Pursuant to the Inspection Law dated November 14, 2022;
Pursuant to Decree No.Decision No. 43/2023/NĐ-CP June 30, 2023 of the Government detailing certain provisions and measures for implementing the Inspection Law;
Pursuant to Decree No.Decision No. 86/2022/NĐ-CP October 24, 2022 of the Government stipulating the functions, tasks, powers, and structure of the Ministry of Education and Training;
Pursuant to Decree No.Decision No. 127/2018/NĐ-CP September 21, 2018 of the Government stipulating responsibilities for state management in education;
In accordance with the proposal of the Inspector General of the Ministry of Education and Training;
The Minister of Education and Training issues this Circular stipulating the contents of specialized inspection in the field of education and internal inspection in educational institutions.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the contents of specialized inspection in the field of education and internal inspection in educational institutions, including: contents of specialized inspection in the field of education; contents and activities of internal inspection in educational institutions.

a) The contents of specialized inspection in the field of education stipulated in this Circular shall apply to Departments of Education and Training, District Education and Training Offices; Inspectors General of the Ministry of Education and Training, Inspectors General of Departments of Education and Training; Heads of specialized inspection teams, members of specialized inspection teams; educational institutions under the State management of the Ministry of Education and Training; related organizations and individuals;
b) Internal inspection in educational institutions stipulated in this Circular shall apply to kindergartens, preschools; general education institutions; centers for continuing education, centers for vocational training and continuing education; boarding schools, semi-boarding schools, preparatory universities; teacher training colleges and higher education institutions under the State management of the Ministry of Education and Training; related organizations and individuals.
Article 2. Principles of specialized inspection and internal inspection activities
1. Compliance with legal regulations, ensuring accuracy, objectivity, honesty, transparency, democracy, and timeliness.
2. No overlap in scope, objects, contents, and timeframes of inspections among agencies performing inspection functions; not hindering the normal operations of inspected agencies, organizations, and individuals.
3. Linking with the performance of professional and administrative duties and responsibilities for state management in education.
Chapter II
CONTENTS OF SPECIALIZED INSPECTION IN THE FIELD OF EDUCATION
Article 3. Contents of specialized inspection regarding state management responsibilities in the field of education
1. State management responsibilities in the field of education for ministries:
a) Conduct research and forecasting human resource needs in sectors under their jurisdiction to serve the development of human resource training plans; application of information technology in human resource management in sectors under their jurisdiction;
b) Implement policies for socialized education, mobilizing legitimate resources and the participation of organizations, individuals, and businesses in human resource training work in sectors under their jurisdiction;
c) Carry out statistical reporting regularly and urgently on the activities and quality assurance conditions of educational institutions directly under the Ministry according to regulations;
d) Fulfill accountability for activities and quality at educational institutions directly under the Ministry within the scope of their authority;
đ) Perform other tasks as prescribed by law.
2. State management responsibilities in the field of education for People's Committees of provinces and centrally-administered cities (hereinafter referred to collectively as provincial level):
a) Advise and submit to the Provincial People's Councils resolutions, decisions, programs, projects, and policies for developing education, student分流后的第一部分翻译如下:

e) Implement the selection and dispatch of students to educational institutions within the national education system and utilize dispatched students in accordance with regulations;
g) Manage public universities directly under the province and private universities within the jurisdiction in accordance with the law;
h) Ensure the correct and adequate allocation of state budget for education at the local level as prescribed; manage and inspect the use of the state budget allocated for education in compliance with the State Budget Law and current budget decentralization management to meet the conditions ensuring the quality of education; implement tuition fees and other lawful revenues from public educational institutions under provincial jurisdiction; implement policies for socializing education and mobilize lawful resources to develop education locally;
i) Implement universal education, eradicate illiteracy, build national standard schools, and establish a learning society at the local level;
k) Direct the implementation of the use, evaluation, training, and development of civil servants, officials, and workers at educational institutions within the scope of management in accordance with regulations;
l) Allocate sufficient land reserves for educational institutions in line with the local education development strategy and plan;
m) Implement state policies and local policies to ensure autonomy and accountability for the performance and quality of education of educational institutions within the scope of management; update information on teaching staff and educational administrators within the scope of management into the national database on education;
