Issuing Model Rules on Operation
of the National Assembly's Ethnic Council and Committees

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
BASED ON THE LAW ON THE ORGANIZATION OF THE NATIONAL ASSEMBLY NO. 57/2014/QH13, AS AMENDED BY SOME ARTICLES IN LAW NO. 65/2020/QH14;
Considering the proposal of the Head of the Delegation Work Committee at the Report No. 760/TTr-BCTĐB
Considering the proposal of the Head of the Delegation Work Department at Report No. 644/TTr-BCTDB dated August 17, 2021;
RESOLUTION:
Article 1
This Resolution promulgates the Model Rules on Operation of the National Assembly's Ethnic Council and Committees.
Article 2
This Resolution shall take effect from the date of signature. Members of the Standing Committee of the National Assembly, relevant agencies, organizations, and individuals shall perform their responsibilities in accordance with this Resolution.

MODEL REGULATIONS ON THE OPERATING PROCEDURES
OF THE NATIONAL ASSEMBLY'S ETHNIC COUNCIL AND COMMITTEES
(Annexed to Resolution No. 283/2021/UBTVQH15
dated August 27, 2021 of the Standing Committee of the National Assembly)
PART I
GENERAL PROVISIONS
Article 1. Scope and Objects Regulated
1. These Regulations specify the organization, tasks, powers, principles of operation, accountability system, working procedures, work relations, and procedural steps for handling matters of the Ethnic Council and Committees of the National Assembly.
2. The permanent members of the Ethnic Council, the permanent members of the Committees of the National Assembly, the members of the Ethnic Council and Committees of the National Assembly, experts and associates of the Ethnic Council and Committees of the National Assembly, the advisory offices assisting the Ethnic Council and Committees of the National Assembly, and other related organizations and individuals are subject to these Regulations.
Article 2. Organization of the Ethnic Council and Committees of the National Assembly
1. The Ethnic Council consists of the Chairperson, Vice-Chairpersons, Permanent Members, Specialized Members, and other Members of the Ethnic Council; the Committees of the National Assembly consist of the Chairperson, Vice-Chairpersons, Permanent Members, Specialized Members, and other Members of the Committees.
2. The permanent members of the Ethnic Council include the Chairperson, Vice-Chairpersons, Permanent Members, and Specialized Members of the Ethnic Council; the permanent members of the Committees of the National Assembly include the Chairperson, Vice-Chairpersons, Permanent Members, and Specialized Members of the Committees.
3. The Ethnic Council and Committees of the National Assembly may establish Subcommittees that operate on a regular basis, for a limited period, or on a case-by-case basis to study and prepare issues within the scope of activities of the Ethnic Council and Committees of the National Assembly. Each Subcommittee may be headed by the Chairperson, the Chairperson of the Committee, or a Vice-Chairperson of the Ethnic Council, a Vice-Chairperson of the Committee, or a Permanent Member. Members of the Subcommittee include Permanent Members, Specialized Members, other Members of the Ethnic Council and Committees of the National Assembly, and other members who may not be members of the Ethnic Council and Committees of the National Assembly or National Assembly deputies.
The number of Subcommittees and the duration of their operations are decided by the Ethnic Council and Committees.
The assignment of Deputy Heads of Subcommittees and the decision on the number of external members invited to join Subcommittees outside the membership of the Ethnic Council and Committees are decided by the permanent members of the Ethnic Council and Committees.
4. When necessary, the Ethnic Council and Committees of the National Assembly may establish Research Groups to serve specialized work and assist in performing the functions and tasks of the Ethnic Council and Committees of the National Assembly. The Chairperson of the Ethnic Council and the Chairperson of the Committee decide on the number of members and assign a Subcommittee Head or Deputy Head to lead the Research Group. Members participating in the Research Group may not be members of the Ethnic Council and Committees of the National Assembly or National Assembly deputies.
5. Other members of the Subcommittees and Research Groups who are not members of the Ethnic Council and Committees of the National Assembly or National Assembly deputies, upon invitation and agreement to participate, must fulfill all regulations and provisions of the Ethnic Council and Committees of the National Assembly when acting as experts.
Article 3. Principles of Operation of the National Assembly's Ethnic Council and Committee
1. The Ethnic Council and the National Assembly's Committee operate under a collective system and make decisions by majority rule.
2. Activities of the Ethnic Council and the National Assembly's Committee must comply with constitutional and legal provisions, be transparent, democratic, and ensure the leadership and guidance of the Party, the National Assembly, the Standing Committee of the National Assembly, and the Chairperson of the National Assembly, Deputy Chairpersons of the National Assembly assigned to oversee them; ensuring the management of the Ethnic Council Chairperson and the Committee's Chairperson.
3. A full session of the Ethnic Council and the National Assembly's Committee must have more than half of its total members present.
4. Decisions of the Ethnic Council and the National Assembly's Committee must be approved by more than half of the total number of members voting.
Chapter II
TASKS AND POWERS
Article 4. Tasks and Powers of the Ethnic Council and the National Assembly's Committee and their Members
1. The Ethnic Council and the National Assembly's Committee perform tasks and powers as prescribed by the Constitution, the Law on Organization of the National Assembly, and other relevant laws.
