This Decree amends and supplements certain articles of Decree No. 23/2015/NĐ-CP on issuing certified copies from original registers, authenticating certified copies from original documents, authenticating signatures, and authenticating contracts and transactions. THE GOVERNMENT ISSUES THE DECREE AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO. 07/2025/NĐ-CP. Article 1. Amending and supplementing certain Articles of Decree No. 23/2015/NĐ-CP on issuing certified copies from original registers, certifying true copies from originals, certifying signatures, and certifying contracts and transactions, amended and supplemented by Decree No. 07/2025/NĐ-CP
1. Amending and supplementing Clauses 2, 3, 4, and 9 of Article 2 as follows:
“2. ‘Certifying true copies from originals’ means the act of an agency, organization, or person authorized under this Decree certifying that a copy is correct with respect to the original.
3. ‘Certifying signatures’ means the act of an agency, organization, or person authorized under this Decree certifying that a signature on a document is the signature of the person requesting certification.
4. ‘Certifying transactions’ means the act of a person authorized under this Decree certifying the time and place of concluding civil transactions, the capacity for civil acts, the voluntary will, signatures, or fingerprints of the parties involved in civil transactions.
9. ‘Person performing certification’ means the Chairman of the People's Committee of communes, wards, and special administrative regions (hereinafter referred to as the People's Committee at the commune level); persons authorized or assigned to perform certification tasks according to Clause 2, Article 5 of this Decree; notaries of Notary Offices, Notary Public Offices (hereinafter referred to as organizations practicing notarization); diplomatic officials, consular officials of Diplomatic Missions, Consular Missions, and other agencies authorized to perform consular functions of Vietnam abroad (hereinafter referred to as Diplomatic Missions).”
Article 5. Authority and responsibility for certification
2. Amending and supplementing Clause 5 as follows:
“1. The Chairman of the People's Committee at the commune level has the authority and responsibility:
a) To certify true copies from originals of documents issued by competent agencies and organizations in Vietnam; competent agencies and organizations in foreign countries; competent agencies and organizations in Vietnam linked with competent agencies and organizations in foreign countries;
b) To certify signatures on documents;
c) To certify the signatures of translators in documents translated from foreign languages into Vietnamese, or from Vietnamese into foreign languages;
d) To certify transactions related to movable assets;
đ) To certify transactions related to land users' rights as prescribed by laws on land;
e) To certify transactions concerning housing as prescribed by laws on housing;
g) To certify wills;
h) To certify documents refusing inheritance;
i) To certify documents dividing inheritances as specified in points d, đ, and e of this clause.
2. The Chairman of the People's Committee at the commune level directs and organizes the implementation of certification activities prescribed in Clause 1 of this Article within their jurisdiction.
Delegation and assignment to perform certification tasks prescribed in Clause 1 of this Article, and signing and using seals when performing certification shall be carried out in accordance with laws on local government organization, laws on specialized agencies under the People's Committee at the commune level, and relevant laws.
3. Diplomatic and consular missions have the authority and responsibility to certify matters specified in points a, b, and c of Clause 1 of this Article. Diplomatic and consular officials sign and affix the seal of the Diplomatic Mission.
4. Notaries have the authority and responsibility to certify matters specified in points a, b, and c of Clause 1 of this Article, sign and affix the seal of the organization practicing notarization.
5. Certification does not depend on the place of residence of the person requesting certification in the following cases:
a) Certifying true copies from originals, certifying signatures;
b) Certifying transactions related to movable assets;
c) Certifying wills, certifying documents refusing inheritance;
d) Certifying power of attorney documents related to the exercise of land users' rights, housing;
đ) Certifying the amendment, supplementation, or cancellation of transactions as specified in points b, c, and d of this clause.
6. Certification of transactions related to land users' rights shall be conducted at the People's Committee at the commune level where the land is located, and certification of transactions concerning housing shall be conducted at the People's Committee at the commune level where the housing is located, except for the cases stipulated in Clause 5 of this Article."
