong ngành Công Thương đăng ký Cờ thi đua của Chính phủ, Cờ thi đua của Bộ với Vụ Thi đua - Khen thưởng.

3. Tập thể đạt danh hiệu “Tập thể lao động xuất sắc” phải là tập thể tiêu biểu, được lựa chọn trong số các tập thể đạt danh hiệu “Tập thể lao động tiên tiến”, theo tiêu chuẩn quy định tại Khoản 1, Điều 27 của Luật Thi đua, Khen thưởng.

4. Tập thể đạt danh hiệu “Tập thể lao động tiên tiến” phải đáp ứng các tiêu chuẩn theo quy định tại Khoản 1, Điều 28 của Luật Thi đua, Khen thưởng.

Đối với các cơ quan, đơn vị, các doanh nghiệp mới thành lập phải có thời gian hoạt động từ một năm (12 tháng) trở lên mới bình xét danh hiệu “Tập thể lao động tiên tiến” và danh hiệu “Tập thể lao động xuất sắc”.

 

Chương III

HÌNH THỨC KHEN THƯỞNG,

TIÊU CHUẨN CÁC HÌNH THỨC KHEN THƯỞNG

 

Điều 14. Các loại hình khen thưởng

1. Khen thưởng theo công trạng và thành tích đạt được là hình thức khen thưởng cho tập thể, cá nhân đạt được thành tích xuất sắc trong thực hiện nhiệm vụ kế hoạch hàng năm hoặc thực hiện kế hoạch nhiều năm.

2. Khen thưởng theo chuyên đề (hoặc theo đợt) là khen thưởng cho tập thể, cá nhân đạt được thành tích xuất sắc trong công tác sau khi kết thúc đợt thi đua do Chủ tịch nước, Thủ tướng Chính phủ, Bộ trưởng và Thủ trưởng đơn vị phát động gắn với thực hiện nhiệm vụ công tác của đơn vị.

3. Khen thưởng đột xuất là khen thưởng cho tập thể, cá nhân đã đạt được thành tích đột xuất trong lao động, sản xuất, phục vụ chiến đấu; dũng cảm cứu người, tài sản của nhân dân hoặc của Nhà nước (thành tích đột xuất là thành tích lập được trong hoàn cảnh không được dự báo trước, diễn ra ngoài dự kiến kế hoạch công việc bình thường mà tập thể, cá nhân phải đảm nhận).

4. Khen thưởng quá trình cống hiến là khen thưởng cho cá nhân có quá trình tham gia trong các giai đoạn cách mạng (giữ các chức vụ lãnh đạo, quản lý trong các cơ quan nhà nước, các đơn vị sự nghiệp, tổ chức chính trị, tổ chức chính trị - xã hội thuộc ngành Công Thương), có công lao, thành tích xuất sắc đóng góp vào sự nghiệp cách mạng của Đảng và của dân tộc.

5. Khen thưởng đối ngoại là khen thưởng cho tập thể, cá nhân người nước ngoài đã có thành tích, có đóng góp vào công cuộc xây dựng và phát triển ngành Công Thương.

Điều 15. Hình thức khen thưởng

1. Hình thức khen thưởng của Nhà nước:

Huân chương, Huy chương, Danh hiệu vinh dự Nhà nước, Giải thưởng Hồ Chí Minh, Giải thưởng Nhà nước và Bằng khen của Thủ tướng Chính phủ.

2. Hình thức khen thưởng của Bộ”:

a) Kỷ niệm chương “Vì sự nghiệp phát triển ngành Công Thương Việt Nam”;

b) Giải thưởng Sáng tạo khoa học nữ ngành Công Thương;

c) Bằng khen của Bộ trưởng Bộ Công Thương.

3. Hình thức khen thưởng của Thủ trưởng cơ quan, đơn vị có tài khoản riêng, con dấu riêng, có tư cách pháp nhân:

Giấy khen.

Điều 16. Tiêu chuẩn các hình thức khen thưởng

1. Huân chương, Huy chương, Bằng khen của Thủ tướng Chính phủ, Danh hiệu vinh dự Nhà nước, Giải thưởng Hồ Chí Minh, Giải thưởng Nhà nước thực hiện theo quy định tại Khoản 1, 2 Điều 20; Khoản 1, 4 Điều 21; Điều 34, 35, 36, 37, 38, 39, 40, 42, 43, 44, 45, 46, 47 của Nghị định số 42/2010/NĐ-CP; từ Điều 7 đến Điều 23 của Nghị định số 65/2014/NĐ-CP và Nghị định số 123/2014/NĐ-CP ngày 25 tháng 12 năm 2014 của Chính phủ quy định về xét tặng danh hiệu “Nghệ nhân Nhân dân”, “Nghệ nhân Ưu tú” trong lĩnh vực nghề thủ công mỹ nghệ.

2. Kỷ niệm chương “Vì sự nghiệp phát triển ngành Công Thương Việt Nam” thực hiện theo Quy chế xét tặng Kỷ niệm chương “Vì sự nghiệp phát triển ngành Công Thương Việt Nam” ban hành kèm theo Quyết định số 46/2008/QĐ-BCT ngày 17 tháng 12 năm 2008 của Bộ trưởng Bộ Công Thương và Thông tư số 08/2011/TT-BCT ngày 30 tháng 3 năm 2011 của Bộ trưởng Bộ Công Thương về việc sửa đổi, bổ sung một số điều quy định về thủ tục hành chính tại Quyết định số 46/2008/QĐ-BCT.