n) Inspect the implementation of laws on education at the local level in accordance with regulations;
o) Direct the implementation of statistical work, information dissemination, and regular annual and ad hoc reports on the field of education to the Ministry of Education and Training;
p) Perform other tasks as prescribed by law;
3. Responsibilities of the People's Committee of districts, towns, cities, and townships (hereinafter referred to collectively as district level) in managing the state in the field of education:
a) Advise and submit to the People's Council of the district level for decision-making on plans, programs, and projects for the development of preschool, primary, and secondary education in the area in line with the provincial education development strategy and the local socio-economic development plan;
b) Direct, guide, and organize the implementation of plans, programs, and projects for the development of preschool, primary, and secondary education in the area after approval by the competent authority; organize the implementation of legal documents on education;
c) Reorganize and restructure educational institutions within the scope of management in accordance with local practical conditions; ensure sufficient staffing for educational management civil servants, the number of employees according to approved job position plans; be responsible for reporting on educational activities, educational quality, management of civil servants, officials, workers, and students, and the implementation of educational development policies within the scope of management;
d) Specify the functions, responsibilities, and authorities of the Department of Education and Training in accordance with the Government's regulations and guidelines from the Ministry of Education and Training;
đ) Guide and inspect educational institutions within the scope of management to ensure educational quality;
e) Implement universal education, eradicate illiteracy, build national standard schools, and establish a learning society in the area;
g) Direct the implementation of the use, evaluation, training, and development of civil servants, officials, and workers at educational institutions within the scope of management in accordance with regulations; regularly update information on teaching staff and educational administrators within the scope of management into the national database on education;
h) Ensure sufficient financial, property, material infrastructure, and land reserves as prescribed; implement policies for socializing education and mobilize resources for education development; issue regulations to ensure autonomy and accountability for the performance and quality of education for educational institutions under their management authority;
i) Inspect compliance with laws by educational institutions under the management authority of the People's Committee at the district level;
k) Direct the implementation of statistical work, information dissemination, and regular and ad hoc reports on the field of education in the area as required by the Provincial People's Committee and the Department of Education and Training;
l) Perform other tasks as prescribed by law;
4. Responsibilities of the People's Committee of communes, wards, and towns (hereinafter referred to collectively as commune level) in managing the state in the field of education:
a) Develop and submit to the People's Council of the commune level for approval the plan for education development in the area; organize the implementation of the education development plan at the local level upon approval;
b) Invest or participate in investment in building educational institutions and community learning centers in accordance with the division of responsibilities as prescribed by the People's Committee at the district level; coordinate with relevant units to advise the People's Committee at the district level on building schools that meet educational quality standards, plans for land use for educational institutions in the area; establish or permit establishment, suspend operations, merge, or divide educational institutions in accordance with the division of responsibilities;
c) Manage community learning centers; coordinate with the Department of Education and Training to manage educational institutions in accordance with the division of responsibilities; mobilize resources to develop education in the commune, create a healthy educational environment, encourage the people to care about education, coordinate with schools to care for the education of children to foster new cultural lifestyles, participate in protecting and preserving historical sites, scenic spots, cultural works, and facilities for student learning and recreation;
d) Inspect the conditions for ensuring the quality of care and education of independent kindergartens and classes on the local level. Be responsible for reporting on educational activities within the scope of management.
đ) Perform other tasks as prescribed by law.
Article 4. Content of specialized inspection concerning the Department of Education and Training
1. Advising the People's Committee at the provincial level to submit to the People's Council:
a) Decisions, plans, programs, projects, policies for education development, student guidance and vocational orientation suitable to the strategic plan for the education sector and the socio-economic development plan of the locality;
b) Annual tuition fee decisions for public educational institutions under the provincial government's management in accordance with the provisions of the law;
c) Civil servant staffing decisions for educational management agencies within the province in accordance with the provisions of the law;
d) Approval of the total number of staff working in public educational institutions under the provincial management in accordance with the provisions of the law.