6. The authentication of transactions related to the rights of land users shall be conducted at the People's Committee of the commune where the land is located; the authentication of transactions concerning housing shall be conducted at the People's Committee of the commune where the house is located, except for the cases stipulated in Clause 5 of this Article.
3. Amend and supplement Article 6 as follows:
“Article 6. Responsibilities of agencies and organizations in receiving copies, documents, and materials issued in electronic form
1. Where laws require submission of copies, agencies and organizations shall be responsible for accepting such copies without requesting certified copies, but may request original documents or copies from the original record for comparison or verification if there is evidence of fraudulent or illegal copies.
2. Where laws require submission of copies from the original record or certified copies, agencies and organizations shall not request original documents unless there is evidence of fraudulent or illegal copies, in which case they may request originals for comparison or verification if deemed necessary.
3. Where laws provide that documents and materials are issued in electronic form, agencies and organizations shall be responsible for accepting and using such electronic forms without requiring paper submissions or certified copies, except where there is evidence of fraudulent or illegal electronic forms, in which case they must handle according to their authority or report to competent authorities for resolution.
4. Supplement Clause 8 and Clause 9 to Article 9 as follows:
"8. Not to require the person requesting certification to submit or present original or certified copies of documents and materials already integrated on VNeID when the person requesting certification has presented corresponding information from VNeID.
9. In cases where the person requesting certification proposes and the certifying person can access information and documents from the National Population Database or other databases as prescribed by law, the certifying person shall be responsible for accessing information and documents from these databases, and shall not require the person requesting certification to present original, copies from the original record, or certified copies for information and documents that have been accessed."
5. Amending and supplementing Clause 2 of Article 12 as follows:
"2. The model statements accompanying this Decree include:
a) Statement certifying a copy from the original;
b) Statement certifying the signature of one person in a document or text; Statement certifying the signature of one person in a document or text at the Public Service Center; Statement certifying the signatures and seals of multiple persons in a document or text; Statement certifying the signatures and seals of multiple persons in a document or text at the Public Service Center; Statement certifying seals; Statement certifying in cases where the person requesting certification cannot sign or seal;
c) Statement certifying the signature of the translator;
d) Statement certifying transactions; Statement certifying transactions at the Public Service Center; Statement certifying the division of inheritance; Statement certifying the division of inheritance at the Public Service Center; Statement certifying the refusal to accept inheritance; Statement certifying the refusal to accept inheritance in cases where two or more people refuse to accept inheritance; Statement certifying the refusal to accept inheritance in cases where one person refuses to accept inheritance at the Public Service Center; Statement certifying the refusal to accept inheritance in cases where two or more people refuse to accept inheritance at the Public Service Center; Statement certifying a will; Statement certifying a will at the Public Service Center."
6. Amend and supplement Clause 4 of Article 13 as follows:
"4. The model certification books accompanying this Decree include:
a) Certification book for copies from the original (CBT/BS);
b) Certification book for signatures/seals (CBT/CK,DC);
c) Certification book for the translator's signature (CBT/CKND);
d) Certification book for transactions (CBT/GD)."
7. Amending and supplementing Article 17 as follows:
“Article 17. Procedure for Issuing Certified Copies from Original Registers
1. The application dossier for issuing certified copies from original registers shall include the following documents:
a) One of the following documents: electronic identification card; original or certified copy of citizen identification card, citizen card, certificate of identification, passport, entry-exit document, or international travel document still valid.
b) Original or certified copy with notarization of documents proving relationship with the person whose original is being requested, as provided for in Clause 2 and Clause 3 of Article 16 of this Decree.
2. Implementation procedures for issuing certified copies from original registers:
a) In case of submitting the application dossier directly to the competent authority or organization, the person requesting the certified copy shall present the documents specified in Clause 1 of this Article for the dossier receiver to check.
b) In case of submitting the application dossier through postal service, the person requesting the certified copy must send along the dossier specified in Clause 1 of this Article and one envelope with postage paid, clearly stating the name and address of the recipient.
c) In case of submitting the application dossier online, the person requesting the certified copy may submit an electronic copy or an electronic copy of the documents specified in Clause 1 of this Article.
