PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 114/2003/NĐ-CP dated October 10, 2003 of the Government on cadres and civil servants at commune, ward, and town levels;

Pursuant to Decision No. 40/2006/QĐ-TTg dated February 15, 2006 of the Prime Minister approving the plan for training and improving the capacity of cadres and civil servants for the period of 2006-2010;

Considering the proposal of the Minister of Home Affairs,

DECISION:

Article 1. Scope of Regulation

This Decision stipulates the organization of training and improving the capacity of cadres and civil servants at commune, ward, and town levels (hereinafter referred to collectively as commune-level cadres and civil servants) in northern mountainous provinces for the period of 2007-2010, including Hòa Bình, Sơn La, Điện Biên, Lai Châu, Hà Giang, Tuyên Quang, Bắc Kạn, Lào Cai, Yên Bái, Phú Thọ, Thái Nguyên, Cao Bằng, Lạng Sơn, Quảng Ninh, Vĩnh Phúc, and Bắc Giang.

1. Training institutions base their determination and implementation of annual enrollment quotas on the conditions ensuring quality of training and socio-economic development requirements, exercising autonomy and accountability.

1. General Objective: To train and improve the cultural level, theoretical political knowledge, professional knowledge, state management, legal knowledge, party work, mass organizations, office automation skills for cadres and civil servants in order to build a cadre and civil servant team at commune level in northern mountainous provinces with firm political qualities, appropriate knowledge according to their responsibilities, and the ability to perform public duties.

2. Specific Objectives for Training and Improving the Capacity of Commune-Level Cadres and Civil Servants in Northern Mountainous Provinces from now until 2010 are as follows:

a) Cultural Level: 100% of specialized cadres and civil servants have a secondary school graduation level or higher (no longer having civil servants with primary school education level). Among them, efforts should be made to train and improve so that 70-80% of cadres and civil servants graduate from high school. Selecting young cadres and civil servants who have graduated from secondary school and have long-term potential for further training to reach a high school graduation level.

b) Professional Level: 100% of specialized cadres and civil servants are trained and improved to reach a level equivalent from elementary to intermediate. By 2010, 80-90% of specialized cadres and civil servants in communes, wards, and towns should reach an intermediate level.

c) Theoretical Political Knowledge: 100% of specialized cadres are trained and improved from elementary to intermediate levels. Combining training and improvement with regular education to enable young cadres with potential for long-term use to reach a high school graduation level and an intermediate theoretical political knowledge level.

d) State Management: 100% of specialized cadres are trained and improved to reach an elementary level or higher; 100% of specialized civil servants in communes, wards, and towns in urban areas and lowland regions are trained to reach an intermediate level; in highland regions, they must reach 100% at an elementary level or higher.

e) Information Technology: 100% of specialized cadres and civil servants are trained in office automation to serve their work.

Article 3. Requirements

1. The training and improvement of commune-level cadres and civil servants in northern mountainous provinces must meet the requirements closely aligned with the functions, tasks, and actual performance of each specific subject; focusing on cultural training and professional knowledge improvement, theoretical political knowledge, and state management in the field where the civil servant is responsible, avoiding widespread training and improvement.

2. The training and improvement of commune-level cadres and civil servants must gradually meet the requirements for economic and social development, maintaining national security and defense, and enhancing the management and operational capabilities of grassroots authorities.

Article 5. Content, curriculum, and duration of training and capacity building

1. Specialized commune-level cadres include: Secretary, Deputy Secretary of the Party Committee, Standing Member of the Party Committee (where there is no dedicated Deputy Secretary for Party Affairs), Chairman of the Vietnam Fatherland Front, Chairman of the Women's Union, Chairman of the Veterans' Association, Secretary of the Youth League, Chairman of the Farmers' Association.

2. Commune-level civil servants include the positions of Chief of Public Security, Military Commander, Office - Statistics, Land Administration - Construction, Finance - Accounting, Justice - Household Registration, Culture - Social Welfare.