2. Members of the Ethnic Council and the National Assembly's Committee have the following tasks and powers:
a) Fulfilling the duties of a National Assembly delegate as stipulated by the Constitution, the Law on Organization of the National Assembly, and other relevant laws; performing the tasks and powers of the Ethnic Council, the National Assembly's Committee, and the National Assembly Delegation where they were elected or participate in activities.
b) Attending all plenary sessions and other activities of the Ethnic Council and the National Assembly's Committee as convened and assigned by the Ethnic Council Chairperson, the Committee's Chairperson, and the Ethnic Council's Standing Committee, the Committee's Standing Committee. In case of absence, permission must be sought and approved by the Ethnic Council Chairperson and the Committee's Chairperson.
c) Participating in discussions and voting on issues within the scope of the Ethnic Council and the National Assembly's Committee's tasks and powers; providing opinions and submitting reports on matters requested by the Ethnic Council and the National Assembly's Committee.
d) Participating in oversight delegations, working delegations, survey and research delegations of the National Assembly, the Standing Committee of the National Assembly, and the Ethnic Council and the National Assembly's Committee as assigned or when invited to attend.
e) Receiving comprehensive information about the program, plan, and activity contents, reports, and specialized documents of the Ethnic Council and the National Assembly's Committee of which they are members.
f) Maintaining contact with relevant agencies and organizations in specific fields; contributing to serving as a bridge and maintaining coordinated relations between the Ethnic Council and the National Assembly's Committee and the National Assembly Delegation where they fulfill their representative duties and performing other tasks assigned by the Ethnic Council's Standing Committee, the Committee's Standing Committee, the Ethnic Council Chairperson, and the Committee's Chairperson.
3. If a member of the Ethnic Council and the National Assembly's Committee is a non-professional delegate and due to the nature of work requirements or personal reasons cannot participate in the activities of the Ethnic Council and the National Assembly's Committee, they may voluntarily submit a resignation letter to cease being a member of the Ethnic Council and the National Assembly's Committee.
4. Annually, the Ethnic Council's Standing Committee and the Committee's Standing Committee coordinate with the Delegate Work Committee to compile and report to the Standing Committee of the National Assembly on the activities of the Ethnic Council and the National Assembly's Committee; the activities of delegates who are members of the Ethnic Council and the National Assembly's Committee. In cases where a member of the Ethnic Council and the National Assembly's Committee fails to allocate more than 50% of the required time for activities according to the Ethnic Council and the National Assembly's Committee's plans throughout the year, the Ethnic Council Chairperson and the Committee's Chairperson will report to the Standing Committee of the National Assembly for approval to terminate the delegate's membership in the Ethnic Council and the National Assembly's Committee.
Article 5. Tasks and Authorities of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees
The Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees assist the National Assembly's Ethnic Council and Committees in handling regular tasks during the period between two sessions of the National Assembly's Ethnic Council and Committees; fully perform the tasks and authorities stipulated in Article 86 of the Law on the Organization of the National Assembly.
Article 6. Tasks and Authorities of Subcommittees and Research Groups
Subcommittees and Research Groups carry out their tasks and authorities according to their assigned fields of expertise, and are responsible before the National Assembly's Ethnic Council, Committees, and before the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees.
Article 7. Tasks and Authorities of the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees
The Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees perform the tasks and authorities stipulated in Article 85 of the Law on the Organization of the National Assembly and the duties of National Assembly deputies as prescribed by the Constitution and the Law on the Organization of the National Assembly.
Article 8. Tasks and Authorities of the Vice-Chairman of the National Assembly's Ethnic Council and the Deputy Head of the National Assembly's Committees
In addition to the general tasks stipulated in Article 4 of this Regulation, the Vice-Chairman of the National Assembly's Ethnic Council and the Deputy Head of the National Assembly's Committees have the following tasks and authorities:
1. Assist the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees in managing the work of the National Assembly's Ethnic Council and Committees according to the division of labor by the Chairman and the Head; participate in performing the tasks and authorities of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees; study and propose to the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees and the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees about issues within the assigned field and those within the jurisdiction of the National Assembly's Ethnic Council and Committees.
2. Be assigned to serve as the Head of Subcommittee, Deputy Head of Subcommittee, or Head of Research Group in accordance with the structure of the Subcommittee and Research Group.
3. Assist the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees in directly coordinating with other National Assembly agencies, the National Assembly Office, and agencies under the Standing Committee of the National Assembly according to the assigned field.
4. Be authorized by the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees to perform the tasks and authorities of the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees when the Chairman and the Head are absent.
5. Directly research, edit, and instruct the Subcommittee, Research Group, and specialized department to prepare opinions on draft laws, ordinances, draft resolutions, and other contents assigned by the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committees for reporting to the Council, Committee, Standing Committee of the Council, and Standing Committee of the Committee of the National Assembly.
Article 9. Tasks and Authorities of Permanent Members
In addition to the general tasks stipulated in Article 4 of this Regulation, Permanent Members of the National Assembly's Ethnic Council and Committees have the following tasks and authorities:
1. Participate and perform the tasks and work of Subcommittees and Research Groups when assigned.
2. Be assigned to serve as the Head of Subcommittee or Head of Research Group in accordance with the structure of the Subcommittee and Research Group.
3. Directly research, edit documents of the National Assembly's Ethnic Council and Committees, and propose to the Standing Committee of the National Assembly's Ethnic Council and Committees, the Chairman, Vice-Chairman of the National Assembly's Ethnic Council, and the Head, Deputy Head of the National Assembly's Committees about contents within the jurisdiction and field of activity of the National Assembly's Ethnic Council and Committees, Standing Committee of the National Assembly's Ethnic Council and Committees.
4. Participate in directing the specialized department to prepare opinions and research materials on draft laws, ordinances, draft resolutions, and other issues assigned.
