DECREE
Detailed provisions on certain articles and measures 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.
Law on Popularizing and Promulgating Legal Knowledge
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Popularizing and Educating about Laws dated June 20, 2012;
At the proposal of the Minister of Justice;
The Government promulgates this Decree to provide detailed provisions on certain articles and measures for implementing the Law on Popularizing and Promulgating Legal Knowledge.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree provides detailed provisions on certain articles of the Law on Popularizing and Promulgating Legal Knowledge regarding the National Legal Day of the Socialist Republic of Vietnam, socialization of popularizing and promulgating legal knowledge work, conditions ensuring the popularizing and promulgating legal knowledge work, and certain measures for implementing this Law.
Article 2. Responsibilities of the Ministry of Justice
The Ministry of Justice shall be responsible before the Government for performing the tasks stipulated in Clause 1, Article 6 and Clause 1, Article 25 of the Law on Popularizing and Promulgating Legal Knowledge, and shall have the responsibility to perform the following tasks:
1. Issuing regulations on specialized matters, professional standards, and professional ethics for popularizing and promulgating legal knowledge.
2. Urging and inspecting ministries, ministerial-level agencies, government-affiliated agencies, and all levels of People's Committees on organizing the National Legal Day of the Socialist Republic of Vietnam.
3. Cooperating with ministries, sectors, localities, and related organizations to implement policies for socializing the popularizing and promulgating legal knowledge work.
4. Issuing criteria for evaluating the effectiveness of the popularizing and promulgating legal knowledge work.
5. Compiling, statistics, and reporting to the Government on the popularizing and promulgating legal knowledge work nationwide.
6. Summarizing, concluding, and rewarding collectives and individuals with outstanding achievements in organizing the National Legal Day of the Socialist Republic of Vietnam and socializing the popularizing and promulgating legal knowledge work.
Article 3. Responsibilities of Ministries, Ministerial-Level Agencies, and Government-Affiliated Agencies
1. Ministries, ministerial-level agencies, and government-affiliated agencies shall perform the tasks stipulated in Clause 1, Article 6 and Clause 1, Article 25 of the Law on Popularizing and Promulgating Legal Knowledge, and shall have the responsibility to perform the following tasks:
a) Organizing the implementation of the popularizing and promulgating legal knowledge work according to their functions, responsibilities, and guidance from the Ministry of Justice;
b) Directing, urging, and inspecting subordinate agencies and units in organizing the National Legal Day of the Socialist Republic of Vietnam;
c) Implementing statistical reports to the Ministry of Justice on the popularizing and promulgating legal knowledge work;
d) Summarizing, concluding, and rewarding collectives and individuals within their sector or field with outstanding achievements in organizing the National Legal Day of the Socialist Republic of Vietnam and socializing the popularizing and promulgating legal knowledge work;
e) Ensuring funding, material resources, and means for the popularizing and promulgating legal knowledge activities.
2. Legal affairs offices of ministries, ministerial-level agencies, and government-affiliated agencies shall have the responsibility to advise ministers, heads of ministerial-level agencies, and government-affiliated agencies on performing the tasks stipulated in Clause 1 of this Article.
Article 4. Responsibilities of All Levels of People's Committees
1. Provincial-level People's Committees (referred to as provincial-level People's Committees), district-level People's Committees, town-level People's Committees, and city-level People's Committees under provinces (referred to as district-level People's Committees) shall perform the tasks stipulated in Clause 1, Article 6 and Clause 2, Article 27 of the Law on Popularizing and Promulgating Legal Knowledge, and shall have the responsibility to perform the following tasks:
a) Organizing the implementation of the popularizing and promulgating legal knowledge work according to their management responsibilities in their respective areas and guidance from the Ministry of Justice;
b) Urging and inspecting specialized agencies under their jurisdiction and lower-level People's Committees in organizing the National Legal Day of the Socialist Republic of Vietnam in their respective areas;
c) Implementing statistical reports on the popularizing and promulgating legal knowledge work;
d) Summarizing, concluding, and rewarding collectives and individuals with outstanding achievements in organizing and implementing the National Legal Day of the Socialist Republic of Vietnam and socializing the popularizing and promulgating legal knowledge work at the local level;
e) Ensuring funding, material resources, and means for the popularizing and promulgating legal knowledge activities.
