Pursuant to the Law on People's Police dated November 20, 2018;

Pursuant to Decree No. 37/2009/NĐ-CP dated April 23, 2009, issued by the Government stipulating important political, economic, diplomatic, scientific and technological, cultural, and social targets to be guarded and protected by the People's Armed Police Force and the responsibilities of relevant agencies and organizations;

Pursuant to Decree No. 39/2021/NĐ-CP dated March 30, 2021, issued by the Government amending and supplementing certain provisions of Decree No. 37/2009/NĐ-CP dated April 23, 2009, issued by the Government stipulating important political, economic, diplomatic, scientific and technological, cultural, and social targets to be guarded and protected by the People's Armed Police Force and the responsibilities of relevant agencies and organizations;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Commander of Mobile Police;

The Minister of Public Security promulgates this Circular amending and supplementing certain articles of Circular No. 20/2010/TT-BCA dated June 23, 2010, issued by the Minister of Public Security detailing the implementation of certain provisions of Decree No. 37/2009/NĐ-CP dated April 23, 2009, issued by the Government stipulating important political, economic, diplomatic, scientific and technological, cultural, and social targets to be guarded and protected by the People's Armed Police Force and the responsibilities of relevant agencies and organizations.

Article 1. Amending and supplementing certain articles of Circular No. 20/2010/TT-BCA

1. Clause 2 of Article 3 shall be amended and supplemented as follows:

"2. For targets listed in the Catalogue but have undergone changes in name or type, no longer having special importance and not requiring armed guarding and protection by the People's Armed Police Force, the Commander of the Mobile Police Force shall take the lead in coordinating with the provincial police force and the agency owning the target to report to the Minister of Public Security for consideration and submission to the Prime Minister for decision to remove the target from the Catalogue." "The Prime Minister shall decide to remove the target from the Catalogue."

2. Clause 3 of Article 7 shall be amended and supplemented as follows:

"3. Organizing forces to guard the following targets:

a) The headquarters of the Ministry of Foreign Affairs;

b) The headquarters of the Ministry of Public Security;

c) The headquarters of the Ministry of Finance;

d) The headquarters of the Ministry of Home Affairs;

đ) The headquarters of the State Bank of Vietnam;

e) The headquarters of the Supreme People's Procuracy;

g) The headquarters of the Supreme People's Court;

h) The National Political Academy under President Ho Chi Minh;

i) The Central Treasury under the Ministry of Finance;

k) The National History Museum;

l) The headquarters of foreign diplomatic missions in Vietnam;

m) The headquarters of international organizations' representative offices in Vietnam that are part of the United Nations system and other international organizations for which Vietnam has committed to ensuring security under international treaties to which Vietnam is a party;

n) The vaults of precious metals, gems, and other rare assets managed and stored by the State Bank of Vietnam at the request of the Government;

o) The printing and minting plants and places for destroying unfit currency under the State Bank of Vietnam;

p) The Central Post Office under the Ministry of Information and Communications;

q) Post Office CP16 under the Central Post Office."

3. Clause 2 of Article 8 shall be amended and supplemented as follows:

"2. Deploying officers and soldiers of the People's Armed Police Force to perform armed guarding and protection duties for targets listed in the Catalogue issued pursuant to Decree No. 39/2021/NĐ-CP at their respective localities, including:

a) The headquarters of the Provincial Party Committee, City Party Committee, Provincial People's Council, and Provincial People's Committee;

b) The National Archive Center under the Department of Archives and Records Management, Ministry of Home Affairs;

c) Dalat Nuclear Research Institute;

d) The headquarters of consular offices in Vietnam;

đ) The National Radio Station, Program Production and Storage Center under Voice of Vietnam;

e) Radio transmitters under Voice of Vietnam;

g) Regional bureaus under Voice of Vietnam in the Northeast, Northwest, Central, Central Highlands, Mekong Delta regions, and Ho Chi Minh City;

h) Vietnam Television in Hanoi;

i) Radio and television transmission stations under Vietnam Television;

k) Provincial treasuries;

l) Branches of the State Bank of Vietnam in provinces and centrally-administered cities;

m) Provincial radio and television stations;

n) Provincial radio and television transmission stations;

o) Hung Temple Complex, Phu Tho Province;

p) Kim Lien Historical Site, Nghe An Province;

q) Ho Chi Minh Square, Nghe An Province;

r) Ho Chi Minh Museum, branch in Binh Thuan Province;

s) Thu Duc Water Plant, Ho Chi Minh City;

t) Nha Be Oil Depot, Ho Chi Minh City;

u) West Highland Ethnic Groups' Monument in Pleiku City, Gia Lai Province."

4. Article 9 shall be amended and supplemented as follows:

"Article 9. Organization of security forces for targets
1. For each target specified in the List issued together with Decree No. 39/2021/NĐ-CP, only the People's Police force shall be organized to perform armed guard duties at the main office of that target.