3. The authority or organization shall issue certified copies based on the original register; the content of the certified copy must be consistent with the original register. In case the original register is no longer stored or does not contain the required information, the authority or organization shall have the responsibility to respond in writing to the requester.
The result will be delivered directly, through postal service, or online according to the method registered by the requester.
4. The time limit for issuing certified copies from original registers shall be implemented in accordance with the provisions of Article 7 of this Decree. The time limit starts from the date when the authority or organization receives a complete and valid dossier directly, marked by post office stamp, or recorded by the public service system as having received a complete and valid dossier.
8. Amend and supplement Article 19 as follows:
“Article 19. Responsibilities of the Requester for Authentication of Certified Copies and the Person Performing Authentication of Certified Copies from Originals
1. The requester for authentication of certified copies shall be responsible for the content, legality, and validity of the original documents or texts used as the basis for authentication of certified copies. The requester has the responsibility to determine the types of documents or texts that need to be authenticated as certified copies from originals in accordance with the law and shall not request authentication of certified copies from originals of documents or texts specified in Article 22 of this Decree.
2. The person performing authentication shall be responsible for the accuracy of the certified copy compared to the original. In case the person performing authentication notices that the law does not stipulate the requirement to use authenticated documents or texts as certified copies from originals, they shall guide the requester about this matter.
9. Amend and supplement Article 28 as follows:
“Article 28. Translation Assistants
1. Persons meeting the criteria and conditions as prescribed in Article 27 of this Decree shall be eligible to serve as translation assistants for People's Committees at the commune level and notary organizations throughout the country.
2. People's Committees at the commune level and notary organizations shall be responsible for checking the criteria and conditions of translation assistants, signing contracts for translation assistance with translators, clearly defining the responsibilities of the translators regarding the content and quality of translations, and then compiling a list of translation assistants and reporting it to the Department of Justice for approval.
3. People's Committees at the commune level, Commune-level Public Service Centers, and notary organizations shall publicly display the list of approved translation assistants at their offices, and simultaneously update it regularly on the Department of Justice's website or information portal.
10. Amend and supplement Article 29 as follows:
“Article 29. Registration of Sample Signature
A translator who is a collaborator of the People's Committee at the commune level must register their sample signature with the People's Committee at the commune level; a translator who is a collaborator of a notary practice organization must register their sample signature with the notary practice organization. When registering the sample signature, the translator must submit a request for registration of the sample signature and directly sign three identical sample signatures on the request for registration of the sample signature in the presence of the Chairman of the People's Committee at the commune level or a person authorized by the Chairman of the People's Committee at the commune level, the Director of the Notary Office, or the Director of the Notary Office.
11. Amend and supplement Article 31 as follows:
“Article 31. Procedures for Authentication of Translator's Signature
1. A translator who is a collaborator of the People's Committee at the commune level or a notary practice organization requesting authentication of their signature must present the translation and the documents or texts to be translated.
When conducting authentication, the person performing the authentication must compare the translator's signature on the translation with the registered sample signature before proceeding with the authentication; if there is doubt about the signature on the translation compared to the sample signature, the translator must sign in the presence of the person performing the authentication.
2. For individuals who are not translators collaborating with the People's Committee at the commune level or a notary practice organization but who self-translate documents or texts for personal purposes and request authentication of their signature on the translation, they must present the following documents:
a) One of the following documents: electronic identification card; original or certified copy of citizen identification card, citizen card, certificate of identification, passport, entry-exit document, or international travel document still valid.
b) The original or certified copy from the original, or a certified copy of one of the documents specified in Clause 2 of Article 27 of this Decree; except in cases where the language being translated is not widely used and the translator does not have a bachelor's degree in foreign languages or a university diploma but is proficient in the language being translated.
A non-widely used language is a language that is rarely represented in documents and texts used in Vietnam and is infrequently translated into Vietnamese or vice versa. The translator must prove that they have lived, studied, or worked in an environment using the non-widely used language, must provide a commitment to proficiency in that language, and bear responsibility for the content of the translation.
c) The translation attached to the documents or texts to be translated.
The person requesting authentication must sign in the presence of the person performing the authentication, except in cases provided for in Clause 3 of Article 24 of this Decree.
