CIRCULAR
Repealing certain regulatory legal documents issued by the Minister of Finance in the securities, insurance business, and banking finance sectors
At the request of the Chairman of the State Securities Commission, the Director of the Insurance Supervision Department, the Director of the Banking Finance Department, and financial organizations, and the Director of the Legal Department;
THE MINISTER OF FINANCE
Pursuant to the Law on Legislative Regulatory Documents issued on June 22, 2015;
Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016, issued by the Government detailing certain provisions and measures to implement the Law on Legislative Regulatory Documents;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Article 1. The Minister of Finance issues this Circular to repeal one regulatory legal document issued by the Minister of Finance in the securities sector, as follows:
Circular No. 194/2009/TT-BTC dated October 2, 2009, of the Ministry of Finance guiding public tender offers for shares of joint-stock companies and certificates of closed-end investment funds.
Article 2. The Minister of Finance issues this Circular to repeal six regulatory legal documents issued by the Minister of Finance in the insurance business sector, as follows:
1. Decision No. 99/2005/QD-BTC dated December 22, 2005, of the Minister of Finance on rules, rates, and liability limits for mandatory civil liability insurance for passenger and cargo transport on inland waterways.
2. Circular No. 99/2011/TT-BTC dated July 7, 2011, of the Ministry of Finance guiding financial management for the pilot implementation of export credit insurance.
3. Circular No. 121/2011/TT-BTC dated August 17, 2011, of the Ministry of Finance guiding certain provisions of Decision No. 315/QD-TTg dated March 1, 2011, of the Prime Minister on the pilot implementation of agricultural insurance from 2011 to 2013.
4. Circular No. 101/2012/TT-BTC dated June 20, 2012, of the Ministry of Finance stipulating certain financial matters for insurance and reinsurance enterprises implementing the pilot agricultural insurance program according to Decision No. 315/QD-TTg dated March 1, 2011, of the Prime Minister on the pilot implementation of agricultural insurance from 2011 to 2013.
5. Circular No. 57/2013/TT-BTC dated May 6, 2013, of the Ministry of Finance amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011, of the Ministry of Finance guiding certain provisions of Decision No. 315/QD-TTg dated March 1, 2011, of the Prime Minister on the pilot implementation of agricultural insurance from 2011 to 2013.
6. Circular No. 96/2013/TT-BTC dated July 23, 2013, of the Ministry of Finance amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011, of the Ministry of Finance guiding certain provisions of Decision No. 315/QD-TTg dated March 1, 2011, of the Prime Minister on the pilot implementation of agricultural insurance from 2011 to 2013, and Circular No. 101/2012/TT-BTC dated June 20, 2012, stipulating certain financial matters for insurance and reinsurance enterprises implementing the pilot agricultural insurance program according to Decision No. 315/QD-TTg dated March 1, 2011, of the Prime Minister on the pilot implementation of agricultural insurance from 2011 to 2013.
5. Circular No. 57/2013/TT-BTC dated May 6, 2013 of the Ministry of Finance amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011 of the Ministry of Finance guiding certain provisions of Decision No. 315/QĐ-TTg dated March 1, 2011 of the Prime Minister on the implementation of pilot agricultural insurance for the period 2011-2013.
6. Circular No. 96/2013/TT-BTC dated July 23, 2013 of the Ministry of Finance amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011 of the Ministry of Finance guiding certain provisions of Decision No. 315/QĐ-TTg dated March 1, 2011 of the Prime Minister on the implementation of pilot agricultural insurance for the period 2011-2013 and Circular No. 101/2012/TT-BTC dated June 20, 2012 stipulating certain financial issues for insurance enterprises and reinsurance enterprises implementing pilot agricultural insurance according to Decision No. 315/QĐ-TTg dated March 1, 2011 of the Prime Minister on the implementation of pilot agricultural insurance for the period 2011-2013.
Article 3. Repeal the entire two regulatory legal documents issued by the Minister of Finance in the field of financial banking as follows:
1. Circular No. 105/2007/TT-BTC dated August 30, 2007, guiding the handling of capital risk in state investment credit and export credit.
2. Circular No. 35/2012/TT-BTC dated March 2, 2012, guiding certain provisions of Government Decree No. 75/2011/NĐ-CP dated August 30, 2011, on state investment credit and export credit.
Article 4: Implementation organization
This Circular takes effect from June 2, 2020.
Heads of units under the Ministry and related agencies are responsible for implementing this Circular./.
