Amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011of the Ministry of Finance
guiding certain provisionsof Decision No. 315/QĐ-TTGdated March 1, 2012 of the Prime Minister
on pilotingagricultural insurance for the period 2011-2013

WHEREAS, Law on Insurance Business No. 24/2000/QH10 dated December 9, 2000 and Law Amending and Supplementing Certain Provisions of the Law on Insurance Business No. 61/2010/QH12 dated November 24, 2010 and guiding documents;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 315/QĐ-TTG dated March 1, 2011 of the Prime Minister on piloting agricultural insurance for the period 2011-2013; Decision No. 358/QĐ-TTG dated February 27, 2013 of the Prime Minister amending and supplementing certain provisions of Decision No. 315/QĐ-TTG dated March 1, 2012 of the Prime Minister on piloting agricultural insurance for the period 2011-2013;
At the proposal of the Director of the Insurance Management and Supervision Department,
The Minister of Finance promulgates this Circular amending and supplementing Circular No. 121/2011/TT-BTC dated August 17, 2011 of the Ministry of Finance guiding certain provisions of Decision No. 315/QĐ-TTG dated March 1, 2012 of the Prime Minister on piloting agricultural insurance for the period 2011-2013 as follows:
Article 1. Amending and supplementing Article 16 of Circular No. 121/2011/TT-BTC as follows
1. Amending Point b, Clause 1 of Article 16 as follows:
"b) Supporting 90% of the insurance premium for farming households and individuals with near-poor status engaged in agricultural production participating in the pilot agricultural insurance program."
2. Supplementing Clause 4 to Article 16 as follows:
"4. Farming households, individuals, and organizations producing agriculture that participate in the pilot insurance program for livestock according to Decision No. 315/QĐ-TTg dated March 1, 2011 of the Prime Minister on piloting agricultural insurance for the period 2011-2013 and Decision No. 1442/QĐ-TTg dated August 23, 2011 of the Prime Minister amending and supplementing certain provisions of Decision No. 719/QĐ-TTg dated June 5, 2008 of the Prime Minister on policies supporting prevention and control of animal diseases; Decision No. 142/2009/QĐ-TTg dated December 31, 2009 of the Prime Minister on mechanisms and policies supporting seedlings, livestock, and aquatic species to restore production in areas damaged by natural disasters and epidemics; and Decision No. 49/2012/QĐ-TTg dated November 8, 2012 of the Prime Minister amending and supplementing Article 3 of Decision No. 142/2009/QĐ-TTg of the Prime Minister on mechanisms and policies supporting seedlings, livestock, and aquatic species to restore production in areas damaged by natural disasters and epidemics shall still be entitled to benefit from support mechanisms according to Decision No. 719/QĐ-TTg dated June 5, 2008 of the Prime Minister on policies supporting prevention and control of animal diseases;"
Based on the actual insurance compensation amount, the Chairman of the People's Committee of the provinces and cities within the pilot implementation area shall decide specifically the direct support level for farming households, individuals, and organizations engaged in agricultural production to ensure that the total insurance compensation amount and the direct support amount for cases where livestock is damaged due to natural disasters and epidemics does not exceed the economic value of the livestock at the time of damage.”
Article 2. Effective Date
1. This Circular takes effect from June 28, 2013. Insurance contracts effective from February 27, 2013 shall enjoy the support mechanism stipulated in this Circular.
2. In the course of implementation, if any difficulties arise, they should be promptly reported to the Ministry of Finance for consideration and resolution ./