2. Matters submitted to the Provincial People's Committee for issuance:
a) Legal documents on education within the jurisdiction;
b) Guidance documents and implementation of legal documents on education; plans integrating the network of educational and training institutions into the provincial planning in accordance with the Law on Planning and related regulations;
c) Plans for developing education within the jurisdiction; plans, programs, and projects for developing secondary general education within the jurisdiction; plans to implement the reform project of general education curricula and textbooks assigned within the provincial jurisdiction; approval documents for establishing, permitting establishment, merging, splitting, separating, or dissolving educational institutions within the jurisdiction according to the分级授权;
d) Approve the restructuring plan for public educational institutions under its management in accordance with the practical conditions of the locality; approve the establishment, restructuring, or dissolution plans for specialized departments under the Department of Education and Training according to regulations;
3. Coordinate with the Department of Personnel and Administration to compile the annual number of staff in public educational institutions into the provincial plan for the number of staff in public service units for approval by the competent authority;
4. Lead and coordinate with relevant units to organize the assessment of conditions for establishing or permitting the establishment of educational institutions according to the分级授权; suspend operations for educational institutions under its management; recruit or delegate recruitment, utilization, training, and development of teachers, education managers, and staff in educational institutions under its management;
5. Lead and coordinate with relevant agencies to perform the State management function of the Provincial People's Committee over higher education institutions, teacher training colleges, and provincial continuing education centers according to the分级授权;
6. Provide professional guidance to the Education and Training Departments and personnel in charge of education at the grassroots level;
7. Manage teaching and educational activities both inside and outside schools; direct the implementation of moral education, lifestyle education, and school safety activities; implement and direct the implementation of the plan to carry out the reform project of general education curricula and textbooks; implement and direct the implementation of educational communication work within the jurisdiction;
8. Regularly update information about the teaching staff and education managers under its management into the education sector database. Fully and promptly implement regular annual and ad hoc reporting systems on statistics and transparency in the field of education within the managed jurisdiction to the Provincial People's Committee and the Ministry of Education and Training as prescribed;
9. Carry out inspections, checks; handle complaints, accusations, suggestions, and reflections; deal with violations in the field of education according to the provisions of the law;
10. Perform other tasks as prescribed by law;
Article 5. Content of specialized inspection concerning the Department of Education and Training
1. Advising the People's Committee at the district level to submit to the People's Council at the same level for decision on plans, programs, and projects for education development in the locality that are consistent with the provincial education development strategy and the local socio-economic development plan.
2. Taking the lead and coordinating with relevant agencies to submit to the People's Committee at the district level:

Manage teaching and educational activities both inside and outside schools; direct the implementation of moral education, lifestyle education, and school safety activities; implement and direct the implementation of the plan to carry out the reform project of general education curricula and textbooks; implement and direct the implementation of educational communication work within the jurisdiction;
6. Regularly update information about the teaching staff and education managers under its management into the education sector database. Fully and promptly implement regular annual reporting systems on transparency in the field of education within the managed jurisdiction to the County People's Committee and the Department of Education and Training as prescribed;
7. Issue guiding documents within the jurisdiction; promote and disseminate education laws;
8. Direct and implement inspection work, complaint resolution, accusation resolution, anti-corruption measures, reporting, statistics, and transparency regarding education for educational institutions under the County People's Committee's management jurisdiction;
9. Perform other tasks as prescribed by law;
Article 6. Content of specialized inspections for higher education institutions and teacher training colleges.
1. The issuance of internal management documents and the dissemination and education of laws; the establishment of organizational structures; the implementation of regulations on transparency in the field of education; internal inspection work and the implementation of regulations on organization and operation according to the Charter of the school's organization and activities.
2. The implementation of regulations on basic training standards, training program standards; admission regulations; training regulations; joint training programs; regulations on opening training majors; compiling, selecting, reviewing, approving, and using teaching materials and textbooks; printing and managing diplomas and certificates.
3. Management and education of students and policies for students.
4. Conditions ensuring educational quality; quality assessment of education.
5. Implementation of regulations on tuition fee collection and management, and other financial resources.
6. Organization of scientific and technological activities; application, development, and technology transfer; provision of scientific services; organization of international cooperation activities in education.
