CIRCULAR

Regulations on standards, tasks, and authorities for

leaders and staff of motor vehicle inspection centers

 for road transport vehicles

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular stipulating the standards for Railway Inspection Officers and requirements for the material and technical facilities of railway inspection organizations.

The Minister of Transport shall issue a Circular to regulate the standards, tasks, and authorities for leaders and staff of motor vehicle inspection centers for road transport vehicles.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates the standards, tasks, and authorities for leaders and staff at motor vehicle inspection centers for road transport vehicles (hereinafter referred to as inspection centers).

Article 2. Applicability

1. This Circular applies to agencies, organizations, and individuals related to the activities of technical safety inspection and environmental protection of motor vehicles (hereinafter referred to as inspection).

2. This Circular does not apply to agencies, organizations, and individuals related to the inspection activities of motor vehicles of the Ministry of National Defense and the Ministry of Public Security for national defense and security purposes.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Leaders of the Inspection Center include: Director, Deputy Director.

2. Staff of the Inspection Center include: Chain supervisors, inspectors, and technical staff.

3. Inspectors include categories: Motor vehicle inspectors and senior motor vehicle inspectors.

Chapter II

STANDARDS AND CONDITIONS FOR LEADERS AND STAFF

OF THE INSPECTION CENTER

Article 4. General Standards for Leaders and Staff

Leaders and staff of the Inspection Center, if they are civil servants or public officials, must meet the standards prescribed by laws on civil servants and public officials.

Article 5. Standardsrime Minister cfor technical staff

1. Professional qualifications: At least graduated from a vocational college.

2. Vocational qualifications: Obtained a Certificate of Completion of Technical Staff Training Course for Motor Vehicle Inspection according to the model specified in Appendix 1 of this Circular on the following contents:

a) Proficient in regulations, inspection procedures, and guidance related to motor vehicle inspection work;

b) Skilled in using software programs serving inspection work: Motor vehicle inspection management program; remote data retrieval program, imported and domestically produced vehicle data retrieval program; warning program for vehicles not inspected or failing safety and environmental standards; vehicle type data retrieval programs.

3. English proficiency: At least level A or equivalent.

Article 6. Standards and conditions for motor vehicle inspectors2003;

1. Professional qualifications: Graduated from a bachelor's degree in automotive engineering; the training program must include the following subjects: Automotive theory, automobile structure, automobile design and calculation, automobile technical maintenance, internal combustion engines and automobile electricity.

2. Work experience: Directly worked in the field of training specified in Clause 1 of this Article for at least two years at repair, maintenance, production, or assembly facilities or at least three years at an inspection center.

3. Vocational qualifications: Obtained a Certificate of Completion of Motor Vehicle Inspection Vocational Training Course according to the model specified in Appendix 2 of this Circular on the following contents:

a) Proficient in regulations, technical standards, technical guidelines, and proficient in performing inspection procedures on the inspection line;

b) Skilled in using software programs serving inspection work: Motor vehicle inspection management program; inspection result evaluation program; remote data retrieval program, imported and domestically produced vehicle data retrieval program; warning program for vehicles not inspected or failing safety and environmental standards; vehicle type data retrieval programs.

4. English proficiency: At least level A or equivalent.

5. Recognized and certified by the Director of the Vietnam Inspection Agency with a Motor Vehicle Inspector Certificate according to the model specified in Appendix 3 and a Motor Vehicle Inspector Card according to the model specified in Appendix 4 of this Circular.

Article 7. Standards and conditions for vehicle inspection officers2. Work experience: At least three years of experience as a vehicle inspection officer.

1. Professional qualifications: Graduated from a bachelor's degree in automotive engineering; the training program must include the following subjects: Automotive theory, automobile structure, automobile design and calculation, automobile technical maintenance, internal combustion engines and automobile electricity.

a) Possess the ability to guide other inspection officers in implementing regulations, standards, technical norms, and operational procedures; guiding practical use of testing equipment and tools; guiding implementation of inspection procedures;

3. Vocational qualifications: Obtained a Certificate of Completion of Motor Vehicle Inspection Vocational Training Course according to the model specified in Appendix 2 of this Circular on the following contents:

b) Possess the ability to identify causes of vehicle breakdowns and accidents.

4. English proficiency: Minimum level B or equivalent; able to read, understand, and translate basic automotive technical parameters in English.

Article 8. Standards and conditions for chain supervisors

5. Recognized and certified by the Director of the Vietnam Inspection Agency with a Motor Vehicle Inspector Certificate according to the model specified in Appendix 3 and a Motor Vehicle Inspector Card according to the model specified in Appendix 4 of this Circular.