2. Commune-level People's Committees, ward-level People's Committees, and town-level People's Committees shall perform the tasks stipulated in Clause 1, Article 6 and Clause 2, Article 27 of the Law on Popularizing and Promulgating Legal Knowledge, and shall have the following responsibilities:
a) Organizing the implementation of the popularizing and promulgating legal knowledge work in their respective areas according to guidance from the district-level People's Committee;
b) Urging and inspecting organizations in their respective areas in organizing the National Legal Day of the Socialist Republic of Vietnam;
c) Implementing statistical reports on the popularizing and promulgating legal knowledge work according to directives from the district-level People's Committee;
d) Summarizing, concluding, and rewarding collectives and individuals with outstanding achievements in organizing and implementing the National Legal Day of the Socialist Republic of Vietnam and socializing the popularizing and promulgating legal knowledge work in their respective areas;
e) Ensuring funding, material resources, and means for the popularizing and promulgating legal knowledge activities.
3. Departments of Justice, Judicial Offices, and Justice-Household Registration officials shall have the responsibility to advise the same-level People's Committee on performing the tasks stipulated in Clause 1 and Clause 2 of this Article.
Chapter II
NATIONAL LEGAL DAY OF THE SOCIALIST REPUBLIC SOCIALISTREPUBLIC OF VIETNAM
Article 5. Law Day of the Socialist Republic of Vietnam
The Law Day of the Socialist Republic of Vietnam (hereinafter referred to as Law Day) shall be organized annually on November 9, ensuring practicality and effectiveness.
The content, form, and responsibility for organizing Law Day shall be implemented in accordance with the provisions of Articles 6 and 7 of this Decree.
Article 6. Content and Form of Organizing Law Day
1. Law Day shall be organized with the following contents:
a) Affirming the position and role of the Constitution and laws in state management and social life;
b) Educating civil servants, public officials, employees, and citizens about their awareness of respecting and complying with the law; their awareness of protecting the law; the benefits of complying with the law;
c) Promoting and disseminating constitutional and legal provisions that are relevant to the lives of the people, linked to the functions and tasks of agencies and units;
d) Mobilizing the people to strictly comply with the law;
đ) Commending and rewarding outstanding collectives and individuals in law-making, enforcing the law, promoting and educating the law, good deeds and exemplary persons in implementing the law;
e) Other contents as guided by the Ministry of Justice.
2. Law Day may be organized in the following forms:
a) Rally; seminar; discussion forum;
b) Legal knowledge quiz;
c) Mobile legal promotion and dissemination; exhibition;
d) Other forms as guided by the Ministry of Justice.
Article 7. Responsibilities for Guiding the Content and Form of Organizing Law Day and Responsibilities for Organizing Law Day
1. Responsibilities for guiding the content and form of organizing Law Day
a) Annually, the Ministry of Justice guides the content and form of organizing Law Day throughout the country;
b) Based on the guidance for organizing Law Day from the Ministry of Justice, the Minister, Head of a ministry-level agency, head of an agency under the Government, and People's Committees at all levels guide the content and form of organizing Law Day; the Central Committee of the Vietnam Fatherland Front guides the content and form of organizing Law Day for member organizations.
2. Responsibilities for organizing Law Day
a) The Minister, Head of a ministry-level agency, Head of an agency under the Government, and Chairpersons of People's Committees at all levels are responsible for organizing Law Day;
b) The Chairman of the Central Committee of the Vietnam Fatherland Front and heads of central agencies of member organizations of the Front organize Law Day for members and affiliates of their organizations based on their functions and tasks.
Chapter III
SOCIALIZATION OF LEGAL PROMOTION AND EDUCATION ACTIVITIES AND SUPPORT POLICIES FOR ORGANIZATIONS, BUSINESSES, AND INDIVIDUALS PARTICIPATING IN LEGAL PROMOTION AND EDUCATIONLEGAL EDUCATION AND SUPPORT POLICIES FOR ORGANIZATIONS, ENTERPRISES, AND INDIVIDUALS PARTICIPATING IN THE DISSEMINATION AND EDUCATION OF LAWFOR ORGANIZATIONS, ENTERPRISES, AND INDIVIDUALSPARTICIPATING IN THE DISSEMINATION AND LEGAL EDUCATION
Article 8. Support Policies for Organizations, Businesses, and Individuals Participating in Legal Promotion and Education Activities or Supporting Funding, Infrastructure, and Means for Legal Promotion and Education Activities
1. Organizations and businesses participating in legal promotion and education activities or supporting funding, infrastructure, and means for legal promotion and education activities shall enjoy the following support policies:
a) They shall be provided with legal materials and free information on policies and laws related to the field of law being promoted and educated; they shall be trained in legal knowledge, professional skills, and techniques for legal promotion and education without charge when participating in such activities using their own funds;
b) They shall be allowed to carry out advertising activities when participating in free legal promotion and education activities or supporting funding, infrastructure, and means for legal promotion and education activities based on a written agreement between the parties in compliance with the regulations on advertising;
c) They shall be commended according to the regulations on commendation and reward.
