Pursuant to the Anti-Corruption Law No. 36/2018/QH14; amended and supplemented by Law No. 59/2020/QH14 and Law No. 81/2025/QH15;
Pursuant to Decree No. 59/2019/NĐ-CP detailing certain provisions and implementing mechanisms of the Anti-Corruption Law; amended and supplemented by Decree No. 134/2021/NĐ-CP;
Pursuant to Decree No. 39/2025/NĐ-CP on the functions, tasks, powers, and organizational structure of the Ministry of Justice;
At the proposal of the Director of the Cadre and Civil Servant Organization Department;
The Minister of Justice issues this Circular regulating the list and periodic rotation term of job positions within agencies and units under the Ministry of Justice and in fields under the management scope of the Ministry of Justice at local administrative levels.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates the list and periodic rotation term of job positions within agencies and units under the Ministry of Justice and in fields under the management scope of the Ministry of Justice at local administrative levels.
Article 2. This Circular applies to civil servants not holding leadership or managerial positions and staff working in positions required to be rotated according to regulations in units under the Ministry of Justice, civil execution agencies, and in fields under the management scope of the Ministry of Justice at local administrative levels.
Article 2. List and periodic rotation term of job positions
Clause 1. The list of job positions subject to periodic rotation is specified in the Appendix attached hereto.
Clause 2. The periodic rotation term for each field of work is specifically determined in the Appendix attached hereto. The starting point for calculating the rotation term is the date when the individual is assigned to work in that position according to the decision of the competent authority as prescribed by law.
Article 3. Implementation Provisions
Article 3. This Circular takes effect from February 8, 2026, and replaces Circular No. 05/2023/TT-BTP dated August 24, 2023, issued by the Minister of Justice regarding the regulation of the list and periodic rotation term of job positions within agencies and units under the Ministry of Justice and in fields under the management scope of the Ministry of Justice at local administrative levels.
Article 4. Chairmen of People's Committees of provinces and cities, Heads of units under the Ministry, civil execution agencies, and related organizations and individuals are responsible for implementing this Circular.
Article 4. Transitional Provisions
In cases where individuals have been assigned to work in positions subject to periodic rotation before the effective date of this Circular, the agencies and units shall continue to monitor and carry over the time spent in those positions to review periodic rotations according to the terms set forth in this Circular./.
