CIRCULAR

Amending and supplementing certain provisions of Circular No. 37/2023/TT-BGTVT dated December 13, 2023 issued by the Minister of Transport on management of cross-border road transport activities

Pursuant to the Law on International Treaties on April 9, 2016;

Pursuant to the ASEAN Framework Agreement on Facilitation of Goods in Transit signed on December 16, 1998;

Pursuant to the ASEAN Framework Agreement on Facilitation of Intra-Regional Land Transport signed on December 10, 2009;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to the ASEAN Framework Agreement on Facilitation of Cross-Border Road Passenger Transport signed on October 13, 2017;

Pursuant to the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion signed on November 26, 1999, amended on April 30, 2004;

Pursuant to the Supplementary Memorandum of Understanding on Routes and Border Gates to Protocol No. 1 of the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion effective from December 13, 2023;

Pursuant to the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on Road Transport signed on January 17, 2013;

Pursuant to the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 22, 1994;

The Agreement on Facilitating the Movement of Motor Vehicles Across Borders Between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed on April 23, 2009;

The Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the Kingdom of Cambodia signed on June 1, 1998;;

On the basis of At the proposal of the Director of the Department of International Cooperation and the Director General of the Vietnam Highway Administration;

On the basis of The Minister of Construction hereby promulgates

Circular amending and supplementing certain provisions of Circular No. 37/2023/TT-BGTVT dated December 13, 2023 issued by the Minister of Transport on management of cross-border road transport activities

Article 1. Amending and supplementing Article 7 "Article 7. List of border gates and routes for goods transport.

1. The list of pairs of border gates and routes for ASEAN goods transport implementing the ASEAN Framework Agreement on Facilitation of Goods in Transit and the ASEAN Framework Agreement on Facilitation of Intra-Regional Land Transport is specified in Appendix II and the geographical scope is indicated in Appendix XI attached hereto.

2. When the parties agree to supplement pairs of border gates and routes for implementing the ASEAN Framework Agreement on Facilitation of Goods in Transit and the ASEAN Framework Agreement on Facilitation of Intra-Regional Land Transport and such agreements become effective for the Socialist Republic of Vietnam, vehicles holding valid ASEAN Combined Transport Permit may operate across borders at the supplemented border gates and routes."

Article 2. Amending and supplementing Article 8

"Article 8. List of border gates and routes for passenger transport

1. The list of pairs of border gates and routes for ASEAN passenger transport implementing the ASEAN Framework Agreement on Facilitation of Cross-Border Road Passenger Transport is specified in Appendix III and the geographical scope is indicated in Appendix XI attached hereto.

2. When the parties agree to supplement pairs of border gates and routes for implementing the ASEAN Framework Agreement on Facilitation of Cross-Border Road Passenger Transport and such agreements become effective for the Socialist Republic of Vietnam, vehicles holding valid ASEAN Combined Transport Permit may operate across borders at the supplemented border gates and routes."

1. The list of pairs of border gates and ASEAN passenger transport routes implementing the ASEAN Framework Agreement on Facilitating Land Passenger Transport Across Borders is specified in Appendix III and the geographical scope is set forth in Appendix XI attached hereto.

2. When the Parties agree to supplement the pairs of border gates and transport routes implementing the ASEAN Framework Agreement on Facilitating Land Passenger Transport Across Borders and such supplementation becomes effective for the Socialist Republic of Vietnam, ASEAN Combined Transport Permits that are still valid may operate across the border at the supplemented pairs of border gates and transport routes.

Article 3. Amending and supplementing Article 11

"Article 11. List of border gates

1. The list of pairs of border gates implementing the GMS Agreement shall be specified in Appendix VII issued together with this Circular.

2. When the Parties sign to supplement pairs of border gates implementing the GMS Agreement and such supplementation becomes effective for the Socialist Republic of Vietnam, means of transport that have been granted GMS Combined Transport Permit and TAD booklets still within their validity period shall be permitted to operate across the border at the supplemented pairs of border gates."

Article 4. Amending and supplementing Article 12

"Article 12. List of routes

1. The list of routes implementing the GMS Agreement shall be specified in Appendix VIII and compared with the geographical scope in Appendix XI issued together with this Circular.

2. When the Parties agree to supplement routes for the implementation of the GMS Agreement and such supplementation becomes effective for the Socialist Republic of Vietnam, means of transport that have been granted GMS Combined Transport Permit and TAD booklets still within their validity period shall be permitted to operate across the border on the supplemented routes."

Article 5. Amending and supplementing Article 15

"Article 15. List of border gates and routes

1. The list of pairs of border gates for international road transport implementing the Memorandum of Understanding on Road Transport between Cambodia, Laos, and Vietnam shall be specified in Appendix IX and compared with the geographical scope in Appendix XI issued together with this Circular.

