Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to the Law on Competition and Reward; pursuant to Decree No. 121/2005/ND-CP dated October 4, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Competition and Reward;

To improve the quality and effectiveness of patriotic competition movements among agencies and units under the Ministry of Finance;

At the proposal of the Director of the Department of Competition and Reward,

DECISION:

Article 1The attached Decision hereby issues "Criteria for Evaluating Annual Competition Results for Collectives and Individuals of Units under the Ministry of Finance".

Article 2. This Decision takes effect from the date of signature, replacing Decision No. 1144/QD-BTC dated April 12, 2005 of the Minister of Finance regarding the issuance of Criteria for Evaluating Annual Competition Results for Units under the Ministry of Finance and shall be applied for evaluation and competition reward assessment starting from 2009.

Article 3. The Director of the Ministry's Office, Heads of the Department of Competition and Reward, and Heads of units under the Ministry of Finance are responsible for implementing this Decision./.

REGULATIONS

CRITERIA FOR EVALUATING ANNUAL COMPETITION RESULTS

FOR COLLECTIVES AND INDIVIDUALS UNDER THE MINISTRY OF FINANCE

(Issued together with Decision No. 2733/QD-BTC dated November 4, 2009)

A. Content of Criteria for Evaluating Annual Competition Results:

I. For Collectives:

1. Criterion 1: Implementation of assigned political tasks (maximum score: 600 points).

1.1. For organizations and units assisting the Minister in performing state management functions (Departments, Ministry Office, Inspectorate and equivalent; Departments under the Ministry and equivalent; Agencies under General Bureaus and equivalent):

For organizations and units assisting the Minister in performing state management functions, the specific content of this criterion is the result of building and implementing programs and plans within their respective fields of responsibility for the year, the results of fulfilling assigned functions and tasks: Assisting the Ministry in researching, drafting, and promulgating legal documents; advising and formulating policies and systems; guiding and resolving issues related to policies and systems for organizations and individuals; Handling proposals from other agencies and localities; Supervising the implementation of policies, systems, and laws; Cooperating with relevant units both within and outside the sector according to regulations.

1.2. For press and publishing agencies under the Ministry:

For press and publishing agencies under the Ministry, the specific content of this criterion is the result of building and implementing programs and plans for the year, the results of fulfilling assigned functions and tasks: Implementing the mission and purpose of publications; Quality of editing, content of publications, quantity published and distributed; Identifying and reporting new issues; Organizing introductions and propaganda of financial policies; Improving and upgrading publications; Financial autonomy and financial management; Compliance with reporting requirements; Cooperation and participation in opinions with relevant units both within and outside the sector according to regulations.

1.3. For Party Committee Office, Trade Union Office, Youth League Office of the Ministry:

For Party Committee Office, Trade Union Office, Youth League Office of the Ministry, the specific content of this criterion is the result of building and implementing programs and plans for the year, the results of fulfilling assigned functions and tasks: Assisting the Standing Committee and Executive Board in guiding and directing subordinate Party organizations and mass organizations as well as all members to implement Party policies and State laws effectively; Planning and organizing the implementation of Party policies and mass movement campaigns; Participating in formulating policies and systems, training and developing cadres of Party organizations and mass organizations; Managing Party fees, union fees, and trade union fees; Party affairs work and other tasks assigned by the Standing Committee according to regulations.

1.4. For enterprises under the Ministry (including the Ministry of Finance Guest House and Sam Son Rest House):

For enterprises under the Ministry (including the Ministry of Finance Guest House and Sam Son Rest House), the specific content of this criterion is the result of achieving business targets and plans; Following operational procedures; Profit targets; Service quality; Fulfillment of budget submission plans; Adherence to State regulations on finance and financial management; Research and application of scientific and technological advancements; Care for the material and spiritual life of employees; Compliance with reporting requirements.

1.5. For educational institutions (including the Cadre Training School):

For educational institutions, the specific content of this criterion is the result of building and implementing programs, plans, and training and development plans for the year, the results of fulfilling assigned functions and tasks: Conducting training and development; Building physical facilities, teaching equipment, textbooks, and learning materials; Scientific research and international cooperation in education; Management of organizational structure, lecturers, staff, civil servants, officials, and students; Management and utilization of financial resources and assets; Fulfilling information and reporting duties; Supporting and cooperating with relevant units both within and outside the sector according to regulations.

2. Criterion 2: Implementation of Party policies, State laws; Law on Thrift and Combating Wastefulness, Law on Preventing and Combating Corruption; Discipline and rules of the sector; Internal regulations and rules of the agency or unit (maximum score: 150 points).

The specific content of this criterion is:

- Organizing the study and implementation of Party policies and State laws;

- Developing action programs and implementing the Law on Thrift and Combating Wastefulness; Law on Preventing and Combating Corruption;

- Adhering to discipline and rules of the sector, internal regulations and rules of the agency or unit.