2. Appointed by the competent authority of the agency or unit.

1. A supervisor of inspection lines must be a senior vehicle inspector.

Article 9. Standards and conditions for leaders of Inspection Centers

1. Practical experience: At least three years of experience as a vehicle inspection officer.

2. Proficient in technical standards, technical norms, regulations, procedures, and operational guidelines related to vehicle inspections and relevant Vietnamese laws and international treaties.

3. Approval document from the Vietnam Vehicle Inspection Department and appointed by the competent authority of the agency or unit according to regulations.

TASKS OF LEADERS AND STAFF AT INSPECTION CENTERS

Article 10. Tasks of operational staff

Operational staff shall perform the following tasks as assigned by the Center's leadership:

1. Receiving, checking files, registering for vehicle inspections, collecting fees, and charges for vehicle inspections.

2. Entering data, searching, and cross-referencing vehicle inspection files.

3. Printing and issuing inspection certificates.

4. Recording files and management ledgers to support inspection work.

5. Statistics, reporting, and updating inspection data.

6. Receiving, managing, and storing inspection files and seals.

7. Participating in training sessions to update and supplement professional knowledge (if applicable).

8. Performing other tasks as assigned by the Center's leadership.

Article 11. Tasks of vehicle inspection officers

Vehicle inspection officers shall perform the following tasks as assigned by the Center's leadership:o gi- Size of the stamp: 1

1. Inspecting the safety and environmental protection technology of vehicles.

2. Checking the quality of safety and environmental protection technology of modified vehicles.

3. Assessing the technical condition of vehicles; assessing accidents related to vehicle safety and environmental protection technology.

4. Checking the operation and maintenance of assigned testing equipment and tools.

5. Participating in scientific research projects, applying scientific and technological advancements.

6. Guiding practical training for graduates of vehicle inspection vocational training courses.

Tasks of senior vehicle inspection officers

8. Performing other tasks as assigned by the Center's leadership.

Article 11. Tasks of vehicle inspection officers

Article 12. Senior vehicle inspection officers shall perform the following tasks as assigned by the Center's leadership:

1. Performing the tasks of vehicle inspection officers as stipulated in Article 11 of this Circular.

2. Leading or participating in scientific research projects, drafting regulatory documents, standards, technical norms, and content for vocational training in vehicle inspection.

3. Advising the Center's leadership on professional and operational issues when requested.

4. Determining the causes of failures in major systems and components of vehicles and assessing serious road traffic accidents.

5. Reviewing designs, researching, proposing contents and methods for inspecting and evaluating new structures, especially those equipped on vehicles.

6. Guiding, inspecting operations, and evaluating trainees and vehicle inspection officers.

7. Participating in training sessions to update and supplement professional knowledge (if applicable).

7. Participate in training to update and supplement professional knowledge (if any).

Article 13. Duties of the Chain Supervisor

The Chain Supervisor shall perform the following tasks according to the division of labor by the Center's leadership:

1. Carry out the duties of a high-level motor vehicle inspector as stipulated in Article 12 of this Circular.

2. Assign tasks to inspectors on the inspection chain (if authorized by the Center's leadership).

3. Guide and inspect the work of inspectors on the inspection chain.

4. Ensure the operation of inspection equipment and tools on the chain in accordance with regulations.

5. Participate in training and updating professional knowledge (if applicable).

Article 14. Duties of the Center's LeadershipFrom 100 million VND to less than 300 million VNDt s

1. Organize and supervise the implementation of vehicle inspection work at the Center to ensure compliance with regulations.

2. Organize the implementation of other tasks assigned according to their functions and responsibilities.

Chapter IV

RIGHTS AND RESPONSIBILITIES OF CENTER LEADERSHIP AND STAFF

Article 15. Rights and Responsibilities of Inspection Staff1. Have the right to request vehicle owners to provide necessary documents when vehicles enter for inspection as prescribed.

2. Have the right to refuse to accept vehicles for inspection if vehicle owners fail to provide necessary documents as prescribed.

3. Have the right to reserve their opinion and report to superiors when their opinions differ from those of the Center's leadership.

4. Shall be responsible before the Center's leadership and the law for the results of the tasks assigned to them.

Article 16. Rights and Responsibilities of Inspectors

3. Amend Clause 3 Article 2 as follows:i1. Shall carry out inspections of assigned stages, sign off on the Vehicle Record Form when assigned.development2. Have the right to reserve their opinion and report to superiors when their conclusions about the technical condition of vehicles or equipment differ from those of the Chain Supervisor and the Center's leadership decision.

3. Have the right to stop the inspection process for vehicles and report to superiors their decisions if they find that the vehicles, equipment, or inspection tools do not meet safety standards or accuracy requirements.