5. Perform other tasks according to the assignment of the Standing Committee of the National Assembly's Ethnic Council and Committees, the Chairman and Head of the National Assembly's Ethnic Council and Committees, or the Vice-Chairman and Deputy Head of the National Assembly's Ethnic Council and Committees responsible for Subcommittees and Research Groups.
Article 10. Duties and Authorities of the Specialized Member
In addition to the general duties stipulated in Article 4 of this Regulation, the Specialized Member of the National Assembly's Ethnic Council and Committee shall have the following duties and authorities:
1. Participate and perform the tasks and work of Subcommittees and Research Groups when assigned.
2. Directly study and edit documents of the Ethnic Council and Committee of the National Assembly, propose to the Standing Body of the Ethnic Council, the Standing Body of the Committee, the Chairperson, and Vice-Chairpersons of the Ethnic Council; the Head and Deputy Heads of the Committee on issues within the jurisdiction of the Ethnic Council, the Committee, the Standing Body of the Ethnic Council, and the Standing Body of the Committee.
3. Participate in directing the specialized department to prepare opinions and research materials on draft laws, ordinances, draft resolutions, and other issues assigned.
4. Perform other tasks as assigned by the Standing Body of the Ethnic Council, the Standing Body of the Committee of the National Assembly, the Chairperson of the Council, the Head of the Committee, or the Vice-Chairperson of the Council, Deputy Head of the Committee responsible for Subcommittees and Research Groups.
Article 11. Duties and Authorities of Other Members of the National Assembly's Ethnic Council and Committees
In addition to the general duties stipulated in Article 4 of this Regulation, members of the National Assembly who are other members of the Ethnic Council and Committees of the National Assembly shall have the following duties and authorities:
1. Be invited to attend expanded meetings of the Standing Body of the Ethnic Council, the Standing Body of the Committees of the National Assembly at the request of the Standing Body or the desire of the member.
2. Independently study and propose to the Chairperson of the Ethnic Council, the Head of the Committee; the Standing Body of the Ethnic Council, the Standing Body of the Committee on issues within their jurisdiction and areas of activity of the Ethnic Council and Committees of the National Assembly or matters of interest to the member.
3. Maintain regular contact with the Chairperson of the Ethnic Council, the Head of the Committee; the Standing Body of the Ethnic Council, the Standing Body of the Committee and other members; fulfill the role of a bridge, maintaining coordination between the Ethnic Council and Committees of the National Assembly and the Delegation of National Assembly representatives and working agencies.
4. Fully participate in activities of the Ethnic Council and Committees of the National Assembly when requested; coordinate and support the Standing Body of the Ethnic Council, the Standing Body of the Committee in implementing activities at localities, working agencies, performing representative duties; provide information about economic and social conditions in localities and working fields to enhance the effectiveness of the Ethnic Council and Committees of the National Assembly's operations.
5. Proactively coordinate with the Delegation of National Assembly representatives, the Office of the Delegation of National Assembly representatives, and People's Councils at localities or working agencies to organize consultation activities, soliciting public opinion from voters regarding draft laws, ordinances, resolutions, and other contents chaired by the Ethnic Council or Committee for review and supervision.
6. Fulfill other duties and authorities as assigned by the Chairperson of the Ethnic Council, the Head of the Committee of the National Assembly and the Standing Body of the Ethnic Council, the Standing Body of the Committee.
Article 12. On the Duties and Responsibilities of Subcommittee and Research Group Members
The duties and responsibilities of Subcommittee and Research Group members shall be defined by the Ethnic Council and Committee to ensure appropriate operation and quality effectiveness.
Chapter III
METHODS OF OPERATION
Section 1
ACTIVITIES OF THE NATIONAL ASSEMBLY'S ETHNIC COUNCIL,
COMMITTEES OF THE NATIONAL ASSEMBLY
Article 13. Forms of Operation of the National Assembly's Ethnic Council and Committees
1. The operation of the National Assembly's Ethnic Council and Committees shall be carried out through plenary sessions, oversight activities, surveys, reviews, explanations, and other activities as prescribed by the Law on the Organization of the National Assembly and other relevant laws. Plenary sessions may be held either in person or online when necessary.
2. Encouragement is given to organizing online activities that are appropriate to specific contents and circumstances but must ensure quality and effectiveness.
3. In cases where urgent, critical issues arise, or in situations of force majeure (due to natural disasters, epidemics), making it impossible to convene a plenary session to address matters within their jurisdiction, the Standing Committee of the Ethnic Council and the Standing Committee of the Committees shall organize a meeting of the Standing Committee and decide to seek opinions from members of the Ethnic Council and Committees in writing or through suitable voting methods.
4. Written opinions or suitable voting methods of members of the Ethnic Council and Committees have the same legal effect as oral statements or direct votes at in-person plenary sessions.
Article 14. Plenary Sessions of the National Assembly's Ethnic Council and Committees
The Chairman of the Ethnic Council and the Head of the Committees shall convene plenary sessions to consider, discuss, and decide on the following issues:
1. Annual programs and plans of activities of the Ethnic Council and Committees.
2. Reviewing or participating in reviewing draft laws, draft resolutions, reports, proposals, projects, and other drafts submitted to the National Assembly; reviewing or participating in reviewing draft ordinances, draft resolutions, reports, proposals, requests, and other drafts submitted to the Standing Committee of the National Assembly. The Ethnic Council and Committees may authorize the Standing Committee of the Ethnic Council and the Standing Committee to carry out participation in review.
3. Examining normative legal documents that have been issued and show signs of being contrary to the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in the assigned fields.