3. Giải thưởng Sáng tạo khoa học nữ ngành Công Thương thực hiện theo Quy chế xét tặng Giải thưởng Sáng tạo khoa học nữ ngành Công Thương ban hành kèm theo Quyết định số 38/2008/QĐ-BCT ngày 21 tháng 10 năm 2008 của Bộ trưởng Bộ Công Thương.

4. Bằng khen của Bộ trưởng Bộ Công Thương tặng thưởng đối với cá nhân gương mẫu chấp hành tốt chủ trương, chính sách của Đảng, pháp luật của Nhà nước và đạt một trong các tiêu chuẩn sau:

a) Lập thành tích xuất sắc, được bình xét trong các đợt thi đua theo đợt, theo chuyên đề do Bộ Công Thương phát động;

b) Lập thành tích đột xuất đặc biệt xuất sắc;

c) Lập được nhiều thành tích có phạm vi ảnh hưởng trong từng lĩnh vực thuộc Bộ;

d) 02 (hai) năm liên tục hoàn thành xuất sắc nhiệm vụ, trong thời gian đó có 02 (hai) sáng kiến được công nhận và áp dụng hiệu quả trong phạm vi cấp cơ sở;

đ) Có quá trình công tác, có nhiều cống hiến đối với sự nghiệp xây dựng và phát triển ngành Công Thương được xét tặng nhân dịp kỷ niệm ngày thành lập ngành, cơ quan, đơn vị hoặc trước khi nghỉ chế độ hưu trí;

e) Các trường hợp khác Bộ trưởng xem xét, quyết định.

5. Bằng khen của Bộ trưởng Bộ Công Thương tặng thưởng đối với tập thể gương mẫu chấp hành tốt chủ trương, chính sách của Đảng, pháp luật của Nhà nước và đạt một trong các tiêu chuẩn sau:

a) Lập thành tích xuất sắc, tiêu biểu được bình xét trong các đợt thi đua theo đợt, theo chuyên đề do Bộ Công Thương phát động;

b) Lập được thành tích xuất sắc đột xuất hoặc nhiều thành tích có phạm vi ảnh hưởng trong từng lĩnh vực thuộc ngành Công Thương;

c) 02 (hai) năm liên tục hoàn thành xuất sắc nhiệm vụ, nội bộ đoàn kết, thực hiện tốt quy chế dân chủ ở cơ sở, tổ chức tốt các phong trào thi đua; chăm lo đời sống vật chất, tinh thần trong tập thể; thực hành tiết kiệm; thực hiện đầy đủ các chế độ, chính sách đối với mọi thành viên trong tập thể.

Việc xét tặng khen thưởng đối với các cơ quan, đơn vị, các tập thể nhỏ thuộc các cơ quan, đơn vị thuộc Bộ lập được thành tích đột xuất, đặc biệt xuất sắc hoặc có thành tích xây dựng và phát triển cơ quan, đơn vị nhân dịp cơ quan, đơn vị kỷ niệm ngày thành lập được thực hiện vào dịp tổng kết công tác cuối năm của Bộ.

6. Giấy khen của Thủ trưởng cơ quan, đơn vị có tài khoản riêng, con dấu riêng, có tư cách pháp nhân

Thực hiện theo quy định tại Khoản 42, Điều 1 Luật Sửa đổi, bổ sung một số điều của Luật Thi đua, Khen thưởng năm 2013.

7. Thi đua theo đợt, theo chuyên đề có thể tổ chức với quy mô rộng lớn trong phạm vi một đơn vị, một địa phương, một ngành, một Bộ

a) Khi tiến hành sơ kết, tổng kết thi đua theo đợt hoặc theo chuyên đề, chủ yếu thực hiện hình thức khen thưởng của cấp phát động thi đua (Giấy khen, Bằng khen);

b) Trường hợp tổ chức trong phạm vi cả nước, khi sơ kết, tổng kết phong trào thi đua từ 03 (ba) năm trở lên, đơn vị chủ trì phát động thi đua lựa chọn những tập thể, cá nhân có thành tích tiêu biểu xuất sắc đề nghị Thủ tướng Chính phủ xét tặng Bằng khen;

c) Trường hợp tổ chức trong phạm vi cả nước, khi sơ kết, tổng kết phong trào thi đua từ 05 (năm) năm trở lên, đơn vị chủ trì phát động thi đua lựa chọn những tập thể, cá nhân có thành tích đặc biệt xuất sắc đề nghị Chủ tịch nước xét tặng “Huân chương Lao động” hạng ba và chủ yếu khen thưởng cho đối tượng trực tiếp lao động sản xuất, công tác.