7. International cooperation activities and foreign-linked training programs.
8. Implementation of political education tasks; student affairs and physical education.
9. Perform other tasks as prescribed by law;
Article 7. Contents of specialized inspection concerning preschool education institutions, general education institutions, and regular education institutions
1. Issuing documents, internal management regulations, and disseminating and educating laws; building organizational structures; implementing provisions on transparency in the field of education; internal inspection work and implementation of provisions on organization and operation according to the Charter and Operation Regulations of educational institutions.
2. Implementing professional regulations, implementing educational content and methods; managing, selecting, and using textbooks, educational materials, teaching equipment, and children's toys.
3. Implementing admission regulations, managing and educating students, and policies for students; managing the issuance of certificates.
4. Socialization of education, managing additional teaching and learning.
5. Conditions ensuring educational quality; compliance with regulations on educational quality assessment.
6. Implementing regulations on collecting, managing, and using tuition fees and other financial resources.
7. Transparency in the activities of national education system educational institutions in accordance with the Ministry of Education and Training’s regulations.
8. Performing other tasks as prescribed by law.
Article 8. Contents of specialized inspection regarding examinations and admissions for junior high schools, senior high schools, general education schools including junior high and senior high levels, continuing education centers, teacher training colleges, and higher education institutions
1. Contents of specialized inspection regarding examinations include:
a) Examination organization and management work;
b) Registration for examinations and preparation for examination organization;
c) Printing, transporting, and preserving examination papers; preserving answer sheets;
d) Examination supervision work;
đ) Examination marking work;
e) Graduation certification;
g) Performing other tasks as prescribed by law.
2. Contents of specialized inspection regarding admissions include:
a) Admission quotas;
b) Construction and publication of admission plans;
c) Conditions ensuring the examination admission process;
d) Implementation of admission regulations;
đ) Inspection of student enrollment and verification of admitted candidates' files;
e) Performing other tasks as prescribed by law.
Article 9. Contents of specialized inspection regarding the implementation of graduation theses and dissertations; graduation review and recognition in higher education institutions and teacher training colleges
1. Contents of specialized inspection regarding the implementation of graduation theses and dissertations include:
a) Issuance of unit regulations;
b) Topic selection process and assignment of advisors;
c) Ensuring conditions for thesis and dissertation implementation; conditions and composition of thesis and dissertation evaluation boards;
d) Implementation of thesis and dissertation evaluation regulations;
đ) Grading, reporting, archiving, and handling complaints and accusations related to theses and dissertations;
e) Performing other tasks as prescribed by law.
2. Inspection of graduation review and recognition includes:
a) Establishment of the Graduation Review Board;
b) Implementation of the graduation review and recognition process;
c) Priority groups for exemption and special graduation recognition;
d) Retention of examination scores, priority points, and encouraging points;
đ) Issuance of temporary graduation certificates and graduation diplomas;
e) Handling complaints and accusations;
g) Implementation of information dissemination, reporting, and archiving systems;
h) Performing other tasks as prescribed by law.
Article 10. Content of specialized inspection for other organizations and individuals participating in educational activities under the management of the Ministry of Education and Training
1. Authority to establish organizations, permit educational activities for organizations and individuals participating in educational activities; contents of decisions on establishment and permission for educational activities; partner organizations or individuals linked with those participating in educational activities (if any).
2. Implementation of regulations concerning material infrastructure, teaching staff, and other conditions ensuring educational quality.
3. Admissions, implementation of educational programs, management, issuance of diplomas and certificates.
4. Disclosure of educational activities and reporting on educational activities to competent authorities.
5. Other contents as prescribed by law.
Chapter III
INTERNAL INSPECTION IN EDUCATIONAL INSTITUTIONS
Article 11. Content of internal inspection in educational institutions
1. Implementation of policies and laws on education.
2. Development and issuance of internal regulations of educational institutions according to the分级授权和权限。
3. Implementation of educational objectives, plans, programs, contents, methods; professional rules, examination rules, admission rules, training rules, regulations on printing, managing, issuing diplomas and certificates; autonomy in opening training majors, issuing training programs, implementing regulations on textbooks and lectures; financial management and asset management; scientific and technological activities and international cooperation; personnel organization work; implementation of regulations on conditions ensuring educational quality of the educational institution; political education tasks and student affairs.