3. The person performing the authentication checks the documents required for authentication, depending on each case, if they find that the documents comply with the provisions of Clause 1 or Clause 2 of this Article and the translated documents or texts do not fall under the cases stipulated in Article 32 of this Decree, then the authentication will be carried out as follows:
a) Record the full statement of authentication of the translator's signature according to the prescribed model;
b) Sign, write clearly the full name, affix the stamp of the agency or organization performing the authentication, and record in the authentication book.
For translations of documents or texts containing two pages or more, each page must be numbered sequentially, signed by the translator and the person performing the authentication; the number of pages, sheets, and statements must be recorded on the last page of the translation or on the page immediately following the last page of the translation; if the document or text contains two sheets or more, it must be stamped with a cross-stamp.
4. In cases where the translator is a diplomatic official or consular official who also performs authentication at representative offices, the diplomatic or consular official must affirm that they have accurately translated the content of the document or text; sign, write clearly the full name, and affix the stamp of the representative office.
12. Amend and supplement Clause 1 of Article 36 as follows:
“1. The person requesting authentication must present one of the following documents: Electronic Identity Card; the original or certified copy of the Citizen Identification Card or Citizen Card or Certificate of Identity or Passport or travel document or international travel document still valid and submit one set of application documents for authentication, including the following documents:
a) Draft transaction;
b) Certificate of ownership right, usage right, or substitute document prescribed by law for property that must be registered for ownership right, usage right in the case of transactions related to such property; except in cases where the person making a will is threatened with death endangering their life.
The procedures for authenticating transactions stipulated in this Article shall be conducted either directly, through postal services, or online via electronic environments.
The documents specified in Point b of this Clause are the original or certified copy or electronic copy certified from the original; in cases of direct submission of applications, the person requesting authentication may submit a copy along with presenting the original for comparison.
13. Supplement Clause 3 of Article 38 as follows:
“3. The procedures for authenticating the amendment, supplementation, or cancellation of transactions stipulated in this Article shall be conducted either directly, through postal services, or online via electronic environments.”
14. Supplement Clause 3 of Article 39 as follows:
“3. The procedures for correcting errors in transactions already authenticated stipulated in this Article shall be conducted either directly, through postal services, or online via electronic environments, with results delivered either directly or through public postal services.”
15. Amend and supplement Article 43 as follows:
“Article 43. Responsibilities of People's Committees at all levels in managing notarization
1. The provincial People's Committee shall manage notarization at the local level and have the following tasks and powers:
a) Organizing the implementation of legal normative documents on notarization at the local level;
b) Guiding and training notarization business for officials and civil servants working in notarization at the commune-level People's Committee and notaries of notary organizations;
c) Organizing propaganda and dissemination of legal provisions on notarization; taking measures to rectify situations where there is abuse of requests for certified copies of documents when performing administrative procedures in the locality;
d) Applying information technology in implementing notarization and state management of notarization within the locality to meet requirements for providing and exchanging information;
đ) Inspecting and auditing the notarization activities of the commune-level People's Committee and notary organizations in the locality;
e) Compiling and publishing a list of persons authorized to certify in commune-level People's Committees in the locality on the Department of Justice’s website or electronic portal, and updating this list when there are changes;
g) Resolving complaints, denunciations, suggestions, and reflections from individuals and organizations, and handling administrative violations related to notarization within their authority;
h) Considering the transfer of the entire or part of the task of certifying copies from originals and certifying signatures to notary organizations in communes with at least one operating and effective notary organization at the time of the decision, with notary organizations distributed reasonably, facilitating individuals and organizations requiring notarization services in the locality;
i) Summarizing the situation and compiling statistics on notarization in the locality, reporting to the Ministry of Justice as prescribed;
The Department of Justice assists the provincial People's Committee in carrying out the tasks specified in points a, b, c, d, e, g, h, and i of this clause and inspecting the notarization activities of the commune-level People's Committee and notary organizations in the locality.