2. Individuals participating in legal promotion and education activities or supporting funding, infrastructure, and means for legal promotion and education activities shall enjoy the following support policies:
a) They shall enjoy the support policies stipulated in Points a and c of Clause 1 of this Article;
b) Persons engaged in legal promotion and education for the target groups specified in Articles 17 and 20 of the Law on Legal Promotion and Education who do not receive salary from the State budget; village elders, village chiefs, and respected persons among ethnic minority communities participating in legal promotion and education shall enjoy the support policies stipulated in Points a and c of Clause 1 of this Article; they shall also receive remuneration and benefits when participating in legal promotion and education activities;
c) Teachers teaching civic education subjects to persons with disabilities through inclusive education shall enjoy the preferential allowance for teachers directly teaching persons with disabilities through inclusive education as prescribed in Decree No. 28/2012/ND-CP dated April 10, 2012 of the Government detailing and guiding the implementation of certain provisions of the Law on Persons with Disabilities.
Article 9. Socialization of the work of disseminating and educating the law for some organizations practicing law and professional associations related to the law
1. The State encourages the Vietnam Bar Federation, the Vietnam Lawyers Association, notary associations, other professional associations related to the law, legal counseling centers, law firms, and notary practices to participate in free dissemination and education of the law to the public; create conditions for members of their own organizations to participate in free dissemination and education of the law to the public through professional activities or at the request of individuals or organizations.
2. The Vietnam Bar Federation, the Vietnam Lawyers Association, notary associations, and other professional associations related to the law shall guide the annual participation in free dissemination and education of the law by lawyers, notaries, bar association members.
3. The Vietnam Bar Federations at all levels, the Vietnam Lawyers Association, provincial and municipal bar associations, notary associations, other professional associations related to the law, legal counseling centers, law firms, notary practices, and their members participating in the implementation of the dissemination and education of the law shall enjoy policies as stipulated in Clause 1, Article 8 of this Decree.
Chapter IV
CONDITIONS TO ENSURE THE WORK OFDISSEMINATION, LEGAL EDUCATION
Article 10. Ensuring organization and personnel for the work of disseminating and educating the law
1. Based on the needs of the work of disseminating and educating the law, the Minister, Head of a ministerial-level agency decides to establish an organization for the work of disseminating and educating the law under the Legal Department of the Ministry, ministerial-level agency.
2. In addition to fulfilling the responsibilities prescribed in Article 38 of the Law on Dissemination and Education of the Law, the Minister, Head of a ministerial-level agency, Head of a governmental agency, and Chairpersons of People's Committees at all levels shall be responsible for allocating sufficient civil servants to perform the work of disseminating and educating the law for special target groups within their areas of management; directing schools and vocational training institutions under their management to allocate sufficient teachers for civic education subjects, teachers, and lecturers for law courses.
Article 11. Ensuring funds for the dissemination and education of the law
1. Funds for the dissemination and education of the law for agencies and organizations benefiting from the state budget and the Steering Committee for the Dissemination and Education of the Law shall be guaranteed by the state budget according to the provisions of Clause 1, Article 39 of the Law on Dissemination and Education of the Law. The preparation of the budget for these funds shall be carried out according to the provisions of Clause 2, Article 39 of the Law on Dissemination and Education of the Law.
2. The Ministry of Finance shall take the lead and coordinate with the Ministry of Justice to guide the management, use, and settlement of accounts for funds ensuring the work of disseminating and educating the law; specify detailed regulations on the remuneration of legal propagandists, legal educators, invited participants in the dissemination and education of the law, and personnel engaged in the dissemination and education of the law for special target groups appropriate to each period.
Chapter V
IMPLEMENTING PROVISIONS
Article 12. Effective Date
This Decree takes effect from May 27, 2013.
Article 13. Responsibility for Implementation
1. The Minister, Head of a ministerial-level agency, Head of a governmental agency, and Chairpersons of provincial and municipal People's Committees directly under the central government shall organize the implementation of the provisions of this Decree according to their assigned functions, tasks, and authorities.
2. The Ministry of Justice shall provide guidance on the implementation of this Decree./.