3. Criterion 3: Building clean and strong Party organizations and mass organizations; Good collective solidarity (maximum score: 100 points).

The specific content of this criterion is:

- Building Party organizations and mass organizations

- Establishing and consolidating unity within the unit's collective, leading.

- Implementing democratic regulations at the grassroots level, handling complaints and denunciations.

4. Criterion 4: Organizing and implementing policies and tasks regarding commendation and reward work; cultural and sports movements, humanitarian and charitable activities (maximum score: 100 points).

The specific content of this criterion is:

- Organizing the implementation and dissemination of the Party's policies, state laws, and the Ministry of Finance's directives on commendation and reward work.

- Work on building and expanding exemplary models.

- Participating in cultural and sports movements; humanitarian and charitable activities.

II. For individuals:

1. Criterion 1: Fulfilling assigned tasks (maximum score: 600 points).

The specific content of this criterion is the quantity, quality, and progress in completing specific professional tasks assigned to individuals during the year.

2. Criterion 2: Adhering to the Party's guidelines and policies, state laws including the Law on Thrift and Combating Wastefulness, the Law on Preventing and Combating Corruption; discipline and rules of the industry; internal regulations and rules of the agency or unit (maximum score: 150 points).

The specific content of this criterion is:

- Disseminating and organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.implementing the Party's guidelines and policies, state laws

- Implementing thrift and combating wastefulness; not engaging in corruption, preventing and combating corruption.

- Implementing discipline and rules of the industry; internal regulations and rules of the agency or unit,

- Preventing social evils.

3. Criterion 3: Morality, working style, spirit of learning to improve competence (maximum score: 100 points).

The specific content of this criterion is:

- Implementing regulations on civilized conduct in the workplace;

- Working style, attitude towards serving organizations and citizens;

- Spirit and attitude towards cooperation and assistance to colleagues;

- Spirit and attitude in building internal solidarity;

- Spirit and attitude when participating in training courses organized by the agency or unit or higher authorities;

- Proactive spirit of self-study and research to improve competence.

4. Criterion 4: Participating in cultural and sports movements, humanitarian and charitable activities (maximum score: 100 points).

The specific content of this criterion is:

- Spirit and attitude, results of participating in competitive movements,

- Spirit and attitude, results of participating in humanitarian and charitable work,

- Spirit and attitude, results of participation (or encouragement) in cultural and sports movements.

B. Scoring and Evaluation:

I. Principles for Scoring:

1. Scoring and evaluating competition results shall only be conducted for collectives and individuals who have registered and signed competition agreements; Evaluations and scoring shall be carried out according to Appendix No. 01/CĐTĐ "Scoring and Evaluation Form for Annual Competition Results of Collectives under the Ministry of Finance" and Appendix No. 02/CĐTĐ "Scoring and Evaluation Form for Annual Competition Results of Individuals under the Ministry of Finance" attached to this Regulation.

2. All collectives and individuals must conduct self-scoring according to each evaluation criterion before proposing commendation awards.

3. When scoring, collectives must base their scores on the annual work summary report of the unit, and individuals must base their scores on their personal annual performance review.

4. The assessment of the quantity, quality, and progress in completing legal documents, projects, and regular tasks throughout the year (including those planned at the beginning of the year and those assigned during the year) of the unit is based on the final annual report of the Ministry's Office and the periodic expanded departmental meetings.

- Projects are considered completed in the year when:

+ For projects and documents within the Ministry's authority to issue: They have been signed and issued by the Ministry.

+ For projects and documents within the authority of higher levels to issue: They have been signed by the Ministry's leadership and submitted to the competent authority for issuance.

- Results of regular tasks: Handling requests from agencies and localities, managing budget balances, interest rates, securities markets, prices, etc.

5. Based on the maximum score set for each criterion, points are deducted (-) according to the degree of violation.

- If multiple violations occur in one criterion requiring point deductions, the total deduction cannot exceed the maximum score set for that criterion.

- The annual competition score achieved by the unit is the difference between the total maximum score set for the four criteria minus the total points deducted due to violations.

6. Heads of units under the Ministry shall re-score small collectives (departments, divisions, etc.) and individuals within the unit upon the recommendation of the unit's Commendation and Reward Council.

7. Ministry leadership shall re-score collectives which are units under the Ministry and individuals who are heads of units under the Ministry based on the recommendations of the units and organizations designated by the Ministry to re-score: the Ministry's Office; the Legal Department; the Cadre Organization Department, the Inspectorate; the Planning and Finance Department; the Standing Committee of the Party Committee of the Ministry of Finance; the Standing Committee of the Trade Union of the Ministry of Finance; the Standing Committee of the Communist Youth League of Vietnam at the Ministry of Finance; the Commendation and Reward Department.

