Amending and supplementing certain articles of Circulars on periodic reporting systems in the aviation sector Periodic Reporting System in the Aviation Sector

Pursuant to Decree No. 12/2017/NĐ-CP dated December 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies;
At the proposal of the Director of the Ministry's Office and the Director of the Civil Aviation Authority of Vietnam;
The Minister of Transport issues this Circular amending and supplementing certain articles of Circulars on periodic reporting systems in the aviation sector.
1. Amending and supplementing Article 19 as follows:
"Article 19. Reporting System
1. The operator of civil airports; the aircraft operator; the owner of production and business establishments, service providers at civil airports shall be responsible for reporting to the Civil Airport Supervision Authority and the Civil Aviation Authority of Vietnam on environmental protection activities at civil airports, detailed as follows:
a) Report title: Environmental protection activity report at civil airports;
b) Content of the report: Contents related to environmental protection activities at civil airports as prescribed in Appendices 1, 2, and 3 issued together with this Circular;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 18 each year;
f) Time period for finalizing report data: From December 15 of the previous reporting period to December 14 of the current reporting period;
g) Report outline template: For the airport operator as prescribed in Appendix 1 issued together with this Circular. For the aircraft operator as prescribed in Appendix 2 issued together with this Circular. For the owner of production and business establishments, service providers at civil airports as prescribed in Appendix 3 issued together with this Circular.
2. The Civil Airport Supervision Authority shall be responsible for reporting to the Civil Aviation Authority of Vietnam on the situation of environmental protection activities at civil airports, detailed as follows:
a) Report title: Situation report on environmental protection activities at civil airports;
b) Content of the report: Contents related to environmental protection activities at civil airports as prescribed in Appendix 4 issued together with this Circular;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 20 each year;
f) Time period for finalizing report data: From December 15 of the previous reporting period to December 14 of the current reporting period;
g) Report outline template: As prescribed in Appendix 4 issued together with this Circular.
3. The Civil Aviation Authority of Vietnam shall be responsible for reporting to the Ministry of Transport on the situation of environmental protection activities in the aviation sector, detailed as follows:

b) Content of the report: Contents related to environmental protection activities at civil airports as prescribed in Appendix 5 issued together with this Circular;

d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 22 each year;
f) Time period for finalizing report data: From December 15 of the previous reporting period to December 14 of the current reporting period;g) Report outline template: As prescribed in Appendix 5 issued together with this Circular."
2. Replacing Appendices 1, 2, and 3 issued together with Circular No. 53/2012/TT-BGTVT dated December 25, 2012 of the Minister of Transport on Environmental Protection in Civil Aviation Activities with Appendices 1, 2, and 3 of this Circular respectively.
3. Supplementing Appendices 4 and 5 to Circular No. 53/2012/TT-BGTVT dated December 25, 2012 of the Minister of Transport on Environmental Protection in Civil Aviation Activities with Appendices 4 and 5 issued together with this Circular respectively.
1. Amending and supplementing Clause 3 of Article 7 as follows:
"3. The employer of aviation staff shall be responsible for compiling and reporting to the Civil Aviation Authority of Vietnam on the implementation of special labor discipline regimes for aviation staff, with detailed contents as follows:
a) Report title: Report on the implementation of special labor discipline regimes for aviation staff;
b) Content of report: Contents related to the implementation of special labor discipline regimes for aviation staff as stipulated in Appendix I issued together with this Circular;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Every six months and annually;
đ) Deadline for submitting reports: For the mid-year periodic report before June 20 of the reporting period. For the annual periodic report before December 20 of the reporting period. The mid-year report will be replaced by the annual report;
e) Time for finalizing data for the report: For the mid-year periodic report from December 15 of the year prior to the reporting period to June 14 of the reporting period. For the annual periodic report from December 15 of the year prior to the reporting period to December 14 of the reporting period;
g) Outline of the report: As prescribed in Appendix I issued together with this Circular."
2. Supplementing Appendix I to Circular No. 46/2013/TT-BGTVT dated November 25, 2013 of the Minister of Transport guiding the implementation of special labor discipline regimes for aviation staff corresponding to Appendix 6 issued together with this Circular.
Article 3. Amending and supplementing some articles of Circular No. 48/2016/TT-BGTVT dated December 30, 2016 of the Minister of Transport regulating maintenance of aviation works
1. Amending and supplementing Clause 2 of Article 10 as follows:
"2. The Civil Aviation Authority of Vietnam shall be responsible for developing and implementing annual regular inspection plans and ad hoc inspections regarding maintenance of aviation works; compiling and reporting to the Ministry of Transport annually or ad hoc when requested by the Ministry of Transport, with detailed contents as follows:
a) Report title: Report on the implementation of maintenance work for aviation works;
b) Content of report: Contents related to the implementation of maintenance work for aviation works as stipulated in Model No. 3 of the Appendix issued together with this Circular;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 20 each year;
f) Time period for finalizing report data: From December 15 of the previous reporting period to December 14 of the current reporting period;
g) Outline of the report: As prescribed in Model No. 3 of the Appendix issued together with this Circular."
2. Supplementing Model No. 3 to the Appendix issued together with Circular No. 48/2016/TT-BGTVT dated December 30, 2016 of the Minister of Transport regulating maintenance of aviation works corresponding to Appendix 7 issued together with this Circular.