 

Chương IV

THẨM QUYỀN QUYẾT ĐỊNH, TRAO TẶNG, THỦ TỤC, HỒ SƠ

VÀ QUY TRÌNH ĐỀ NGHỊ KHEN THƯỞNG

 

Điều 17. Thẩm quyền quyết định, trao tặng

1. Thẩm quyền quyết định, trao tặng Huân chương, Huy chương, Giải thưởng Hồ Chí Minh, Giải thưởng Nhà nước, Danh hiệu vinh dự Nhà nước, Cờ thi đua của Chính phủ, Chiến sĩ thi đua toàn quốc, Bằng khen của Thủ tướng Chính phủ, thực hiện theo quy định tại các Điều 77, 78 của Luật Thi đua, Khen thưởng.

2. Bộ trưởng Bộ Công Thương quyết định tặng thưởng các danh hiệu thi đua:

a) Cờ thi đua của Bộ;

b) Chiến sĩ thi đua cấp Bộ;

c) Tập thể lao động xuất sắc:

- Bộ trưởng quyết định tặng danh hiệu “Tập thể lao động xuất sắc” cho các đơn vị hành chính, sự nghiệp thuộc Bộ; các Doanh nghiệp thuộc Bộ (trừ các Tập đoàn kinh tế, Tổng công ty);

- Bộ trưởng ủy quyền cho Thủ trưởng các cơ quan, đơn vị có tư cách pháp nhân, có tài khoản riêng, con dấu riêng quyết định tặng danh hiệu “Tập thể lao động xuất sắc” cho các đơn vị, ban, phòng, khoa, xí nghiệp, phân xưởng, tổ, đội là đơn vị thành viên trực thuộc.v.v…

d) Lao động tiên tiến và Chiến sĩ thi đua cơ sở cho cá nhân và Tập thể lao động tiên tiến cho tập thể đối với các đơn vị thuộc cơ quan Bộ không có tư cách pháp nhân.

3. Bộ trưởng Bộ Công Thương quyết định tặng thưởng các hình thức khen thưởng:

a) Kỷ niệm chương “Vì sự nghiệp phát triển ngành Công Thương Việt Nam”;

b) Giải thưởng Sáng tạo khoa học nữ ngành Công Thương;

c) Bằng khen của Bộ trưởng Bộ Công Thương.

4. Thủ trưởng các cơ quan, đơn vị có tư cách pháp nhân, có tài khoản riêng, con dấu riêng quyết định tặng thưởng các danh hiệu thi đua:

a) Tập thể lao động tiên tiến;

b) Tập thể lao động xuất sắc;

c) Lao động tiên tiến;

d) Chiến sĩ thi đua cơ sở.

5. Thủ trưởng các cơ quan, đơn vị có tư cách pháp nhân, có tài khoản riêng, con dấu riêng quyết định tặng thưởng hình thức khen thưởng:

Giấy khen.

Điều 18. Lễ trao tặng danh hiệu thi đua và hình thức khen thưởng

Việc công bố, trao tặng các danh hiệu thi đua, hình thức khen thưởng là dịp để tôn vinh những gương người tốt, việc tốt và điển hình tiên tiến. Lễ trao tặng phải được tổ chức trang trọng, thiết thực, tiết kiệm, tránh phô trương, lãng phí.

1. Tổ chức mít tinh, lễ kỷ niệm, trao tặng và đón nhận danh hiệu vinh dự Nhà nước, Huân chương, Huy chương, Cờ thi đua của Chính phủ, Bằng khen của Thủ tướng Chính phủ được thực hiện theo quy định tại Nghị định số 145/2013/NĐ-CP ngày 29 tháng 10 năm 2013 của Chính phủ quy định việc tổ chức ngày kỷ niệm; nghi thức trao tặng, đón nhận hình thức khen thưởng, danh hiệu thi đua; nghi lễ đối ngoại và đón, tiếp khách nước ngoài.

2. Bộ trưởng Bộ Công Thương được sự uỷ quyền của Lãnh đạo Đảng, Nhà nước trao tặng danh hiệu Cờ thi đua của Chính phủ cho các cơ quan, đơn vị thuộc Bộ và trực tiếp trao tặng Cờ thi đua của Bộ, Bằng khen của Bộ trưởng cho các cơ quan, đơn vị trực thuộc Bộ và Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương tại Hội nghị tổng kết công tác hàng năm của Bộ.

3. Bộ trưởng Bộ Công Thương uỷ quyền cho Thủ trưởng các cơ quan, đơn vị chịu trách nhiệm tổ chức trao tặng các danh hiệu thi đua và hình thức khen thưởng, cụ thể như sau:

a) Đối với Huân chương và Huy chương: sau khi nhận được thông báo của Vụ Thi đua - Khen thưởng và các quyết định, hiện vật khen thưởng, Thủ trưởng cơ quan, đơn vị lập kế hoạch tổ chức, đón nhận, trình Bộ trưởng (thông qua Vụ Thi đua - Khen thưởng). Sau khi có ý kiến chỉ đạo của Bộ trưởng, Vụ Thi đua - Khen thưởng phối hợp với các cơ quan, đơn vị tổ chức công bố, trao tặng và có thể tổ chức kết hợp với những chương trình, nội dung thiết thực khác của cơ quan, đơn vị để tiết kiệm thời gian, chi phí. Đối với một số trường hợp đặc biệt, Vụ Thi đua - Khen thưởng lập kế hoạch tổ chức đón nhận trình Bộ trưởng và tổ chức công bố, trao tặng;