4. Establishing specialized supervision delegations of the Ethnic Council and Committees and examining reports of these delegations.
5. Organizing explanatory sessions on issues within the scope of responsibility of the Ethnic Council and Committees.
6. Proposing the Standing Committee of the National Assembly to consider submitting for a confidence vote in the National Assembly against individuals elected or approved by the National Assembly.
7. Establishing Subcommittees of the Ethnic Council and Committees upon the proposal of the Standing Committee of the Ethnic Council and the Standing Committee.
8. Considering and approving reports on the activities of the Ethnic Council and Committees to submit to the National Assembly and the Standing Committee of the National Assembly.
9. Other issues within the mandate and authority of the Ethnic Council and Committees.
Article 15. Decision to Organize Plenary Sessions
1. Based on annual, six-month, quarterly, and monthly programs and plans of activities, upon the proposal of the Standing Committee of the Ethnic Council, the Standing Committee of the Committees, and the professional department assisting with work, the Chairman of the Ethnic Council and the Head of the Committees shall decide to organize plenary sessions to resolve matters within their jurisdiction.
2. The organization of plenary sessions of the Ethnic Council and Committees of the National Assembly must be publicly announced on the National Assembly's electronic portal, except in cases of closed sessions.
3. National Assembly deputies who are not members of the Ethnic Council and Committees may register to attend public sessions of the Council and Committees on issues of interest to them.
Article 16. Chairperson, participants, documents, minutes of plenary meetings
1. The Chairman of the National Assembly's Ethnic Council and the Head of the Committee shall preside over plenary meetings. In necessary cases, the Chairman of the Ethnic Council and the Head of the Committee may delegate a Vice-Chairman of the Ethnic Council or a Deputy Head of the Committee to manage specific contents during plenary meetings.
2. Participants and guests attending plenary meetings of the Ethnic Council and the Committee shall be carried out according to the provisions of Clause 2, Article 4 and Clause 2, Article 15 of this Regulation.
3. Representatives of relevant agencies, organizations, and individuals invited to attend meetings on related matters shall be responsible for attending the meeting or sending someone to attend in their place; if they cannot attend, they must notify the specialized department in writing to report to the Chairman of the Ethnic Council and the Head of the Committee of the National Assembly.
4. Meeting documents shall be sent in advance to members of the Ethnic Council, members of the Committee, and guests attending the meeting; representatives of news agencies and press shall be provided with documents except confidential ones; meeting documents shall be used and stored in accordance with laws on archives and records management.
5. Plenary meetings of the Ethnic Council and the Committee must be recorded in minutes and may be recorded when necessary.
Article 17. Soliciting opinions of members of the Ethnic Council and the Committee in writing
1. Soliciting opinions of members of the Ethnic Council and the Committee in writing shall only be implemented in cases where it is not possible to organize a plenary meeting of the Council and the Committee as stipulated in Clause 3, Article 13 of this Regulation.
2. The Standing Committee of the Ethnic Council and the Standing Committee of the Committee shall be responsible for drafting the content and sending it to solicit opinions from members of the Ethnic Council and members of the Committee.
3. Members of the Ethnic Council and the Committee shall be responsible for studying and submitting written opinions within the required time frame and content to the Standing Committee of the Ethnic Council and the Standing Committee of the Committee. If more than half of the total number of members of the Ethnic Council and the Committee agree with the content, it shall be considered a decision of the Ethnic Council and the Committee.
Article 18. Issuing documents by the Ethnic Council and the Committee of the National Assembly
1. The Chairman of the Ethnic Council and the Head of the Committee shall assign members of the Standing Committee of the Ethnic Council and the Standing Committee of the Committee to lead the organization and drafting of document drafts to be submitted to the Standing Committee of the Ethnic Council and the Standing Committee of the Committee for review and approval before submission to the Ethnic Council and the Committee.
2. Members of the Ethnic Council and the Committee shall examine, provide opinions, and decide to approve draft documents at plenary meetings or through other appropriate forms.
3. The Standing Committee of the Ethnic Council and the Standing Committee of the Committee shall be responsible for studying and incorporating member opinions, perfecting the document, reporting to the Chairman of the Ethnic Council and the Head of the Committee for examination and decision on signing and issuing.
Article 19. Coordination activities of the Ethnic Council and the Committee of the National Assembly
1. The Ethnic Council and the Committee of the National Assembly shall be responsible for participating in the main review and coordinating according to the provisions of Article 79 of the Law on the Organization of the National Assembly and coordinating in performing other tasks when assigned.
2. The Standing Committee of the Ethnic Council and the Standing Committee of the Committee of the National Assembly shall coordinate with the Representative Delegation Working Group to assist the Standing Committee of the National Assembly in proposing and implementing plans for personnel planning, organizational work, cadre management, and policies for National Assembly agencies and full-time National Assembly deputies according to the cadre management hierarchy; monitoring and evaluating the effectiveness of full-time National Assembly deputies' activities.
3. The Standing Committee of the Ethnic Council and the Standing Committee of the Committee of the National Assembly shall coordinate with the People's Petitions Working Group to assist the Standing Committee of the National Assembly in receiving citizens who come to complain, report, make suggestions, and reflect issues; receiving, studying, and transferring petitions to competent authorities, organizations, units, and individuals for resolution; supervising and urging the resolution process according to the law. The handling and resolution of petitions shall be carried out in accordance with the detailed Resolution on the reception activities of National Assembly agencies and National Assembly deputies.
