Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Housing Law issued on November 25, 2014;

Pursuant to the Law on Management and Use of State Property dated June 3, 2008;

Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Minister of Construction;

The Prime Minister issues this Decision on the standards for official housing.

Article 1. Scope of regulation and applicable subjects

1. Scope of regulation: This Decision sets forth the standards for official housing including: Usage area standards and interior equipment quotas for official housing.

a) Central ministries and agencies, provincial People's Committees, official housing management agencies, and units managing and operating official housing.

b) Individuals eligible to rent official housing as prescribed in Article 32 of the Housing Law 2014.

c) Organizations and individuals related to the allocation and rental of official housing.

Article 2. Provisions on the design of official housing

1. Types of official housing

a) For detached houses

They shall be designed as single-detached or semi-detached villas. The maximum height shall not exceed three floors. The area of the villa compound shall not be less than 350 square meters and not more than 500 square meters, including two types:2 and not exceeding 500 m2.

b) For apartment units in urban areas

Designed as closed apartments, each unit must have a usage area of at least 25 square meters.2 e) Type 5 apartment: Usable area from 25 to 45 square meters2.

c) For houses in rural areas

Designed as closed houses, each house must have a usage area of at least 25 square meters.2 1. Type A villa: To be allocated for members of the Politburo, Secretaries of the Central Committee of the Party.2.

2. Official housing shall be designed according to usage area standards suitable for each group of individuals (positions). The usage area of official housing is specified as follows:

Article 3. Eligibility and conditions for renting official housing

Eligibility and conditions for renting official housing shall be implemented as prescribed in Article 32 of the Housing Law 2014.

Article 4. Standards for using official housing

1. Type A detached house

To be allocated for members of the Politburo and Secretariat.

2. Type B detached house

To be allocated for positions with a starting salary coefficient of 10.4 or higher, except those specified in Clause 1 of this Article.

3. Type 1 apartment in urban areas

To be allocated for positions with a starting salary coefficient from 9.7 to under 10.4.

4. Type 2 apartment in urban areas

To be allocated for positions with a position allowance coefficient of 1.3 or higher; Major General, Brigadier General in armed forces; scientists assigned to lead national-level special important scientific and technological tasks as stipulated by the Science and Technology Law and equivalent positions.

5. Type 3 apartment in urban areas or Type 1 house in rural areas

To be allocated for positions with a position allowance coefficient from 0.7 to under 1.3; Senior Specialist (A3); teachers, doctors, and healthcare staff with equivalent positions working in remote, difficult, and border areas; Colonel, Lieutenant Colonel, Major in armed forces; scientists assigned to lead national-level special important scientific and technological tasks as stipulated by the Science and Technology Law and equivalent positions.

6. Type 4 apartment in urban areas or Type 2 house in rural areas

To be allocated for positions with a position allowance coefficient from 0.2 to under 0.7; Specialist (A2); teachers, doctors, and healthcare staff with equivalent positions working in remote, difficult, and border areas; Lieutenant Colonel, Captain in armed forces.

7. Type 5 apartment in urban areas or Type 3 house in rural areas

To be allocated for positions of Specialist (A0, A1) or equivalent positions; Chairpersons of Village People's Councils, Chairpersons of Village People's Committees; teachers, doctors, and healthcare staff with equivalent positions working in remote, difficult, and border areas; officers from Second Lieutenant to Major in armed forces, professional soldiers.

8. Type 4 house in rural areas

To be allocated for positions of Class B and C civil servants, professional soldiers; teachers, doctors, and healthcare staff with equivalent positions working in remote, difficult, and border areas.

Article 5. Standards for interior equipment in official housing

b) For purchased apartments to be used as official housing: If the purchased apartment already has basic furniture, it shall not be replaced but only supplemented with missing items according to Clause 2 of this Article;

a) Interior equipment for basic official housing shall be provided when purchasing a house (apartment) without existing interior equipment. For houses (apartments) purchased with existing interior equipment, replacement shall not be provided for movable machines and devices not fixed to the housing (such as washing machines, refrigerators, and other similar devices), and only supplementary equipment lacking or not in compliance with the design as stipulated in Clause 2 and Clause 4 of this Article shall be provided.

b) Interior equipment and furniture for official housing must have a minimum service life of five years.

2. Interior equipment for detached houses and apartments allocated as official housing in urban areas includes: Living room table and TV stand, air conditioners for all rooms, dining room table set, refrigerator, kitchen cabinet (integrated), stove and exhaust hood; standing cabinet, bed, mattress, washing machine, hot water heater, one desk and chair set.