3. Non-specialized commune-level cadres.

Article 5. Training and Capacity Building Program

1. For full-time cadres: focus on general education training; theoretical political program, law, state administration management; specialized knowledge and skills in party work, united front, mass organizations, and office information technology.

2. For commune-level civil servants: concentrate on cultural training, office information technology, specialized knowledge and skills in state administration management according to fields and corresponding job titles of each cadre and civil servant.

3. For non-full-time cadres: assign the People's Committee of the province to develop training programs and materials suitable for their functions and tasks based on local management requirements.

Article 6. Content of the Training and Capacity Building Program

1. For cadres and civil servants who have not completed secondary school:

 a) For full-time cadres: use the theoretical political program for leading cadres at the grassroots level in the Central Highlands system compiled by the Ho Chi Minh National Academy of Politics (revised and supplemented with relevant policies related to Central Highland provinces to suit the characteristics of cadres in Northern mountainous provinces).

 b) For seven positions of commune-level civil servants: use seven sets of specialized materials in state administration management by nine relevant ministries issued in 2005 for commune-level civil servants in Central Highland provinces who have not completed secondary school, revised to fit the management characteristics of Northern mountainous provinces.

2. For cadres and civil servants who have completed secondary school:

 a) For full-time cadres: train in political college level, specialized knowledge, and capacity building in state management, party work, united front, mass organizations, and office information technology.

 b) For seven positions of commune-level civil servants: train in specialized college level, and capacity building in state management and office information technology according to the standards set out in Decision No. 04/2004/QĐ-BNV dated January 16, 2004 of the Ministry of Home Affairs.

Article 7. Forms of Training and Capacity Building

Organize training and capacity building based on the characteristics and conditions of each locality through centralized, periodic centralized, and part-time forms.

Article 8. Duration of Training and Capacity Building

The duration of training and capacity building shall be implemented according to the guidance of Ministries and guiding agencies regarding the training program and time frame suitable for each type of program.

Article 9. Methods of Training and Capacity Building

Encourage the initiative and proactivity of learners through increased exchange, discussion, and practical case studies in management, and organizing visits to exemplary management models.

Article 10. Locations for Training and Capacity Building

Training is organized at local training institutions. Provincial Committees coordinate and unify the organization of training with relevant Ministries, central academies, and universities when direct teaching support is needed. Utilize local schools and centers for joint training and capacity building to increase the scale and progress of training and capacity building to achieve the set goals until 2010.

Article 11. Training and Capacity Building Budget

1. The budget for compiling, revising, supplementing training programs, textbooks, and teacher training costs for localities to train and build capacity for commune-level cadres and civil servants in Northern mountainous provinces by relevant Ministries and the Ho Chi Minh National Academy of Politics is allocated within the annual budget estimate of these Ministries and the Academy.

2. The budget for organizing training and capacity building for commune-level cadres and civil servants in localities is arranged from the annual cadre and civil servant training and capacity building plan index (allocated by the State) guaranteed by the local budget.

Article 12. Responsibilities of Ministries, Sectors, and Localities

1. Ministry of Home Affairs:

 a) Aggregate annual training plans and targets based on those of localities; coordinate with the Ministry of Finance and the Ministry of Planning and Investment to propose allocation targets for training to localities for approval by the competent authority;

 b) Support localities with teaching staff and trainers; transfer programs and training materials for the position of Office - Statistics for localities to organize training and capacity building;

 c) Inspect and urge ministries, sectors, the National Academy of Political Science under Ho Chi Minh, and provincial People's Committees to implement according to approved schedules and plans;

 d) Summarize and evaluate the results of training and capacity building for commune-level civil servants in provinces and the implementation outcomes of tasks by ministries, sectors, and the National Academy of Political Science under Ho Chi Minh to report to the Prime Minister.

2. Ministry of Planning and Investment and Ministry of Finance:

Coordinate with the Ministry of Home Affairs to balance targets and annual plans towards prioritizing additional funding for training and capacity building for commune-level cadres and civil servants in northern mountainous provinces for approval by the competent authority; guide and inspect the management and use of funds in accordance with the law.