b) Đối với danh hiệu Chiến sĩ thi đua toàn quốc và hình thức khen thưởng Bằng khen của Thủ tướng Chính phủ cho cá nhân, tập thể: Thủ trưởng cơ quan, đơn vị chủ động lập kế hoạch, tổ chức công bố, trao tặng cho cá nhân, tập thể được khen thưởng của cơ quan, đơn vị mình phụ trách và thông báo cho Vụ Thi đua - Khen thưởng biết để chỉ đạo, theo dõi;

c) Đối với các danh hiệu thi đua và hình thức khen thưởng thuộc thẩm quyền của Bộ trưởng Bộ Công Thương: Bộ trưởng uỷ quyền cho Thủ trưởng cơ quan, đơn vị tổ chức công bố, trao tặng cho cá nhân, tập thể thuộc cơ quan, đơn vị mình quản lý;

d) Đối với tập thể, cá nhân được tặng danh hiệu thi đua và hình thức khen thưởng thuộc thẩm quyền của Thủ trưởng cơ quan, đơn vị do cơ quan, đơn vị tổ chức công bố, trao tặng.

Điều 19. Tuyến trình khen thưởng

1. Cấp nào chủ trì phát động thi đua theo đợt, theo chuyên đề thì cấp đó lựa chọn cá nhân, tập thể xuất sắc để khen thưởng hoặc đề nghị cấp trên khen thưởng.

2. Thủ trưởng cơ quan, đơn vị thuộc Bộ có trách nhiệm khen thưởng theo thẩm quyền hoặc trình cấp trên khen thưởng đối với cá nhân, tập thể thuộc phạm vi quản lý.

3. Đối với Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương

a) Việc đề nghị tặng thưởng các danh hiệu thi đua và hình thức khen thưởng của Nhà nước do Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương xét trình theo các quy định của Luật Thi đua, Khen thưởng, Nghị định số 42/2010/NĐ-CP, Nghị định số 65/2014/NĐ-CP và các văn bản hướng dẫn của Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương;

b) Bộ Công Thương hiệp y khen thưởng đối với các danh hiệu thi đua và hình thức khen thưởng của Nhà nước theo đề nghị của Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương hoặc Ban Thi đua - Khen thưởng Trung ương;

c) Việc đề nghị danh hiệu “Cờ thi đua của Bộ Công Thương” và các hình thức khen thưởng theo thẩm quyền quyết định của Bộ trưởng Bộ Công Thương thực hiện như các cơ quan, đơn vị thuộc Bộ khi Bộ tiến hành phát động thi đua theo chuyên đề.

4. Đối với các Hiệp hội ngành hàng thuộc ngành Công Thương

Chủ tịch Hiệp hội xem xét và đề nghị Bộ trưởng Bộ Công Thương khen thưởng theo thẩm quyền.

5. Đối với đơn vị ngoài ngành

Thủ trưởng cơ quan, đơn vị có hoạt động liên quan trong lĩnh vực Công Thương có đề xuất với các cấp có thẩm quyền xem xét và đề nghị Bộ trưởng Bộ Công Thương khen thưởng theo thẩm quyền.

Điều 20. Hồ sơ đề nghị khen thưởng

1. Vụ Thi đua - Khen thưởng có trách nhiệm tiếp nhận hồ sơ đề nghị khen thưởng của các cơ quan, đơn vị trong và ngoài ngành.

2. Đối với Bằng khen và Cờ thi đua của Bộ Công Thương, 01 (một) bộ hồ sơ gồm:

a) Tờ trình đề nghị khen thưởng của Giám đốc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương đối với tập thể, cá nhân thuộc Sở hoặc Thủ trưởng cơ quan, đơn vị thuộc Bộ đối với tập thể và cá nhân thuộc cơ quan, đơn vị đó (Phụ lục 2);

b) Biên bản họp Hội đồng Thi đua - Khen thưởng của Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương hoặc biên bản họp của Hội đồng Thi đua - Khen thưởng cơ quan, đơn vị thuộc Bộ (Phụ lục 3);

c) Báo cáo thành tích của tập thể (ký và đóng dấu của Thủ trưởng cơ quan, đơn vị) và cá nhân (ký, ghi rõ họ tên, có xác nhận của Thủ trưởng cơ quan, đơn vị ký tên và đóng dấu) được đề nghị khen thưởng (Phụ lục 4 và Phụ lục 5);

d) Bản sao Quyết định hoặc Chứng nhận tặng danh hiệu “Chiến sĩ thi đua cơ sở”, “Tập thể lao động xuất sắc” của cấp có thẩm quyền;

đ) Xác nhận sáng kiến, đề tài nghiên cứu khoa học được Hội đồng sáng kiến, Hội đồng khoa học cấp cơ sở công nhận; Bản sao Giải thưởng quốc gia, quốc tế (nếu có).

3. Đối với danh hiệu “Anh hùng Lao động”, hồ sơ được thực hiện theo quy định tại Khoản 23, Điều 1 của Nghị định số 39/2012/NĐ-CP (Phụ lục 6 và Phụ lục 7).

