Pursuant to Decree No. 76/2009/NĐ-CP dated September 5, 2009 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 4, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces personnel; 1Pursuant to Decree No. 74/2009/NĐ-CP dated September 9, 2009 of the Government detailing and guiding the implementation of certain provisions of the Civil Execution Law regarding civil execution management agencies, civil execution agencies, and civil servants engaged in civil execution work; 1At the proposal of the Minister of Justice, the Minister of Home Affairs, and the Minister of Finance

The Prime Minister promulgates this Decision prescribing the system of job responsibility allowances for Enforcement Officers, Examination Officers, and Execution Secretaries working at civil execution agencies and civil execution management agencies under the Ministry of Justice; Notaries working at Notary Offices.i Article 1. Scope of Application

This Decision prescribes the system of job responsibility allowances for Enforcement Officers, Examination Officers, and Execution Secretaries working at civil execution agencies and civil execution management agencies under the Ministry of Justice; Notaries working at Notary Offices.;

2. The system of job responsibility allowances prescribed in this Decision shall not apply to Enforcement Officers, Examination Officers, and Execution Secretaries working at Military Zone Execution Agencies, Naval Forces Execution Agencies, General Staff Execution Agencies, and the Execution Agency under the Ministry of National Defense..

Article 1. Scope and Applicability

Article 2. Levels of Job Responsibility Allowances

The system of job responsibility allowances based on percentage of the current salary plus leadership position allowance and seniority allowance (if applicable) is specified as follows:

1. A rate of 15% applies to Senior Examination Officers and Notaries.

2. A rate of 20% applies to Senior Enforcement Officers, Principal Examination Officers, Execution Secretaries, and Intermediate Execution Secretaries.

3. A rate of 25% applies to Intermediate Enforcement Officers and Examination Officers.

4. A rate of 30% applies to Junior Enforcement Officers.

Article 3. Principles of Application

1. The entities entitled to job responsibility allowances as stipulated in Clause 1, Article 1 of this Decision shall be paid by the agency to which they belong.

2. Job responsibility allowances shall be paid concurrently with monthly salaries; they shall not be used to calculate social insurance contributions and health insurance benefits.

3. Periods during which job responsibility allowances shall not be paid include:

a) Time spent abroad on official business, study, or training receiving 40% of their regular salary as prescribed in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces personnel;

b) Time spent studying in Vietnam for three consecutive months or more;

c) Time off without pay for one month or more consecutively;

d) Time off receiving social insurance benefits as prescribed by laws on social insurance;

e) Time when temporarily suspended from duty or detained.

The funding for the payment of job responsibility allowances shall be guaranteed by the state budget.

Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, and Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision.

This Decision replaces Decisions No. 233/2005/QĐ-TTg dated September 26, 2005 of the Prime Minister on the system of job responsibility allowances for Enforcement Officers and Notaries and Decision No. 86/2007/QĐ-TTg dated June 11, 2007 of the Prime Minister on the system of job responsibility allowances for Examination Officers in civil execution./.

This Decision replaces Decisions No. 233/2005/QĐ-TTg dated September 26, 2005, of the Prime Minister on the regulations for job responsibility allowances for Enforcement Officers and Notaries, and Decision No. 86/2007/QĐ-TTg dated June 11, 2007, of the Prime Minister on the regulations for job responsibility allowances for Execution Reviewers./.
