CIRCULAR
Amending and supplementing some Articles of Circular No. 01/2018/TT-BTC
dated January 2, 2018 of the Ministry of Finance on management and use of funds for traffic safety assurance
and use the funds to ensure traffic order and safety

Pursuant to the State Budget Law promulgated on June 25, 2015;
Pursuant to Resolution No. 50/2017/QH14 dated November 14, 2017 of the National Assembly on the allocation of the central budget for 2018;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing the implementation of certain provisions of the State Budget Law;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 22/2017/QĐ-TTg dated June 22, 2017 of the Prime Minister on the organization and operation of the National Traffic Safety Committee and Provincial Traffic Safety Committees;
Implementing Decision No. 1629/QĐ-TTg dated November 23, 2018 of the Prime Minister on the allocation of the state budget for 2019; Notification No. 25/TB-VPCP dated January 19, 2019 of the Government Office conveying the conclusions of Deputy Prime Minister Truong Hong Loc - Chairman of the National Traffic Safety Committee at a meeting on implementing urgent measures to ensure traffic safety in the near future;
At the proposal of the Director of the Department of Administrative and Public Financial Affairs;
The Minister of Finance hereby issues this Circular amending and supplementing some Articles of Circular No. 01/2018/TT-BTC dated January 2, 2018 of the Ministry of Finance on management and use of funds for traffic safety assurance.
Article 1. Amending and supplementing some Articles of Circular No. 01/2018/TT-BTC dated January 2, 2018 of the Ministry of Finance on management and use of funds for traffic safety assurance
1. Point a, Clause 1, Article 3 shall be amended and supplemented as follows:
"a) Propaganda and dissemination of traffic safety laws: Production, editing, broadcasting, distribution, transmission of information products with journalistic nature, radio and television programs, publications, and other information products (leaflets, posters, banners, slogans, film clips, video clips), text messages via mobile phones and social networks, organizing discussion forums, contests, exhibitions, rallies, and other forms and products of communication to strengthen information and propaganda on traffic safety, prevention of traffic accidents. The head of the agency entrusted with the task of communication shall be responsible for selecting the form, product, and content of communication and approving the budget estimate for the work within the allocated budget according to their authority, ensuring compliance with policies and regulations, economy, efficiency, and conformity with the legal provisions on bidding, ordering, and assigning tasks."
2. Point b, Clause 1, Article 3 shall be amended and supplemented as follows:
"b) Expenses for summary meetings, finalization meetings, seminars, training sessions to implement tasks and activities for traffic safety assurance;"
3. Supplementing point e, g, Clause 2, Article 3 as follows:
"e) Expenses for operating hotlines for traffic safety assurance;
g) Expenses for implementing additional tasks to enhance traffic safety assurance arising unexpectedly during the year in collaboration with ministries, sectors, and central-level agencies."
4. Supplementing point h, i, k, Clause 4, Article 3 as follows:
"h) Expenses for operating hotlines for traffic safety assurance;
i) Expenses for handling black spots and potential accident sites on roads in accordance with the regulations of the Minister of Transport on identifying and dealing with dangerous locations on operational roads, ensuring no overlap with other sources of funding;
k) Expenses for implementing additional tasks to enhance traffic safety assurance arising unexpectedly during the year in collaboration with departments, sectors, and provincial-level agencies under municipal people's committees."
5. Point c, Clause 2, Article 5 shall be amended and supplemented as follows:
"c) For localities:
- Departments of Transportation, Public Security of provinces and centrally-administered cities, and all levels of Traffic Safety Committees shall prepare budgets for traffic safety assurance according to assigned tasks and submit them to the financial authorities at the same level for review and consolidation into annual budget reports to be submitted to the provincial People's Councils for approval in accordance with regulations. Specifically, the Public Security of provinces and centrally-administered cities shall include budgets covering the costs of traffic safety assurance tasks of public security agencies at the district, town, city, and commune levels, and submit them to the financial authorities at the same level, while also sending copies to the Ministry of Public Security for overall monitoring and management of the public security sector.
- Provincial People's Councils shall submit to the provincial People's Councils for decision on the use of central government supplementary targeted funds from traffic violation fines and local government funds to implement traffic safety assurance tasks in their respective areas; specifically determining the amount of support for provincial and centrally-administered city public security agencies to carry out traffic safety assurance tasks in their areas in accordance with Point b, Clause 9, Article 9 of the State Budget Law; the results of allocation and budget assignment to provincial and centrally-administered city public security agencies shall be sent to the Ministry of Public Security for overall monitoring and management of traffic safety assurance funds for the public security sector.
In 2019, provincial People's Councils shall proactively use supplementary targeted funds from traffic violation fines transferred from the central government budget to the local budget to implement traffic safety assurance tasks, prioritizing public security forces, transport inspection agencies, and handling black spots and potential accident sites in accordance with Decision No. 1629/QĐ-TTg dated November 23, 2018 of the Prime Minister on the allocation of the state budget for 2019.
- The budget allocated for the provincial and centrally-administered municipal police forces to perform tasks ensuring traffic safety and order within their jurisdictions (including both central government supplementary funds with specific purposes and local budgets) shall be implemented through the withdrawal of budget estimates.
For the year 2019, in cases where localities have already provided funding to the provincial and centrally-administered municipal police forces in the form of advance payment orders before this Circular takes effect, such funding may continue to be disbursed in the form of advance payment orders for the allocated budget estimates as prescribed. From the date this Circular takes effect, remaining 2019 budget allocations that have not yet been disbursed in the form of advance payment orders shall be implemented through the withdrawal of budget estimates.
Article 2. Implementation
1. This Circular takes effect from July 15, 2019.
2. In cases where referenced documents in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replacement documents shall apply.
3. During implementation, if any difficulties arise, they should be reported to the Ministry of Finance for timely resolution./.