4. Đối với danh hiệu “Chiến sĩ thi đua toàn quốc”, “Cờ thi đua của Chính phủ” và các hình thức khen thưởng Huân chương, Bằng khen của Thủ tướng Chính phủ, Huy chương, hồ sơ được thực hiện theo quy định tại các Khoản 6, 10, 12, 15, 18, Điều 1 của Nghị định số 39/2012/NĐ-CP, hồ sơ gồm:

a) Tờ trình đề nghị (Phụ lục 2);

b) Biên bản họp Hội đồng Thi đua - Khen thưởng (Phụ lục 3);

c) Bản sao Quyết định hoặc Chứng nhận tặng các danh hiệu thi đua và các hình thức khen thưởng của cấp có thẩm quyền cho tập thể, cá nhân được đề nghị khen thưởng;

d) Báo cáo thành tích của cá nhân, tập thể được đề nghị khen thưởng phải có chữ ký, ghi rõ họ tên người lập và có chữ ký, đóng dấu (nếu có) xác nhận của Thủ trưởng cơ quan, đơn vị (Phụ lục 4 và Phụ lục 5);

đ) Xác nhận sáng kiến, đề tài nghiên cứu khoa học được Hội đồng sáng kiến, Hội đồng khoa học các cấp công nhận; Bản sao Giải thưởng quốc gia, quốc tế (Phụ lục 8);

e) Xác nhận hoàn thành nghĩa vụ nộp ngân sách nhà nước đối với tập thể, cá nhân là Thủ trưởng cơ quan, đơn vị doanh nghiệp có nghĩa vụ nộp ngân sách nhà nước (có xác nhận hoàn thành nghĩa vụ thuế của cơ quan thuế tỉnh, thành phố trực thuộc Trung ương);

g) Ý kiến của Ủy ban nhân dân địa phương (xã, phường) về các mặt hoạt động trên địa bàn;

h) Đối với các tập thể, cá nhân trong ngành (thuộc các tỉnh, thành phố trực thuộc Trung ương), các Bộ, ngành, đoàn thể Trung ương cần có hiệp y của Bộ Công Thương chỉ cần gửi báo cáo thành tích kèm theo công văn đề nghị xin ý kiến hiệp y.

5. Đối với khen thưởng đột xuất, khen thưởng thi đua theo đợt hoặc theo chuyên đề

Hồ sơ được thực hiện theo quy định tại Khoản 2, Điều 61 của Nghị định số 42/2010/NĐ-CP và Khoản 20, Điều 1 của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị kèm theo danh sách cá nhân, tập thể được đề nghị khen thưởng (Phụ lục 2);

b) Báo cáo tóm tắt thành tích do cơ quan, đơn vị quản lý trực tiếp lập, (nêu rõ thành tích, công trạng lập được) để đề nghị khen thưởng (Phụ lục 9 hoặc Phụ lục 10).

6. Đối với khen thưởng quá trình cống hiến, hồ sơ được thực hiện theo quy định của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị quản lý cán bộ trước khi nghỉ hưu (Phụ lục 2);

b) Báo cáo thành tích (Phụ lục 11).

7. Đối với khen thưởng cho người nước ngoài, hồ sơ được thực hiện theo quy định tại Khoản 13, Điều 1 của Nghị định số 39/2012/NĐ-CP, gồm:

a) Tờ trình đề nghị khen thưởng của cơ quan, đơn vị có người nước ngoài công tác (Phụ lục 2);

b) Báo cáo thành tích (Phụ lục 12).

8. Bằng khen của cấp Bộ, Bằng chứng nhận danh hiệu “Chiến sĩ thi đua cấp Bộ” (Phụ lục 13).

9. Bằng chứng nhận danh hiệu “Tập thể lao động xuất sắc”, “Tập thể lao động tiên tiến” (Phụ lục 14).

10. Bằng chứng nhận danh hiệu “Chiến sĩ thi đua cơ sở” (Phụ lục 15).

Điều 21. Thời gian nhận hồ sơ

1. Khen thưởng theo công trạng và thành tích đạt được đối với tập thể, cá nhân thuộc thẩm quyền của Bộ

a) Đối với khen thưởng hàng năm cho các danh hiệu thi đua, hình thức khen thưởng thuộc thẩm quyền của Bộ trưởng và danh hiệu “Cờ thi đua của Chính phủ”, chậm nhất ngày 15 tháng 12 hàng năm (tính theo dấu bưu điện);

b) Đối với khen thưởng danh hiệu “Chiến sĩ thi đua toàn quốc”, chậm nhất ngày 20 tháng 02 hàng năm (tính theo dấu bưu điện);

c) Đối với Huân chương, Huy chương, Bằng khen của Thủ tướng Chính phủ, thời hạn nhận hồ sơ theo từng trường hợp cụ thể.

d) Đối với danh hiệu “Anh hùng Lao động”, 5 năm xét một lần, trừ trường hợp có thành tích đặc biệt xuất sắc đột xuất.

2. Đối với các danh hiệu thi đua, hình thức khen thưởng được quy định tại Khoản 4 và Khoản 5 Điều 17 Thông tư này thuộc thẩm quyền của Thủ trưởng cơ quan, đơn vị, do Thủ trưởng cơ quan, đơn vị xem xét, quyết định thời gian nhận hồ sơ.