Article 17. Rights and Responsibilities of the Chain Supervisor

1. Shall carry out inspections of assigned stages, conclude inspection results, and sign off on the Inspection Report as prescribed.

Article 16. Rights and Responsibilities of Inspectors

2. Have the right to revoke the conclusion of an inspector if they find it incorrect and bear responsibility for their decision.

4. Have the right to reserve their opinion and report to superiors when their conclusions about the technical condition of vehicles or equipment differ from the Center's leadership decision.

5. Shall be responsible before the Center's leadership and the law for the results of the tasks assigned to them.

1. Shall carry out inspections of assigned stages, conclude inspection results, and sign off on the Inspection Report as prescribed.

Article 18. Rights and Responsibilities of the Center's Leadership

1. Shall sign Certificates of Safety Technical Inspection and Environmental Protection for Motor Vehicles, Certificates of Quality Safety Technical Inspection and Environmental Protection for Modified Motor Vehicles, and related records as prescribed.

2. Have the right to revoke the conclusion of the Chain Supervisor or Inspector if they find it incorrect and bear responsibility for their decision.

3. Have the right to reward and penalize leaders and staff within the Center according to regulations.

4. Shall be responsible before the Director of the Vietnam Vehicle Inspection Agency, the Director of the Department of Transport of provinces and centrally-administered cities, and the law for the activities of the Center according to their assigned functions and responsibilities.

TRAINING, RECOGNITION OF INSPECTORS

4. Shall be responsible before the Director of the Vietnam Vehicle Inspection Agency, the Heads of the Departments of Transport of provinces and centrally governed cities, and under the law for the activities of the Center according to the assigned functions and tasks.

Chapter V

PROFESSIONAL TRAINING AND RECOGNITION OF INSPECTORS

Article 19. Professional Training

1. The content of the professional training program for vehicle inspectors and technical staff shall be specified in Appendix 5 of this Circular.

2. Based on the content of the training program prescribed in Clause 1 of this Article, the Director of the Vietnam Vehicle Inspection Agency shall be responsible for issuing:

a) Professional training materials for vehicle inspectors and technical staff;

b) Basic training standards;

c) Standards for training officers.

3. Annually, the Vietnam Vehicle Inspection Agency shall be responsible for developing plans, enrolling students, organizing training, and issuing Certificates to trainees who complete the training course.

Article 20. Recognition of Vehicle Inspectorst T1. The Director of the Vietnam Vehicle Inspection Agency shall recognize and issue Certificates and Inspector Cards to individuals meeting the criteria stipulated in this Circular.

2. The Vietnam Vehicle Inspection Agency shall organize annual evaluations of the professional qualifications of recognized vehicle inspectors and confirm them on the Certificate of Vehicle Inspector.

3. The Certificate of Vehicle Inspector has a validity period of five (5) years and is renewed annually.

4. The Inspector Card has a validity period of one year and is issued simultaneously with the Certificate of Vehicle Inspector or reissued when confirming annually on the Certificate of Vehicle Inspector.

Article 21. Files and Issuance of the Certificate of Vehicle Inspector

1. For motor vehicle inspectors, the file includes:o 2. Check personal information of citizens against information in the Citizen Identity Card Database:ngument permittt Ta) A request from the inspection center for recognition and issuance of the Certificate and Inspector Card for motor vehicle inspectors. In cases where the Certificate is requested for the second time or more, the request must clearly state the number of the previously issued Certificate;ib) A professional curriculum vitae according to the model specified in Appendix 6 of this Circular (for initial recognition);

c) A certified copy of the university graduation certificate according to Clause 1 of Article 6 of this Circular, accompanied by a transcript of grades (for initial recognition);

d) A copy of the Certificate of completion of the Professional Training Course for motor vehicle inspection; certificates of participation in update and supplementary professional training (if applicable);

2. For high-level motor vehicle inspectors, the file includes:

a) A request from the inspection center for recognition of high-level motor vehicle inspectors;

b) A professional curriculum vitae according to the model specified in Appendix 6 of this Circular (if there are updates);

đ) Certified copy of the English proficiency certificate (still valid);

e) Color photograph (soft file, taken within six months).

c) A copy of the Certificate of completion of the Professional Training Course for high-level motor vehicle inspection; certificates of participation in update and supplementary professional training (if applicable);

Article 22. Procedure for Recognition and Issuance of the Certificate of Vehicle Inspector

1. Procedures and methods of implementation:

a) Organizations and individuals shall complete the file in accordance with Article 21 of this Circular and submit one set of files to the Vietnam Vehicle Inspection Agency;

d) Certified copy of the English proficiency certificate (still valid);