4. Implementation of laws related to the organization and activities of units, organizations, and individuals within the educational institution.
5. Implementation of tasks of receiving citizens, handling complaints and denunciations in schools in accordance with the provisions of laws on receiving citizens, handling complaints, and handling denunciations.
6. Implementation of anti-corruption tasks in the field of education in accordance with the provisions of laws on anti-corruption.
7. Implementation of other tasks as prescribed by law.
Article 12. Forms of internal inspection in educational institutions
1. Internal inspection activities in educational institutions are conducted in two forms:
a) Annual planned inspections approved by the head of the educational institution and notified to the inspected entities, units, organizations, and individuals concerned;
b) Unscheduled inspections conducted when signs of violations of laws are detected, upon request for handling complaints and denunciations; preventing and combating corruption, or assigned by the head of the educational institution.
2. Based on specific conditions of the unit, the head of the educational institution selects appropriate forms of internal inspection.
Article 13. Internal inspection team in educational institutions
1. The internal inspection team in educational institutions is established by the decision of the head of the educational institution. The internal inspection team in educational institutions has a Team Leader, Deputy Team Leader (if necessary), and members of the inspection team.
2. Within their scope of duties and powers, the head of the educational institution issues regulations on the internal inspection process, annual inspection plans when deemed necessary, ensuring compliance with the provisions of the Inspection Law as stipulated in Article 67 of Decree No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and measures to implement the Inspection Law.
Chapter IV
IMPLEMENTATION
Article 14. Responsibilities of the Inspectorate under the Ministry of Education and Training
1. Advise the Minister of Education and Training to guide specialized inspection business for the Inspectorates of Departments of Education and Training, internal inspections within educational institutions.
2. Advise the Minister of Education and Training to build a specialized inspection workforce in the field of education, internal inspections within educational institutions according to their authority and legal regulations.
Article 15. Responsibilities of the Department of Education and Training
1. Guide specialized inspection business in the field of education, internal inspections within educational institutions under the provincial People's Committee's state management authority.
2. Organize professional training on specialized inspection business in the field of education, internal inspections within educational institutions for staff members who are expected to participate in specialized inspection activities in the field of education and internal inspections within educational institutions under the Department of Education and Training's state management authority over education.
Article 16. Responsibilities of Educational Institutions
1. The head of the educational institution organizes internal inspections to strengthen management work, ensure compliance with policies and laws, and the implementation of assigned tasks and powers for agencies, organizations, and individuals under their management according to the Inspection Law, Decree No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and measures for implementing the Inspection Law and related legal regulations.
2. The head of the educational institution selects the content, form, and organizes the operation of the internal inspection team according to regulations.
3. Organize professional training on internal inspections within educational institutions for those expected to participate in internal inspection activities.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Effective Date
1. This Circular takes effect from February 10, 2025.
2. In cases where the legal regulatory documents cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replacing legal regulatory documents shall be applied.
3. This Circular replaces the following Circulars of the Minister of Education and Training:
a) Circular No. 39/2013/TT-BGDĐT dated December 4, 2013 guiding specialized inspections in the field of education;
b) Circular No. 54/2012/TT-BGDĐT dated December 21, 2012 stipulating about education inspection collaborators;
c) Circular No. 31/2014/TT-BGDĐT dated September 16, 2014 amending and supplementing some articles of Circular No. 54/2012/TT-BGDĐT dated December 21, 2012 stipulating about education inspection collaborators;
d) Circular No. 51/2012/TT-BGDĐT dated December 18, 2012 stipulating about the organization and activities of education inspection in higher education institutions and vocational secondary schools;
đ) Circular No. 23/2016/TT-BGDĐT dated October 13, 2016 stipulating about the organization and activities of examination inspections;
e) Circular No. 24/2016/TT-BGDĐT dated November 14, 2016 promulgating the Program for training education inspection collaborator business skills.
Article 18. Responsibility for Implementation
The Director of the Office, the Chief Inspector of the Ministry, heads of units related to the Ministry of Education and Training; Chairmen of Provincial People's Committees; Directors of Departments of Education and Training; Heads of Education and Training Divisions; Heads of agencies, organizations, units, and individuals related shall be responsible for implementing this Circular./.