3. Ministries: Defense, Public Security, Finance, Justice, Natural Resources and Environment, Construction, Culture and Information, Labor, Invalids and Social Affairs:

 a) Edit, revise, and supplement the content of specialized and professional management materials for commune-level professional civil servants in the Central Highlands according to Decision No. 253/QD-TTg dated March 5, 2003 of the Prime Minister to suit the characteristics of management and cadre levels in northern mountainous provinces; complete the compilation of materials and textbooks to transfer to provincial People's Committees by June 2007;

 b) Coordinate with provincial People's Committees to transfer programs, materials, and textbooks for specialized and professional management in their respective fields; train teachers; direct subordinate units and training institutions to plan support for localities in directly training and capacity building for commune-level cadres and civil servants in northern mountainous provinces according to specialized fields after reaching consensus on work plans and methods with provincial People's Committees.

4. Ministry of Education and Training:

Study and promulgate shortened regular education programs for general secondary schools suitable for commune-level cadres and civil servants so that northern mountainous provinces can organize training and capacity building with the goal of having 100% of commune-level cadres and civil servants achieve junior high school graduation by 2010, 70-80% achieving senior high school graduation, and 100% being able to use office software as stipulated in Article 2 of this Decision; complete the promulgation of regular education programs for all levels by June 2007.

5. National Academy of Political Science under Ho Chi Minh:

 a) Compile, revise, and supplement political theory programs and materials for grassroots-level political leaders in the Central Highlands according to Decision No. 253/QD-TTg dated March 5, 2003 of the Prime Minister already issued to suit policies and characteristics of specialized cadres with incomplete secondary education in the social system of communes, wards, and towns in northern mountainous provinces;

 b) Transfer training and capacity building materials to provincial People's Committees; direct subordinate units and training institutions within the Academy to cooperate with localities in directly training and capacity building essential knowledge for specialized cadres working in party, mass organizations, and associations at commune, ward, and town levels according to plans approved by provincial People's Committees after reaching consensus with provincial People's Committees on training and capacity building methods; complete material transfers to provincial People's Committees by June 2007;

 c) Report to the Prime Minister the results of assigned tasks under this Decision (through the Ministry of Home Affairs for consolidation).

6. People's Committees of Provinces in Northern Mountainous Region:

 a) Approve annual training plans and targets for commune-level cadres and civil servants and training and capacity building plans from now until 2010 based on overall targets according to Decision No. 40/2006/QD-TTg dated February 15, 2006 of the Prime Minister approving the Training and Capacity Building Plan for Cadres and Civil Servants for the 2006-2010 period and specific goals set out in Clause 2 of Article 2 of this Decision;

 b) Coordinate with relevant ministries, sectors, and the National Academy of Political Science under Ho Chi Minh during the compilation of training and capacity building programs and materials for commune-level cadres and civil servants to ensure practicality and effectiveness in training and capacity building;

 c) Direct agencies, units, and subordinate training institutions to compile appropriate capacity building programs and materials for non-specialized cadres based on specific management tasks assigned on the commune, ward, and town level of the province and directly organize training and capacity building according to delegated training management levels;

 d) Be responsible for providing textbooks, materials, teacher training, methods of implementing plans, and organizing training and capacity building for grassroots-level cadres and civil servants in the province or sending them for training and capacity building at the central level if training is conducted through centralized forms;

 đ) Based on annual budget targets allocated by the State and local budget capabilities, allocate funds for the training and capacity building of commune-level cadres and civil servants in accordance with the state budget law;

 e) Within their authority, study and promulgate preferential policies for commune-level cadres and civil servants who are ethnic minorities or women when they are sent for training and capacity building;

 g) Inspect, urge, tally, assess, and report the results of training and capacity building for commune-level civil servants to the Ministry of Home Affairs for consolidation and reporting to the Prime Minister.

Article 13. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 14. The Ministers, Heads of agencies at the ministerial level, Heads of government agencies, and Chairpersons of People's Committees of the 16 northern mountainous provinces mentioned in Article 1 are responsible for implementing this Decision./.