4. The Standing Committee of the Ethnic Council and the Standing Committee of the Committee of the National Assembly shall lead and coordinate with the Secretary-General of the National Assembly - the Director of the National Assembly Office to specify the organization, division of tasks, and specific powers of specialized units directly assisting the Ethnic Council and the Committee of the National Assembly in:
a) Building content, programs, procedures, and processes for National Assembly sessions, Standing Committee of the National Assembly meetings, and other activities led by the National Assembly leadership; preparing content for draft Resolutions of the National Assembly and the Standing Committee of the National Assembly, compiling reports summarizing opinions, incorporating feedback, and explanations of the Standing Committee of the National Assembly.
b) Providing conditions to ensure material infrastructure, finance, and other equipment.
c) Developing planning, mobilization, recruitment, appointment, commendation, and disciplinary measures for civil servants and implementing policies for civil servants under specialized units directly assisting the Ethnic Council and the Committee of the National Assembly.
d) Performing other tasks as stipulated in the Resolution of the Standing Committee of the National Assembly on the functions and responsibilities of the National Assembly Office.
Section 2
ACTIVITIES OF THE STANDING COMMITTEE OF THE ETHNIC COUNCIL,
STANDING COMMITTEE OF THE COMMITTEE, SUB-COMMITTEES AND RESEARCH GROUPS
Article 20. Forms of Operation of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee
The operation of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee is carried out through meetings, supervision activities, surveys, reviews, and other activities of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee. In cases where it is not possible to organize a meeting of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee, the Chairman of the Ethnic Council and the Head of the Committee may decide to seek opinions from members of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee in writing or through other appropriate forms. The Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee vote collectively and decide by majority. Other opinions are recorded and reflected in the report of the Standing Committee.
Article 21. Activities of Subcommittees and Research Groups
1. The Head of the Subcommittee is responsible to the National Assembly's Ethnic Council, the Committee, the Standing Committee of the National Assembly's Ethnic Council, the Standing Committee of the Committee, the Chairman of the Council, and the Head of the Committee for the activities of the Subcommittee; has the responsibility to direct, assign tasks, and manage the members to carry out the tasks of the Subcommittee.
2. The Head of the Research Group is responsible to the Standing Committee of the National Assembly's Ethnic Council, the Standing Committee of the Committee, the Chairman of the Council, and the Head of the Committee for the activities of the Research Group; has the responsibility to direct, assign tasks, and manage the members to carry out the tasks of the Research Group.
3. Subcommittees and Research Groups operate under the expert system. The activities of Subcommittees and Research Groups can be conducted through forms such as organizing advisory research; surveys, information collection, meetings, conferences, seminars, roundtable discussions, and other appropriate forms based on actual conditions regarding resources and specific content.
4. Subcommittees and Research Groups report to the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee on the results of their assigned tasks in an appropriate form; promoting the proactive role of Subcommittees and Research Groups, each member of Subcommittees and Research Groups, but ensuring the principle of being subject to the management of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee.
Article 22. Mechanism for Assignment, Coordination, and Responsibility in the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee
1. The Chairman of the National Assembly's Ethnic Council and the Head of the Committee lead and manage the operations of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee; directly assigns and coordinates the activities of the Vice Chairmen of the National Assembly's Ethnic Council, the Vice Heads of the Committee, and the Members of the Standing Committee and the Specialized Members; implements the mechanism of assigning tasks to Research Groups and individual members of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the Committee.
2. The Vice Chairmen of the National Assembly's Ethnic Council and the Vice Heads of the Committee who are assigned to head Subcommittees or Research Groups are responsible for building plans, directing the organization and implementation, and bearing responsibility for the activities of Subcommittees and Research Groups; representing Subcommittees and Research Groups to present opinions on matters they are responsible for at plenary sessions.
3. Members of the Standing Committee who are assigned to head Subcommittees or Research Groups are responsible for building plans, directing the organization and implementation, and bearing responsibility for the activities of Subcommittees and Research Groups.
4. Specialized Members are responsible for implementing the contents according to their assignments or coordination by the Chairman of the National Assembly's Ethnic Council, the Head of the Committee, the Head of the Subcommittee, ensuring quality, progress, and bearing responsibility for the assigned work content.
Article 23. Responsibilities for preparing contents subject to review and opinion preparation by the National Assembly's Ethnic Council and Committee
1. The Standing Body of the Ethnic Council and the Standing Body of the Committee shall assign Subcommittees and Research Groups to take the lead in preparing contents for review or participating in review and opinion preparation for draft projects, draft proposals, reports, and programs.
2. The Subcommittees and Research Groups assigned to organize the lead preparation for review or participation in review and opinion preparation shall have the following responsibilities:
a) Checking and examining the files and procedures submitted in accordance with the provisions of the law;
b) Organizing activities to support the preparation for review and opinion preparation; coordinating with drafting agencies and relevant agencies and organizations to exchange issues related to the content of review and opinion preparation;
c) Preparing reports from the Subcommittees and Research Groups, draft reports on opinions of the Standing Body of the Ethnic Council and the Standing Body of the Committee on the contents assigned under their responsibility to report at meetings of the Standing Body of the Ethnic Council and the Standing Body of the National Assembly’s Committee;
d) Supporting the Standing Body of the Ethnic Council and the Committee in adopting and perfecting the report of the Standing Body to be reported to the Council and the Committee;
đ) Assisting in building and perfecting draft reports on review or participation in review and opinions of the Ethnic Council and the Committee to be submitted to the National Assembly and the Standing Committee of the National Assembly;
e) Organizing the adoption of opinions from the Ethnic Council and the Committee and other participating opinions to perfect draft review reports and consolidated opinion reports to be reviewed and decided upon by the Chairman of the Ethnic Council and the Head of the Committee;
g) Organizing the preparation of draft explanatory documents, adoption, and revision of documents for draft projects, draft proposals, reports, and programs after receiving opinions from the National Assembly and the Standing Committee of the National Assembly;
h) Organizing the lead review and technical perfection of draft laws, ordinances, and resolutions before and after approval by the National Assembly and the Standing Committee of the National Assembly; submitting the document for signature by the Chairman of the National Assembly.
