Circular No. 28/2015/TT-BNNPTNT Issuing the List of Protected Cultivated Plant Species

CIRCULAR

Issuing the List of Plant Species Protected|||

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Intellectual Property Law No. 50/2005/QH11 dated November 29, 2005; the Law Amending and Supplementing Certain Provisions of the Intellectual Property Law No. 36/2009/QH12 dated June 19, 2009;

At the proposal of the Director of the Plant Cultivation Department;

The Minister of Agriculture and Rural Development issues the List of Plant Species Protected.

Article 1. Attached to this Circular is the List of Plant Species Protected in Vietnam, including 107 plant species.

Article 2. Effectiveness

1. This Circular takes effect from September 29, 2015.

2. This Circular replaces the following Decisions and Circulars:

a) Decision No. 1213/QĐ-BNN-TT dated April 8, 2002 of the Minister of Agriculture and Rural Development on issuing the List of Five Plant Species Protected;

b) Decision No. 68/2004/QĐ-BNN dated November 24, 2004 of the Minister of Agriculture and Rural Development on supplementing Ten Plant Species to the List of Plant Species Protected;

c) Decision No. 56/2007/QĐ-BNN dated June 12, 2007 of the Minister of Agriculture and Rural Development on supplementing Twelve Plant Species to the List of Plant Species Protected and assigning units to conduct DUS testing;

d) Decision No. 103/2007/QĐ-BNN dated December 24, 2007 of the Minister of Agriculture and Rural Development on supplementing Ten Plant Species Protected and assigning units to conduct DUS testing;

đ) Decision No. 98/2008/QĐ-BNN dated October 9, 2008 of the Minister of Agriculture and Rural Development on supplementing Fifteen Plant Species to the List of Plant Species Protected and assigning units to conduct DUS testing;

e) Circular No. 33/2009/TT-BNNPTNT dated June 10, 2009 of the Minister of Agriculture and Rural Development on supplementing Eleven Plant Species to the List of Plant Species Protected;

g) Circular No. 21/2010/TT-BNNPTNT dated April 5, 2010 of the Minister of Agriculture and Rural Development on supplementing Five Plant Species to the List of Plant Species Protected;

h) Circular No. 11/2013/TT-BNNPTNT dated February 6, 2013 of the Minister of Agriculture and Rural Development on issuing the Supplementary List of Twenty-One Plant Species Protected.

Article 3. The Director of the Ministry's Office, the Director of the Crop Production Department, Heads of Units under the Ministry, Directors of Provincial Departments of Agriculture and Rural Development, organizations and individuals related to this matter are responsible for implementing this Circular./.