đ) Color photograph (soft file, taken within six months).

b) The Vietnam Vehicle Inspection Agency shall accept and check the components of the file: If the file is incomplete, it shall guide organizations and individuals to complete it; if the file is complete, it shall issue a receipt for the result (in case of direct submission);itself c) The Vietnam Vehicle Inspection Agency shall evaluate the file: If the file does not meet the requirements, it shall inform organizations and individuals; if the file meets the requirements, it shall decide to recognize and issue the Certificate and Inspector Card;d) The acceptance of files and delivery of results shall be conducted at the agency's office or through the postal system.

a) Within five working days from the date of receiving a complete file as prescribed, the Vietnam Vehicle Inspection Agency shall issue a written response to organizations and individuals if the file does not meet the requirements;

b) Within fifteen working days from the date of receiving a complete file as prescribed, the Director of the Vietnam Vehicle Inspection Agency shall issue a Decision recognizing and issuing the Certificate and simultaneously issuing the Inspector Card if the file meets the requirements.

Article 23. Revocation of the Certificate and Inspector Card

Vehicle inspectors shall have their Certificate and Inspector Card revoked if they violate any of the following acts with a level of disciplinary action equivalent to a warning or higher:

1. Violating standards, norms, procedures, and regulations on vehicle inspection.

2. Time limit for processing:

a) Within five working days from the date of receiving complete files as prescribed, the Vietnam Vehicle Inspection Agency shall issue a written response to organizations or individuals if the file does not meet the requirements.

b) Within fifteen working days from the date of receiving complete files as prescribed, the Director of the Vietnam Vehicle Inspection Agency shall issue a Decision recognizing and issuing a Certificate, and at the same time issue an Inspector Card if the file meets the requirements.

3. Amend Clause 3 Article 2 as follows:iArticle 23. Revocation of Certificate For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.and Card

An Inspector's Certificate and Inspector Card shall be revoked when they violate any of the following acts with a disciplinary action equivalent to a warning or higher:

1. Violating standards, specifications, procedures, and regulations on vehicle inspection.

2. Engaging in corrupt behavior, harassment, or intentionally causing difficulties for customers during the performance of duties.

Chapter VI

IMPLEMENTING PROVISIONS

Article 24., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP The Head of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Corporation, the Directors of Provincial Department of Transport under central cities and provinces, the Heads of agencies, organizations and individuals related shall be responsible for implementing this Circular.

1. The Vietnam Vehicle Inspection Agency shall be responsible for organizing guidance and inspecting the implementation of the provisions of this Circular at vehicle inspection centers nationwide.

2. The Directors of Provincial Departments of Transport under central cities shall be responsible for implementing and inspecting the implementation of the provisions of this Circular at subordinate vehicle inspection centers.

3. For leaders of vehicle inspection centers, those in charge of inspection lines, inspectors, and technical staff who have been appointed, recognized, issued certificates and inspector cards but have not yet met the standards prescribed in Chapter II (except Clause 1 of Article 5, Clause 1 of Article 6, and Clause 1 of Article 7) of this Circular, they shall be responsible for completing training courses to meet the standards within a period not exceeding three years from the date this Circular takes effect.

Article 25. Effectiveness and responsibility for enforcementh

1. This Circular shall take effect from January 1, 2014, and revoke the following consolidated documents:

a) Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, of the Minister of Transport on the issuance of standards, tasks, responsibilities, authorities, rewards, and penalties for vehicle inspection officers at motor vehicle inspection centers;

b) Decision No. 3165/2002/QĐ-BGTVT dated October 2, 2002, of the Minister of Transport amending and supplementing certain articles of the standards, tasks, responsibilities, authorities, rewards, and penalties for vehicle inspection officers at motor vehicle inspection centers issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, of the Minister of Transport;

c) Circular No. 07/2011/TT-BGTVT dated March 7, 2011, of the Minister of Transport amending and supplementing certain articles of the standards, tasks, responsibilities, authorities, rewards, and penalties for vehicle inspection officers at motor vehicle inspection units issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, of the Minister of Transport.

2. Provisions regarding rewards and penalties for leaders and staff of motor vehicle inspection centers shall be implemented according to Circular No. 42/2012/TT-BGTVT dated October 16, 2012, of the Minister of Transport on responsibilities and handling violations in the vehicle inspection process.

3. The Heads of the Ministry's Office, the Inspectorate, the Departments, the Director of the Vietnam Vehicle Inspection Agency, the Directors of Provincial Departments of Transport under central cities, heads of agencies, organizations, and individuals related to this matter shall be responsible for enforcing this Circular./.