2. The list of pairs of border gates and routes for transit transport implementing the Memorandum of Understanding on Road Transport between Cambodia, Laos, and Vietnam shall be specified in Appendix X and compared with the geographical scope in Appendix XI issued together with this Circular.

3. When the Parties agree to supplement pairs of border gates for international road transport and pairs of border gates and transit routes implementing the Memorandum of Understanding on Road Transport between Cambodia, Laos, and Vietnam and such supplementation becomes effective for the Socialist Republic of Vietnam, means of transport that have been granted Cambodia-Laos-Vietnam Combined Transport Permit still within their validity period shall be permitted to operate across the border at the supplemented pairs of border gates and transit routes."

Article 6. Amending and supplementing Article 19

"Article 19. List of border gates

1. The list of pairs of border gates implementing the Vietnam-China Road Transport Agreement shall be specified in Appendix VII and compared with the geographical scope in Appendix XI issued together with this Circular.

2. Means of transport must enter and exit through the same border gate (excluding passenger transport vehicles or those under contracts).

3. When the two Parties agree to supplement pairs of border gates implementing the Vietnam-China Road Transport Agreement and such supplementation becomes effective for the Socialist Republic of Vietnam, means of transport that have been granted Transport Permit still within their validity period shall be permitted to operate across the border at the supplemented pairs of border gates."

Article 7. Amending and supplementing Article 20

"Article 20. List of routes

1. The routes for the implementation of the Vietnam-China Road Transport Agreement shall be specified in Appendix XII and compared with the geographical scope in Appendix XI issued together with this Circular.

2. When the two Parties agree to supplement routes for the implementation of the Vietnam-China Road Transport Agreement and such supplementation becomes effective for the Socialist Republic of Vietnam, means of transport that have been granted Transport Permit still within their validity period shall be permitted to operate across the border on the supplemented routes."

Article 8. Amend and supplement Article 23

"Article 23. List of border gates

1. The list of pairs of border gates implementing the Vietnam-Laos Road Transport Agreement is specified in Appendix XIII and the geographical scope is compared in Appendix XI issued together with this Circular.

2. When both sides sign to agree on supplementing pairs of border gates implementing the Vietnam-Laos Road Transport Agreement and it becomes effective for the Socialist Republic of Vietnam, vehicles that have been granted Vietnam-Laos Combined Transport Permits and are still within their validity period shall be allowed to operate across the border at the supplemented pairs of border gates. The crossing of persons and vehicles through additional border gates shall be agreed upon by the two provinces sharing the border."

Article 9. Amend and supplement Article 26

"Article 26. List of border gates

1. The list of pairs of border gates between Vietnam and Cambodia implementing the Vietnam-Cambodia Road Transport Agreement is specified in Appendix XVIII and the geographical scope is compared in Appendix XI issued together with this Circular.

2. Other pairs of border gates between Vietnam and Cambodia, when approved by the governments of the two countries to be upgraded to international border gates, shall implement the Vietnam-Cambodia Road Transport Agreement."

Article 10. Amend and supplement some points and clauses of Article 27

1. Replace the phrase "Department of Transportation" and "Department of Transportation and Construction" with the phrase "Department of Construction" in point d clause 1.

2. Replace the phrase "Department of Transportation" and "Department of Transportation and Construction" with the phrase "Department of Construction" in point c clause 2.

3. Replace the phrase "Ministry of Transportation" with the phrase "Ministry of Construction" in point d clause 3.

Article 11. Amend and supplement some points and clauses of Article 28

1. Delete the phrase "Inspectorate" in point c clause 1 and point b clause 2.

2. Replace the phrase "Department of Transportation, Department of Transportation and Construction" with the phrase "Department of Construction" in clause 2.

Article 12. Repeal Article 30

Article 13. Amend and supplement Appendices issued together with the Circular

1. Replace the phrase "Ministry of Transportation" with the phrase "Ministry of Construction" in Appendix XXII issued together with Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transportation.

2. Replace the phrase "Department of Transportation" and "Department of Transportation and Construction" with the phrase "Department of Construction" in Appendices XIX, XX, XXI issued together with Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transportation.

3. Replace Appendices II, III, VII, VIII, IX, X, XI, XII, XIII, XVIII issued together with Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transportation respectively with Appendices I, II, III, IV, V, VI, VII, VIII, IX, X issued together with this Circular.

4. Supplement Appendix XXIII into Circular No. 37/2023/TT-BGTVT corresponding to Appendix XI issued together with this Circular.

Article 14. Implementation clause

This Circular takes effect from November 20, 2025./.