2. The commune-level People's Committee manages notarization within the commune's territory and has the following tasks and powers:
a) Managing the implementation of notarization tasks as prescribed in this Decree;
b) Propagating, disseminating, and mobilizing the people to comply with legal provisions on notarization;
c) Issuing certified copies from original transactions that have been notarized;
d) Resolving complaints, denunciations, suggestions, and reflections from individuals and organizations, and handling administrative violations related to notarization within their authority;
đ) Summarizing the situation and compiling statistics on notarization and reporting to the Department of Justice as prescribed;
The Office of the People's Council and People's Committee coordinates with the One-stop Public Service Center to assist the commune-level People's Committee in carrying out the tasks specified in points a, b, and c of this clause.
The Chairman of the commune-level People's Committee, or the person authorized or assigned to perform notarization tasks as stipulated in Clause 2, Article 5 of this Decree, must notify the Department of Justice of the sample signature to be used for certification.
16. Amend and supplement Article 47 as follows:
“Article 47. Transitional Provisions
1. For transactions certified at the Notary Office or People's Committee of communes before July 1, 2025, the amendment, supplementation, cancellation of transactions, correction of errors in certified transactions, and issuance of certified copies from original certified transactions shall be carried out at the People's Committee of communes that store the certification files.
2. Registers of certified copies from originals, registers of certified signatures/seals, registers of certified translator signatures, and registers of certified transactions established before this Decree takes effect shall continue to be used until December 31, 2025.”
Article 2. Replacing Certain Phrases and Appendices of Decree No. 23/2015/NĐ-CP on Issuing Copies from Originals, Certifying Copies from Originals, Certifying Signatures, and Certifying Contracts and Transactions, Amended and Supplemented by Decree No. 07/2025/NĐ-CP
1. Replacing phrases:
a) Replace the phrase "ID card/residence book/electronic ID card/citizen identification certificate/passport/travel documents/international travel documents still valid or electronic citizen identification" at Point a Clause 1 Article 24, Clause 2 Article 40 with the phrase "One of the following documents: electronic citizen identification; original or certified copy of the residence book or citizen identification or citizen identification certificate or passport or travel documents or international travel documents still valid."
b) Replace the phrase "ID card/residence book/electronic ID card/citizen identification certificate/passport/travel documents/international travel documents" at Clause 2 Article 25 with the phrase "electronic citizen identification or residence book or citizen identification or citizen identification certificate or passport or travel documents or international travel documents."
c) Replace the phrase "contracts, transactions" with "transactions" in the name of the Decree, Chapter III, and in Articles and Clauses: Article 1; Clause 8 Article 2; Name and Clause 4 Article 3; Clause 3 Article 9; Clause 1 Article 10; Article 11; Clause 3 Article 14; Clause 4 Article 25, and in Articles 34, 35, 36, 37, 38, 39, 40.
d) Replace the phrase "fees" with "charges" in Clause 3 Article 10; Clause 4 Article 14; Name and Clauses 1, 2 Article 15.
2. Replacing the Model Affidavits and Registers of Certification attached to Decree No. 23/2015/NĐ-CP on Issuing Copies from Originals, Certifying Copies from Originals, Certifying Signatures, and Certifying Contracts and Transactions, Amended and Supplemented by Decree No. 07/2025/NĐ-CP with the Model Affidavits and Registers of Certification attached to this Decree.
Article 3. Effectiveness
1. This Decree takes effect from November 1, 2025.
2. Abolishing the following relevant provisions:
a) Article 1 of Decree No. 07/2025/NĐ-CP on Amending and Supplementing Several Articles of Decrees in the Field of Civil Status, Nationality, and Certification;
b) Articles 13, 14, 15, 16, 17 and Clause 2 Article 24 of Decree No. 120/2025/NĐ-CP on Defining the Administrative Authority of Two Levels of Local Government in the Ministry of Justice's Field;
c) Article 64 of Decree No. 104/2025/NĐ-CP detailing several articles and measures for implementing the Notarization Law.
Article 4. Responsibilities for Implementation
1. The Minister of Justice is responsible for organizing the implementation of this Decree.
2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial and municipal People's Committees are responsible for implementing this Decree.