8. Units and organizations designated to assist the Ministry in re-scoring have the responsibility to monitor and understand the functional and operational situation of units and unit heads to provide accurate and timely recommendations.

9. The Commendation and Reward Department shall consolidate the re-scoring recommendations of the designated units and organizations and submit them to the Ministry for scoring of collectives which are units under the Ministry and individuals who are heads of units under the Ministry.

II. Procedures for Conducting Scoring:

1. At the end of the year's work (end of the annual competition movement), the unit's Commendation and Reward Council bases its scoring on the unit's annual work summary report and submits it to the unit head for decision.

2. At the end of the year's work, before holding the annual work summary meeting at departments, divisions, and units, each individual must write an annual work review and self-score.

- After receiving the self-scores of individuals, the Commendation and Reward Councils of units under the Ministry will re-score each individual and small collectives within the unit and submit to the unit head for decision.

3. The results of the evaluation and scoring of the competition activities of units under the Ministry must be reported to the Ministry (through the Standing Committee of the Competition and Commendation Council of the Ministry - Department of Competition and Commendation) before January 31 of the following year for the Ministry to re-score. The results of the evaluation and scoring of small groups within the unit (departments, divisions, etc.) and individuals within the unit shall be kept at the unit. For small groups and individuals proposed for commendation forms within the authority of the Ministry, the Prime Minister, the Government, and the State President, they shall be submitted along with the commendation dossier when submitting to the Ministry for review.

- The re-scored points of groups and individuals serve as a basis for the unit to assess and propose commendations and to recommend higher authorities to grant commendations.

III. Total Points for Criteria and Bonus Points:

1. The maximum total points of the four criteria for evaluating annual competition results for groups and individuals is: 950 points.

2. The total bonus points for each group and individual is 50 points. Based on the results of striving, completing, and exceeding the set targets of the competition content of groups and individuals, groups and individuals will be considered and awarded bonus points as follows:

- The head of units under the Ministry awards bonus points to individuals (from deputy leaders downwards) and groups (departments, divisions, etc.) within the unit based on the assessment of the Unit's Competition and Commendation Council's proposal.

- The leadership of the Ministry of Finance awards bonus points to groups which are units under the Ministry and individuals who are heads of units under the Ministry based on the assessment of the Standing Committee of the Ministry of Finance's Competition and Commendation Council.

IV. Application of Evaluation Results and Scoring in Assessing Competition Activities and Commendations:

1. Point ranges corresponding to commendation forms to be considered for recommendation (applicable to groups and individuals):

- Achieving less than 800 points or having one or more criteria with all points deducted will not be considered for commendation.

- Achieving from 800 to 850 points: To be considered for commendation forms within the authority of the head of the agency or unit under the Ministry.

- Achieving from 851 to 925 points: To be considered for commendation forms within the authority of the head of the unit under the Ministry and those within the authority of the Ministry and the Minister.

- Achieving 926 points or more: To be considered for commendation forms within the authority of the head of the unit or agency under the Ministry, those within the authority of the Ministry, the Minister, and those within the authority of the Government, the Prime Minister, and the President.

2. Small groups (departments, divisions, etc.) under units under the Ministry will not be considered for commendation if any of the following situations occur:

- Having officials, civil servants, or employees disciplined with a warning or higher.

- Having an individual within the unit currently being prosecuted or investigated.

- Having officials, civil servants, or employees evading military service obligations.

- Having officials, civil servants, or employees giving birth in violation of laws on population and family planning.

3. Individuals will not be considered for commendation if any of the following situations occur:

- Being disciplined with a warning or higher.

- Currently being prosecuted or investigated.

- Evading military service obligations.

- Giving birth in violation of laws on population and family planning.

C. Implementation Organization:

1. Heads of units, agencies, and organizations under the Ministry of Finance are responsible for disseminating, implementing, and enforcing this Regulation throughout all officials, civil servants, and employees in their units.

2. Heads of units and agencies with vertical systems, and heads of units under the Ministry with departmental structures shall base this Regulation to specify the specific content of the criteria for evaluating annual competition results for groups and individuals within their systems in accordance with their organizational structure and assigned functions and tasks.

3. When there are changes in the organizational structure of the Ministry or the functions and tasks of units under the Ministry, the Department of Competition and Commendation has the responsibility to submit to the Ministry for amendments and supplements to this Regulation to ensure appropriateness.

4. Heads of units and agencies are responsible for the results of scoring competition activities annually for groups and individuals within their units.

5. During the implementation process, if there are difficulties, units shall report to the Ministry (through the Department of Competition and Commendation) for timely consideration, amendment, and supplementation.

6. Assign the Department of Competition and Commendation, the Standing Committee of the Competition and Commendation Council of the Ministry of Finance the responsibility to guide, urge, and inspect the implementation of this Regulation./.