Article 24. Responsibilities for preparing contents for participation in review and opinion preparation by the National Assembly's Ethnic Council and Committee
1. The Standing Body of the Ethnic Council and the Standing Body of the Committee shall assign Deputy Chairpersons of the Ethnic Council, Deputy Heads of the National Assembly’s Committee, Subcommittee Leaders, or Members of the Standing Body of the Ethnic Council and the Standing Body of the Committee to organize the preparation of contents for participation in review or opinion preparation for draft projects, proposals, reports, and programs.
2. The Chairperson of the Ethnic Council, the Head of the Committee, Deputy Chairpersons of the Ethnic Council, Deputy Heads of the Committee, Subcommittee Leaders, and Members of the Standing Body of the Ethnic Council and the Standing Body of the Committee assigned to organize the lead preparation for participation in review and opinion preparation shall have the following responsibilities:
a) Coordinating with the leading review agency and the drafting agency to exchange issues related to the content of participation in review and opinion preparation;
b) Preparing draft documents for participation in review and opinion preparation by the Standing Body of the Ethnic Council and the Standing Body of the Committee or by the Ethnic Council and the Committee; organizing the collection of opinions from members of the Standing Body of the Ethnic Council and the Standing Body of the Committee, if necessary, convening a meeting of the Standing Body or a plenary session, or sending requests for opinions from members of the Ethnic Council and the Committee in writing; adopting and perfecting the document to submit to the leading review agency and the leading opinion preparation agency;
c) Representing the Standing Body of the Ethnic Council and the Standing Body of the Committee to express opinions on participation in review and opinion preparation at meetings of the leading review agency and the leading opinion preparation agency;
d) Organizing the preparation of documents to advise the Chairman of the Ethnic Council and the Head of the Committee to speak about the content of participation in review and opinion preparation at meetings of the Standing Committee of the National Assembly;
đ) Organizing the conduct of review and technical perfection of draft laws, ordinances, and resolutions before submission to the National Assembly and the Standing Committee of the National Assembly for approval to ensure constitutionality, legality, and consistency with the legal system;
e) Organizing the conduct of review and technical perfection of laws and resolutions after approval by the National Assembly to submit for signature by the Chairman of the National Assembly.
Article 25. Regular Meetings of the National Ethnic Council and the Standing Committee
1. Regular meetings of the National Ethnic Council and the Standing Committee shall be organized to carry out the following main activities:
a) Preparing contents for presentation at the plenary sessions of the Council and the Committee or passing draft documents for the Council and the Committee's comments;
b) Coordinating the work of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee;
c) Reviewing and approving the program and plan of activities of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee;
d) Preliminarily examining draft laws, draft resolutions of the National Assembly, reports, proposals, projects, and other drafts to be submitted to the Standing Committee of the National Assembly for consideration before submission to the National Assembly;
đ) Discussing and providing opinions on the adoption and revision of draft laws, ordinances, draft resolutions, reports, proposals, and other projects after they have been commented on by the National Assembly or the Standing Committee of the National Assembly;
e) Preparing opinions for examination and participation in the review of projects, drafts, reports, proposals, and other documents that are primarily reviewed and prepared by the National Ethnic Council and other Committees of the National Assembly;
g) Implementing and directing supervisory and survey activities; reviewing supervisory and survey reports before presenting them for consideration and decision-making at plenary sessions;
h) Reviewing and providing opinions on draft reports on the activities of the National Ethnic Council and the Committee, opinions of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee, and other documents before their discussion and consideration at plenary sessions.
2. The Standing Committee of the National Ethnic Council and the Standing Committee of the Committee may organize expanded meetings with the participation of some other members of the National Ethnic Council and the Committee and invite representatives from relevant agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and related agencies to attend.
3. Regular coordination and consultation meetings within the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee shall be held at least once a month; other regular meetings of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee shall be decided by the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly.
Article 26. Handling Official Correspondence, Documents, and Petitions Sent to the National Ethnic Council and the Committee of the National Assembly
1. The Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly shall directly handle and delegate deputy chairmen to handle official correspondence sent to the National Ethnic Council and the Committee according to their areas of responsibility.
2. Deputy Chairmen of the National Ethnic Council and Deputy Heads of the Committee of the National Assembly shall handle official correspondence sent to the National Ethnic Council and the Committee according to the delegation of the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly.
3. Official correspondence, documents, and petitions must be handled, responded to, followed up, and filed and stored in accordance with regulations; the specialized department shall be responsible for assisting in handling, classifying, and recording according to the legal provisions on archiving and record keeping.
Article 27. Issuance of Documents by the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee
1. The Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly shall delegate members to head the organization of drafting documents. The specialized department shall be responsible for advising, organizing research, and drafting documents.
2. Members of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee shall review and provide opinions on draft documents.
3. The person delegated to head the drafting process shall be responsible for explaining, adopting opinions, perfecting the document, and reporting to the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly for consideration and decision on signing and issuing the document.