3. Khen thưởng đột xuất, khen thưởng theo chuyên đề, hồ sơ được gửi chậm nhất không quá 15 (mười lăm) ngày kể từ khi lập được thành tích đột xuất hoặc sau khi kết thúc chuyên đề công tác.

Điều 22. Quy trình đề nghị khen thưởng

Sau khi tiếp nhận hồ sơ đề nghị khen thưởng hoặc hiệp y khen thưởng, Vụ Thi đua - Khen thưởng có trách nhiệm thẩm định các danh hiệu thi đua, các hình thức khen thưởng theo quy định hiện hành và tổng hợp trình Chủ tịch Hội đồng Thi đua - Khen thưởng xem xét, quyết định hoặc xin ý kiến các thành viên Hội đồng bằng văn bản. Kết quả bình xét của Hội đồng được tổng hợp trình Bộ trưởng quyết định. Quy trình đề nghị khen thưởng cho các đối tượng cụ thể như sau:

1. Đối với các trường hợp đề nghị khen thưởng Huân chương Sao Vàng, Huân chương Hồ Chí Minh và danh hiệu “Anh hùng Lao động”, Vụ Thi đua - Khen thưởng báo cáo xin ý kiến chỉ đạo của Bộ trưởng, Chủ tịch Hội đồng Thi đua - Khen thưởng trước khi họp Hội đồng Thi đua - Khen thưởng Bộ và trong hồ sơ trình Thủ tướng Chính phủ (thông qua Ban Thi đua - Khen thưởng Trung ương thẩm định để Thủ tướng Chính phủ trình Chủ tịch nước) phải có ý kiến bằng văn bản của Ban cán sự Đảng Bộ Công Thương.

2. Đối với các trường hợp xét tặng danh hiệu thi đua và các hình thức khen thưởng cho các cá nhân, tập thể của các cơ quan, đơn vị thuộc Bộ, Thủ trưởng cơ quan, đơn vị lập Tờ trình, Biên bản họp Hội đồng Thi đua - Khen thưởng cơ sở gửi về Vụ Thi đua - Khen thưởng để thẩm định trình Hội đồng Thi đua - Khen thưởng Bộ xem xét.

Vụ Thi đua - Khen thưởng hoàn tất hồ sơ trình Bộ trưởng quyết định khen thưởng theo thẩm quyền hoặc trình Thủ tướng Chính phủ quyết định (thông qua Ban Thi đua - Khen thưởng Trung ương).

3. Đối với các trường hợp xét tặng danh hiệu thi đua và các hình thức khen thưởng Cờ thi đua của Bộ, Bằng khen của Bộ trưởng cho các cá nhân và tập thể thuộc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương, Vụ Thi đua - Khen thưởng tổng hợp, thẩm định, trình Hội đồng Thi đua - Khen thưởng Bộ xem xét và hoàn tất hồ sơ trình Bộ trưởng quyết định.

4. Đối với các trường hợp khen thưởng cho cá nhân, tập thể ngoài ngành, Thủ trưởng cơ quan, đơn vị có quan hệ trực tiếp lập Tờ trình kèm báo cáo tóm tắt thành tích của cá nhân, tập thể được đề nghị khen thưởng, gửi về Vụ Thi đua - Khen thưởng để tổng hợp, thẩm định trình Hội đồng Thi đua - Khen thưởng Bộ xem xét và hoàn tất hồ sơ trình Bộ trưởng quyết định.

5. Vụ Thi đua - Khen thưởng chịu trách nhiệm đề xuất với Hội đồng Thi đua - Khen thưởng Bộ để trình Bộ trưởng xem xét đề nghị cấp có thẩm quyền khen thưởng các danh hiệu thi đua và các hình thức khen thưởng đối với Lãnh đạo Bộ.

 

Chương V

HỘI ĐỒNG THI ĐUA - KHEN THƯỞNG CÁC CẤP

 

Điều 23. Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Thành lập Hội đồng Thi đua - Khen thưởng Bộ Công Thương để chỉ đạo hoạt động thi đua, khen thưởng của ngành Công Thương.

2. Thành lập Hội đồng Thi đua - Khen thưởng tại các cơ quan, đơn vị thuộc Bộ để chỉ đạo hoạt động thi đua, khen thưởng ở cơ quan, đơn vị.

Điều 24. Thẩm quyền quyết định thành lập Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Bộ trưởng quyết định thành lập Hội đồng Thi đua - Khen thưởng Bộ.

2. Thủ trưởng cơ quan, đơn vị thuộc Bộ có tài khoản riêng, con dấu riêng, có tư cách pháp nhân quyết định thành lập Hội đồng Thi đua - Khen thưởng của cơ quan, đơn vị mình phụ trách.

Điều 25. Thành phần Hội đồng Thi đua - Khen thưởng các cấp trong ngành Công Thương

1. Thành phần Hội đồng Thi đua - Khen thưởng Bộ thực hiện theo Quyết định số 10292/QĐ-BCT ngày 13 tháng 11 năm 2014 của Bộ trưởng Bộ Công Thương về việc thành lập Hội đồng Thi đua - Khen thưởng Bộ Công Thương.

