Regulations on the level of collection, collection system, payment, management, and use of fees and charges in the diplomatic field applicable to Vietnamese representative agencies abroad
Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;
Pursuant to the Law on Representative Agencies of the Socialist Republic of Vietnam Abroad dated June 18, 2009;
Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 16, 2014;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to the Nationality Law dated November 13, 2008;;
Pursuant to Decree No. 136/2007/NĐ-CP dated August 17, 2007 of the Government on the entry and exit of Vietnamese citizens and Decree No. 94/2015/NĐ-CP dated October 16, 2015 amending and supplementing certain articles of Decree No. 136/2007/NĐ-CP;
Pursuant to Decree No. 111/2011/NĐ-CP dated December 5, 2011 on consular certification and legalization;
Pursuant to Decree No. 82/2015/NĐ-CP dated September 14, 2015 on visa exemption for overseas Vietnamese residents and foreign spouses, children of overseas Vietnamese residents, or Vietnamese citizens;;

The Minister of Finance promulgates this Circular regulating the level of collection, collection system, payment, management, and use of fees and charges in the diplomatic field applicable to Vietnamese representative agencies abroad.
This Circular regulates the level of collection, collection system, payment, management, and use of fees and charges in the diplomatic field applicable to diplomatic representative agencies, consular representative agencies, and other agencies of Vietnam authorized to perform consular functions abroad (hereinafter referred to collectively as Vietnamese representative agencies abroad).
Article 2. Fee and Charge Payers
Organizations and individuals of Vietnam and organizations and individuals from foreign countries receiving public services or serving state management tasks in the diplomatic field from Vietnamese representative agencies abroad must pay fees and charges as prescribed in this Circular.
Article 3. Organizations collecting fees and charges
Vietnamese representative agencies abroad providing services to organizations and individuals regarding state management tasks in the diplomatic field in accordance with the law are the entities collecting fees and charges as prescribed in this Circular.
Article 4. Rates of Fees and Charges
The levels of collection of fees and charges specified in the Table of Collection Levels of Fees and Charges in the Diplomatic Field (Annexes 1 and 2) issued together with this Circular shall be applied at all Vietnamese representative agencies abroad.
Article 5. Cases of exemption or reduction of fees and charges
1. Exemption from payment of fees and charges in the following cases:
a) Foreign persons invited as guests (including their spouses, biological parents, in-laws, and accompanying children) of the Party, National Assembly, State, Government; or those personally invited by the leadership of the Party, National Assembly, State, Government of the Socialist Republic of Vietnam;
b) Staff and administrative technical personnel of foreign diplomatic agencies, consular agencies, and international organization representative agencies in Vietnam and members of their families (spouses, biological parents, in-laws, and minor children) according to the principle of reciprocity;
c) Foreign persons holding diplomatic passports, official passports, ordinary passports, or travel documents issued by foreign countries who are exempted from visa fees under international treaties to which Vietnam is a party, as provided by Vietnamese law, or according to the principle of reciprocity;
d) Foreign persons entering Vietnam to carry out relief or humanitarian work for Vietnamese organizations and individuals;
đ) Foreign persons entering Vietnam upon invitation for exchange between ministries, sectors, provinces, and cities according to the principle of reciprocity;
e) Persons who have rendered meritorious service to the revolution and the country;
g) Cases where foreign citizens need to be taken advantage of due to diplomatic needs or for humanitarian reasons, or Vietnamese citizens facing particularly difficult circumstances or risks;
h) Cases applying for visas but being exempted from visa fees according to the regulations of the Vietnamese Government, international treaties to which Vietnam is a party, or bilateral agreements.
2. Vietnamese residents settled in China, Laos, Thailand, and Cambodia, or in countries currently experiencing war or dangerous epidemics threatening lives, shall have their fees and charges in the diplomatic field reduced according to the Table of Collection Levels of Fees and Charges in the Diplomatic Field (Annexes 1 and 2) issued together with this Circular.
3. For cases exempted from payment of fees and charges in the diplomatic field as stipulated above, the entity collecting fees and charges must stamp "exempted from fees and charges" (GRATIS) on the issued documents.
Article 6. Declaration, Payment of Fees and Charges
1. The head of Vietnamese representative agencies abroad is responsible for examining and deciding to choose reputable banks to open accounts for Vietnamese representative agencies abroad to serve their activities, ensuring the safety of deposits in the Temporary Holding Fund of the State Budget at Vietnamese representative agencies abroad.
2. Regarding various registration fees
The Ministry of Foreign Affairs directs Vietnamese representative agencies abroad to organize accounting for the collection of diplomatic charge revenues; when revenue is generated, 100% (one hundred percent) of the diplomatic charge revenue and the actual interest earned from bank deposits shall be deposited into the Temporary Holding Fund of the State Budget at Vietnamese representative agencies abroad.