4. Documents of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee shall bear the seal of the National Ethnic Council and the Committees of the National Assembly.
Section 3
MATTERS CONCERNING BUSINESS TRAVEL; INFORMATION AND REPORTING REGIMES;
MANAGEMENT AND USE OF OPERATING FUNDS; AUTHORITY TO SIGN DOCUMENTS
Article 28. Organization of working delegations and dispatching personnel for work
1. The dispatching of personnel to participate in domestic working delegations at the request of the National Assembly leadership and upon the proposal of relevant agencies and organizations shall be examined and decided by the Chairman of the National Ethnic Council and the Head of the National Assembly's Committees. The dispatched personnel shall be responsible for reporting the results of their work to the Chairman of the National Ethnic Council and the Head of the Committee after completing their mission.
2. The organization of working delegations of the National Ethnic Council and the National Assembly's Committees to study and survey experiences abroad shall be carried out in accordance with the National Assembly's Foreign Affairs Operation Regulations, the regulations of relevant National Assembly agencies, and related provisions of the Party and State.
3. The Chairman of the National Ethnic Council and the Head of the National Assembly's Committees shall report to the competent authority to decide on the list of the Committee's delegation going abroad for work or to dispatch representatives of the National Ethnic Council and the Committee to attend training sessions, international conferences, seminars, and join working delegations led by the National Assembly leadership or other agencies. The head of the delegation and the personnel dispatched abroad shall be responsible for submitting a written report to the National Assembly Standing Committee, National Assembly Leadership, the Chairman of the National Ethnic Council, the Head of the National Assembly's Committees, and the Head of the Delegation Work Department regarding the results of their mission.
Article 29. External Relations and International Cooperation
1. The National Ethnic Council and the National Assembly's Committees shall carry out external relations with relevant agencies of foreign national assemblies, other foreign agencies, and international organizations to study and exchange professional experiences, thereby contributing to strengthening external relations and international cooperation in accordance with the Party and State's foreign policy.
2. The National Ethnic Council and the National Assembly's Committees shall propose and plan the annual external activities and international cooperation programs of the Council and the Committees as prescribed.
3. The external activities and international cooperation of the National Ethnic Council and the National Assembly's Committees shall be conducted in accordance with the National Assembly's Foreign Affairs Operation Regulations.
Article 30. Information, Reporting, and Media Spokesperson System
1. The permanent bodies of the National Ethnic Council and the National Assembly's Committees shall regularly report to the National Assembly Standing Committee on the situation of their activities as prescribed and as required by the National Assembly Leadership monthly, quarterly, and annually.
2. The Chairman of the National Ethnic Council and the Head of the National Assembly's Committees shall represent the Council and the Committees in presenting reports before the National Assembly and the National Assembly Standing Committee. In cases where the Chairman of the National Ethnic Council and the Head of the National Assembly's Committees cannot attend the National Assembly Standing Committee meeting to present the report, they may delegate this responsibility to the Deputy Chairmen or Deputy Heads.
3. Members of the National Ethnic Council and the National Assembly's Committees shall implement the reporting system as prescribed by the Law on the Organization of the National Assembly, the Rules of Procedure of the National Assembly Sessions, and these Regulations.
4. The Chairman of the National Ethnic Council and the Head of the National Assembly's Committees, in their capacity as heads of the National Ethnic Council and the National Assembly's Committees, have the authority to respond or delegate members of the National Ethnic Council and the National Assembly's Committees to respond and provide information to the media regarding the opinions of the Committee on matters within the functions, tasks, and powers of the National Ethnic Council and the National Assembly's Committees.
Article 31. Management and use of funds
The management and use of funds at the National Ethnic Council and Committees of the National Assembly must ensure the principles of purposefulness, transparency, clarity, effectiveness, and compliance with regulations.
Article 32. Authority to sign documents of the National Ethnic Council and Committees of the National Assembly and issuance of documents
1. The Chairman of the National Ethnic Council and the Head of the Committee shall representatively sign documents of the National Ethnic Council, Committees of the National Assembly, and the Standing Body of the National Ethnic Council and the Standing Body of the Committee, except in cases where authority to sign on behalf is delegated.
2. The Vice-Chairman of the National Ethnic Council and the Deputy Head of the Committee shall sign documents within the scope of their assigned responsibilities upon authorization from the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly; sign letters for comments, meeting invitations, and other related documents directly linked to the content they are responsible for, as well as according to the assignment of the Chairman of the National Ethnic Council and the Head of the Committee.
3. Members of the Standing Body of the National Ethnic Council and the Standing Body of the Committee may be authorized to sign documents within the scope of their assigned responsibilities upon authorization from the Chairman of the National Ethnic Council and the Head of the Committee; sign letters for comments and meeting invitations sent to internal organs of the National Assembly regarding issues directly related to the content they are responsible for. or other specific tasks assigned by the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly.
4. Procedures for issuing documents shall be carried out in accordance with general regulations of the National Assembly Office.
Article 33. Relations of the Standing Body of the National Ethnic Council and the Standing Body of the Committees of the National Assembly with relevant agencies and organizations
Based on their functions and tasks as prescribed, the Standing Body of the National Ethnic Council and the Standing Body of the Committees of the National Assembly have the responsibility:
1. To build and maintain regular coordination relationships with the organs of the National Assembly, organs under the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, and the Head of the National Assembly Office in performing tasks assigned by the Standing Committee of the National Assembly.