2. For new targets added to the List pursuant to the decision of the Prime Minister, the Ministry of Public Security shall issue documents assigning the Mobile Police Command or the Provincial Police Force under the direct jurisdiction of the Central Government to arrange People's Police officers to perform armed guard duties for such targets.The Prime Minister, depending on specific objectives, shall instruct the Ministry of Public Security to issue documents assigning the Mobile Police Command under the Ministry of Public Security or the provincial or centrally-affiliated city police force to arrange People's Police officers to perform armed guard duties for the protection of such targets.

5. Article 11 is amended and supplemented as follows:

"Article 11. Responsibilities of the People's Police units assigned to perform armed guard duties for targets
1. To closely coordinate with the agencies having the targets, police units, local authorities, and related organizations to ensure the safety of the targets. To develop and implement plans and schemes for protecting and preventing acts that threaten the safety of the targets; organize drills and responses to unexpected situations; apply appropriate police measures, with armed activities being the basic component in guarding and protecting, proactively preventing, detecting, stopping, and promptly dealing with acts that harm the safety of the targets.

2. To coordinate with provincial-level functional agencies, functional agencies under the Ministry of Foreign Affairs, and the agencies having the targets to build and install watchtowers and technical equipment serving armed guard duties for diplomatic mission offices, consular offices, offices of international organizations within the United Nations system in Vietnam, and other international organization offices in Vietnam committed to security protection by the Government under international treaties to which Vietnam is a party."

6. Article 14 is amended and supplemented as follows:

"Article 14. Responsibilities for Implementation
1. Agencies with important political, economic, diplomatic, scientific-technological, cultural, and social targets, which are guarded and protected by the People's Police force, shall implement the provisions of Decree No. 37/2009/NĐ-CP, Decree No. 39/2021/NĐ-CP, and this Circular.

2. The Mobile Police Command shall be responsible for directing, guiding, inspecting, urging, and organizing the implementation of this Circular.

3. The Equipment and Logistics Department shall be responsible for organizing the provision of weapons, means, and support tools for the forces directly performing armed guard duties for targets nationwide in accordance with the law.

4. Based on the proposals of local police units, the Construction Management and Barracks Department shall be responsible for coordinating with functional agencies under the Ministry of Foreign Affairs, provincial-level functional agencies, and related units to study and propose competent authorities to allocate barracks for People's Police units performing armed guard duties for diplomatic mission offices, consular offices, offices of international organizations within the United Nations system in Vietnam, and other international organization offices in Vietnam committed to security protection by the Government under international treaties to which Vietnam is a party, ensuring the following requirements:

a) Living space suitable for the performance of tasks;

b) A communal dining room;

c) A meeting room and space for unit-wide communal activities;

d) A place to store weapons, means, and support tools.

5. Heads of subordinate units under the Ministry of Public Security and Directors of Provincial Police Forces under the direct jurisdiction of the Central Government shall be responsible for implementing this Circular.

During the implementation process, if any difficulties arise, relevant agencies and organizations, police units, and localities shall report to the Ministry of Public Security (through the Mobile Police Command) for timely guidance."

Article 2. Supplementing, replacing, and abolishing certain terms, phrases, points, clauses, and articles of Circular No. 20/2010/TT-BCA

1. Replace the phrase "General Administration of Police for Administrative Management of Public Order and Social Safety" with the phrase "Mobile Police Command" in Article 3 and Article 7.

2. Remove the phrase "draft Decision" in point a, clause 1, Article 3.

3. Add the phrase "(amended and supplemented by Decree No. 39/2021/NĐ-CP)" after the phrase "Decree No. 37/2009/NĐ-CP" in clause 1, Article 3, clause 1, Article 5, clause 2, Article 5, and Article 6.

4. Abolish clause 3, Article 3.

5. Replace the phrase "List attached to Decree No. 37/2009/NĐ-CP" with the phrase "List attached to Decree No. 39/2021/NĐ-CP" in Article 5.

6. Replace the term "Directorate General" with the term "Commander" in clause 2, Article 5.

7. Replace the phrase "Protection Police Directorate" with the phrase "Mobile Police Command" in clause 2, Article 5 and Article 10.

8. Add the phrase "Mobile Police Command," after the phrase "Ministry of Public Security," in clause 2, Article 6.

9. Replace the phrase "embassies of countries in Vietnam, consular offices of countries in Vietnam, representative offices of United Nations bodies in Vietnam" with the phrase "representative offices of diplomatic missions, consular offices, and representative offices of international organizations under the United Nations system in Vietnam; representative offices of other international organizations in Vietnam committed to security protection under international treaties to which Vietnam is a party" in clause 5, Article 6.

10. Abolish clause 6, Article 6.

11. Add the phrase "Decree No. 39/2021/NĐ-CP" after the phrase "Decree No. 37/2009/NĐ-CP" in clause 1, Article 8.

Article 3. Implementation Provisions

This Circular takes effect from October 1, 2022./.
