Article 1. Scope of Regulation

1. Hạ sĩ quan, binh sĩ phục vụ tại ngũ từ tháng thứ mười ba trở đi thì được nghỉ phép hàng năm; thời gian nghỉ là 10 ngày (không kể ngày đi và về) và được thanh toán tiền tàu, xe, tiền phụ cấp đi đường theo quy định hiện hành.

Article 2. Applicability

1. Non-Commissioned Officers and Soldiers Serving in Active Duty, Discharged from Active Duty.

2. Hạ sĩ quan, binh sĩ là học viên các học viện, nhà trường trong, ngoài Quân đội, thời gian học từ một năm trở lên có thời gian nghỉ hè giữa hai năm học thì thời gian nghỉ này được tính là thời gian nghỉ phép và được thanh toán tiền tàu, xe, tiền phụ cấp đi đường theo quy định hiện hành.

3. Trường hợp đặc biệt do yêu cầu nhiệm vụ chiến đấu, sẵn sàng chiến đấu hoặc ở những nơi điều kiện đi lại khó khăn không thể giải quyết cho nghỉ phép thì được thanh toán bằng tiền. Mức tiền thanh toán một ngày không nghỉ phép bằng mức tiền ăn cơ bản một ngày của hạ sĩ quan, binh sĩ bộ binh.

4. Hạ sĩ quan, binh sĩ đã nghỉ phép năm theo chế độ, nếu gia đình gặp thiên tai, hỏa hoạn nặng hoặc bố, mẹ đẻ; bố, mẹ vợ hoặc bố, mẹ chồng; người nuôi dưỡng hợp pháp; vợ hoặc chồng và con đẻ, con nuôi hợp pháp từ trần, mất tích hoặc hạ sĩ quan, binh sĩ lập được thành tích đặc biệt xuất sắc trong thực hiện nhiệm vụ thì được nghỉ phép đặc biệt, thời gian không quá 05 ngày (không kể ngày đi và về) và được thanh toán tiền tàu, xe, tiền phụ cấp đi đường theo quy định hiện hành.

Điều 5. Chế độ phụ cấp thêm do kéo dài thời gian phục vụ tại ngũ và chế độ phụ cấp khuyến khích đối với hạ sĩ quan, binh sĩ nữ phục vụ tại ngũ

1. Ngoài chế độ phụ cấp quân hàm được hưởng theo quy định, hạ sĩ quan, binh sĩ phục vụ tại ngũ, được Bộ trưởng Bộ Quốc phòng quyết định kéo dài thời gian phục vụ tại ngũ thì từ tháng thứ hai mươi lăm trở đi, hàng tháng được hưởng thêm 250% phụ cấp quân hàm hiện hưởng.

Khoản phụ cấp thêm này không áp dụng đối với hạ sĩ quan, binh sĩ đang chờ chuyển chế độ quân nhân chuyên nghiệp, công nhân, viên chức quốc phòng; chờ đi học, dự thi tuyển sinh; đang học ở các học viện, nhà trường trong, ngoài Quân đội và các trường hợp khác.

2. Hạ sĩ quan, binh sĩ nữ phục vụ tại ngũ, hàng tháng được hưởng phụ cấp khuyến khích mức 0,2 so với mức lương cơ sở.

Article 4. Additional allowances for extending service time and incentives for female non-commissioned officers and soldiers serving on active duty

Clause 1. In addition to the rank allowance received according to regulations, non-commissioned officers and soldiers serving on active duty who have their service time extended at the decision of the Minister of National Defense shall receive an additional 250% of their current rank allowance from the twenty-fifth month onwards each month.

This additional allowance does not apply to non-commissioned officers and soldiers awaiting transfer to professional military personnel, workers, or defense civil servants; awaiting admission to school or entrance examination; studying at academies, schools within and outside the Military, and other cases.

Clause 2. Female non-commissioned officers and soldiers serving on active duty shall receive an encouragement allowance equivalent to 0.2 times the base salary each month.

Article 5. Certain regimes and policies for non-commissioned officers and soldiers serving on active duty

1. Exempt from postal charges when transferring money, mail items, parcels; entitled to receive four stamps/month at the price set by the Ministry of Information and Communications, and monthly rank allowance concurrently.

2. Those who were members of poor households, students before enlistment and borrowed money from the social policy bank shall be temporarily exempted from repayment and interest during their service period according to current regulations.

3. Non-commissioned officers and soldiers on active duty meeting the conditions and standards regarding political quality, morality, culture, health, and age may participate in recruitment according to the regulations of the Ministry of National Defense and be granted preferential points in recruitment according to current regulations.

Article 6. Regime and policies for relatives of non-commissioned officers and soldiers on active duty

1. The relatives of non-commissioned officers and soldiers on active duty as stipulated in Clause 2, Article 2 of this Decree shall be provided with emergency hardship assistance in the following cases:

a) When the residence of non-commissioned officers and soldiers on active duty suffers accidents, fires, natural disasters leading to house collapse, floating away, burning down, or having to relocate or property being severely damaged economically, they will be assisted with VND 3,000,000 per person per incident;

b) The relatives of non-commissioned officers and soldiers on active duty suffering illness for one month or more, or hospitalized for seven days or more, will be assisted with VND 500,000 per relative per incident;

c) The emergency hardship assistance regime prescribed in point a of this Clause shall not exceed two times/year for each non-commissioned officer and soldier; the emergency hardship assistance regime prescribed in point b of this Clause shall not exceed two times/year for each relative of non-commissioned officers and soldiers;

d) The relatives of non-commissioned officers and soldiers on active duty who have died, passed away, or gone missing will be assisted with VND 2,000,000 per person.