3. The maximum budget limit for basic interior furnishings for villas and residential apartments in urban areas as stipulated in Clause 2 of this Article is as follows:

a) For one-bedroom apartments with one living room (corresponding to Type 4 and Type 5 apartments): 120 million VND.

b) For two-bedroom apartments with one living room (corresponding to Type 2 and Type 3 apartments): 160 million VND.

c) For three-bedroom apartments with one living room (corresponding to Type 1 apartment): 200 million VND.

d) For villas with 4 bedrooms, 1 living room, and 1 office: VND 250 million.

4. Interior equipment for houses allocated as official housing in rural areas includes: Living room table and TV stand, air conditioners for all rooms, dining room table set (if applicable), refrigerator, kitchen cabinet, stove. In places without grid electricity, electrical appliances shall not be installed.

b) For two-bedroom, one-living room official apartments (corresponding to Type D attached houses and Type 2, Type 3 apartments): VND 160 million;

a) For closed houses with shared bedroom and living room (corresponding to Type 4 apartment): 75 million VND.

b) For closed houses with one separate bedroom and one separate living room (corresponding to Type 2 and Type 3 apartments): 90 million VND.

c) For fully enclosed houses with 2 separate bedrooms and 1 living room (equivalent to type 1 apartments): VND 120 million.

6. The selection of interior equipment for installation must be appropriate to the function, area, and space of each room in the apartment, ensuring economy and efficiency.

7. When the market price of basic interior equipment fluctuates (increases or decreases) by more than 20% compared to the maximum budget limit specified in Clause 3 and Clause 5 of this Article, the adjustment of the budget limit shall be carried out as follows:

- For central agencies' housing projects (excluding the Ministry of National Defense and the Ministry of Public Security): The Ministry of Construction shall coordinate with the Ministry of Finance to report to the Prime Minister for consideration and decision.

- For housing projects of the Ministry of National Defense and the Ministry of Public Security: The Ministry of National Defense and the Ministry of Public Security shall coordinate with the Ministry of Construction and the Ministry of Finance to report to the Prime Minister for consideration and decision.

- For local housing projects: The Department of Construction shall coordinate with the Department of Finance to report to the provincial People's Committee for consideration and decision.

8. The use of funds for purchasing basic interior equipment for public service housing must be budgeted, implemented according to the budget, and settled according to current laws.

Article 6. Principles for allocating public service housing

1. For the positions of General Secretary, President, Prime Minister, and Chairman of the National Assembly, allocation shall be made from the existing public service housing fund, ensuring working conditions and security requirements.

2. In cases where public service housing (owned by the Communist Party of Vietnam) is a villa with land and building areas exceeding the prescribed standards, the allocation shall be decided by the Standing Secretariat of the Politburo.

3. In cases where tenants of public service housing belong to the groups of positions stipulated in Clauses 4, 5, 6, 7, and 8 of Article 4 of this Decision and live together as a family, additional living space for each family member (6 square meters per person) shall be added.2 usage/person).

4. In cases where a person concurrently holds multiple positions with different housing standards, the highest housing standard among those positions shall apply.

5. In cases where there is insufficient public service housing to allocate according to the standards, based on the existing public service housing fund, the public service housing management agency shall consider the rental arrangement; the tenant of public service housing must pay rent (equal to the rental price specified in Article 33 of the Law on Housing 2014 multiplied by the actual usable area recorded in the Public Service Housing Rental Contract), even if the actual usable area of the public service housing exceeds or falls below the standards prescribed in Clause 2 of Article 2 of this Decision.

Article 7. Implementation

1. Responsibilities of the Ministry of Construction

a) Supervise and urge all ministries, sectors, and localities nationwide to implement this Decision.

b) Guide methods for determining rental prices and managing the use of public service housing.

2. Provincial People's Committees directly under the Central Government shall be responsible for directing the management and allocation of public service housing within their jurisdiction according to the provisions of this Decision.

Article 8. Effectiveness

1. This Decision takes effect from August 25, 2015.

2. In cases where a decision has been made to lease public service housing that has not yet been equipped with basic interior equipment before the effective date of this Decision, the status quo shall remain unchanged according to the leasing decision until the tenant is transferred to new public service housing meeting the prescribed standards under this Decision; the installation of basic interior equipment for public service housing must be approved by the competent authority.

3. This Decision replaces Decision No. 09/2008/QĐ-TTg dated January 11, 2008, issued by the Prime Minister regarding principles for designing and using public service housing, and abolishes related regulations on public service housing standards from the effective date of this Decision.

Article 9. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of provincial People's Committees directly under the Central Government, heads of relevant agencies and organizations, and tenants of public service housing are responsible for implementing this Decision./.
