Issuing the List of Traditional Herbal Medicines and Traditional Drugs with Moderate Risk under the Management Responsibility of the Ministry of Health

Pursuant to the Law on Product Quality and Safety No. 05/2007/QH12 amended and supplemented by Law No. 78/2025/QH15;
Pursuant to the Medicine Law No. 105/2016/QH13 amended and supplemented by Law No. 44/2024/QH15;
Pursuant to the Government Decree No. 37/2026/NĐ-CP detailing and guiding the implementation of certain provisions and measures of the Law on Product Quality and Safety;
Pursuant to the Government Decree No. 163/2025/NĐ-CP detailing and guiding the implementation of certain provisions and measures of the Medicine Law;
Pursuant to Decree No.Decision No. 42/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Traditional Medicine Management Department;
The Minister of Health issues this Circular on the issuance of the List of Traditional Herbal Medicines and Traditional Drugs with Moderate Risk under the Management Responsibility of the Ministry of Health.
Article 1. Issuing the List of Traditional Herbal Medicines and Traditional Drugs with Moderate Risk under the Management Responsibility of the Ministry of Health
The List of Traditional Herbal Medicines and Traditional Drugs with Moderate Risk under the Management Responsibility of the Ministry of Health is detailed in the Appendix attached to this Circular.
Article 2. Responsibilities for Implementation
1. The Department of Traditional Medicine Management shall be responsible for organizing the implementation, guidance, and inspection of the implementation of this Circular throughout the country.
2. Provincial People's Committees shall be responsible for:
a) Organizing the implementation, guidance, and inspection of the implementation of this Circular within their jurisdiction;
b) Directing relevant agencies in the work of managing and inspecting the quality of traditional herbal medicines and traditional drugs listed in the List of Traditional Herbal Medicines and Traditional Drugs with Moderate Risk under the Management Responsibility of the Ministry of Health in accordance with the laws on medicine.
3. State drug testing facilities shall be responsible for conducting quality inspections of traditional herbal medicines and traditional drugs in accordance with the laws on medicine.
Article 3. Effectiveness
This Circular shall take effect from July 1, 2026.
In the course of implementation, if there are difficulties or obstacles, it is requested that agencies, organizations, and individuals report to the Ministry of Health (Department of Traditional Medicine Management) for resolution./.