2. Thành phần Hội đồng Thi đua - Khen thưởng của cơ quan, đơn vị có tài khoản riêng, con dấu riêng, có tư cách pháp nhân gồm:

a) Chủ tịch là Thủ trưởng cơ quan, đơn vị;

b) Phó Chủ tịch là Chủ tịch Công đoàn cơ quan, đơn vị;

c) Ủy viên Thường trực là người đảm nhận một trong các chức danh sau: Chánh Văn phòng, Trưởng phòng, ban Hành chính, Tổ chức, Tổng hợp hoặc cá nhân phụ trách công tác thi đua, khen thưởng của cơ quan, đơn vị;

d) Các uỷ viên gồm đại diện cấp uỷ Đảng, Đoàn Thanh niên cộng sản Hồ Chí Minh, Trưởng các phòng, ban, bộ phận chuyên môn do Thủ trưởng cơ quan, đơn vị quyết định trên nguyên tắc số lượng là 3, 5, 7, 9 hoặc 11 thành viên.

Điều 26. Nguyên tắc làm việc, nhiệm vụ, quyền hạn của Hội đồng Thi đua - Khen thưởng các cấp

1. Hội đồng Thi đua - Khen thưởng các cấp có chức năng giúp cho Thủ trưởng cơ quan, đơn vị cùng cấp về công tác thi đua, khen thưởng, làm việc theo nguyên tắc tập trung dân chủ và biểu quyết theo đa số. Trường hợp ý kiến các thành viên Hội đồng Thi đua - Khen thưởng ngang nhau thì ý kiến của Chủ tịch Hội đồng là quyết định.

2. Nguyên tắc làm việc, nhiệm vụ và quyền hạn cụ thể của Hội đồng Thi đua - Khen thưởng Bộ thực hiện theo Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ Công Thương ban hành kèm theo Quyết định số 10293/QĐ-BCT ngày 13 tháng 11 năm 2014 của Bộ trưởng Bộ Công Thương về việc ban hành Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ Công Thương.

3. Nguyên tắc làm việc, nhiệm vụ và quyền hạn cụ thể của Hội đồng Thi đua - Khen thưởng cơ quan, đơn vị do Thủ trưởng cơ quan, đơn vị quy định không trái với Quy chế hoạt động của Hội đồng Thi đua - Khen thưởng Bộ.

 

Chương VI

THÔNG BÁO KẾT QUẢ KHEN THƯỞNG, LƯU TRỮ HỒ SƠ KHEN THƯỞNG

SỬ DỤNG QUỸ THI ĐUA, KHEN THƯỞNG

 

Điều 27. Thông báo kết quả khen thưởng

1. Các tập thể, cá nhân đủ tiêu chuẩn khen thưởng và đã được cấp có thẩm quyền Quyết định khen thưởng, trong thời hạn không quá 15 (mười lăm) ngày, kể từ ngày có Quyết định khen thưởng, cơ quan thẩm định hồ sơ phải thông báo cho đơn vị đề nghị khen thưởng biết.

2. Đối với các trường hợp không đủ tiêu chuẩn khen thưởng, cơ quan thẩm định phải thông báo (có nêu rõ lý do) cho đơn vị đề nghị khen thưởng biết trong thời gian 15 (mười lăm) ngày như quy định tại Khoản 1, Điều này.

3. Trường hợp hồ sơ được gửi không đúng tuyến trình, cơ quan thẩm định phải thông báo và trả hồ sơ cho đơn vị đề nghị khen thưởng trong thời hạn không quá 05 (năm) ngày, kể từ ngày nhận được hồ sơ.

Điều 28. Lưu trữ hồ sơ khen thưởng

1. Hội đồng Thi đua - Khen thưởng các cấp có trách nhiệm lưu trữ hồ sơ khen thưởng của cấp mình theo quy định để ghi nhận thành tích của các thế hệ đối với sự nghiệp cách mạng của Đảng, dân tộc, giáo dục truyền thống, xây dựng cơ quan, đơn vị và phục vụ cho việc tra cứu, giải quyết đơn, thư khiếu nại của công dân hoặc xác nhận cho các đối tượng được hưởng chính sách khi có yêu cầu.

2. Hồ sơ khen thưởng phải được bàn giao cho Lưu trữ của cơ quan, đơn vị khi hết thời hạn lưu trữ theo quy định của pháp luật về lưu trữ.

Điều 29. Quản lý và sử dụng quỹ thi đua, khen thưởng

1. Quỹ thi đua, khen thưởng của Bộ được thực hiện theo quy định tại Khoản 1, Điều 67 của Nghị định số 42/2010/NĐ-CP; Thông tư số 71/2011/TT-BTC ngày 24 tháng 5 năm 2011 của Bộ Tài chính hướng dẫn việc trích lập, quản lý và sử dụng Quỹ thi đua, khen thưởng theo Nghị định số 42/2010/NĐ-CP.

2. Bộ Công Thương khuyến khích các cá nhân, tập thể trong và ngoài ngành hỗ trợ, đóng góp để bổ sung Quỹ thi đua, khen thưởng hàng năm của Bộ.