2. Legitimate children and adopted children of non-commissioned officers and soldiers on active duty are exempted or reduced school fees when studying at public or private educational institutions according to Decree No. 86/2015/NĐ-CP dated October 2, 2015 of the Government on mechanisms for collecting and managing tuition fees for educational institutions under the national education system and policies for exemption, reduction of tuition fees, and support for learning expenses from the academic year 2015-2016 to the academic year 2020-2021.

Article 7. One-time discharge allowance, employment creation allowance, train fare, and travel allowance for non-commissioned officers and soldiers upon discharge

1. In addition to the one-time social insurance benefit enjoyed according to the laws on social insurance, non-commissioned officers and soldiers upon discharge will receive a one-time discharge allowance, with each year of service in the military entitling them to a one-time allowance equivalent to two months' basic salary as stipulated by the Government at the time of discharge. For partial months, the calculation is as follows: less than one month does not qualify for a discharge allowance; from one month to six months inclusive qualifies for one month's basic salary; from over six months up to twelve months qualifies for two months' basic salary.

2. Non-commissioned officers and soldiers completing thirty months of service on active duty, upon discharge, will receive an additional two months' rank allowance currently enjoyed; if discharged before the thirty-month term, the service period from the twenty-fifth month to less than thirty months will receive an additional one month's rank allowance currently enjoyed.

3. Non-commissioned officers and soldiers fulfilling their compulsory service obligations according to the Law on Military Service, upon discharge, will receive an employment creation allowance equivalent to six months' basic salary as stipulated by the Government at the time of discharge.

4. Upon discharge, non-commissioned officers and soldiers will be organized a farewell meeting by the directly managing unit, with a budget of VND 50,000 per person; they will be escorted back to their place of residence according to regulations or provided with ordinary train or bus tickets and travel allowance from the unit to their place of residence.

Article 8. Training, vocational education, and employment resolution upon discharge from military service

1. Non-commissioned officers and soldiers who were studying or had been called to study at vocational training institutions or universities before enlistment shall have their results preserved and be accepted back to continue their studies at those institutions.

In cases where non-commissioned officers and soldiers complete their compulsory military service and require vocational training support if they meet the conditions for such support, they shall be supported according to the provisions of Decree No. 61/2015/NĐ-CP dated July 9, 2015, of the Government on job creation support policies and the National Employment Fund.

2. Non-commissioned officers and soldiers who were working in state agencies or political organizations before enlistment shall be re-employed and assigned work positions by those agencies or organizations upon discharge, with income not lower than before enlistment; in cases where those agencies or organizations have been dissolved, the superior agencies or organizations shall be responsible for assigning appropriate work positions. If the superior agencies or organizations have also been dissolved or there are no superior agencies or organizations, the Department of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant state agencies at the same level to resolve employment issues.

3. Non-commissioned officers and soldiers who were working in economic organizations before enlistment shall be re-employed and assigned work positions by those organizations upon discharge, with wages and remuneration commensurate with their job positions and pre-enlistment wages and remuneration; in cases where the economic organizations have ceased operations, been dissolved, or declared bankrupt, the treatment and policies for non-commissioned officers and soldiers upon discharge shall be implemented as for employees of those economic organizations according to current laws on social insurance; the local social insurance agency where the economic organization has paid social insurance contributions shall be responsible for paying social insurance benefits according to current regulations.

4. Non-commissioned officers and soldiers accepted to work in state agencies, organizations, and economic entities of various ownership components shall be classified according to the job they hold, with their time of military service counted towards their work tenure and entitled to benefits and policies according to current regulations for cadres, civil servants, public officials, and workers of those economic entities.

5. Non-commissioned officers and soldiers discharged according to Clause 1, Article 43 and Clause 1, Article 48 of the Military Service Law 2015, when returning to their home regions, shall be given priority in job placement and points in civil servant and public official recruitment and hiring; during the probation period, they shall enjoy 100% of the salary and allowances corresponding to the recruited rank based on their educational qualifications.

Article 9. Sources of Funding for Implementation

The funds for implementing the regime and policies stipulated in this Decree shall be guaranteed from the state budget in accordance with the laws on the state budget.

Article 10. Effective Date

1. This Decree takes effect from June 1, 2016.

2. The regimes and policies stipulated in this Decree shall be implemented from January 1, 2016.

3. Non-commissioned officers and soldiers enlisted before January 1, 2016, recognized as having completed their compulsory military service according to the Military Service Law 2015, shall upon discharge enjoy the benefits and policies stipulated in Articles 7 and 8 of this Decree.

4. Decree No. 122/2006/NĐ-CP dated October 26, 2006, of the Government detailing the implementation of certain articles of the Law Amending and Supplementing Certain Provisions of the Military Service Law 2005 regarding the regimes and policies for non-commissioned officers and soldiers serving in the military; Clause 5, Clause 6, Clause 7, Article 1 of Decree No. 17/2007/NĐ-CP dated February 1, 2007, of the Government amending and supplementing certain provisions of the Regulations on Service of Non-commissioned Officers and Soldiers of the Vietnam People's Army issued together with Decree No. 54/CP dated August 7, 1995, of the Government; Decree No. 88/2011/NĐ-CP dated September 29, 2011, of the Government on the regimes and policies for families of non-commissioned officers and soldiers serving in the military shall cease to be effective from the date this Decree takes effect.

Article 11. Responsibility for Implementation

1. The Minister of Defense shall be responsible for guiding the implementation of this Decree.

2. The Ministry of Finance shall cooperate with the Ministry of Defense to develop and implement the state budget estimate according to the State Budget Law to ensure the implementation of the regimes and policies stipulated in this Decree.

3. The Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central city, are responsible for enforcing this Decree./.