The costs for collecting charges are covered by the state budget within the organizational budget of the entity collecting charges according to the state budget expenditure standards as prescribed by law.
3. Regarding fees
The Ministry of Foreign Affairs directs Vietnamese representative agencies abroad to organize accounting for the collection of diplomatic fee revenues; when revenue is generated, 70% (seventy percent) of the diplomatic fee revenue and the actual interest earned from bank deposits shall be deposited into the Temporary Holding Fund of the State Budget at Vietnamese representative agencies abroad.
4. Fees and charges in the diplomatic field are calculated in US dollars (USD) according to the Table of Collection Levels of Fees and Charges in the Diplomatic Field issued together with this Circular. In cases where fees and charges in the diplomatic field are collected in the local currency, the conversion from US dollars (USD) to the local currency shall be based on the selling rate of US dollars (USD) published by the bank where the Vietnamese representative agency abroad has opened an account.
When the exchange rate for converting from US dollars (USD) to the local currency fluctuates by more than ten percent (10%) compared to the currently applied exchange rate, the Head of the Vietnamese Representative Office abroad shall adjust the consular fees and charges in the local currency according to the new exchange rate, and notify the Ministry of Foreign Affairs in writing before implementation.
In cases where there are two (02) or more Vietnamese Representative Offices in a country or territory authorized to collect fees and charges in the diplomatic field, the Head of the Vietnamese Representative Office with the highest authority shall base on the selling rate of the local bank to determine a unified collection rate for the remaining Vietnamese Representative Offices.
5. In cases where organizations and individuals from Vietnam and foreign organizations and individuals have paid fees and charges in the diplomatic field as stipulated in this Circular but do not meet the conditions to be issued consular documents or refuse to accept the results of their file processing, the entity collecting the fees and charges shall not refund the amount of fees and charges already collected.
Article 7. Management and Use
1. The Ministry of Foreign Affairs may use thirty percent (30%) of the actual collected diplomatic fees to spend according to the provisions of Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016, guiding the implementation of certain articles of the Law on Fees and Charges and other relevant laws.
2. The Ministry of Foreign Affairs shall issue regulations on managing and using thirty percent (30%) of the diplomatic fees retained. If unused at year-end, the retained fees shall be carried over to the next year for spending according to the regulations.
Article 8. Settlement of Collection and Expenditure of Fees and Charges in the Diplomatic Field
1. Vietnamese Representative Offices abroad shall be responsible for opening accounting books to record and account for the collection and expenditure of fees and the submission of charges in the diplomatic field according to the current administrative and public service accounting system. The Head of the Vietnamese Representative Office abroad shall be responsible for managing and accounting for all types of fees and charges in the diplomatic field of their office; they must submit monthly reports on fee and charge collections in the diplomatic field to the Ministry of Foreign Affairs (according to the model specified in Appendix 4 and 5 of this Circular).
2. The Ministry of Foreign Affairs shall be responsible for inspecting and settling the collection and expenditure of fees and charges in the diplomatic field of Vietnamese Representative Offices abroad according to current regulations.
3. The Ministry of Foreign Affairs shall coordinate with the Ministry of Finance to organize regular or surprise inspections of the collection, submission, management, and use of fees and charges in the diplomatic field at Vietnamese Representative Offices abroad according to the provisions of this Circular.
Article 9. Implementation Organization
1. This Circular takes effect from January 1, 2017, replacing Circular No. 236/2009/TT-BTC dated December 15, 2009, issued by the Minister of Finance guiding the system of collection, submission, management, and use of charges in the diplomatic field applicable to Vietnamese diplomatic missions and consular offices abroad; Circular No. 156/2015/TT-BTC dated October 8, 2015, amending and supplementing Circular No. 236/2009/TT-BTC dated December 15, 2009, issued by the Minister of Finance guiding the system of collection, submission, and management and use of consular fees applicable to Vietnamese diplomatic missions and consular offices abroad.
2. Entities collecting fees and charges in the diplomatic field shall be responsible for:
a) Publicly posting the name of the fees and charges, the collection rates, methods of collection, payers, exemptions, reductions, and the legal documents governing the collection of fees and charges in the diplomatic field at the collection points in both Vietnamese and English or the official language of the host country;
b) When collecting money, they must issue and provide receipts for the payers of fees and charges in the diplomatic field. Receipts for fees and charges shall be printed and issued at Vietnamese Representative Offices abroad according to the model specified in Appendix 3 attached to this Circular.
5. During the implementation process, if any difficulties arise, the relevant agencies are requested to promptly reflect them to the Ministry of Finance for consideration and resolution.