2. To build and maintain relations with central ministries, sectors, and relevant organizations to ensure the performance of their own functions and tasks.
3. To build and maintain regular relations with People's Councils, People's Committees, and Delegations of the National Assembly of provinces and centrally-administered cities in activities related to the National Ethnic Council and the Committees of the National Assembly.
4. The establishment of coordination relationships with relevant agencies and organizations can be implemented through signing cooperation agreements or other forms decided by the Council, the Committee, the Standing Body of the Council, and the Standing Body of the Committee.
Chapter IV
REGIME OF EXPERT USE, SCIENTIFIC PERSONNEL,
COOPERATIVE MEMBERS AND RESPONSIBILITIES FOR ADVISORY SERVICES AND ASSISTANCE
OF THE SPECIALIZED DEPARTMENT
Article 34. Regime of expert and cooperative member use
1. The National Ethnic Council and Committees of the National Assembly may invite experts, scientists, and cooperative members who have appropriate knowledge and professional qualifications, and experience working in the fields managed by the National Ethnic Council and Committees of the National Assembly.
2. Experts, scientists, and cooperative members shall provide advisory services, research, and consultation on issues that align with their expertise and professional requirements as stipulated when invited by the National Ethnic Council and Committees of the National Assembly. Experts and cooperative members may be invited to participate in the activities of the National Ethnic Council, Committees of the National Assembly, Subcommittees, and the Standing Body of the National Ethnic Council and the Standing Body of the Committee with tasks assigned by the National Ethnic Council and Committees of the National Assembly, and express opinions on issues assigned for study at sessions and meetings of the National Ethnic Council, Committees of the National Assembly, and Subcommittees when invited.
In case of inability to attend, they must notify the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly.
3. Experts and cooperative members shall be entitled to remuneration in accordance with current regulations; they may be invited to participate in the activities of the National Ethnic Council, Committees of the National Assembly, Subcommittees, and the Standing Body of the National Ethnic Council and the Standing Body of the Committee with tasks assigned by the National Ethnic Council and Committees of the National Assembly, and express opinions on issues assigned for study at sessions and meetings of the National Ethnic Council, Committees of the National Assembly, and Subcommittees when invited.
4. Cooperative members shall maintain regular contact with the Standing Body of the National Ethnic Council and the Standing Body of the Committee and are responsible for carrying out tasks as required by the Standing Body of the National Ethnic Council and the Standing Body of the Committee, the Chairman of the National Ethnic Council, and the Head of the Committee of the National Assembly. They shall not use the name of the National Ethnic Council and Committees of the National Assembly in other activities.
Article 35. Responsibilities for advisory and support services of the Professional Department
1. The Professional Department is the direct unit providing advisory and support services to the National Ethnic Council, the Committee of the National Assembly, and the Standing Committees of the National Ethnic Council and the Committee; it implements the direct guidance of the Chairman of the National Ethnic Council, the Head of the Committee of the National Assembly, the Vice Chairmen of the National Ethnic Council, the Deputy Heads of the Committee, and the Standing Members and Specialized Members of the National Ethnic Council and the Committee according to assigned tasks.
2. Powers and responsibilities of the Head of the Professional Department:
a) To be responsible before the leadership of the National Assembly Office, the Chairman of the National Ethnic Council, the Head of the Committee of the National Assembly, the Standing Committee of the National Ethnic Council, and the Standing Committee of the Committee for the implementation of the tasks of the Professional Department and other tasks as prescribed by the Head of the National Assembly Office; b) According to the directives of the Standing Committee of the National Ethnic Council and the Standing Committee of the Committee, to propose the composition of participants, issue invitations, and direct the preparation of materials and other conditions ensuring the plenary sessions and meetings of the Standing Committees of the National Ethnic Council and the Committee; organize the recording of minutes, and perform secretarial and archival duties as prescribed;
c) To propose and compile a list of experts and collaborators and their respective policies and submit them to the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly for consideration and decision;
d) To sign internal meeting invitations, notifications, and letters on behalf of the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly, or in special cases, as directed;
e) To assign Deputy Heads and staff members to lead the drafting of review reports and provide opinions. Deputy Heads and staff members are responsible for advising and supporting the Chairman, the Head, the Vice Chairmen, the Deputy Heads, Subcommittees, and Research Groups in performing their tasks; they must attend and serve all sessions of the National Ethnic Council and the Committee. Staff members from other groups may be invited to attend Committee sessions based on the nature and content of the work.
1. This model regulation shall take effect from the date of signature.
Chapter V
IMPLEMENTING PROVISIONS
Article 36. Effective Date
2. The National Ethnic Council and the Committees of the National Assembly shall base their working regulations on this model regulation and relevant legal documents, and develop appropriate working regulations in accordance with their specific tasks, powers, characteristics, and circumstances.
3. The Standing Committee of the National Ethnic Council and the Standing Committee of the National Assembly shall regularly report to the Standing Committee of the National Assembly on the implementation of the working regulations of the Council and the Committee by December each year.
Article 37. Amendments and Supplements to the Regulation
During implementation, if there are emerging issues or new requirements necessitating amendments and supplements, the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly shall send their opinions to the Head of the Delegation Work Committee for consolidation and reporting to the Standing Committee of the National Assembly for consideration and decision.
During the implementation process, if any obstacles arise or new regulations or requirements necessitating amendments or supplements are identified, the Chairman of the National Ethnic Council and the Head of the Committee of the National Assembly shall submit their opinions to the Director of the Deputies' Operations Division for consolidation and reporting to the Standing Committee of the National Assembly for consideration and decision.