"6. Compiling and reporting to the Civil Aviation Authority of Vietnam on the results of training and security training activities in aviation, with detailed contents as follows:
a) Report title: Report on the results of training and security training activities in aviation;
b) Content of report: Contents related to the results of training and security training activities in aviation as stipulated in Appendix 3a issued together with this Circular;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 20 each year;
e) Time for finalizing data for the report: From December 15 of the year prior to the reporting period to December 14 of the reporting period;

d) Frequency of reporting: Annually;
e) Deadline for submitting reports: Before December 20 each year;

3. Supplementing Appendices 3a and 3b to Circular No. 43/2017/TT-BGTVT dated November 16, 2017 of the Minister of Transport regulating training, upgrading, and security training in aviation corresponding to Appendices 8 and 9 issued together with this Circular.
4. Abolishing Point e of Clause 1 of Article 56.
Article 5. Amend and supplement some provisions of Circular No. 13/2019/TT-BGTVT dated March 29, 2019, issued by the Minister of Transport detailing the Aviation Security Program and Quality Control of Aviation Security in Vietnam.

"5. The agencies and units managing and operating aviation security equipment shall be responsible for reporting to the Civil Aviation Administration of Vietnam on the management of aviation security equipment, with detailed contents as follows:
a) Report title: Report on the management of aviation security equipment;
b) Report content: Contents related to the management of aviation security equipment as prescribed in Appendix XXVIII attached hereto;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
d) Deadline for submission of report: Before December 20 each year;
e) Period for finalizing data for the report: From December 15 of the previous reporting period to December 14 of the current reporting period;
g) Report outline template: As prescribed in Appendix XXVIII attached hereto."
2. Amend and supplement Clause 5 of Article 104 as follows:

Agencies and units equipped with weapons and support tools shall be responsible for reporting to the Civil Aviation Administration of Vietnam on the management of weapons and support tools and training and instruction on the storage and use of weapons and support tools, with detailed contents as follows:
a) Report title: Report on the management of weapons and support tools and training and instruction on the storage and use of weapons and support tools;
b) Report content: Contents related to the management of weapons and support tools and training and instruction on the storage and use of weapons and support tools as prescribed in Appendix XXIX attached hereto;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
d) Deadline for submission of report: Before December 20 each year;
e) Period for finalizing data for the report: From December 15 of the previous reporting period to December 14 of the current reporting period;

a) Report title: Report on the results of implementing quality control of aviation security;
b) Report content: Contents related to the results of implementing quality control of aviation security as prescribed in Appendix XXX attached hereto;
c) Method of sending and receiving reports: Reports can be in paper form or electronic form. Reports shall be sent to the receiving authority through one of the following methods: direct delivery, postal service, fax, email system, or other methods as prescribed by law;
d) Frequency of reporting: Annually;
d) Deadline for submission of report: Before December 20 each year;
e) Period for finalizing data for the report: From December 15 of the previous reporting period to December 14 of the current reporting period;
g) Report outline template: As prescribed in Appendix XXX attached hereto."
4. Supplement Appendices XXVIII, XXIX, XXX to Circular No. 13/2019/TT-BGTVT dated March 29, 2019, issued by the Minister of Transport detailing the Aviation Security Program and Quality Control of Aviation Security in Vietnam, corresponding to Appendices 10, 11, 12 attached hereto.
Article 6. Implementation Provisions
This Circular takes effect from December 15, 2020.
Article 7. Implementation Organization
The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments, Directors of the Civil Aviation Administration of Vietnam, Directors of Airport Supervision Units, Heads of relevant agencies, units, and individuals are responsible for implementing this Circular.
