CIRCULAR

Amending and supplementing certain provisions of Circular No. 46/2011/TT-BGTVT dated June 30, 2011 on the issuance and revocation of Insurance Certificate or Financial Security under the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 of the Minister of Transportetermining concerning the issuance and revocation of Insurance Certificate or Financial Security under the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Decree No. The Minister of Transport issues this Circular regulating the forms of certificates and logbooks for technical safety and environmental protection issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.

Pursuant to the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 to which Vietnam is a member;

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

The Minister of Transport hereby promulgates this Circular amending and supplementing certain provisions of Circular No. 46/2011/TT-BGTVT dated June 30, 2011 of the Minister of Transport on the issuance and revocation of Insurance Certificate or Financial Security under the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001. qregulating the issuance and revocation of Insurance Certificate or Financial Security under the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001.

Article 1. Amending and supplementing certain provisions of Circular No. 46/2011/TT-BGTVT dated June 30, 2011 of the Minister of Transport on the issuance and revocation of Insurance Certificate or Financial Security under the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001

Clause 1 of Article 3 shall be amended and supplemented as follows:

"1. The Insurance Certificate or Financial Security regarding civil liability for bunker oil pollution damage (hereinafter referred to as the Certificate) shall be issued by the Vietnam Maritime Administration or the Branch Maritime Administration, Port Maritime Office authorized by the Vietnam Maritime Administration to perform ship registration work (hereinafter collectively referred to as the Ship Registration Authority) to confirm the validity of the insurance or financial security for ships, in accordance with the requirements set forth in Article 7 of the Bunker Convention 2001."

Article 2. Repeal Article 10.

Article 3. Effectiveness

This Circular shall take effect from October 1, 2019.

Article 4. Organization of Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