3. Quỹ thi đua, khen thưởng của Bộ được sử dụng để:

a) Chi tiền thưởng hoặc tặng phẩm lưu niệm cho các cá nhân, tập thể thuộc cơ quan Bộ theo các quyết định khen thưởng;

b) Trích 20% trong tổng Quỹ thi đua, khen thưởng của Bộ để chi cho công tác tổ chức, chỉ đạo các phong trào thi đua;

c) Cuối năm số dư trong Quỹ được chuyển sang năm sau để tiếp tục sử dụng cho công tác thi đua, khen thưởng.

4. Mức chi tiền thưởng cụ thể kèm theo các danh hiệu thi đua, hình thức khen thưởng thực hiện theo quy định từ Điều 71 đến Điều 76 của Nghị định số 42/2010/NĐ-CP.

5. Quỹ thi đua, khen thưởng của Bộ do Vụ Thi đua - Khen thưởng chịu trách nhiệm quản lý; Quỹ thi đua, khen thưởng của các cơ quan, đơn vị có tư cách pháp nhân, có tài khoản riêng, con dấu riêng được sử dụng chi tiền thưởng hoặc tặng phẩm lưu niệm cho các cá nhân, tập thể thuộc cơ quan, đơn vị được khen thưởng.

 

Chương VII

TỔ CHỨC THỰC HIỆN

 

Điều 30. Kiểm tra công tác thi đua, khen thưởng

1. Vụ Thi đua - Khen thưởng có trách nhiệm giúp Hội đồng Thi đua - Khen thưởng Bộ kiểm tra công tác thi đua, khen thưởng tại các cơ quan, đơn vị trong ngành.

2. Thủ trưởng cơ quan, đơn vị có trách nhiệm kiểm tra công tác thi đua, khen thưởng tại cơ quan, đơn vị do mình quản lý.

Điều 31. Xử lý vi phạm và giải quyết khiếu nại, tố cáo

1. Cá nhân, tập thể gian dối trong việc kê khai thành tích để được khen thưởng thì bị huỷ bỏ quyết định khen thưởng, bị thu hồi hiện vật và tiền thưởng đã nhận; tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định.

2. Thủ trưởng cơ quan, tổ chức xác nhận sai sự thật hoặc làm giả hồ sơ cho người khác để đề nghị khen thưởng thì tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định.

3. Việc giải quyết khiếu nại, tố cáo về công tác thi đua, khen thưởng thực hiện theo Điều 98 của Luật Thi đua, Khen thưởng và theo các quy định của pháp luật về khiếu nại, tố cáo.

4. Vụ Thi đua - Khen thưởng có trách nhiệm tiếp nhận, giải quyết các khiếu nại, tố cáo về công tác thi đua, khen thưởng thuộc thẩm quyền và phối hợp với Thanh tra Bộ, các đơn vị có liên quan kiểm tra, xác minh và báo cáo Chủ tịch Hội đồng Thi đua - Khen thưởng Bộ, Lãnh đạo Bộ Công Thương xem xét, quyết định.

Điều 32. Báo cáo công tác thi đua, khen thưởng

1. Định kỳ quý IV hàng năm, các cơ quan, đơn vị thuộc Bộ Công Thương, Sở Công Thương các tỉnh thành phố trực thuộc Trung ương tổng kết, đánh giá công tác thi đua, khen thưởng, bình xét khen thưởng năm và gửi báo cáo về Bộ Công Thương chậm nhất là ngày 15 tháng 12.

2. Các cơ sở đào tạo thuộc Bộ Công Thương tổng kết, đánh giá công tác thi đua, khen thưởng, bình xét khen thưởng năm và gửi báo cáo về Bộ Công Thương chậm nhất là ngày 10 tháng 8.

3. Các cơ quan, đơn vị trong ngành có phát động phong trào thi đua và sau một đợt thi đua, có trách nhiệm sơ kết, tổng kết, bình xét thi đua và gửi báo cáo về Bộ Công Thương.

Điều 33. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 03 tháng 10 năm 2015 và thay thế Thông tư số 43/2011/TT-BCT ngày 26 tháng 12 năm 2011 của Bộ Công Thương về việc quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương.

2. Hội đồng Thi đua - Khen thưởng Bộ chỉ đạo thực hiện Thông tư này.

3. Giao Vụ Thi đua - Khen thưởng chịu trách nhiệm theo dõi, đôn đốc, kiểm tra việc thực hiện Thông tư này và căn cứ tình hình thực tiễn phong trào thi đua hàng năm, nghiên cứu đề xuất số lượng và tỷ lệ khen thưởng hợp lý để Bộ trưởng xem xét, quyết định.

4. Thủ trưởng các cơ quan, đơn vị tổ chức triển khai thực hiện Thông tư này và cụ thể hoá các tiêu chuẩn phù hợp với tình hình hoạt động của cơ quan, đơn vị.

5. Trong quá trình thực hiện Thông tư quy định chi tiết thi hành công tác thi đua, khen thưởng trong ngành Công Thương, nếu có vướng mắc hoặc những điều chưa phù hợp, Thủ trưởng các cơ quan, đơn vị thuộc Bộ, Giám đốc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương phản ánh về Bộ Công Thương để nghiên cứu, bổ sung, sửa đổi./.
